Visit to Site The contractor shall visit the sites during the tender period to ascertain the nature, extent and practicability of the proposed scheme and means of access, in respect of Local Authority and Police restrictions. The Contractor shall include within the tender for any costs arising from any restrictions imposed by the aforementioned bodies, as not claim on the grounds of want of knowledge in this respect will be entertained. The Contractor shall assume for the purpose of carrying out the works that the dwellings will be tenanted and that responsibility for gaining access to individual dwellings will be his own. Examination and Adjustment of the priced bill(s) Any errors discovered in the tender analysis shall be notified to the contractor, and they will be afforded the opportunity of confirming, amending or withdrawing their offer. In conjunction with the NJCC Code of Procedure for Single stage Selective Tendering, Item 6.3 & 6.4. Compound The Contractor is to include in his tender for the provision of a suitable compound facility comprising office accommodation, health and welfare facility, and storage areas sufficient for the execution of the works. Include installation, running costs and removal from site upon completion. Location In addition, the Contractor is required to make adequate enquiries during the tender stage to identify suitable locations for his compound and in the event of wining the tender shall obtain all necessary permission for the establishment of the compound. No claim in respect of want of knowledge regarding the provision of this facility will be entertained.

GENERAL British Standard and Code of Practice The letters BS and CP in the specification shall mean “British Standard” and “Code of Practice” respectively published by the British Standards Institution, 24-28 Victoria Street, London. SW1. The BS and CP numbers given refer to the latest unless otherwise indicated. Reference to BSI Documents. References are to the versions and amendments listed in the latest British Standards catalogues. Technical Literature. Copies of the following must be kept on site, readily accessible for reference to all supervisory personnel. Manufacturer’s literature relating to all products to be used in the Works. BSI Handbook No.3, with all current revision sheets included and superseded sheets removed. Relevant BS Codes of Practice. All British Standards in this contract shall also deem to include for equivalent standards that are required in other EEC countries.

CONTRACTOR’S LIABILITY Contractor’s Responsibility The Contractor shall be held entirely responsible for any damage which may be caused to the adjoining properties and surrounding roads, footpaths and garden areas or persons, caused by negligence, omission or default of the Contractor, his servants or agents or of any Sub-Contractor, his servants or agents, or lack of protection or any other cause arising through the execution of the works, and he shall make good any such damage at his own cost and shall hold the Council free from any claim which may be made in consequence of any such damage, or of any act of thing done permitted or suffered by the Contractor, his workmen or servants. Protection of Public Property. The Contractor shall do no unlawful act or omit to do anything required by law, in or about or incidental to the execution of the Contract, and all such work performed by the Contractor and the Contractor’s servants shall be dome without negligence and with all such due care, skill and ability as not to occasion any avoidable or unlawful interference, injury, nuisance, inconvenience or prejudice (whether immediate or consequential), with or to the rights, interests or property of any persons, or Corporations, or Local or other Authorities (including the Council), and shall also comply with the rules and regulations and the statutory provisions for the protection and benefit of the Post Office Authorities, Ministry of Transport (Railways, Canals and Road Haulage) and other services and companies which may be affected. Insurance Claims If any even occurs which may give rise to any claim or proceeding in respect of loss or damage to the Works or injury or damage to persons or property arising out of the Works, forthwith give notice in writing to the Employer (through Contract Administrator) and the Insurers. Indemnify the Employer against any loss, which may be caused by the Contractor’s failure to give such notice.

OBLIGATIONS AND RESTRICTIONS IMPOSED BY THE EMPLOYERS. Unpriced Items in Bills of Quantities/Specification/Schedule of Work. Should the Contractor leave unpriced any of the items in the Bills of Quantities/Specifications/Schedules of Work he shall comply with all conditions referred to at his own expense and without extra charge to the Employer Bond The Contractor may have to provide surety and execute a bond with a Bank, Guarantee Corporation or Insurance Company approved by the Employer for the performance of the Contract. The Bond shall be ten per cent (10%) of the Contract Sum. The Contractor shall pay all costs of the incidental to the preparation of the Bond. The bond will be released on certification of practical of the works. Setting Out and Levelling. The Contractor shall take dimensions from the existing premises and verify all dimensions given on drawings. He shall set out and level the works, and shall provide all instruments and attendance for checking this work. Attendances The Contractor shall allow for attendance on sub-contractors and the general attendance of one trade upon another. Tolerances in Construction The Contractor is responsible for the co-ordination of tolerances (whether manufacturing or workmanship) between different materials or components of the building. Claims attributed to varying tolerances between materials and components will not be considered.

Discrepancies in Documents If the Contractor finds any discrepancy between the drawings and Specification or ambiguous instruction he is to inform the Supervising Officer and his decision is to be obtained before a tender is submitted. Warranty The Contractor shall warrant that he has exercised and will exercise all proper skill and carer in the design of the works and the selection of materials and goods. He will in addition to (the above) comply with and satisfy any performance specification or requirements included in or referred to in his tender as part of the description of the works. Contingencies A contingency sum of £15,000 is to be included and can only be used as directed in writing by the Contract Administrator. Work Covered Up The Contractor must give due notice to the Contract Administrator when any work or materials are intended to be covered up, in order that the correct dimensions may be taken. In default thereof, the work shall be uncovered at the Contractor’s expense. Pay all Fees The Contractor is to allow for an included in his tenders all fees properly charged by statutory undertakings for use of or supply of their services.

