A s we celebrate American Independ-ence Day, it is important to considerwhat it means to be an American.

If we are born in this country, we are Americans frombirth. We may not have made a conscious choice aboutour nationality and people at birth, but as we mature, wemake a choice to continue to live as Americans. We canquestion why we are Americans or we can stand up andproudly proclaim, “We are Americans!”

As an adult, I have done many things to actively chooseto be an American. When I voluntarily served nine yearsin the U.S. Navy Reserve, I wore the uniform as an Amer-ican officer with great pride. I chose to serve my country,just as my father had made a conscious decision to serve.

The “Old Navy” store each year markets a Fourth ofJuly American T-shirt. Each year, as I wear my Americanshirt on Independence Day, I become very much awareof what it means to be an American. I actively choose tobe an American as I look at myself in the mirror with theAmerican flag across my chest.

I choose to be an American because this country wel-comed my grandparents as immigrants in search of a safeplace to raise their children.

I am a proud American because I know the first Presi-dent of the United States, George Washington, went outof his way to travel to the small synagogue in Newport,Rhode Island, to proclaim that Jews will forever be wel-come, and protected, as citizens.

I am an American because President Abraham Lincoln,with all of the things that were on his mind and schedule,took time out to make special provisions for Rabbis toserve as Chaplains comforting those who wore the bluein the Civil War. Jews would have the same benefits andservices that all other Americans have.

I am an American because this nation chose the wordsof a Jewish poetess to be posted at the base of the Statueof Liberty to actively grant refuge to all in need. (By theway, the words of Emma Lazarus would be moving andspecial even if she had not been a Jew.)

I am an American because we are a nation of many mi-norities brought together with common aspirations. Tobe an American means to be hopeful and optimistic.These are the characteristics that I want as my own.

I am an American because the two greatest basketballcoaches in professional basketball through the 1970’s, RedAuerbach and Red Holtzman, were proud Jews. This wasa country were the best basketball dynasty ever could be

led by decades by a Jew without any show of prejudice orhatred.

I am an American because this is a nation where insteadof locking Jews up or pursuing Jews in pogroms, Ameri-can soldiers freed Jewish inmates from concentrationcamps. Our country lost many thousands of soldiers toensure a Holocaust would stop and that one cannot hap-pen again.

I am an American because this is a land where a Jew canserve as Mayor not only in New York where there is alarge Jewish population, but also in cities like Las Vegaswhere the Jews are a rather small minority.

I am an American because this is a country in which thegreatest pitcher of his day can be applauded for not pitch-ing on Yom Kippur. This is a country where you are ad-mired for standing up for values and heritage.

I am an American because only in America could theNavy bend the rules to ensure that the Father of the Nu-clear Navy, a proud Jew, could continue to serve his coun-try in uniform well into his nineties. This is a country inwhich talent and skill matters more than ancestry.

I am an American because this is a country that does notcare whether your grave is marked with a cross or a MagenDavid, you are remembered as an American hero.

I am an American, part of a country were all three ofmy representatives in Congress, including both Senatorsand my Congressman are Jews who proudly support Israeland the Jewish people both within and beyond the wallsof the Capitol Building.

I am proud to live as an American in a country where aperson of color can be elected President without respectto his skin color.

I am a citizen of a nation that protects those with hand-icaps, that provides special education, and that gives op-portunity to those with need.

While I was born an American citizen, I now activelychoose to be an American. I do this with pride of history.I do this for my children. I do this because I truly believethat America has made the world a better place. I do thisbecause I honestly believe that through America, ourworld will increasingly become a better place.

May G-d continue to bless and protect the people ofthe United States of America. •

I n the last post, we mentioned that we fast on the17th of Tamuz because the Luchos, the tabletscontaining the Ten Commandments, were bro-

ken on this day.

