At a meeting of the Executive Council held in the Executive Council Chambers, at Perth, on the nineteenth day of March, 1975, thefollowing Orders in Council were authorised to be issued :-
Constitution Act, 1889-1970
ORDER IN COUNCIL
WHEREAS section 74 of the Constitution Act, 1889-1970 provides, inter alia, that the Governor in Council may vest in heads ofdepartments, or other officers or persons within the State, power to make minor appointments to public offices under the Govern-ment of the State : Now therefore, His Excellency the Governor acting with the advice and consent of the Executive Council hereby-
(a) vests in F . A . Bull, Chief Clerk, Accounts Branch, Medical and Health Services, and in any person temporarily appointed toperform the normal duties of the said F. A. Bull during his absence or incapacity, the power to make appointments in re-spect of the department/departments specified in Column 1 of the Schedule hereto, of employees of the category/categoriesspecified respectively in Column 2 of the Schedule hereto in relation to those departments, on such terms and conditionsas are contained from time to time in the awards and agreement specified respectively in Column 3 of the Schedule heretoin relation to those categories of employment ; and
(b) revokes the power previously vested in R . V. Croxton and in any person temporarily appointed to perform the normalduties of the said R . V . Croxton during his absence or incapacity, to make minor appointments in respect of the depart-ment/departments specified in Column 1 of the Schedule hereto.

Constitution Act, 1889-1970
ORDER IN COUNCIL
WHEREAS section 74 of the Constitution Act, 1889-1970, provides, inter alia, that the Governor in Council may vest in heads ofdepartments, or other officers or persons within the State, power to make minor appointments to public offices under the Governmentof the State : Now, therefore, His Excellency the Governor, acting with the advice and consent of the Executive Council herebyvests in Brian John Loughton, Resident Engineer, Public Works Department and in any person temporarily appointed to performthe normal duties of the said Brian John Loughton during his absence or incapacity, the power to make appointments in respectof the Department specified in Column 1 of the Schedule hereto, of employees in the categories specified respectively in Column 2of the Schedule hereto in relation to that Department, on such terms and conditions as are contained from time to time in theAwards and/or Agreements specified respectively in Column 3 of the Schedule hereto in relation to those categories of employees .

To all to whom these Presents shall come,
GREETING :WHEREAS by a Commission dated the 19th June,1974, I, James Maxwell Ramsay, was duly ap-pointed Lieutenant-Governor of the State of West-ern Australia and its Dependencies in the Com-monwealth of Australia ; and whereas in certainLetters Patent under the Great Seal being datedat Westminster, the 29th day of October, 1900,constituting the office of Governor in and over theState of Western Australia and its Dependenciesin the Commonwealth of Australia it is provided :that in the event of the office of the Governor be-coming vacrant the Lieutenant-Governor shall dur-ing Her Majesty's pleasure, administer the Govern-ment of the State, first taking the Oaths in thoseLetters Patent directed to be taken by the Gov-ernor and in the manner therein prescribed ; whichbeing done the Lieutenant-Governor is by thoseLetters Patent authorised, empowered, and com-manded by Her Majesty to do and execute, duringHer Majesty's pleasure, all things that belong tothe Office of Governor according to the tenor ofthose Letters Patent and according to the instruc-tions to the said Governor mentioned therein andthe Laws of the State; and whereas the office ofthe Governor in and over the State of WesternAustralia and its Dependencies in the Common-wealth of Australia has become vacant : Now thisis to give notice that I, the said James MaxwellRamsay, have duly taken the Oaths required by theLetters Patent and have, in pursuance of the Let-ters Patent, this day assumed the office of Ad-ministrator of the Government of the State andby the terms of the Letters Patent Her Majestydoth require and command all officers and Min-isters and all the other the inhabitants of the

VACANCIES IN THE PUBLIC SERVICE

The possession of, or progress towards, an appropriate tertiary level academic qualification will be considered a factor,increasing in importance with the level of classification, when determining efficiency of applicants in the Clerical Division .
Applications also called outside the Service under section 24.University Degree or equivalent preferably with post graduate studies . Preference to applicants with experienceof executive direction in a field related to environmental planning, research and evaluation . A knowledge of seniorlevel Government procedures and practices desirable but not essential .
(d) Applicants should possess a degree or qualification in Town Planning and be a member of the Royal AustralianPlanning Institute or a similarly approved professional institution . An additional qualification in an allied pro-fession is desirable but not essential .Applicants must have appropriate planning experience .University Degree or equivalent . Preference to applicants with post graduate research experience in a related field .Experience in the management and control of private consultant contractors and familiarity with general conservationplanning and policy issues in Australia .