Security Notwithstanding anything contained in the above, the Contract Administrator reserves the right, without infringing the responsibility of the Contractor, to require additional security measures to be taken if, in his opinion, this is necessary. Any claim arising from delays directly or indirectly caused by lack of construction with the Contract Administrator will not be entertained. Individual units of accommodation are to be released as work proceeds in the order set out in the approved programme of works and will be subject to the satisfactory completion of those units previously released and being worked upon. All dwellings may be inspected only to appointments, which will be arranged by the Contract Administrator. Contract Particulars. The Contractor will prepare a programme for the works immediately after receiving acceptance of his tender and agree it with the Contract Administrator prior to signing the contract. Work will then be executed in accordance with that programme which will become a contract document. Once work has commenced on any dwelling, the work shall proceed diligently and efficiently so as to cause minimum inconvenience and loss to the tenant. The Contractor has to make his own arrangements with all or any of the tenants for the proper execution of the works inside the dwellings, at all times maintaining the agreed programme and modus operandi. Residents are to be given by letter, one weeks notice by the Contractor of the commencement date on each unit. Further, the Contractor will visit each unit 48 hours before commencement on that unit as final notice and agreement to start. The Contractor is to allow for working to the exteriors of occupied dwellings and shall maintain gas, water and electrical supplies to each dwelling to the occupier’s convenience. The Contractor will be required to programme his work so that adequate facilities are always available for toilets, sink, washing up, heating and hot and cold water supplies. The Contractor shall ensure that television and wireless aerials and telephone facilities are available at all times and pedestrian access from the highway is maintained throughout.

3/3 C/F Programme of Operations One week before commencement of the contract the Contractor shall present to the Contract Administrator, for his observations and ultimate agreement, a comprehensive programme of operations in the form of a bar chat covering all sequences from commencement and completion of each dwelling. Additionally, the Contractor must ask for reconsideration and possible alterations and/or operating of the bar chart at least two weekly intervals. Site Supervision The Contractor shall allow to have permanently on site a supervisor/agent/manager who shall be responsible for all aspects of the work. All materials where not particularly specified shall be at least to British standards quality or, if no such standard exists, be of the best quality obtainable consistent with the type of work being carried out and suitable for their intended purpose. Where manufacturer issues instructions and recommendations on the correct use of his products, the Contractor shall comply strictly with these instructions, unless they conflict with the relevant British Standard of Code of Practice. In such a case, the Contractor shall contact the Contract Administrator before commencing the work. When a choice of material is provided, the Contractor shall submit to the Contract Administrator the relevant samples before commencing work. All work shall then be carried out in accordance with approved sample. Dayworks No work, which can, in the reasonable opinion of the Contract Administrator, be properly related to contract rates, shall form part of a Daywork charge. Dayworks can only be carried out after receipt of the written instructions of the Contract Administrator, Vouchers for Dayworks will be prepared and presented by the Contractor and shall clearly state all details of labour, names of workmen, rates of wages and materials and shall be delivered in duplicate to the Contract Administrator the Friday following the week in which the work was carried out. Daywork charges submitted later will not be considered. The Foreman and the Clerk of Works shall sign all Daywork sheets and this will be accepted as a fair record of time and materials. This data will not be assumed to be the authority for a variation, nor as authority for a Dayworks charge for work which the Contract Administrator considers can be charged as a measured rate. General Foreman’s time will not be allowed and subordinate-working foreman shall be charged as ordinary workmen. The contractor is requested to state the percentage additions for profit and overheads to the prime cost of labour, materials and plant in order to provide the basis for payment for authorised Daywork. The rates for plant shall be current hire charges.

The Contractor shall state below the percentage additions required: Dayworks Overheads and Profit……………………..% Materials Overheads and Profit……………………..% Plant Overheads and Profit………………………% Working Hours The Works shall be carried out during normal working hours, which shall be as 0800 to 1730 hours, Mondays to Fridays inclusive. Overtime Overtime will not be permitted without the prior approval of the Contract Administrator. The Contractor will be responsible for the cost of any overtime working unless ordered in writing by the Contract Administrator. Only net cost differences between plain and overtime rates will be refunded to the Contractor, should the Contract Administrator order any work in this way. No claims will be entertained in respect of non-manual workers or establishment charges or profits. Emergency Attendance The Contractor is to allow for and provide, at no extra cost, any temporary services to the houses where the existing services are necessarily disturbed. This includes such items as water services, electricity services, both power and internal and external lighting, gas services, including flues which penetrate the structures, and drainage to both rainwater and foul drainage, toilet and washing facilities including continuing availability of TV and telephone and the like. Particular attention must be paid to maintaining the heating services to the tenant’s reasonable satisfaction (flues in outer walls may need adjustment). The Contractor must at the end of each working day ensure that all these items are to the reasonable satisfaction of the tenant. At all times, the houses must be left wind/weatherproof and at the end of the working day be capable of reasonable security. The tenants must be able to park their cars safely and securely at all times and should their existing personal arrangements be disturbed by the works the Contractor will allow for suitable provision where required. Site Meetings The Contract Administrator will arrange a meeting to be attended by all relevant parties as soon as possible following the signing of the contract. Any necessary site meetings will be called as required by the Contract Administrator and he will not vexatious refuse to call such a meeting at the request of the Contractor.