In the Jerusalem Talmud (Ta'anis 4:5) there is a discussionof the events leading up to the breaking of the Luchos.Moshe ascended Mt. Sinai to receive the Torah, and toldthe nation that he would be there for 40 days. After whatthe nation erroneously assessed to be 40 days, Moshe hadnot reappeared, and the nation began to fear that Moshewould not return. People approached Aharon, Moshe'sbrother, asking him to "create" a new leader, which was theGolden Calf. As they were creating and then worshipingthe Golden Calf, Moshe was still receiving the Torah fromG-d. G-d informed Moshe to descend the mountain, as"your nation has become corrupt." Moshe went down, and metYehoshua, Moshe's devoted student and assistant, who hadbeen waiting for Moshe. Both heard sounds coming fromthe camp. Yehoshua thought the sounds might be those ofbattle. Moshe responded that the sounds were not thesounds of war, but rather the sounds of song. Moshe thencontinued down the mountain, and when he saw the nationengaged in the worship of the Golden Calf, he broke theLuchos.

The Talmud tells us that we learn an important rule froman aspect of Moshe's behavior. From the fact that we seeMoshe did not break the Luchos until he saw the nationengaged in idol worship, we learn that a person cannotjudge based on an estimation. Though Moshe heard thenation's celebratory noises and had a clear picture of whatwas occurring, he did not break the Luchos until he sawwith his own eyes that the nation was not deserving of theLuchos.

The Chasam Sofer, in explaining this Gemora, notes thatG-d informed Moshe that nation had become corrupt evenbefore he descended the mountain. In fact, Moshe askedfor forgiveness for the nation before he descended. So whythen did he wait before breaking the Luchos?

The Gemora explains that Moshe broke the Luchos be-cause of a judgement he made: If, by the Pesach offering,we find that a male who is uncircumcised, lacking in onlyone respect in his observance, cannot take part, a fortiorithe nation, who were denying G-d's providence by wor-shiping the Golden Calf, could not take part in receivingthe Torah and the Luchos, upon which were engraved theTen Commandments. For this reason, G-d did not wantMoshe to bring the Luchos down to the people. However,Moshe felt that perhaps the people had some explanationbehind their actions. Perhaps they were not really denying

G-d's providence. Our Sages explain that Satan fooled thenation into thinking Moshe had died by placing a vision ofMoshe lying on his deathbed into the heavens. Moshethought that perhaps this was why the nation took the ac-tion that they did. He gave the people the benefit of thedoubt.

However, G-d, who knows what is in the heart of man,knew that from the time the nation heard the Ten Com-mandments, there were nonbelievers. Now that theythought that Moshe was dead, they had a seemingly validpretense for idol worship and their true colors came out.Moshe did not know that this was the case when Hashemtold them the nation was corrupt. Only when he heard thesongs of the people was he able to detect that somethingwas amiss. Moshe detected an element of joy in thosesongs that was not present when the nation received theTorah. He knew that the people did not deserve the Lu-chos. Hashem's statement was confirmed. The small doubtthat Moshe previously had vanished. So why did Moshewait before breaking the Luchos?

Moshe had to see that the Jews were engaged in this be-havior before he rendered judgement. Being almost surewas not enough. Moshe could not take any action until heknew with absolute certainty that the nation was acting im-properly. Moshe achieved that degree of certainty onlyupon seeing the Jews dancing and singing around theGolden Calf with his own eyes. Consequently, Moshebroke the Luchos only upon seeing the nation worshipingthe Golden Calf. And from here we learn that we cannotjudge based on an estimation.

The 17th day of Tamuz marks the beginning of the endof the Holy Temples. The Temple was destroyed, our Sagestell us, because of baseless hatred. Because people did nottreat each other properly, the Temple was destroyed, andthe Jewish nation was sent into an exile which has not yetended. In Pirkei Avos (The Ethics of Our Fathers) ourSages tell us that we should always be careful to give every-one the benefit of the doubt. If Moshe, who was told in-formation by G-d about the Jewish nation, still gave thepeople the benefit of the doubt and did not act until heknew the circumstances with certainty, we, who usually donot have a source as reliable as G-d for our information,should certainly give others the benefit of the doubt andnot jump to conclusions. It is fitting that on the day webegin to mourn a destruction that occurred because of ourinterpersonal relations, we learn an important lesson aboutthese relations from another tragedy that occurred manyyears before on the same day.