VACANCIES IN THE PUBLIC SERVICE-continuedUniversity Degree or equivalent, majoring in science and/or engineering . Preference to applicants with researchand field experience over a range of scientific and engineering matters, and in the management and control of privateconsultant contractors with familiarity of general conservation issues in Australia .Applicants must :-
1. Have experience as a Foreman in Charge of a Plant Maintenance Workshop .2. Have experience with all types of Construction Plant used by the Board including multiple de-watering
equipment.3 . Be familiar with the field operations of the various branches of the Board .
Experience in stores would be an advantage .Relevant purchasing experience necessary .Associateship in Library Studies, W.A.I .T ., or Registration Certificate of L .A .A . or equivalent qualification .Background education in science (preferably Agriculture), science degree or diploma desirable .Qualified in the trade as a Motor Mechanic with preference for applicants with several classes of Motor Driver's Li-cences .Tertiary degree in chemistry, higher qualifications desirable . APPLICATIONS are invited under Section 32 ofthe "Land Act, 1933-1972", for the leasing ofReserve No. 3646 (Beverley Suburban Lot 155)containing an area of 2 .023 4 hectares, for the pur-pose of "Grazing", for a term of one (1) year ata rental of $30.00, subject to the following con-ditions :-
(1) The land shall not be used for any pur-pose other than "Grazing" without theprior approval in writing of the Ministerfor Lands .
(2) The lease shall be renewable at the willof the Minister for Lands and subject todetermination at three months' notice byeither party after the initial term of one(1) year. Should the lease be so renewed,the rental fixed may be re-appraised atsuch amount as the Minister for Landsmay at any time and from time to timedetermine.
(3) The lessee shall not cut down fell injure ordestroy any living timber or scrub uponthe demised land except for the purposeof destroying poisonous growth or by theagistment of stock in reasonable numbers .
(4) The lessee shall not without the previousconsent in writing of the Minister forLands assign, transfer, mortgage sublet orpart with the possession of the demisedland .
(5) The land shall be occupied and used bythe lessee for the purpose specified withinnine (9) months of the commencement ofthe lease and thereafter will be continu-ously so used to the satisfaction of theMinister.
(6) No structures will be erected without theprior approval in writing of the Ministerfor Lands .
(7) Compensation shall not be payable to thelessee in respect of any improvementseffected by him on the demised land andremaining thereon at the expiration orearlier termination of the lease .
(8) The lessee shall, within twelve monthsfrom commencement of the lease, fencethe external boundaries with a stock-prooffence to the satisfaction of the Minister.
(9) The lessee shall take all reasonable pre-cautions to prohibit the drinking ofalcoholic liquor on the demised land .
(10) The Minister or his representative mayenter the land for inspection at anyreasonable time .
(11) The lessee shall not keep or suffer or per-mit to be kept or maintained on the de-mised land any dog or bitch .
(12) Power is reserved to the Minister forLands to direct that the number of stockdepasturing on the demised land shall bereduced if the Minister is of the opinionthat the demised land is overstocked to anextent sufficient or likely to cause perman-ent damage to the land ; failure to complywith any such direction will result in theforfeiture of the lease .
Applications accompanied by an amount of$31.50, being one year's rental and lease fee mustbe lodged at the Lands and Surveys Department,Perth on or before Wednesday, 30th April, 1975 .

Principal
1 . In these regulations the Pre-School Education Act (Councilregulations . of Delegates) Regulations, 1974, published in the Government
Gazette on the 29th March, 1974 are referred to as the principalregulations .
Reg . 3amended . 2 . Regulation 3 of the principal regulations is amended-
(a) by deleting the passage " which shall not be earlier thanforty-two days after the despatch of the notice," in linesone and two of paragraph (a) ;
(b) by adding after the regulation designation "3." the sub-regulation designation "(1)" ; and
(c) by adding the following subregulations :-
(2) The date required to be specified in the notice sentpursuant to subregulation (1) of this regulation shall netbe earlier than-
(a) forty-two days after the despatch of the notice,in the case of a meeting called pursuant to sub-section (1) of section 30 of the Act (other than ameeting to which paragraph (b) of this subregula-tion applies) ;
(b) fourteen days after the despatch of the notice, inthe case of a meeting called pursuant to subsection(1) of section 30 of the Act, if the notice statesthat in the opinion of the Board business to bedealt with at the meeting requires urgent considera-tion by the Council ;
(c) fourteen days after the despatch of the notice, inthe case of a meeting called pursuant to sub-section (2) of section 30 of the Act .
(3) Whenever a notice is sent to an approved bodypursuant to subregulation (1) of this regulation a copy ofthat notice shall also be sent to the persons appointed asdelegates by that body of whose appointment the Secretaryof the Board has been notified prior to the despatch of thenotice to that body .