Samples The Contract Administrator will require samples for his approval of all materials to be used and these are to be deposited with the Contract Administrator and the Contractor is to allow for this in his tender. The Contract Administrator reserves the right to retain any or all samples which do not depreciate in quality, both as evidence of quality and as standards by which future deliverables are judged. All materials used in the works must conform to approve samples before and after use in the works. Where surface finishes are specified or self finished elements are used, the Contractor must obtain approval of the appearance of the first works completed before proceeding to the other similar works. Materials not achieving the approved standards are to be removed from site immediately following the instruction of the Contract Administrator. Any stored samples will wherever possible be returned to the Contractor before practical completion if he gives notice to this effect, in writing, to the Contract Administrator at the time he deposits the samples. Approvals Where work is specified “to be approved of, to the Contract Administrator’s instructions” then the work carried out shall be either to the express approval of the Contract Administrator or to standards expressly set up by samples deposited by the Contractor. The Contract Administrator’s formal approval can only be signified officially in writing and any inspections, comments or other actions of the Contract Administrator shall not be deemed to be his approval of any part of the works or the whole of the works. Advertisements and Signboard Provide and erect a suitable temporary tubular steel frame work on the site and attach thereto the Council’s signboard size 1219 mm x 305 mm which must be collected from the office of the Contract Administrator and returned on completion of the contract. (Note: No advertisements of any description will be allowed on the site other than by the express permission of the Employer). Should the Contractor wish to display a signboard with his own name on the site, he must submit details of such display board to the Supervising Officer.

GENERAL OBLIGATIONS Specification Whilst preparing tenders, contractors will not alter this specification in any manner without the written approval of the Contract Administrator. This specification is typical for all dwellings. There are obvious deviations from block to block and it is required that tenderers recognise these themselves and allow in the tender for all necessary works and the extent of works to each dwelling. Minor differences occur due to tenant’s fixtures such as telephone cables, TV cable/aerials etc. and these variants are to be taken into account by tenderers, allowed for in the tender and executed properly as part of the works. Existing external structural alterations and extensions of a dwelling, carried out by the tenant, are detailed separately in the Additional Works section of this specification Every endeavour has been made to detail in this specification all works required, but it will be required that the contractor agree with the Contract Administrator the extent of the work on each dwelling before commencing. Maintenance of Public Footways and Highways. The Contractor must note and act accordingly that it is an offence under the road Traffic Act to drive vehicles across footways and/or verges without authority and persons so doing will be liable for any damage caused. The necessary permission can only be obtained from the Highways Authority. The Contractor must allow for this on his tender. Allow for maintaining the Public Highways at all times (this includes footpaths and verges) during the contract and making good any damage to the highways, including re-turfing any grassed areas damaged. The highways are to be kept free of debris and materials caused by or attributable to the contract works or workpeople. Any damage caused by the works to roads, verges, planting, buried services, overhead services, street furniture or any other appendages to the highways, are to be restored and made good to the satisfaction of the Contract Administrator and the owners. Any reasonable claims for restitution of damage to or in the highways not made good by the Contractor within 14 days of instructions being issued by the Contract Administrator may be deducted from monies owing to the Contractor from the contract works and used to pay for the restitution at the direction of the Contract Administrator. Allowing for advising all statutory bodies and complying with any of their requirements before commencing the works, including any new accesses, connections to the services etc. Failure to comply with re-instatement in a reasonable time following an instruction will permit the Contract Administrator to arrange for the re-instatement to be carried out by others and the cost deducted from any monies owing to the Contractor. 3/7 C/F

The Contractor must obtain the tenant’s written permission if he desires to use the tenant’s garden for the deposit of materials and he must make his own arrangements and include for all his costs. The Contractor must acquaint himself with the position and location of all ducts, pipes, cables etc. and be responsible for and allow for any necessary repairs following damage caused by the contract works. No claim in respect of wants of knowledge or that incorrect information was given in these respects will be entertained. Access Access to the dwellings shall be from the existing roads, which shall be kept clear of materials, equipment and vehicles at all times. Safety, Health and Welfare All work shall be allowed for and carried out in accordance with the factories’ Act 1961, the Offices, Shops and Railways Premises Act 1963 and the Health and Safety at Work Act 1974, including any rules and regulations or orders made hereunder. All aspects of the Council’s Health & Safety Policy (copy enclosed) shall be adhered to. Safeguarding the Works, Materials and Plant. The Contractor is to allow for taking all precautions necessary to safeguard the dwellings, the materials and plant on the site against inclement weather, vandalism and theft during the contract period (and any extension of contract) and making good at his own cost and damage caused. Work people will not be permitted to enter any part of the existing dwellings unless work is being executed on that dwelling and entry to the dwellings is to confirmed by the Contract Administrator and all of his employees to the minimum necessary for the proper execution of the works specified. On no account are materials, skips and equipment to be stored on tenant’s gardens. Demolition All old materials ensuring from the pulling down and works of alterations are, unless otherwise stated, to become the property of the Contractor and, together with all rubbish and debris, are to be removed from the site to a tip or dump provided by the Contractor. Debris shall be removed from the building as it arises. No burning of unwanted timber or materials will be allowed on the site. The Contractor will be held solely responsible for the safety of the existing buildings and the sufficiency of all temporary work and shall carry out all necessary work in cutting out and making good holes, chases and fixings, any temporary filing or propping etc. and is to be made good after removal of all disturbed work. The Contractor shall make good the existing building after all trades.