May we all merit to see the Temple rebuilt speedily, in ourdays. •

Crime and Punishment. In a corporeal world,the correlation of a jail sentence to a crimedoes not symbolize a cogent philosophical

message. Of course, it may tell us that crime does not pay.Unfortunately, that comprehensive message does not dif-ferentiate between one who steals to sustain his family,and the greedy scam-artist who bilks widows out of theirlife's savings. The two felons may sit only a few cells apartfrom each other, with an arsonist or barroom brawler sep-arating them, but the crimes that sent them to their dismalabodes are so very different in intent.

Divine justice does better. Every aveirah generates a pun-ishment specifically designed to send a distinct Heavenlymessage to the afflicted. Of course, it may take an other-wise perspicacious mind to correlate what life is handingto him and how it relates to his mortal misdeeds. We donot always relate events that occur to the acts we have per-petrated. Sometimes it is too much for us to bear, andsometimes our ideas may lead us to wrongful conclusions,harming both our psyche and morale.

But when the Torah teaches us about crime and punish-ment we are more fortunate. The lessons of our past arenow devoid of the guilt-ridden, depressive response wemay have currently; rather they are moral springboardfrom which to bound to greater heights. And thus, whenthe Torah tells us of a clear crime and an immediate re-sponse, we have to transpose the relationship between thetwo to attain another moral lesson.

The people spoke against G-d and Moshe - "Why did youbring us up from Egypt to die in this wilderness, for there is no foodand no water, and our soul is disgusted with the insubstantial food[Manna]?" G-d sent the fiery serpents against the peopleand they bit the people. A large multitude of Israel died.The people came to Moshe and said, "We have sinned, for we havespoken against Hashem and against you! Pray to Hashem that Heremove from us the serpent" (Numbers,21:5-7). The peoplecomplained about their fare, and were punished withsnakes. If Divine retribution is corollary to the crime, howdo snakes correspond to kvetching?

Rashi quotes the Midrash Tanchuma. "Hashem said asit were - let the serpent which was punished for slanderousstatements come and exact punishment from those whoutter slander; Let the serpent to which all kinds of foodhave one taste [that of earth; cf (Gen:3:14) and (Yoma:75a)] come and exact punishment from these ingrates towhom one thing (the manna) had the taste of many dif-

ferent dainties.

What was the slander of the snake? Didn't he just con-vince Chava to take a bite of the fruit? What connectionis there with the Manna? The old Jewish yarn has a Bubby(grandmother) taking her grandchild, little Irving, to thebeach toward the end of spring. There is hardly anyonearound as the child, dressed in a spring suit, plays inno-cently on the shore. Suddenly a wave breaks and sweepshim into the vast ocean. The grandmother, who cannotswim, yells toward the deserted beach, "Someone! Pleasesave my Irving! Please! Anybody!"

Out of nowhere, a man charges forward, dives into theocean and swims valiantly toward the helpless child. Mo-ments later he is holding the gasping child aloft, while hisweeping grandmother dashes toward them. She whisksthe child from the man, and looks over the child makingsure he is still in one piece.

Then she turns to the man, nods her head slightly andparts her otherwise pursed lips. "He was wearing a hat."

In Gan Eden, the Garden of Eden, life was blissful.Adam and Chava had all they could have wanted, exceptfor one type of fruit -- The Eitz Hada'as, The Fruit ofKnowledge. It was the snake that taught his human co-hort, the concept of total self-indulgence, rendering thempowerless to say, "No!"

The desert dwellers did not fare much differently. Theircelestial fare adapted to almost any flavor in the world.Water flowed freely from the rock. But they were not con-tent. They wanted more. The unfulfilled flavors that theManna refused to replicate were on their minds. They feltthat Manna was only a mere simulacrum of the lusciouscuisine that they desired. Their craving for everything,manifested itself in punishment through the animal thathas his most favored fare, anytime anywhere -- the snake.To a snake, all dust is desirous!

When the Jewish nation were both led and fed, througha hostile environment, yet complained that their miracu-lous bread is insubstantial, then the only correlation, pow-erful enough to make them mend their thoughtless wayswas the bite of the very being who gains no enjoymentfrom what he bites, while having all he desires.

