RE: Summary of Contract Negotiated with Norwalk Federation of Educational
Personnel
DATE: September 21, 2017
After reaching a tentative agreement on a successor collective bargaining
agreement with the NFEP on August 7, 2017 (for a contract commencing July 1, 2017), we
were notified that the NFEP membership ratified the agreement on September 12, 2017,
and it now comes to the Board of Education for its ratification. In these negotiations, the
parties agreed to amend the provisions concerning salary and health insurance and changes
to the language of the predecessor contract. Below, we will summarize the key terms of
the new agreement:
1. Duration:
The new contract is for three years, effective July 1, 2017 and ending June 30,
2020.
2. Salary:
The new contract provides for salary increases as follows:
2017 - 2018: step movement and 1.8% general wage increase
(retroactive), for a total projected cost of 2.63%

2018 - 2019: step movement and 1.8% general wage increase, for a total
projected cost of 2.48%
2019 - 2020: step movement and 1.8% general wage increase, for a total
projected cost of 2.35%
In considering the above wage increases, we note that the statewide average general
wage increases (without step costs) for non-certified board of education settlements
during the same time period are 2.122%; 2.216%; and 2.112%, respectively.
3. Health Insurance:
Under the new contract, medical benefits will be provided through the Connecticut
State Partnership Plan 2.0 (SPP); while dental and vision benefits shall be offered
separately. Employee premium cost sharing for medical benefits shall remain at
13% until June 30, 2018; and shall increase to 14% during the 2018 - 2019 school
year and to 15% during the 2019 - 2010 school year. The parties agreed to
commence midterm negotiations relating solely to health insurance if the Board’s
application to admit NFEP to the SPP is rejected, or in the event of one of the
following, they may commence such negotiations:
the SPP in its current form ceases to exist or is modified such that the cost
of the plan substantially increases;
Conn. Gen. Stat. Section 3-123rrr (authorizing boards of education to enroll
employees in the State Partnership Plan 2.0) is amended or modified such
that the cost of the plan substantially increases;
the cost of the plan is expected to result in the triggering of an excise tax
under the Affordable Care Act (ACA); or
there are material changes to the ACA such that the cost of the plan
substantially increases.
The agreement with NFEP further provides that, in the event of any such midterm
negotiations (as well as in successor contract negotiations), the High Deductible
Health Plan with a Health Savings Account shall be the baseline for negotiations.
4. Other Changes:
Require union officials to receive his/her supervisor’s permission prior to
conducting union business during work hours and to document such time
appropriately on the timekeeping software.

Eliminate the two-hour per month release time for union officials to attend
Norwalk Federation of Teachers executive meetings.
Require on-line posting of job descriptions following the implementation of
the Employee Intranet.
Require on-line posting of job vacancies.
Amend the procedures concerning compensatory time, i.e., require 72-hours
advance notice and permit usage within two pay periods.
Eliminate mini-child rearing leave as an employee benefit.
In summary, this agreement carries the contract forward for three years with few language
changes, none of which impedes the operation of the district or operates to disadvantage
the Board. Further, the agreement provides for salary increases that are below the average
general wage increase for non-certified board of education settlements. In addition, the
contract makes an appropriate change in medical insurance in order to take advantage of
cost savings during challenging financial times and permits a reopener relating to health
insurance in the event of a change impacting the relative cost of the insurance plan. We

SETTLEMENT SUMMARY RE: NEGOTIATIONSBETWEEN THE
NORWALK BOARD OF EDUCATIONAND
UPSEU, CUSTODIANS, MAINTENANCE AND SECURITY STAFF
The parties commenced negotiations in the spring of 2016 concerning the agreement whichexpired June 30, 2016. The parties reached a settlement agreement in mediation on 7/17/17 andthe Union ratified the agreement at a meeting on September 16, 2017. The agreement nowawaits a ratification vote by the Board of Education.
The salient features regarding this settlement are as follows:
Insurance
All of these employees will move over to the State Partnership Plan, SPP 2.0, as of October 1,2017. This occurred by virtue of a Memorandum of Agreement executed between the partiesindependent of the new contract being ratified. This movement reflects a change in Board of Ed.strategy that occurred during negotiations when it became apparent that even the proposedHDHP plan would be too expensive. During negotiations, moving these employees to the SPP2.0 health insurance plan became a priority objective.
Attached to this summary is a cost estimate generated by the Board’s insurance consultant thatcompared the current cost of maintaining these employees in their HDHP plan and PPO plan, toconverting them all to the HDHP plan or, in the alternative, to the State Partnership Plan, SPP2.0. As that analysis indicates, the Board of Education’s share of the cost of providing theseemployees with health insurance benefits under both the HDHP and PPO plans was $2,604,011.Moving them all to the HDHP plan, as originally proposed, would have reduced the Board’s