Noise and Pollution Control The Contractor shall ensure that all plant such as compressors are fitted with efficient silencers, drills are muffled and nosy plant shall be kept as far as practicable from people living and/or working nearby. The Contractor will allow for and comply with the Control of Pollution Act 1974 and BS 5228 Workmanship All workmanship and methods of working shall be in accordance with the relevant British Standard Code of Practice. When no such code exists, they shall be in accordance with recognised good building practice. If any work is considered by the Contract Administrator to be not in accordance with such requirements, the Contractor shall rectify the work at his own expenses. Materials All materials used in the works, whether directly specified or not, are to be suitable for their purpose, to accord with good building practice and also comply in all respects with the relevant British Standard current at the time. All materials shall be new unless the Contract Administrator specifically requires the use of old materials. All materials shall where applicable, match the existing as far as possible. Plant Allow for providing all necessary hoist, ladders, tackle, cranes, tarpaulins, tools, scaffold, plant and vehicles and allow for all labour and materials for the proper execution of the works, both as specified and implied and for maintaining all of those items on site for as long as they are properly required for the diligent completion of the contract. Transport Allow for providing all necessary transport for the workpeople for the execution of the works. Lighting and Power. The Contractor must allow for and make his own arrangements with the respective Board for supply of electricity to the works and provide all connections, including fuse boards, distribution boards, sockets, plugs, lighting points, cable, flex, etc, as required for his proper executing of the works. On completion all is to be removed and all disturbance to existing services made good. Water for the Works Clean water for use on the works will be available from the existing supplies, but the Contractor is to allow for paying all charges. TEMPORARY ACCOMMODATION

Generally

The Contractor shall obtain prior approval of the Contract Administrator to the sitting of all temporary offices, stores, latrines, structures, enclosures, etc. All temporary works are to be cleared away on practical completion of the works, all disturbance reinstated and made good to the reasonable satisfaction of the Contract Administrator and it is deemed that these requirements are included and allowed for in the tender in respect of the following temporary works. Buildings Allow for providing all temporary buildings for use by the contractor or his staff including weatherproof dry sheds for the protection of materials delivered to site for on the works. Allow for the provision of either a separate hutment or room within the temporary buildings for the use of the Supervising Officer. The room is to be approximately 4 m x 3m, wind and weather tight at all times and equipped with a desk, chair and three upright chairs and a simple “worktop” approximately 850 mm deep for spreading out drawings. The Supervising Officer Office must also have adequate electric lighting, one twin 13 amp socket outlet and adequate heating (not solid fuel) Telephone Allow for providing a telephone service to the site in the Forman’s Office for the full period of the contract. In addition also providing a portable phone to the person in charge, which must be kept on his person at all, times. Allow for paying all installation and connection charges, all rental charges and all call charges. Temporary Screen The Contractor is to provide and maintain all temporary screens as required for the site compound and be removed when longer required, as agreed with the Contract Administrator. Temporary Services Allow for and provide all temporary services as previously specified. Rubbish and Cleaning Allow for clearing up and carting away all rubbish as it accumulates during the progress of the works, including any caused by sub-contractors. On practical completion of each dwelling, the Contractor is to leave the total hereditament free from rubbish, surplus materials and builder’s plant and equipment, temporary buildings etc.

Cleaning the works All completed work is to be left perfectly clean and in new condition. All window and door glazing is to be cleaned outside. Allow for the removal of all splashes or similar. Touch up as required and leave all in good order and to the reasonable satisfaction of the Contract Administrator. Protection of Existing Fences, Walls, Trees and Shrubs. The contractor shall carefully preserve and protect from damage all trees and shrubs on the site, including gardens, lawns, plants and the like, within the boundaries of individual properties, until completion of the works. Access to Buildings Due allowance is to be made by the Contractor for making amicable arrangements with the tenants, or other responsible persons in charge, for gaining access to buildings when required. Should such amicable arrangements for such facilities are refused or otherwise be unobtainable, the Contractor shall inform the Supervising Officer. Under no circumstances is the Contractor, of his employees to enter a building or to open doors or windows without the prior permission of the tenant or other responsible person in-charge. AIMS AND OBJECTIVES.

To install the specified door entry system, communal entrance doors and access ramps as required to comply with the Disability Discrimination Act 1995, to the blocks of flats listed within the specification. It will be the successful contractor’s responsibility to co-ordinate and programme the various specialist sub contracts/suppliers with regard to design, installation and commissioning.

The door entry system is no to go live until all fobs have been issued and signed for.

DOOR ENTRY SYSTEM Compliance with Regulations The installation of the door entry system shall comply to current good practice and as far as applicable the 17th edition of the IEE Regulations and British Standards. The system and works shall be in full compliance with the protection requirements of Council Directive 89/336/EEC on the approximation of the laws of the member states relating to electromagnetic compatibility when installed in strict accordance with manufacturers instructions Commissioning, Instruction and door entry system suppliers Final Commission On completion of the works, the door entry system supplier and PAC Integrated access control system supplier must undertake the Final Commission and Inspection of the works and provide certification accordingly. The contractor is to allow for the upgrade of the Council’s host PC from EasiNet Residential version 3.2 to current version 3.5. At least two and up to four members of staff will be nominated as operators of the system. These operators must receive sufficient training on the operation and configuration of the system to enable these operators to train others. The training shall be conducted by the manufacturer's own training staff or by other certified training staff. The contractor shall test in each and every dwelling and from all locations. In addition each Tenant or Leaseholder shall be given full instruction, both written and verbal as to the correct use and operation of the system and its features, and provided with 3 No. key fobs.. The contractor is to ensure all staff have a suitable means of identification and are competent to liaise suitably with these occupiers DOOR ENTRY AND ACCESS CONTROL SYSTEMS THE SYSTEM The video entry system shall be manufactured by Bell Systems (Telephones) Ltd of Presley way, Crownhill, Milton Keynes, MK8 OET. Telephone 01908 261106 and shall be Bellissimo Video Phone BLV2. The access control system shall be manufactured by PAC of 1 Park Gate Close, Bredbury, Stockport, Cheshire, SK6 2SZ. Telephone 0161 4063400. The system is to be installed, upgraded and integrated into PAC EasiNet Residential system installed on the host machine at St Albans City & District Council.