Our goal in life is to revel in the blessing, rejoice in allthe good that we have, despite the shortcomings of a lim-ited world, and the trivial amenities we may lack. One mustlearn to appreciate his head, even if he is missing his hat.•

This was an intense week. Last Sunday, I hung out with a mom struggling with the disappointment andfrustration of a series of failed fertility treatments. On Monday, I met with a young mother who wasstill reeling from a stillbirth right before Passover. On Wednesday, I visited a mother whose teenage

daughter hates her and has rejected everything this devoted and amazing mother holds sacred. And last night I spokewith an old friend who shared that the final months of her most recent pregnancy were an extended nightmare of fre-quent panic attacks and debilitating anxiety.

We tend to think of being a mom as something so natural, so cheerful, so rosy-cheeked…"As American as motherhoodand Apple Pie." But as I get older, and experience more experiences and meet and speak with more moms, I am struckmore and more by the occupational hazards of motherhood. A professional choice as dangerous, as disaster-prone (atleast on an emotional level) as coalmining or car-racing or sky-scraper window washing.

At the finale of this week spent ruminating upon the riskiness of my chosen lifepath, I was reading (for the umpteenthtime) Rabbi Noach Weinberg zt"l brilliant "48 Ways to Wisdom" and came across the following quotation:

"If you spend your life avoiding pain, you will also avoid its deepest pleasures."

Which reminded me of a very emotional event I'd attended a few hours before. My dear friend, who has struggled foryears and years and years with infertility, who has endured thousands of shots and hundreds of painful treatments andthe ongoing kind of searing disappointment that only a woman who yearns to hold a child in her arms can fathom,watched as her newborn son was passed over to theprayer-shawled mohel at his brit.

After the brit, when I wished the father "MazalTov!" I looked into his flushed face and realized thatuntil that moment I had never in my life been a wit-ness to true happiness.

A life without the responsibilities and risks andstruggles of motherhood is probably a much easierlife. But a life devoid of pain is also a life chronically,tragically, profoundly devoid of true joy. •

Whenever we express our gratitude - especially withsong and joy – we work miracles and invoke phe-nomenal Divine compassion. The entire task of a

Jew is to give thanks, for the Hebrew word for Jew, Yehudi,means “one who gives thanks.” If you thank Hashem foreverything, you won’t have to run after rebbes and Kabbal-ists to ask for blessings because you’ll be blessed in everysingle way. On the other hand, if a person persists in cryingand complaining, no blessing will help him.

One young woman told me that she began writing downthe miracles and the big blessings that Hashem does for herin a little notebook that she keeps in her purse. Ever since,she’s always happy because she’s always thanking Hashem.Her life has turned into paradise on earth.

Another young man in our Yeshiva was sued for moneythat he never owed. The company that was suing him hadan entire staff of lawyers who had all kinds of circumstan-tial evidence against him. The young man went up in thehills north of Jerusalem, and thanked Hashem for twohours, telling Hashem how much he appreciates the wake-up call and making a firm resolution to appreciate Hashem’s

many favors and to strengthen his prayer and his gratitude.Within 48 hours, he received a letter from the lawyer apol-ogizing for the mistake and misunderstanding. Who knowshow many thousands of dollars in legal fees and hours ofcourt battles would have been required for him to prove hisinnocence. Who says the court wouldn’t have ruled againsthim? We have all kinds of stories like this, about how per-sonal-prayer sessions of gratitude – literally thankingHashem for their troubles - saved people from severe andharsh judgments.

Hashem has given me the privilege to see with my owneyes how people in Israel and abroad have made comebacksfrom even terminal illnesses when the doctors had alreadygiven up all hope. How! They simply took my advice andstarted to thank Hashem for the terminal disease! Theythank Hashem for the fact that there’s no one left to dependon but him! There are dozens of people that we knowabout who were smart enough to do so. Many people havewritten us that the doctors gave them a few weeks ormonths to live, and they’re still with us a year or two later.Some people have seen malignant growths disappear alto-gether.

Emuna teaches us that there’s no such thing as bad in theworld. If a person thinks that there’s a concept of bad inthe world, it’s simply because he hasn’t yet learned a bookby the name of The Garden of Emuna. No two peoplehave the same mission in the world; therefore, everythingHashem does is for the very best, to guide each individualalong his or her unique path and ultimate soul correction.

