Section: 7003.15 Compensation Subject: Paid Sick Leave Effective Date: 5/27/2015 Approved By: Board of Directors Policy: Gorman Learning Center (“GLC”) provides sick leave benefits to eligible employees to enable them to take paid sick leave in order to provide a cushion for incapacitation due to an illness or injury. Sick leave may be used for the diagnosis, care, or treatment of an existing health condition, or for preventive care for the employee or the employee’s family member. Family members include: child, spouse, parent, registered domestic partner, grandparent, grandchild and sibling. Sick leave may also be used for victims of domestic violence, sexual assault or stalking. Sick leave may only be used for an actual illness or injury and for no other purpose. Time off for medical and dental appointment will be treated as sick leave. Paid Sick Leave All non-certificated, year-round (12 month), full-time employees who have completed ninety (90) days of continuous service with GLC (the “Introductory Period”) are eligible for paid sick leave benefits based on their continuous length of service measured starting from the completion of 90 day Introductory Period after the date of hire “Continuous length of service” is defined as service that is uninterrupted by termination of employment and subsequent rehire by the Company or a break in service by a leave of absence without pay. New, non-certificated, year-round (12 month), full-time employees will be prorated and frontloaded with sick leave on their date of hire. A new employee will not be entitled to use sick leave until the 91 st day of employment. Paid Sick Leave

Under the Healthy Workplaces/Healthy Families Act of 2014 Paid Sick Leave, all other Gorman Learning Center employees (ISTs, Facilitators, and part-time staff) are eligible for paid sick leave benefits. An eligible employee is someone who, on or after July 1, 2015, works in California for 30 or more days within a year from the beginning of employment, is entitled to paid sick leave. New employees will be frontloaded with paid sick leave on their date of hire. A new employee will not be entitled to use sick leave until the 91st day of employment. Current employees covered under this Act, will be frontloaded paid sick leave at the beginning of each academic school year. Non-certificated, year-round (12 month), full-time employees who currently receive vacation, sick and paid personal time will not receive an additional three days of paid sick leave.

Paid Sick Leave Maximum

There is no maximum for paid sick leave, for non-certificated, year-round (12 month) full-time employees.

The maximum for employees under the Healthy Workplaces/Healthy Families Act of 2014 Paid Sick Leave is 3 days per year or 24 hours per year. No unused leave rolls over, however a new bank of sick leave is credited to employees at the beginning of each succeeding year.

If an employee retires from Gorman Learning Center, the unused sick leave amount may be credited toward an employee’s retirement. If an employee leaves (voluntary resignation or termination) Gorman Learning Center, sick leave is not paid out and may transfer to the next place of employment

Once an employee has exhausted sick leave, the employee may continue on an unpaid medical leave, if eligible under applicable medical leave law, depending upon the facts and circumstances of the employee’s basis for leave beyond the accrued sick leave.

Employees on unpaid leave are not entitled to earn any additional sick leave benefits.

Paid Sick Leave on Termination

On termination of employment, the employee shall not be paid out for unused sick leave.

Paid Sick Leave Notification to Supervisor

Employees must notify their immediate supervisor no later than one-half hour before the start of their workday that they will be absent from work.

Paid Sick Leave Advances; Pay In Lieu of Sick Leave

An employee is not permitted to borrow on future sick leave benefits.

No employee will receive pay in lieu of sick leave.

Sick Leave and Holidays

To qualify for pay, all employees must work the last scheduled day before and the first scheduled day after the holiday unless the employee is absent:

At the Supervisor’s request and or approval Due to closure of schools because of inclement weather Due to sickness with a doctor's note verifying need for absence Prior to or following Jury Duty or Bereavement Leave

Unexpected absences preceding and following a holiday will not be included in an employees pay.