A PAC engineer must be available on site at the St Albans District Council offices to ensure as smooth a transition as possible. The system shall be installed by competent tradesman to the highest of standards. The manufacturer shall be accredited with BS EN ISO 9002. The Door Entry system shall be designed to accept both video and audio handsets and shall give total security ensuring only the unit called can release the entrance door for a preset time. The system shall have privacy of speech and each tenant handset fully isolated. Damage to any particular handset should not affect the rest of the system. Common wiring will not be accepted. The door controllers shall be the PAC 512 controller installed. In an agreed location, to be determined on site with the Contract Administrator, within the communal area. DOOR PANEL The door panel shall be a flush mounted vandal resistant panel manufactured from 12swg polished stainless steel of the L.C.P vandal resistant panel range. Bellissimo BSP/VR panel or similar approved. A single flush type stainless steel vandal resistant button to be provided for each flat and one for the timed entry of services. The push buttons to be individually fixed to the panel with a nut assembly on the threaded barrel of the push button, numerals to be engraved. The panel shall allow for a minimum of 20mm overlap on to the brickwork. The panel is to be fixed to the flush box with tamper proof bolts. Each panel to be suitably engraved and filled in black to include each flat number and ‘Trades’ next to the relevant push buttons. The trades button is to be connected to a 7 day Quartz reserve time clock with automatic BST/GMT adjustment. A speech amplifier unit is to be housed in the front door panel to provide full duplex speech to each telephone. It must incorporate a weather resistant plastic cone loudspeaker and low frequency microphone. The volume of each amplifier must be individually adjusted with two continuously variable controls. A reassurance tone shall be incorporated to confirm the operation of the unit to any user. The panel shall house a blue/grey PAC Oneprox panel mount proximity reader, flush mounted into a 40mm x 40mm cut out fixed on M4 mounting studs located above the push buttons. This reader will be wired back to the PAC access control cabinet via 8-core alarm cable and be terminated into reader channel no.1. The panel will incorporate a high resolution CCD day/night flush mounted colour camera module located above the PAC proximity reader. This camera module will house 4 no. infrared lights for night vision.

Connections to each handset must be protected with relays and fuses and have diagnostic L.E.D indication. Suitable measures shall be adopted to facilitate repair and maintenance. PAC ACCESS CONTROL CABINET The access control equipment is to be housed in a steel lockable cabinet, which must be IP55 rated and be wall mounted in communal area cupboard or a suitable location determined by the Contract Administrator. The unit is to be powered from the mains via a 230V unswitched fused spur. The unit must house the following components: One PAC 512 controller per two doors.* 12V DC 3 amp power supply unit GSM shall be used for communication for communication between Door controllers and the Administration PC. The communication speed on a GSM network is 9600kbps currently. Surveys for signal strength are to be undertaken in the given locations for each block. The contractor is to supply Vodafone sims to be connected, SADC to include within existing contract. All handsets shall be installed in the entrance hall of each flat, securely fixed to the wall and mounted at 1000 - 1200mm above finished floor level. The handsets are to be manufactured of high impact ABS plastic, white in colour with clear instructions on the cover. The body shall have fixing holes to the rear and be connected to the handset by means of a coiled cord having a sleeve at the point of entry. The handset must give 100% privacy of speech to and from the door panel and only the handset called shall be capable of operating the front door locks for a preset time. Should a handset be left off its cradle it must not interfere with the rest of the system in any way. The handset shall allow the Residents to mute the buzzer by operating a push button and a red L.E.D shall illuminate to remind them the buzzer is muted. Depressing the same button will reconnect the buzzer and the red L.E.D will no longer be illuminated. A second green LED provided shall be illuminated in the event of the front or rear doors being left open.

The handset shall have an audible ringing tone with volume control and be capable of adaptation to incorporate extension sounders, beacons and inductive loops for hard of hearing.

PAC ELECTRONIC KEY FOBS Allow for an approved installer to supply Stanley Token fobs for the entire programme all these fobs from the central PC at St Albans prior to installation. Allow to issue 3no individually coloured fobs per flat. The contractor must obtain a signed receipt note from each Resident and hand to client on completion. LOCKING SYSTEM The entrance doors will be locked via 2 no. Adams rite Armlock magnetic locks top and bottom of each door. The power to the magnetic locks will be via the 12V DC power supply unit and the N/C contacts of the 12V DC relay in the PAC access control cabinet. Due to current demand, under no circumstances should the locks be supplied from the door control P.C.B in the control equipment enclosure. Egress shall be via a stainless steel double pole request to exit button engraved ‘PUSH TO EXIT’ installed 1000mm above FFL. The positive of the magnetic lock supply will be run through the N/C contacts of one pole of the button. The N/O contacts of the second pole will be used as the input into the PAC controller triggering the timed output of the lock. Wiring the request to exit in this manner ensures the locks will always release even in the event of equipment failure. FIREMAN’S SWITCH. To be a drop key type manufactured from stainless steel. Provide, fix and wire 1no. Fireman’s switch at high level flush to brickwork adjacent to new communal front door and to the approval of the Supervising Officer. Due to the nature of the Building the Fireman’s switch will be a key type opened by an FB4 key (standard used by St Albans Fire Brigade). The contractor will demonstrate to the Supervising Officer the Fireman’s switch is in full working order. The Fireman’s switch shall be wired to the control panel using MICC or other approved and shall be fully operating to allow access to the Fire Brigade. The switch shall be labelled accordingly and suitable for external locations, as should the exterior cabling. Fascia to be stainless steel with straight fine-grained finishes. CABLES. Cabling to be BTCW1308. System cabling to be 8 core alarm cable contained within galvanised steel conduits fitted to comply with BS EN 61386-1:2004 in communal areas.