share to $2,271,971. As the attached analysis indicates, moving all of these employees over toSPP 2.0 reduces the Board’s share to $1,953,374. The difference in cost is $650,637. However,in 2017-18, since these rates will only be in effect for nine of the twelve months, the estimatedsavings are 75% of that amount, or $487,978. As a consequence of the SEBAC negotiationswith the State, amendments to SPP 2.0 will reduce the rate structure for SPP 2.0 byapproximately 7.7%. Those lower rates will further enhance the savings to the Board, effectiveJuly 1, 2018. Based upon the June 7 enrollment, using the Arthur J. Gallagher analysis, it isanticipated that beginning July 1, 2018 the health insurance savings will be approximately$800,000 per year, and likewise through the final year of this contract.
In addition, although the employees’ premium share remained at 13% for the 2016-17 year, itincreased to 14% on July 1, 2017, and increases to 15% on July 1, 2018, and 16% on July 1,2019.
Duration – 4 years, 7/1/2016 – 6/30/2020
Salary
The parties reached a settlement on the general wage increases for the four year contract asfollows: 2% - 2% - 2.5% - 2.5%. Unlike certified employee negotiations which include the costof the increment in the overall settlement, MERA contract negotiations typically do not. Theestimated increment cost in each of the four years is as follows: 1.86% - 0.88% - 0.16% - 0%.
The base salary account for this bargaining unit is $5,063,646. The GWI settlement for the fouryears is 9%, or an average of 2.25%. This settlement is in the average range of settlements forthe time period in question as reported by CCM and its Municipal Labor and Finance DataReporter.
Net Cost Analysis
This analysis uses the base year salary account of $5,063,646 and base insurance calculationsreflected in the attached cost analysis. Note: replacement of unit members through attrition andsubcontracting may further reduce these amounts. The calculations used in this illustration donot compound the salary increases or compound the insurance trend.

Ability to contract out bargaining unit work through attrition
During the negotiations, it was a priority of the Board negotiating team to preserve its ability tocontinue to subcontract out bargaining work through attrition. No changes to contract languageoccurred during negotiations which would impair the Board’s effort to continue to accomplishthis goal.
Miscellaneous
Within six months after ratification, all employees will be required to receive their paychecksthrough direct deposit.

Pension – the contract previously included misleading references to the pension which suggestedthe Board of Education was responsible for this benefit, and could have entangled the Board inlitigation. Such references have been deleted or otherwise modified to clearly indicate thatpension negotiations are between this bargaining unit and the City, not the Board of Education.
Miscellaneous Union proposals
Section 5.02D – Employees will continue to be entitled to advance pay for vacation.
Section 6.01 D – Remove language that sick leave will not be granted for recuperation for anillness or injury directly related to another employer.
Section 8.05 – Replace all references to “Local 1042” with “the Union”.

ADHD AWARENESS MONTH October 2017
The Norwalk Board of Education recognizes October as National ADHD Awareness Month to bring awareness to the issues surrounding Attention Deficit and Hyperactivity Disorder. ADHD is one of the most common neurodevelopmental disorders of childhood. It is usually first diagnosed in childhood and often lasts into adulthood. The terms ADHD and ADD both refer to the same disorder, with the only difference being that some people have attention deficit and hyperactivity, while others do not. ADHD affects people of every age, gender, IQ, and social-economic background. In 2011, the Centers for Disease Control and Prevention reported that the percentage of children in the United States who have ever been diagnosed with ADHD is now 9.5 percent, with boys being diagnosed two to three times as often as girls. Diagnosing ADHD is a Complex Process as many of the symptoms look like extreme forms of normal behavior. Additionally, a number of other conditions resemble ADHD. What makes ADHD different from other conditions is that the symptoms are excessive, pervasive, and persistent. That is, behaviors are more extreme, show up in multiple settings, and continue showing up throughout life. We know ADHD can create problems for students in school, at home, and with friends, and can impact the chances of a student succeeding. Children with ADHD may have trouble paying attention, controlling impulsive behaviors or be overly active. Children with ADHD are often faced with a number of simultaneous challenges, including anxiety, depression, sleep disorders and more. The good news is that when children, teens, and adults are diagnosed early and receive treatment, they can lead more fulfilling lives. By declaring this ADHD Awareness Month, the Board of Education encourages the community to reflect on this disorder and to seek out information that will help them to understand and appreciate the challenges that their fellow students are facing day in and day out.

DOWN SYNDROME AWARENESS MONTH October 2017
To bring awareness to Down syndrome, the Norwalk Board of Education recognizes October as Down syndrome Awareness Month. Down syndrome was first described and classified by a doctor named John Langdon Down in the late nineteenth century. In 1959, a French physician identified Down syndrome as a chromosomal condition. In 2000, an international team of scientists successfully identified and catalogued each of the approximately 329 genes on chromosome 21. This accomplishment opened the door to great advances in Down syndrome research. There are approximately 400,000 people living in the United States with Down syndrome, the most commonly occurring genetic condition. Down syndrome affects people of all ages, races and economic levels. Approximately one in every 700 babies in the United States is born with Down syndrome, or around 6,000 births per year. There are still many misconceptions about Down syndrome and those who have it regarding cause, cognitive function, social ability, learning and employment capabilities. Quality educational programs, a stimulating home environment, good medical care and positive support from family, friends community enable people with Down syndrome to develop their full potential and lead fulfilling lives. By declaring this Down syndrome Awareness Month, the Board of Education celebrates people with Down syndrome, their abilities and accomplishments.
