Dear Sir/Madam Proposed Avoca South Industrial and Business Estate, Durban North: Submission of the Final Scoping Report for Approval Following the inclusion of all comments on the Draft Scoping Report received from registered Interested and Affected Parties (I&APs), the Scoping Report and Plan of Study for EIA has been finalised and will be submitted to the KZN Department of Economic Development, Tourism and Environmental Affairs (DEDTEA) for approval. In parallel to this submission, the Final Scoping Report has been made available to all registered I&APs for public review and comment from 16 February to 18 March 2015 (30 days). This is to ensure that all I&APs have the chance to review the submitted report and whether their comments on the Draft Scoping Report have been included in the Final Scoping Report and Plan of Study for EIA. In this regard, please find enclosed a copy of the Final Scoping Report for the environmental authorisation process required for listed activities identified in terms of the National Environmental Management Act (Act no. 107 of 1998) (NEMA). Only minor changes have been made to the Draft Scoping Report during finalisation and include:
• Minor grammatical changes throughout the document. • Minor changes to public participation details for the Final Scoping Report. • Changing clay stock piling quantum values from 500m3 to 500 000m3. • Updating of the Comment and Response Report (CRR) to include comments received during
the Draft Scoping Report public comment period.

NOTIFICATION OF AN ENVIRONMENTAL AUTHORISATION PROCESS FOR THE PROPOSED AVOCA SOUTH INDUSTRIAL AND BUSINESS ESTATE EIA NEAR COROVOCA TOWNSHIP
AND MOUNT MORIAH, DURBAN NORTH
GCS REFERENCE NO: 12-634 Notice is hereby given of the Environmental Impact Assessment (EIA) process and an Integrated Water Use Licence Application (IWULA) for the proposed Avoca South Industrial and Business Estate located on the corner of Curnick Ndlovu Highway and Main Road R102 (MR577), GPS Co-Ordinates: -29.748598° S, 31.024457°E, Durban North, KwaZulu-Natal. The proposed Avoca South Industrial and Business Estate will be comprised of approximately 12 light industrial and warehousing levelled platforms. The EIA and IWULA will be undertaken by GCS (Pty) Ltd on behalf of Investec Property Limited as authorised by Main Street 57 (Pty) Ltd (PO Box 78949, Sandton, 2146). This is in compliance with Regulation 54 of the Environmental Impact Regulations (GN R.543 - 2010), under Section 24(5) of the National Environmental Management Act, 1998 (Act No.107 of 1998) and the National Water Act (No 36 of 1998). The NEMA activities which are triggered by the proposed project are listed under GNR 544, and as such require an application for an Environmental Authorisation in the form of a BA process. The following activities are relevant to the project:
Activity 5: “The construction of facilities or infrastructure for any process or activity which requires a permit or license in terms of national or provincial legislation governing the generation or release of emissions, pollution or effluent and which is not identified in Notice No. 544 of 2010 or included in the list of waste management activities published in terms of section 19 of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) in which case that Act will apply.”
Activity 15: “Physical alteration of undeveloped, vacant or derelict land for residential, retail, commercial, recreational, industrial or institutional use where the total area to be transformed is 20 hectares or more.”
Activity 18: “The route determination of roads and design of associated physical infrastructure including roads that have not yet been built for which routes have been determinate before 03 July 2006 and which have not been authorized by a competent authority in terms of the Environmental Impact Assessment Regulations, 2006 or 2009, made under section 24(5) of the Act and published in Government Notice No. R. 385 of 2006,-
1) The road reserve is wider than 30 meters; or
2 )The road will cater for more than one lane of traffic in both directions”
The NWA activities which are triggered by the proposed project are listed under Section 21, and as such, require an IWULA in terms of: (c) Impeding or diverting the flow of water in a watercourse; and (i) Altering the bed, banks, course or characteristics of a watercourse. All interested and/or affected parties (I&APs) are invited to register in writing with GCS in order to receive further information and correspondence on the project including notices on project progress, public meetings and reports. Under Regulation 56 of NEMA, registered Interested and Affected Parties are entitled to comment on draft submissions. Under Section 24 O of NEMA, on receipt of draft reports you are requested to submit any comments within a 40 day period, this being from the 2nd of June 2015 to the 12th of July 2015. Purpose of this Document
The purpose of this document is to provide all interested and affected parties (I&APs)
with information about the Avoca South Industrial and Business Estate and to introduce
and explain the Environmental Impact Assessment (EIA) and process. This BID also
aims to explain the public participation process that is prescribed by the National
Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) and invites all
I&AP’s to comment on issues and concerns related to the project.
The site for the proposed Avoca South Industrial and
Business Estate is situated on the corner of Curnick
Ndlovu Highway and Main Road R102 (MR577).
Located to the north and west of the site are the
MR577, Mount Moriah residential area and Corovoca
Township and the Curnick Ndlovu Highway. To the
south of the site is the N2 National Route and the
residential areas of Avoca and Avoca Hills. Located
to the east of the site is the proposed Avoca North
Industrial and Business Estate site. See page 4 for
Locality Map.
Location of the Development Project Description
The proposed establishment of Avoca South
Industrial and Business Estate will comprise a
number of light industrial, general business and
warehousing platforms, while the remainder of the
site will be zoned as open space or conservation and
roads. The land is currently used by Corobrik to mine
clay and produce clay bricks in its factory on the site.
Approximately 98 hectares of the total 157 hectares
of land will be leveled to form platforms and
subdivided for the development. The proposed
development will include provincial road upgrades,
and service infrastructural upgrades for water, sewer
and electricity. The stockpiling of 500m³ of clay
reserves is likely to be included.

Environmental Impact Assessment Process
Section 24 of the National Environmental Management Act (Act No. 107 of 1998) (NEMA) requires that
activities (e.g. construction), which may impact on the environment must obtain an environmental
authorization from a relevant authority before commencing with the activities. Such activities are listed under
Regulations Listing Notice 1 GNR 544 and Listing Notice 2 GNR 545 (Dated 29 November 2013) of NEMA.
In terms of the proposed project, the Department of Agriculture and Environmental Affairs (DAEA) is the
competent authority for environmental authorization. The listed activities which are triggered by the proposed
project are included under GNR 545, and as such require an application for an Environmental Authorization
in the form of an Environmental Impact Assessment (EIA) process. All activities under GNR 544 which
require a Basic Assessment (BA) will be included as part of the full EIA process.
Full EIA activities identified to date include:

In parallel to this submission, the Final Scoping Report has been made available to all registered I&APs for public review and comment from 16 February to 18 March 2015 (30 days). This is to ensure that all I&APs have the chance to review the submitted report and check that their comments on the Draft Scoping Report have been included in the Final Scoping Report and Plan of Study for EIA. The duration of the project will be 6 months.
The Established Contractor shall be registered in CIDB contractor grading designation6CE or higher.
The Established Contractor must have appropriate road bridge constructionexperience in rivers comparable to the Ntuze River.
Established Contractors who do not have a proven road bridge constructionexperience record of bridges on this size river are not eligible to tender for thisproject.