GENERAL REQUIREMENTS. Lock release whether by PAC fob, trades button or handset button will give release for an adjustable period of up to 10 seconds irrespective of the duration of time the button is pressed. At no time will any dwelling be able to interrupt a call to another dwelling or give lock release if the handset has not been called. The system will allow for the simple addition of strobe lights and extension sounders for the hard of hearing, as well as extension desk top mounted phones for the disabled. INSTALLATION. The cabling to be BTCW1308. Cable containment within the communal areas of the building including the intake cupboard will be in galvanised steel conduit. The door panels etc. should be earth bonded. The cables will be neatly clipped within the flats. Allow for up to a total of 5m of cabling within each flat. The client will ensure a suitable fused spur will be fitted within the under stair cupboard. The door panel back box and fireman’s switch back box are to be flush into the brickwork. If when installed the rear of the back boxes are exposed then a suitable plywood panel should be fixed to the internal wall to cover them. Allow for making good to any building/chasing in works. The manufacturer of the equipment shall have available and produce to the Contractor upon request a full set of clear equipment connection diagrams and installation instructions. The Contractor shall resolve any queries with the manufacturer prior to tender and be fully conversant with the system connection and installation. Commissioning and installation procedures shall be executed in accordance with the manufacturers recommendations. Commissioning of the Easinet residential software is to be carried out by a PAC engineer. Other materials or equipment. Any other materials required shall be from an approved source or supplier and is to be agreed by the contract administrator Maintenance Schedules Commissioning and installation shall be executed by the specialist contractor, strictly in accordance with the manufacturers recommendations. The above is prior to the manufacturers own final commission and inspection test. The contractor shall provide to the Supervising Officer two copies of the installation layout, manufacturers instructions and brief outline of maintenance requirements for system. ELECTRICAL WORKS. All works to be undertaken by NICEIC registered contractor. For each equipment cupboard in all the communal areas supply and install all wiring and controls (fused spur unit) at suitable location to provide mains power to operate panel from existing landlords services.

Important: The contractor is to ensure that allowance has been made for all the necessary wiring from the equipment cupboard to the relevant blocks. In addition, the contractor is also responsible for ensuring that all existing services are connected and left in full working order. On completion of the works, the Contractor shall carry out a full testing of existing installation and new connections, in accordance with IEE Regulations and shall submit to the Contract Administrator duly completed Domestic Electrical Installation certificate of Domestic Minor Works in NICEIC format as appropriate. BUILDING WORKS Formation of new concrete steps and brick paving/ concrete ramps in compliance with DDA 2005 regulations and in connection with installation of new controlled door entry systems to blocks. CONTRACTORS CODE OF CONDUCT The contractor is required to ensure that all operatives are fully conversant with the following code of practice. If the code is not adhered to then the contractor will be required to remove the operative from site and/or will be suspended. This Code of Conduct requires workers/operatives to :

SAFEGUARDING The Contractor acknowledges that the Council has legal responsibilities under Section 11 of the Children Act 2004 (“CA 2004”), and the Safeguarding Vulnerable Groups Act 2006 ("SVGA 2006").

Section 11 of the CA 2004, states

(2)Each person and body to whom this section applies must make arrangements for

ensuring that—

(a)their functions are discharged having regard to the need to safeguard and promote

the welfare of children; and

(b)any services provided by another person pursuant to arrangements made by the

person or body in the discharge of their functions are provided having regard to that

need.

Therefore, In providing the Services under this Contract, the Contractor warrants that it will comply with Section 11 of CA 2004, the Council’s Safeguarding Policy, (Appendix 2) and Hertfordshire Safeguarding Board procedures (HSCB) http://www.hertsdirect.org/caresupport/childfam/childprotection/acpc/procedures. The Contractor will cooperate to enable the Council to comply with CA 2004, the SVGA 2006 and HSCB procedures and shall not do any act either knowingly or recklessly that would cause the Council to be in breach of the CA 2004, SVG 2006 and HSCB procedures. The Contractor shall: ensure that senior management within its organisation are committed and responsible for monitoring the actions of their Staff to safeguard and promote the welfare of children, young people and vulnerable adults.

identify a manager with the overall responsibility and the ultimate accountability for the Contractors’ contribution to safeguarding and promoting the welfare of children, young people and vulnerable adults.

record and report concerns in accordance with the Council Policy. consider how the delivery of the Services will take account of the need to safeguard and promote the welfare of children by carrying out an assessment of the needs of the children and young people and vulnerable adults affected under this Contract and the Contractor shall determine priorities and actions designed to improve outcomes for children, and vulnerable adults ensure that all Staff working with and all Staff in contact with children, young people and vulnerable adults have an understanding of their roles and responsibilities and receive CRB checks at the appropriate level in accordance with Council Policy, see Vetting and Barring below.

ensure that staff are trained pursuant to their contact with children and vulnerable adults, in accordance with the Council Policy. Records of training, detailing names, course details and dates of training are to be provided to the Council within 6 months of the contract commencement date.