STATUTE No. 10 .
STUDENT DISCIPLINARY STATUTE .
1 . In this Statute, unless the context otherwise requires-"Appeals Committee" or "Committee" means the Council
Appeals Committee constituted in accordance with section17 ;
"Board of Discipline" or "Board" means a Board of Disciplineconstituted in accordance with sections 13 or 14 ;
"Director" includes any Assistant Director to whom the Directorhas delegated any of his powers and functions undersection 3 ;
"Examination" means an examination conducted by the Institute,and includes an examination conducted by any other personor body prescribed by the Statutes as a person or bodyauthorised to conduct examinations for the Institute, andalso includes any academic assessment of a student or hiswork in accordance with the relevant procedures adoptedwithin the Institute or any School or Department fromtime to time ;
"Member of the Institute" means a person who is a member ofthe Council, a member of the staff of the Institute or astudent ;
"Misconduct" shall have the meaning set out in section 2 ;"Senior Officer of the Institute" means the Director, an Assistant
Director, a principal of a School or College, a Dean of aSchool, a Head of a Department, and such other membersof the staff of the Institute as the Director may designatefrom time to time for the purposes of this Statute .
2. In this Statute, "misconduct" means conduct on the part of astudent which impairs the reasonable freedom of other persons topursue their studies, researches, duties or lawful activities in theInstitute, or upon Institute premises or to participate in the lifeof the Institute or which is otherwise detrimental to the properconduct of the Institute and without limiting the generality of theforegoing, includes-
(a) wilfully obstructing or disrupting any teaching, study,research or examination ;
(b) wilfully obstructing or disrupting any official meeting, pro-ceeding or ceremony within the Institute or any Instituteactivity ;
(c) wilfully interfering with the freedom of speech within theInstitute of any member of the Institute or of any personinvited by any section of the Institute to express his views ;
(d) wilfully interfering with the freedom of movement withinthe Institute of any member of the Institute or any visitor ;
(e) failing to leave any place within the Institute forthwithupon being directed to leave it by a Senior Officer of theInstitute ;
(f) entering any place within the Institute which the studentis forbidden by any Statute By-law or Rule to enter or whichthe student has been forbidden to enter by any SeniorOfficer of the Institute ;
(g) acting dishonestly or unfairly in connection with any exam-ination or other academic work ;
(h) wilfully obstructing or attempting to obstruct or deter anymember of the staff of the Institute in the performance ofhis duties ;
(i) wilfully damaging or wrongfully dealing with any Instituteproperty or the property within the Institute of any person ;
(j) assaulting or attempting to assault any person within theInstitute ;
(k) failing to comply with any provision of any Statute, By-law or Rule ;
(1) failing to comply with any penalty imposed under anyStatute, By-law or Rule .
An instance of misconduct shall be deemed to be a disciplinaryoffence within the meaning of the Act .

