The law is very specific on this subject. Here are a few pertinent parts: 1. Uninspected passenger vessel means an uninspected vessel of less than

100 gross tons carrying not more than 6 passengers, including at least one passenger for hire.

2. 2. A passenger is defined as an individual carried on the vessel except; the owner, the master, or a member of the crew engaged in the business of the vessel who has not contributed consideration for carriage and who is paid for on board services.

3. 3. It also defines ―passenger for hire as a passenger for whom consideration is contributed as a condition of carriage on the vessel, whether directly or indirectly flowing to the owner, charterer, operator, agent, or any other person having an interest in the vessel.

4. 4. Consideration means an economic benefit, inducement, right, or profit including pecuniary payment accruing to an individual, person, or entity.

5. 5. If anyone is paying, the operator is now carrying passengers for hire and can only carry 6 persons on the boat. (Not counting the crew)

Exercise • During you exam, you inadvertently activate the EPIRB. What do

you do? 1. Switch it off immediately 2. Immediately activate the self-test function 3. Contact the CG before turning it off 4. Switch it off immediately and contact the CG

EPIRB False alerts They should be turned off immediately and contact the nearest CG unit and pass the vessel name, number, and EPIRB HEX ID

written on the EPIRB to them. Explain what happened and that it was mistakenly activated. This will expedite the time of uncertainty of an actual/possible distress and minimized search and rescue research and resource hours.

Example: All Stations, All Stations, All Stations

This is NAME, CALL SIGN, DSC NUMBER, POSITION.

Cancel my distress alert of DATE, TIME UTC, Master NAME, CALL SIGN, DSC NUMBER, DATE, TIME UTC.

Failure to cancel a false alert immediately will result in the deployment of search and rescue units by Rescue Co-ordination Centers in an effort to locate the source of the alert. The EPIRB can be deactivated by the following methods; (a) Switching it off; (b) Drying the unit thoroughly, especially the area around the salt water contacts; (c) Placing it in its bracket; (d) Disconnecting the battery; (e) Wrapping it in a double layer of aluminum foil.