Are you having a tough time in life? Maybe it’s becauseHashem wants you to make a right turn instead of a left.Do you have a so-called friend that’s giving you a hard time?Maybe Hashem wants you to associate with other people.Have you lost your job? Maybe Hashem wants you to learnto appreciate what you have, and maybe Hashem has a bet-ter job in store for you? So without losing your job, you mayhave stagnated for years in the same place. We all have toopen our eyes and observe how every single thing that hap-pens to us in life is for our ultimate benefit. Once we startthanking Hashem, all stern judgments are totally mitigated,what the Zohar calls “sweetened at the source.”

Our expressions of gratitude to Hashem have the un-equivocal power to convert harsh judgments into total com-passion and loving-kindness.

How can Rebbe Nachman say that there’s no bad in theworld at all? Simple – since Hashem does everything for thebest, then everything Hashem does is good, and we shouldthank Him for it! From the standpoint of emuna, complain-ing that something is bad is the worst form of heresy. Nowonder crying and complaining cause calamity.

A person’s notion of bad is when his desires are differentthan Hashem’s desires for him. As such, a person that en-counters difficulties when he’s not doing what Hashemwants him to do is liable to think of a situation as bad. Let’ssee a few examples: suppose you dream of landing a certainsoulmate, but he or she rejects you. Now you become de-pressed and broken-hearted because you didn’t get yourway. Instead of crying and complaining, you should bethanking Hashem, because that person was not your soul-mate! He or she would have made a terrible partner for youin marriage. Let’s take another example: you’re devastatedbecause you weren’t accepted into medical school. Maybeyour soul correction is to be a teacher? Maybe Hashemwants you to be a spiritual leader, a doctor of souls insteadof a doctor of bodies? So stop crying and thank Hashem –everything He’s doing is for your very best!

People think that thanking Hashem for everything – forthe good and the seemingly opposite – is some kind ofBreslever nonsense. Sorry – it’s an absolute obligation men-tiond in the Gemara and codified in Jewish law (see ShulchanAruch, Orach Chaim 222:3).

Any person that makes expressions of gratitude a dailypart of his or her life – for everything Hashem does, thegood and the seemingly otherwise – will see tremendousmiracles and solutions to problems that he never dreamedcould be solved.

So, what can we do to rectify the terrible trait of ingrati-tude, crying, and complaining? Two things:

First, we should devote half of our daily hitbodedut – 30minutes a day – to asking Hashem to help us overcome theterrible trait of ingratitude, until we really feel the changewithin us and we start thanking Hashem for every singleblessing in life, the good and the seemingly opposite.

Second, our sages say that whoever lacks gratitude to hisfellow man will certainly lack gratitude to Hashem. There-fore, we should make a special effort to say thank you toanyone that does a favor for us, especially to our parentsand our spouses. By the way, if you have a problem withmarital strife, you can solve it in a minute: just buy a littlepocket notebook and jot down all the favors that yourspouse does for you every single day. 99% of shalom-bayitproblems stem from ingratitude.

Rebbe Natan said that nothing will help us until we learnto say “Thank you” to Hashem. If you lack something,whether it be a soulmate, a job, or children of your own,thank Hashem for an hour a day for your deficiency andyou’ll see major miracles.

Rebbe Nachman says that when humility spreads in theworld, Moshiach will come. Gratitude is in effect humility,when a person expects nothing and appreciates everythingHashem gives him. On the other hand, ingratitude goeshand-in-hand with arrogance, when a person has a sense ofentitlement and thinks he the whole world owes him; he’sthen upset with Hashem when he doesn’t get what he wants.So, the more people thank Hashem, the sooner Moshiachwill come!

The more a person internalizes the principles of emuna,the more he or she will realize that everything is for the best.