In accordance with the Data Protection Act 1998 ensure that there is effective monitoring and collating of information which is shared with the Council to prevent children and young people and vulnerable adults from suffering or being at risk of suffering harm

The Council reserves the right to visit the Contractor’s organisation to audit, inspect and monitor the Contractor’s compliance with the Safeguarding clauses, including disclosure evidence and training records. The Council reserves the right to request additional Criminal Records Bureau checks are carried out if there is any doubt about the outcome of any individuals’ check.

Failure by the Contractor to comply with the provisions of the Safeguarding clauses may lead to the termination of this Contract at the absolute discretion of the Council.

STAFF VETTING AND BARRING

Under the SGVA 2006 a person who is barred from working with children or vulnerable adults will be breaking the law if they work or volunteer, or try to work or volunteer with those groups.

A body which knowingly employs someone who is barred to work with those groups will also be breaking the law.

If a body works with children or vulnerable adults and dismisses a member of staff or a volunteer because they have harmed a child or vulnerable adult, or this step would have been taken if they had not left, the Independent Safeguarding Authority must be told immediately. To not advise the Independent Safeguarding Authority is an offence.

Definitions for Vulnerable Groups and Children and further details of the SVGA 2006 are contained in Appendix 1. The Contractor, in accordance with the SVGA 2006 will ensure that:

before a Named Employee begins to perform any of the Services, he or she discloses any convictions, reprimands or final warnings they may have, or any other relevant information which makes them unsuitable to perform any of the Services

the results are obtained of a check of the most extensive available

kind made with the Criminal Records Bureau or other body as may be prescribed in legislation, in respect of each Named Employee and in accordance with Appendix 1 and Council Policy.

The Contractor shall use one of the following methods for the advice, processing and storage of CRB checks:

through the Council through an external umbrella body Where the Contractor’s CRB checks are processed either directly by theProvider or by an umbrella body other than the Council, the Contractor shall provide copies of such checks and will ensure that no person who discloses any convictions, cautions, reprimands, final warnings or other relevant information or who is found to have any information following the results of a CRB check, is employed or engaged by the Contractor or on the Contractor’s behalf without the Council’s prior written consent (such consent not to be unreasonably withheld or delayed). Appendix 1 guidelines will be followed.

Where the Contractor uses the Council’s CRB Umbrella Body the Contractor will

ensure that no person who discloses any convictions, cautions, reprimands, final warnings or other relevant information or who is found to have any information following the results of a CRB check, is employed or engaged by the Contractor or on the Contractor’s behalf without the Council’s prior written consent (such consent not to be unreasonably withheld or delayed). Appendix 1 guidelines will be followed.

The Contractor shall ensure that the Council is kept advised at all times of any

member of Staff who, subsequent to his/her commencement of employment as a member of Staff, receives a conviction or whose previous convictions become known to the Contractor (or any employee of a sub-contractor involved in the provision of the Services) The Council reserves the right to demand that the Contractor removes the said member of staff from duties that involve contact with children, young people and vulnerable adults.

By signing this Contract, the Contractor warrants to follow the criteria listed in Appendix 1

The disclosure number, date of issue, level of check and Named Employees shall be provided for each employee (including volunteers) and stored securely within the Provider’s organisation in accordance with the Data Protection Act 1998. Where the disclosure information is on a CRB certificate, an up-to-date risk assessment should be kept by the organisation The use of “relevant information” in Appendix 1means all information relating to Criminal Records Bureau checks and or Criminal Records Bureau disclosures and other such checks as may be prescribed in legislation.

Sub-Contractors

In the event that the Contractor enters into any sub-contract in connection with this Contract, it shall impose obligations on its sub-contractor in the same terms as those imposed on it pursuant to Clauses XX and shall procure that the sub-contractor complies with such terms. The Contractor shall indemnify the Council and keep the Council indemnified in full from and against all loss, damages, injury, claims, costs and expenses (including legal expenses) awarded against or incurred or paid by the Council as a result of or in connection with any failure on the part of the sub-contractor to comply with such terms.

Appendix 1 A child is a person who is not yet 18. A young person is someone under the age of 25.

Under the SVGA a vulnerable adult is a person who is aged 18 years or older and:

• is living in residential accommodation, such as a care home or a residential special school;

• is living in sheltered housing; • is receiving domiciliary care in his or her own home; • is receiving any form of health care; • is detained in a prison, remand centre, young offender institution, secure

training centre or attendance centre or under the powers of the Immigration and Asylum Act 1999;

• is in contact with probation services; • is receiving a welfare service of a description to be prescribed in regulations; • is receiving a service or participating in an activity which is specifically

targeted at people with age-related needs, disabilities or prescribed physical or mental health conditions. (e.g. age-related needs includes needs associated with frailty, illness, disability or mental capacity);

• is an expectant or nursing mothers living in residential care; • is receiving direct payments from a local authority/HSS body in lieu of social

care services; • requires assistance in the conduct of his or her own affairs.

