MSHA Part 100• Reformulates the process of assigning points to arrive at an

assessment.

• Adds a provision to an operator’s history addressing “repeat violations”.

• Eliminates the $60 single penalty assessment for “non-S&S violations”.

• Increases the dollar amount of each point in a conversion table.

• Maximum $60,000 for civil penalty (no change)

• Minimum of $2000 and $4000 for Unwarrantable failure and Withdrawal orders respectively.

• Failure to notify MSHA within 15 minutes of a fatality or injury that has reasonable potential to be a fatality from $5,000 to $60,000.

• Makes all violations subject to “special assessment.”

MSHA Part 100What is an Accident1. A death of an individual at a mine;

2. An injury to an individual at a mine, which has reasonable potential to cause death;

3. An entrapment of an individual for more than 30 minutes;

3. An entrapment of an individual for more than 30 minutes or which has a reasonable potential to cause death;

4. An unplanned inundation of a mine by a liquid or gas;

5. An unplanned ignition or explosion of gas or dust;

6. An unplanned mine fire not extinguished within 30 minutes of discovery;

6. In underground mines, an unplanned mine fire not extinguished within 10 minutes of discovery; in surface mines and surface areas of underground mines, an unplanned fire not extinguished within 30 minutes of discovery;

7. An unplanned ignition or explosion of a blasting agent or an explosive;

8. An unplanned roof fall at or above the anchorage zone in active workings where roof bolts are in use; or, an unplanned roof or rib fall in active workings that impairs ventilation or impedes passage

9. A coal or rock outburst that causes withdrawal of miners or which disrupts regular mining activity for more than one hour;

10. An unstable condition at an impoundment, refuse pile or culm bank which requires emergency action in order to prevent failure, or which causes individuals to evacuate an area; or, failure of an impoundment, refuse pile or culm bank;

11. Damage to hoisting equipment in shaft or slope which endangers an individual or which interferes with use of the equipment for more than 30 minutes; and

12. An event at a mine that causes death or bodily injury to an individual not at the mine at the time of the event.

VPID = # assessed violations (15 mos.) Divided by Total inspection days (15 Mos.)

– Penalty not used for mines with less than 10 citations for the 15 month period.

– Only assessed violations that have been paid or finally adjudicated

– Inspection day = full or partial day at mine site per inspector.

– Have the authority to take past violations into consideration, (prior to promulgation) but will pay close attention to retroactive circumstances that result in unfair penalty increases.

– Using 2005 data average penalty points for M/NM was 7.6 points.

– Maximum of 25 penalty points versus 20 points old rule.

• Flagrant Definition…. “a reckless or repeated failure to make reasonable efforts to eliminate a known violation of a mandatory health or safety standard that substantially and proximately caused, or reasonably could have been expected to cause, death or serious bodily injury.”