3. Without prejudice to the generality of the Director's powersof delegation under Sections 14 (3) or 34 (id) of the Act, the Dir-ector may at any time and from time to time delegate all or anyof his powers and functions under this Statute to any AssistantDirector .
4. The penalties that may be imposed for any instance of mis-conduct are-
(a) a fine not exceeding $50 ;(b) suspension of all or any of a student's rights and privileges
within the Institute including-U) suspension from attendance at or exclusion from
lectures, seminars, tutorials and other classes ;(ii) suspension from the use of or .exclusion from labora-
tories or other Institute facilities or any part of suchfacilities ;
(iii) suspension from attendance at or exclusion from anyexamination ;
(iv) exclusion from the Institute or any part of the Insti-tute ;
for any specified period, not exceeding the remainder ofthe calendar year ; or(v) refusal of re-enrolment as a student ;
(c) cancellation or deprivation of credit for any examinationor other academic work but only if the misconduct involvedacting dishonestly or unfairly in connection with any ex-amination or other academic work ;
(d) expulsion from the Institute ;(e) restitution of or for any Institute property lost, damaged
or destroyed by the student up to a maximum of $100 .
5 . (1) Any person or body authorised to impose any penaltyunder the Act or this Statute or any other Statute By-law or Rulemay caution or reprimand the student instead of or in addition toany other penalty that may be imposed .
(2) A penalty may be partly of one kind and partly of another .(3) A penalty may be suspended by the person or body imposing
it until the time for lodging an appeal has expired or generallyon such terms and conditions, including undertakings by the stu-dent, as the person or body suspending the penalty thinks fit .
(4) If the penalty is expulsion from the Institute, it shall nottake effect until after the time for lodging an appeal has expired,and it has been confirmed by the Council, but all the student'srights and privileges shall be suspended until the Council has de-cided whether or not to confirm the expulsion .
(5) A student expelled from the Institute shall not be re-enrolledexcept with the authority of the Council .
(6) No degree or diploma shall be conferred on a student chargedwith misconduct until after the charge has been dealt with inaccordance with this Statute, and any appeal by the student hasalso been dealt with or the time for lodging an appeal has expired,and any fine imposed has been paid, unless otherwise decided by theDirector .

(b) exclude the student from any examination or any part ofany examination but only if in his opinion it is necessaryto do so to preserve order and decorum in the place wherethe examination is being conducted ;
or impose a penalty under both paragraphs (a) and (b) of thissubsection .
(2) The Assistant Director (Educational Services) may suspendall or any of the student's rights and privileges-
(a) if the student does not pay a fine imposed on him underthis Statute or under any other Statute By-law or Rulewithin the time specified by the person or body imposingit or if no time is specified, within 14 days after the dateon which it was imposed or within such extended time asthe Assistant Director (Educational Services) allows ; or

(7) Subject to the rights of appeal specified in this Statute, anydecision under this Statute that a student has been guilty of mis-conduct or imposing a penalty or both is final and conclusive .
Director'spowers. 6 . (1) The Director may (in addition to his powers under Sec-
tion 11)(a)(b)
for any instance of misconduct by a student-fine the student a sum not exceeding $50 ; orsuspend for a period not exceeding 14 days all or any of thestudent's rights and privileges within the Institute ;

(b) if the student does not pay any fees or other debt due andpayable by him to the Institute within such time or ex-tended time as the Assistant Director (Educational Serv-ices) allows .
Any suspension imposed by the Assistant Director (EducationalServices) under this subsection shall cease to have effect on pay-ment of the overdue fine, fees or other debt in respect of which itwas imposed.
(3) The Assistant Director (Educational Services) shall forth-with confirm by written notice to the student any penalty imposedunder this section .
Principal's
8 . (1) A Principal of a School or College, a Dean of a School orDean's andHeads of
a Head of a Department and such other senior members of theDepartments Academic staff as may be designated by the Director from time topowers . time for the purposes of this section may for any instance of mis-
conduct by a student within the School or College or Department,as the case may be, or with respect to an activity conducted by theSchool, College or Department or an activity for which it is res-ponsible within the Institute-
(a) fine the student a sum not exceeding $20 ;(b) suspend for a period not exceeding 14 days all or any of
the student's rights and privileges within the School,College or Department in which the misconduct occurred ; or
(c) cancel the student's credit or deprive him of credit for anexamination or other academic work or any part thereofdone within the School, College or Department in whichthe misconduct occurred, but only if the misconduct in-volved acting dishonestly or unfairly in connection withany examination or other academic work ;
or impose a penalty under any two or more of paragraphs (a), (b)or (c) of this subsection .
(2) The Principal, Dean or Head of Department concerned shallforthwith-
(a) confirm by written notice to the student any penalty im-posed on him under this section ; and
(b) report the matter in writing to the Assistant Director(Educational Services) .
Librarian's
9 . (1) The Librarian may for any instance of misconduct by apowers .
student in or in relation to the Library-(a) fine the student a sum not exceeding $20 ;(b) suspend for a period not exceeding 14 days all or any of
the student's rights and privileges in relation to the library,including exclusion from the library premises or any part ofsuch premises ;
or impose a penalty under both paragraphs (a) and (b) of thissubsection .
(2) The Librarian shall forthwith-(a) confirm by written notice to the student any penalty im-
posed on him under this section ; and(b) report the matter in writing to the Assistant Director
(Educational Services) .Otherperson'spowers .
Reference toa Board ofDiscipline .
10 . (1) This section authorises the following persons to imposethe penalty specified in subsection (2) of this section-
All members of the academic staff, and such members of thesenior technical staff, senior library staff and senior ad-ministrative staff as may be charged with responsibilityfor the operation or maintenance of any facility of theInstitute or who may otherwise be designated by the Direc-tor for the purposes of this Section .
(2) Any person authorised by this section may for any instanceof misconduct by a student in any lecture, seminar, tutorial orother class, laboratory, library or other facility conducted or super-vised by him exclude the student therefrom for a period not exceed-ing the next following twenty-four hours .
(3) A person imposing a suspension under this section shallforthwith report the matter in writing to the relevant Principal,Dean or Head of Department, or the Assistant Director (EducationalServices) as the case may be, and the person to whom the matteris so reported shall thereupon affirm or annul the suspension imposedand take such other action in exercise of his powers under thisStatute as he may consider appropriate .
11 . (1) A student may refer to a Board of Discipline by way ofappeal any decision made against him or any penalty imposed onhim under sections 6 to 9 Inclusive, or under any other Statute,By-law or Rule which prescribes that the conduct complained of isdeemed to be "misconduct" for the purposes of this Statute .(2) The Director may, in the name of the Institute, charge a
student with misconduct and refer the charge to a Board . A refer-ence shall be made by notice in writing to the Chairman of theBoard of Reference appointed under section 13 (2) .
(3) Whenever the Director charges a student with misconduct andrefers the charge to a Board, he may suspend for a period notexceeding 28 days all or any of the student's rights and privileges

