notiCe oF restriCtions on aCtivities in anD movement into, Within anD From Control area

I , RODERICK MICHAEL ANDREWARTHA, Chief Veterinary Officer, acting pursuant to section 40 of the Animal Health Act 1995 (‘the Act’), hereby give notice that the prohibitions and controls set out in Schedule 1 are to apply with respect to the State of Tasmania, an area subject to a declaration in force under section 39 of the Act to be a Control Area:

Schedule 1

1. For the purposes of this Notice:

“oyster farming equipment” means any equipment, conveyance and other infrastructure such as trays, baskets, catching materials, post and rail, cables vessels, floats and the like, that is used in the cultivation, farming, harvest and storage of oysters;

“oyster” includes the spat or seed of an oyster and includes any part of the flesh or shell of an oyster;

“oyster product” means any animal product comprising wholly or partly oysters;

“primary production of seafood” has the same meaning as in the Primary Produce Safety (Seafood) Regulations 2014;

2. The movement of oysters or oyster products into, within or out of the control area is prohibited unless:

a) the oysters or oyster products are moved directly to a premises or place where they are to be sold or served for human consumption, and will not at that premises or place, or during transit, come into contact with any other live oysters being used in the primary production of seafood; or

b) the oysters or oyster products are part of a batch or sample that is moved for the purposes of testing or analysis in accordance with the requirements of the Act, the Primary Produce Safety Act 2011 or another Act; or

c) the oysters or oyster products are moved by or under the direction of an inspector; or

d) the movement of the oysters or oyster products is in accordance with a permit issued by an inspector authorising the movement of the oysters or oyster products into, within or out of the control area.

3. The movement of oyster farming equipment into, within or out of the control area is prohibited unless;

a) the movement is in accordance with a permit issued by an inspector authorising the movement; or

b) the equipment is moved by or under the direction of an inspector.

This notice is made and takes effect on this 9th of February 2016 at 3:00 pm and remains in force until revoked, or until the control area to which it relates ceases to be in force.

This declaration will remain in force until it is revoked by notice in writing.

This declaration is made and takes effect on 9th February 2016 at 3:00 pm.

LIQUOR LICENSING ACT 1990

IN ACCORDANCE with the provisions of section 19 of the above Act, I extend the hours during which liquor may be sold at general, on and club licence premises on the following dates and times for the year 2016 and each successive year:

Midnight 24 December until 2.00am Christmas Day

Midnight 31 December until 3.00am New Year’s Day

The sale of liquor in accordance with the above is only authorized subject to the following conditions:

1] No liquor is removed from the licensed premises during the hours specified in this extension.

2] Any conditions of an out-of-hours permit issued in respect to a general, on and club licence premises also apply to these extended hours.

Rescission

Any previous extension of authorized hours issued under section 19 of the Act is hereby rescinded.

I, PETER CARL GUTWEIN, the Minister for Planning and Local Government—

(a) having considered a modification prepared by the Tasmanian Planning Commission to the planning directive entitled “Planning Directive No. 1 – The Format and Structure of Planning Schemes” (the original planning directive) and being satisfied that the modification is for the purpose of clarifying, removing inconsistencies with an Act and amending the planning directive so as to make it consistent with another planning directive, and that the public interest will not be prejudiced—

i. under section 16 of the Land Use Planning and Approvals Act 1993 as in force before the commencement of section 10 of the Land Use Planning and Approvals Amendment (Tasmanian Planning Scheme) Act 2015 (the Act), dispense with the requirements of sections 10, 11 and 12 of the Act in relation to the modification; and

ii. under section 16 of the Act and with reference to section 13 of the Act, give notice of the issue of the modified planning directive, entitled “Planning Directive No. 1 – The Format and Structure of Planning Schemes”, which consists of the original planning directive as modified in accordance with the modification; and

(b) Under section 13 of the Act, specify that the modified planning directive takes effect on and from 17 February 2016.

The planning directive in force before the modification is revoked by virtue of section 16(2)(c) of the Act.

I, PETER CARL GUTWEIN, the Minister for Planning and Local Government—

(a) hereby issue Interim Planning Directive No. 1 – Bushfire-Prone Areas Code; (the Interim Planning Directive) under section 12A (2)(a) of the Land Use Planning and Approvals Act 1993, as in force before the commencement of section 10 of the Land Use Planning and Approvals Amendment (Tasmanian Planning Scheme) Act 2015 (the Act); and

(b) Under former section 12A (6)(b) of the Act, specify that the Interim Planning Directive takes effect on and from 23 February 2016 for a period of 12 months.

The Interim Planning Directive suspends the provisions of Planning Directive No. 5 – Bushfire-Prone Areas Code and comprises alternate Bushfire-Prone Areas Code provisions to be inserted in interim planning schemes.

The Interim Planning Directive is available on the Tasmanian Planning Commission’s website: www.planning.tas.gov.au.
