NOTICE OF RESIDENTIAL FORECLOSURE MEDIATION PROGRAM

--- IT MAY BE POSSIBLE TO SAVE YOUR HOME ---

You have been served with a foreclosure complaint that could cause you to lose your home. The Winnebago County Circuit Court has established a Residential Foreclosure Mediation Program (“Mediation Program”) to assist homeowners who have been served with foreclosure complaints. All homeowners may apply, free of charge, to participate in the Mediation Program.

WHAT IS MEDIATION?

In the Mediation Program, a neutral Mediator helps homeowners and lenders discuss possible agreements to remedy delinquent loans. The mediator does not take sides, and there will be an agreement only if the homeowner and lender both agree.

WHAT MUST I DO?

To participate in this free Mediation Program you must:

Complete the Application online at www.ilforeclosureprogram.org within 21 days of the dateyou were served with the foreclosure complaint (contact HomeStart at 815-962-2011 only if youdo not have online access, or if you need language assistance); and

Follow the instructions in the online Application and provide the Intake Coordinator(HomeStart) with all of the documents it requests within 14 days of completing the onlineApplication.

If you do not comply with these requirements and meet these deadlines, you will not be eligible to participate in the Mediation Program. HomeStart will not provide you with legal services; if you need

legal services but cannot afford them, please contact Prairie State Legal Services at 888-966-7757.

After you apply online, HomeStart will review your Application to determine whether you are eligible to participate in a Mediation. HomeStart will then schedule a Pre-Mediation Conference with you to discuss your Application within 30 days of the date you applied online. After you attend the Pre-Mediation Conference, and if it is determined that your situation is appropriate for mediation, a date will be set for the Mediation. Both you and the lender’s representative must attend the Mediation.

PLEASE NOTE

While no court action will be taken against you while you are participating in the Mediation Program, there is no guarantee that an agreement can be reached between you and your lender. If you dispute your lender's claims, you should consult an attorney and fully participate in the foreclosure litigation.

NOTIFICACION DE PROGRAMA DE MEDIACION DE JUICIOS HIPOTECARIOS

-PUEDE QUE SEA POSIBLE DE SALVAR SU RESIDENCIA-

Si ha recibido una citación de juicio hipotecario que pueda causar la perdida de su residencia. El Tribunal del Distrito del Condado de Winnebago ha establecido una Programa de Mediación ( « Mediation Program ») para ayudar a los dueños de casa que hayan recibido una demanda de juicio hipotecario. Todo dueño de casa puede solicitar de participar, gratuitamente, en el Programa de Mediación.

QUE ES MEDIACION? En el Programa de Mediación, un Intercesor imparcial, ayuda a los dueños de casa y a los representantes de prestamos hipotecarios, a discutir y a encontrar posiblemente un arreglo que pueda remediar los prestamos delincuentes. El Intercesor es totalmente imparcial y habra un arreglo solamente si el representante del préstamo hipotecario y el dueño de casa se ponen de acuerdo.

QUE DEBO HACER?

Para participar en este Programa de Mediación gratuito usted debe:

Llenar la aplicación en linea: wwwilforclosureprogram.org a los 21 días de la fecha en la que recibió la demanda de juicio hipotecario ( pongase en contacto con HomeStart 815 962 2011 solamente si usted no tiene acceso a linea internet, o si necesita ayuda con el idioma); y Siga las instrucciones de la Aplicación en la linea Internet y provea todos los documentos que el Coordinador ( Home Start) les haya pedido, a los 14 días de haber completado la aplicación en linea.

Si usted no cumple con estos requisitos y en el limite de tiempo indicado, usted no sera aceptado a participar en el Programa de Mediación. Home Start no le va proporcionar ayuda legal; si usted necesita servicios legales y si no puede pagarlos, por favor pongase en contacto con Prairie State Legal Services, 888 966 7757.

Después de llenar la aplicación en linea, HomeStart va a revisar su aplicación para determinar si podrá participar en Mediación. HomeStart le dará una cita para una Conferencia Pre- Mediación para poder discutir con usted su aplicación, 30 días después de la fecha de haber terminado su aplicación en linea. Después de asistir a la Conferencia Pre-Mediacion, y si se determina que su situación es aceptada para la Mediación, se fijara una fecha para la Mediación. Usted y el representante del préstamo hipotecario deben asistir a la Mediación.

SE LE ADVIERTE Aunque no se presentara ninguna acción judicial mientras participa en el Programa de Mediación, no podemos garantizarle, que se pueda llegar a un acuerdo entre usted y el prestador. Si usted disputa las alegaciones del prestador, usted debe consultar con un abogado y debe participar plenamente en el Juicio Hipotecario.