within the Institute (other than in relation to hearings before theBoard or an Appeals Committee) pending the hearing of the case .The Board to which the charge has been referred may, at any timeafter the reference, lift the suspension, but unless it does so, thesuspension shall continue until the period for which it was imposedhas elapsed or the Board gives its decision in the case whichevershall first occur .
Powers of
12 . (1) A Board of Discipline shall have power to hear and ad-a Board. judicate upon any reference to it under Section 11 .(2) In the case of a reference by way of appeal under subsection
11 (1), the Board shall hear the matter again from the beginningand it may, in addition to other powers conferred by this Section,affirm or annul the decision or penalty or both, or may reduce or in-crease the penalty or impose in its place any other penalty whichmay be imposed under this Statute .
(3) In the case of a reference under subsection 11 (2) the Boardmay find that a charge of misconduct has been proved, or it maydismiss the charge, and it may, for any instance of misconduct, im-pose any penalty which may be imposed under this Statute .
(4) If a Board finds a charge of misconduct has been establishedit may decline to record a finding of misconduct or to impose apenalty if in its opinion the misconduct was trivial, or if, for anyother reason, the Board is of opinion that a finding of misconductshould not be recorded or a penalty should not be imposed .
(5) The decision of the Board on a reference by way of appealunder subsection 11 (1) shall be final and conclusive, except thatif the penalty is expulsion from the Institute, the provisions ofsubsection 5 (4) shall apply .
Constitution 13 . (1) A Board of Discipline shall be constituted by the Direc-of a Board . for in accordance with this Section whenever a matter is referred
to a Board under Section 11 .(2) A Board of Discipline shall consist of-
(a) a Chairman appointed by the Director, who must be eithera qualified legal practitioner or hold a degree in law ;
(b) two members of the full-time academic staff selected atrandom by the Director from a panel of five members ofthe academic staff nominated annually by the AcademicStaff Association .
(c) two students selected at random by the Director from apanel of five students nominated annually by the StudentGuild ;
(3) If any of the persons mentioned in paragraphs 2 (b) or 2(c) of this section is unable or unwilling to act as a member of theBoard the Council shall elect a substitute member from the mem-bers of the Council to fill the vacancy .
(4) If a person is selected as a member of a Board and in theopinion of the Chairman he should not act as a member of theBoard due to his involvement in the case, the Director shall selectat random a substitute from the panel of which he is a member .
Procedure or 14 . (1) The quorum of a Board of Discipline shall be three mem-a Board. bers, of whom one must be the Chairman . A Board may act and
continue to act notwithstanding the absence of any member ormembers but a decision can only be given by not less than threemembers, including the Chairman, all of whom have been presentthroughout the hearing .
(2) If, for any reason, a Board is unable to obtain a quorum oris unable to reach a decision on any matter, the Chairman shallreport to the Council accordingly, which shall then
(a) appoint a substitute Board in which event the provisionsof Section 13 shall not apply, and a Board may be consti-tuted by the Council appointing any five members of theCouncil to constitute the substitute Board ; or
(b) with the exception of members appointed to the AppealsCommittee, constitute itself as a Board of Discipline .
(3) The Chairman of a Board shall have a deliberative but not acasting vote .
(4) On any question whether a charge of misconduct has beenapproved, if the votes are equally divided, the charge shall bedeemed not to have been proved . On any question whether an ap-peal should be allowed, if the votes are equally divided, the appealshall be allowed .
(5) A Board of Discipline which has been duly constituted underthis Section shall continue to act in the matter notwithstandingany change in the membership or constitution of the Council .
(6) A Board of Discipline constituted to hear and adjudicateupon a charge of misconduct made against a student or an appealmade to it may have referred to it a charge or charges of miscon-duct made against another student or other students or anothercharge or other charges against the first mentioned student or anyother appeal or appeals and the Board may deal with all thecharges and appeals referred to it, except that-
(a) the Board shall not deal with more than one charge or