In accordance with the SVGA 2006 and with the Council Policy (Appendix 2), all staff and volunteers must have satisfactory Enhanced CRB checks and references prior to appointment:

(a) who work directly and regularly with children, young people or

vulnerable adults or

(b) who provide advice regularly to children, young people or vulnerable adults over the telephone or via electronic communication including the internet and text messaging which relates to their physical, emotional or educational well-being or

(c) who are involved in establishing and operating the database containing basic information about children, young people or vulnerable adults in England and those whose employment requires them to access this database (Contact Point)

Enhanced Disclosure

(a) This is the highest level of check available to anyone involved in regularly caring for, training, supervising or being in sole charge of children, young people or vulnerable adults.

(b) Enhanced Disclosures contain the following checks:

• Protection of Children Act (POCA) List

• Protection of Vulnerable Adults (POVA) List

• Information that is held under Section 142 of the Education Act 2002 (formerly known as List 99)

• Relevant and proportionate information held by the local police forces

• Police records of Convictions, Cautions, Reprimands and Final Warnings

Under the SVGA 2006 it is unlawful to employ persons, regardless of any mitigating circumstances, who may have regular contact with children, young people or vulnerable adults and who work in Regulated Activity which is defined as

• Activity involving contact with children or vulnerable adults and is of a specified nature (e.g. teaching, training, care, supervision, advice, medical treatment or in certain circumstances transport) on a frequent, intensive and/or overnight basis;

• Activity involving contact with children or vulnerable adults in a specified place (e.g. schools, care homes etc), frequently or intensively;

• Fostering and childcare; • Certain specified positions of responsibility (e.g. school governor, director

of children's services, director of adult social services, trustees of certain charities).

and who are either:

(a) included on lists maintained by the Secretary of State for Health and are

judged to be unsuitable to work with children, young people or vulnerable adults. (Unsuitability includes but is not limited to previous convictions. Referral to the lists must be made by a "childcare organisation" if the person concerned was employed in a post involving the care of children, young people or vulnerable adults and commits misconduct (whether or not within the course of his/her employment) which has harmed a child or vulnerable adult or put a child or vulnerable adult at risk of harm.

OR

(b) subject to a disqualifying order made on being convicted or charged with the following offences against children, young people or vulnerable adults:

� murder; � manslaughter; � rape;

� other serious sexual offences; � grievous bodily harm; and/or � other serious acts of violence.

Therefore, the Council will not employ and will not allow Contractors to employ persons to work with children, young people or vulnerable adults who are banned for the reasons detailed above.

It is the Council's normal policy to consider it a high risk to employ persons, who may have regular contact with children, young people or vulnerable adults if they have

been convicted or charged at any time with the following offences against children or adults:

� grievous bodily harm; and/or � other serious acts of violence. � serious class A drug related offences; � robbery/burglary/theft; and/or � deception/fraud. Examples of types of convictions and what you should do; If your organisation‘s CRB checks are processed by an umbrella organisation, you must use the Council criteria when deciding whether the outcome of CRB checks is satisfactory and whether the individual concerned is suitable to work with children, young people and vulnerable adults. The following is a non exhaustive list of examples of how the Council would deal with particular disclosures. It is important to note that each case should be decided on its own facts and appropriate advice sought as necessary:-

(a) Sexual offences against a child or vulnerable adult– Offer of employment should not be made.

(b) Other sexual offences - the circumstances, age of the conviction, the type of

job they are to be doing and the specific duties and the client group they are working with. If any doubt an offer of employment should not be made.

(c) Recent serious violent crimes and supply of drugs, or a pattern of possession

which is recent would usually result in an offer of employment not being made.

(d) One off possession of cannabis, especially if some years ago - offer of

employment would usually be made.

(e) Any convictions for theft, fraud, criminal damage etc are taken more seriously if the person has access to money, equipment or property or works in people's homes. An offer of employment would depend on the circumstances and the age of the conviction.

(f) Drink driving offences – this would be an issue where the applicant will be

driving children, young people or vulnerable adults as part of their duties, or there is a pattern. A one off drink driving offence where the appointing officer is happy there is no longer an issue an offer of employment would be made.

(g) One off minor violence which can be explained, employment is usually offered

but will depend on what the job is and the person's attitude towards the offence.

(h) Speeding tickets and parking fines do not appear on Disclosures.

What to do if a CRB disclosure comes back with criminal information declared

(a) If a disclosure comes back with criminal information declared, then a thorough risk assessment needs to be undertaken. You as the potential employer must look at both the job and the person and weigh up whether there is a risk to the

service user(s) against possible safeguards and precautions. Remember our foremost duty is the safety of our children, young people and vulnerable adults.

(b) The set of questions below from ‘NACRO’ can be used as an aid when

entering discussion with an applicant and when making a decision of employment:

• How does the offence impact on the role that the person has applied for?

• The nature of the crime?

• Is the offence a one off or are there a number of offences (repeat offences)?

• How long ago it occurred?

• Is it a juvenile or adult offence?

• The circumstances involved?

• Is the behaviour behind the crime a concern?

• Is the context behind the crime a concern?

• Has the situation leading to the crime changed?

• What evidence is there of change?

• What is the Person’s attitude to the crime?

• Job requirements?

• Safeguards against offending at work - is the role supervised or does it involve unsupervised work?

Spent & Unspent Convictions

If an offender stays on the right side of the law for the specified time after their conviction it becomes ‘spent’, hence the convicted person does not have to reveal or admit its existence in most circumstances. However, there are some exceptions relating to employment and these are listed in the Exceptions order to the Rehabilitation of Offenders Act 1974. The two main exceptions relate to working with children and young people or working with vulnerable adults, where CRB checks will reveal both spent and unspent convictions.