I urge everybody to walk around with a little notebook intheir pocket, to pay attention to life’s miracles – both bigand small – write them down, and thank Hashem for themevery day during your personal prayer session. This littlenotepad will save your life. When you begin thankingHashem for everything, then Hashem will give you manymore reasons to thank Him. Not only will you see miracles,but solutions and salvations to the terrible problems andpredicaments that you never dreamed of successfully over-coming.•

This week the most illustrious ca-reer in Biblical history begins itsfinal chapters. Moshe is offi-

cially informed that he will pass on and istold who his successor would be. But ininforming Moshe of the transition,Hashem repeats both here in the Book ofBamidbar (27:12) and again in the Bookof Devorim (32:51) the reason thatMoshe will not lead the B'nai Yisrael intothe Land of Israel. It is because he hit thewater producing rock instead of speakingto it.

Why does Hashem seem to stressMoshe's sin? Rashi, the classic medievalcommentator, explains that Moshe askedHashem to publicly declare his sin inorder to declare that this sin was his onlyflaw. He was afraid lest some would saythat he, too, was amongst those who weredestroyed for rebellion in the desert. Hewas afraid that he would be equated withthe rebels and sinners. Thus, he askedHashem to emphasize that the only flawhe committed was that of the rock.

It is very difficult to understand. Howcould Moshe even suspect that anyonewould place him on that level? How couldone even imagine that he was excludedfrom entering Israel for an act of treasonthat led to the demise of others? Why wasit so important to Moshe that the Torahreiterates that the incident at the rock washis only transgression?

Radio commentator Paul Harvey oncepresented a piece of American history inthe following manner:

George Armstrong was appointed tothe United States Military Academy in

1857. After graduating and commissionedin the cavalry, he quickly established a rep-utation for daring and brilliance in battle.His reputation was so well acclaimed thatat the age of twenty-three, he was madethe youngest brigadier general in UnitedStates history. George's energy and cun-ning paralleled the other great Georgeswho left their mark on military history --Generals George Washington andGeorge S. Patton. In fact, George Arm-strong was so successful, that by the endof the Civil War he became of the one ofthe most celebrated commanders.

His pursuit of Lee's army from Rich-mond in April 1865 destroyed the confed-erate lines of defense and capturedprisoners, wagons, and guns - until, on themorning of April 9 he had totally de-feated the enemy. It was to no one otherthan General George Armstrong that theConfederate flag of defeat was first pre-sented.

After the Civil War, his career continuedto flourish. He was assigned to the newlyformed seventh Cavalry, Fort Riley,Kansas, and was promoted to the rank ofLieutenant Colonel. In the fall of 1868 hewon a brilliant victory over Black Kettle'sband of Cheyenne Indians in the battleof the Washita and took part in many suc-cessful engagements over the next eightyears.

But history has almost no recollectionof the illustrious career of GeneralGeorge Armstrong. On June 22, 1876,General George Armstrong and his regi-ment, a force of about 655 men, set outfor Little Bighorn. He encountered anoverwhelming force of at least 4,000 well-

armed Sioux warriors and was killed to-gether with his entire regiment.

No longer were the Civil War successesthe hallmark of General George Arm-strong's career. Only remembered is thegreat defeat at Little Bighorn led by Gen-eral George Armstrong - did I mentionhis last name -- Custer - General GeorgeArmstrong Custer at his last stand.

People often tend to forget the illustri-ous careers of great people because of aflaw that ended it. Moshe was punishedfor an infraction that is difficult to com-prehend in mortal terms. He hit a rock,and produced water -- one of history'sgreatest miracles -- for a thirsting nation.Yet something was wrong. He was sup-posed to speak to the rock and instead hehit it. And between him and his Creator,there was a price to pay. We however mustrealize that a mistake, as great as its con-sequences were, cannot mar the illustriouscareer of the man who led us out ofEgypt and developed us into the nationthat we are today. In no way can that pun-ishment diminish any regard that we havefor Moshe. At Moshe's departure, thatpoint was to be reiterated repeatedly. It isonly because of the rock that he did notenter.

How often does a man who works tirelessly foryears and who errs in his last stand, go down indisgrace for the act that terminated his career?How many people's last stand becomes their mostnotorious if not their only stand? PerhapsHashem's reiteration vis-a-vis Moshe area lesson to all of us. There are no firststands and there are no last stands. If westand for something worthy, then westand forever! •