appeal at the same hearing unless, in its opinion, thecharges arise out of instances of misconduct which-
(i) comprise a series of instances of the same or a sim-ilar character ;
(ii) are committed in the furtherance of a common ob-jective; or
(iii) occur during group activity by the students chargedor on whom penalties have been imposed, whetheror not with other students .
(b) if the Board forms the opinion at any stage before makingknown its decision that it should in the interests of justicerefrain from hearing or desist from proceeding further withany of the charges or appeals, it shall so refrain or de-sist and another Board shall be constituted to deal with anysuch charge or appeal .
Appeal to
15 . (1) A student may appeal to the Appeals Committee againstthe Appealscommittee . any decision made against him by or any penalty imposed on him
by a Board of Discipline in any case which was not itself an appealto the Board.
(2) The Institute may appeal to an Appeals Committee againstany decision by a Board of Discipline in any case which was notitself an appeal to the Board .
(3) No appeal may be made limited to the question of costs .Powers of
16 . (1) An Appeals Committee to which an appeal is made maythecommittee . affirm or annul the decision or penalty or both, or reduce or in-
crease the penalty, or impose in its place any other penalty whichmay be imposed under this Statute .
(2) (a) On any appeal against the imposition of a penalty only,only matters relevant to the penalty shall be dealt with .
(b) On any appeal, an Appeals Committee may hear the casefrom the beginning, hear additional evidence or rely onthe record of the Board of Discipline, as it shall thinkfit. Any point of law shall be decided by the Chairmanalone .
(3) The decision of an Appeals Committee shall be final andconclusive, provided that if the penalty is expulsion from theInstitute the provision of subsection 5 (4) shall apply .
Constitution 17 . (1) The Council shall, at its regular March meeting eachcommittee. year, appoint an Appeals Committee which shall consist of :-
(a) a Chairman, who must either be a qualified legal practitioneror hold a degree in law ;
(b) two members of the Council .(2) If a member of the Appeals Committee is involved in any
matter the subject of an appeal to the Appeals Committee or was amember of the Board of Discipline from which an appeal is beingmade, he shall not participate in the appeal as a member of theAppeals Committee .
(3) The Council may appoint a substitute member to take theplace of any person excluded from participation under subsection (2)of this section or to fill a casual vacancy .
(4) The Chairman and members of the Committee shall continuein office until the appointment of the next Appeals Committee, exceptthat an Appeals Committee shall continue in office to conclude thehearing of any appeal and to give its decision notwithstandingthe appointment of a new Appeals Committee .
Procedure of 18 . (1) All members of an Appeals Committee must be presenta Committee-throughout the hearing of an appeal .(2) The Chairman of an Appeals Committee shall have a deliber-
ative but not casting vote .(3) On any question whether an appeal should be allowed, if the
votes are equally divided, the appeal shall be allowed .Secretary of 19 . The Assistant Director (Educational Services) or a memberBoard or of the administrative staff appointed by him shall act as Secretarycommittee . of all Boards of Discipline and Appeals Committees .Lodgement
20. A reference to a Board of Discipline by way of appeal or anof Appeal. appeal to an Appeals Committee must be lodged with the Assistant
Director (Educational Services) within seven days after the decisionappealed against has been notified to the student, unless the Boardor Committee to whom the appeal is made allows an extension oftime. An extension of time shall not be allowed unless the Board orCommittee is satisfied that there was good reason for failure to lodgethe reference or appeal within the time allowed .
Notice
21 . (1) The Assistant Director (Educational Services) shall giveof hearing. to a student charged with misconduct before a Board of Discipline
or who is a party to an appeal not less than five days written noticeof the hearing by the Board of Discipline or Appeals Committee .The notice shall contain particulars of :-
(a) the charge in the case of a charge referred to a Board ofDiscipline ;
(b) the time and place of the hearing ; and(c) the student's rights under section 23 (1) .
(2) If. the student falls to appear at the hearing and the Board orCommittee is satisfied that the student has been given notice inaccordance with this section, it may proceed with the hearingin the student's absence, or order an adjournment .

General
22 . The procedure of a Board of Discipline or Appeals CommitteeDiscretion re.including the order in which evidence may be called and adressesto Procedureheard shall be in the discretion of the Board or Committee .
Hearings .
23 . (1) During any hearing, the student shall be entitled-(a) to be represented by a legal practitioner, another student,
or a member of the staff of the Institute ;(b) to be present with his representative throughout the hear-
ing except when the Chairman and members of the Boardof Discipline or Appeals Committee wish to confer privatelyamong themselves, or to consider their decision ;
(c) either himself or by his representative to call and examinewitnesses, cross-examine witnesses other than any witnesscalled by him or his representative, and to address theBoard or Committee .
(2) The Director may appoint a legal practitioner or a mem-ber of the staff of the Institute to represent the Institute at thehearing and any person so appointed may call and examine wit-nesses, cross-examine witnesses called by the student or his repre-sentative, and address the Board or Committee .
(3) Hearings of a Board or Committee shall be in private unlessthe student charged elects otherwise, in which event they shall beopen to other members of the Institute provided that-
(a) if charges against two or more students are being dealtwith together before the Board or Committee and any oneof them elects a private hearing, the hearing shall be pri-vate ; and
(b) the Board or Committee may order that an open hearingbe continued in private if in its opinion order cannot other-wise be maintained .
(4) At every hearing, the Board or Committee shall have completeauthority to keep order and it may order the removal of any per-son, including (notwithstanding the provisions of subsection (1) ofthis section) a student in respect of whom the hearing is takingplace or the representative of such a student, for unruly conduct.
(5) The Assistant Director (Educational Services) shall forthwithconfirm by written notice to the student any penalty imposed onhim by a Board or Committee .
Costs. 24 . (1) Where a student desires to engage a legal practitioner torepresent him before a Board of Discipline or an Appeals Commit-tee and is unable to engage legal representation through either theState or Federal Legal Assistance programmes, then the Institutewill reimburse him reasonable legal expenses, the amount to be de-termined and certified by the Board or Committee .
(2) a Board of Discipline which has heard a charge of misconductagainst a student or an appeal by a student may award the studentthe whole or part of his costs of the hearing or appeal as the casemay be .
(3) An Appeals Committee may award a student appellant thewhole or part of his costs incluping the costs of the appeal to theCommittee and the costs of the hearing of the charge by the Boardof Discipline .
(4) If an Appeals Committee or a Board of Discipline makes anaward of costs, it shall fix the amount payable and it shall be paidto the student out of Institute funds .
Decisions. 25. Every decision of a Board of Discipline and an Appeals Com-mittee together with short reasons therefor shall be expressed inwriting and the Secretary of the Board or Committee shall forth-with give a copy of the decision to the student .
Notices . 26 . (1) Any notice or copy of decision required to be given to aperson under this Statute shall be sufficient if given to him inperson or sent to him by registered post addressed to the lastaddress known to the Institute as his place of residence .
(2) Any notice or copy of decision given by post shall be deemedto have been given when the letter would have been received atthe address in the normal course of post .
Repeal .
27 . The Student Disciplinary By-laws made by resolution of theCouncil on 19th November, 1968 are hereby repealed .

by deleting the words "three hundred" appearing in the last line of thesaid paragraph and by substituting therefor the words "seven hundred andfifty" .
