Livingston County, located in the northeast quarter of Illinois, is about 92 miles southwest of Chicago, midway between Chicago and Springfield. It consists of 1,043 square miles in area and is fourth in size in the state. The county was organized on February 27, 1837, from parts of McLean, LaSalle, and Iroquois counties. The only county seat, at Pontiac, was incorporated in 1856 by an act of the State Legislature. Township Government was adopted in 1858. Pontiac is located on the Vermilion River.

HISTORY OF THE LIVINGSTON COUNTY COURTHOUSE COMPILED BY ARNOLD NATZKE & STANLEY WEBER

FOR RE-DEDICATION ON OCTOBER 13, 2002 1837: February 27 – Livingston County was established as the 66th of what would become 102 Illinois counties. 1841: July 23 – The first courthouse, a 30 x 22 two story frame building was completed at a cost of $800. 1856: The second courthouse, a two story brick structure, was completed at a cost of $14,000. 1874: July 4 – The courthouse, along with the Union Block to the south, was destroyed by fire. 1875: November 4 – The third and present courthouse was completed and accepted by the County Board. The county contracted the construction of the building for a cost of $75,000. Actual cost was $90,000 and, as a result, the Contractor filed for bankruptcy. 1885: Plumbing and sewage pipes were installed. 1891: Steam heat boilers were installed. The courthouse was then wired for electricity and the tower was lit on May 8 th. It could be seen from Fairbury. 1892: The hand-wound clocks were placed on all four sides of the tower. 1903: June 3 – The Soldiers’ and Sailors’ monument on the northeast corner of the courthouse block was dedicated by then President of the United States, Theodore Roosevelt. 1936: Two additions were added on the east side of the courthouse, and one on the west side. The additions were built by the Works Project Administration of the Federal Government, commonly known as the W.P.A. 1961: The courthouse was painted in colors of yellow, maroon and white rather than battleship gray. 1976: The second floor of the courthouse was remodeled into three courtrooms rather than the original one large courtroom. In addition, the elevator was added at this time. 1983: A Hollywood movie, “Grandview U.S.A.,” was made in Pontiac, featuring the courthouse. 1986: The courthouse was named to the National Register of Historic Places. 2001: A 1-½ year project was undertaken to restore the exterior, including the removal of 25 layers of paint, and some internal repairs to improve safety in the tower area. Extensive restoration to the building included the repair of a bullet hole in the overhand, which was put there by a former Sheriff to allow water to drain until repairs could be made. Weber Metal Products and Allen Meister took on the daunting task of repairing the clock to synchronize all four sides. All work was planned with the goal of restoring the building as close as possible to its original appearance, with the use of long lasting, energy efficient materials. The project was completed at a cost of slightly over $2,000,000, with $500,000 awarded to the county from Illinois First funds. A complete report on the project is filed with the County Clerk’s Office. 2002: October 13 – In celebration of completion of the exterior renovation, a re-dedication of the courthouse was held featuring state and local dignitaries, the Pontiac Municipal Band, and members of local high school bands.

The Circuit Clerk’s Office is the administrative and clerical arm of the Circuit Court. The office maintains official court records, recording documents for filing and appeals, serves as a source of data and information for various government agencies and the

general public. In addition, the Circuit Clerk’s office collects all fines, fees, costs and penalties assessed pursuant to state statutes and County Board resolutions, and distributes those monies on a monthly basis to the county, state, municipalities and townships.

The County Clerk and Recorder’s Office issues marriage licenses, maintains birth, death and marriage records, and presides over elections. The office works closely with the County Assessor and Treasurer in the real estate tax process. In addition, the County Clerk’s Office is responsible for processing applications for raffle, liquor, fireworks and transient merchant applications, maintaining

records of small business assumed names, notaries public, and preparing official proceedings of County Board meetings. The Recorder maintains land records, including deeds, mortgages, liens, assignments, releases, and plats.

Sheriff’s Department is responsible for preventing and controlling crime in areas of the county not served by their own law

enforcement agency. The department also operates the county jail, in addition to serving summonses, executing court judgments, conducting criminal investigations, continuous training and education for personnel, and numerous functions required by Illinois Statutes. The Department also provides security for the Courthouse, notifying departments and the public of holidays set by the

County Board, and determining necessity of closing the courthouse in the event of emergencies such as extreme weather conditions.

The State’s Attorney’s office is not only in charge of prosecuting criminal matters, but also serves as legal counsel to the county government in civil matters. The office also contains a Victim Witness Coordinator who is in charge of processing requests for orders

of protection and addressing the needs and rights of victims of criminal offenses.

The County Treasurer is responsible for preparing and mailing tax bills for each parcel of real estate and for each mobile

home assessed in the county. Duties include collecting and distributing tax monies to the appropriate taxing authorities, holding a tax sale for delinquent taxes, investing county funds, and keeping the County Board informed of the county’s financial status.

The County Board Office is responsible for managing the activities of the County Board on a day to day basis. The Executive Director assists the County Board by preparing meeting agendas, preparing minutes of committee meetings and implementing

policies, procedures and projects as directed by the County Board. The Human Resource Director assists the county in the recruitment, job analysis, compensation and benefits for county employees. The Network & Computer Systems Administrator

manages and maintains the integrity and functionality of the complete Livingston County computerized information systems including voice and data communications.

In addition to providing probation supervision for adults and juveniles, the Probation and Court Services office is responsible for overseeing programs to reduce criminal activity, and determine appropriate sentencing by means of pre-sentence reports. The juvenile intake program provides an opportunity divert juveniles from the formal court system when appropriate.

ORDINANCE AMENDING ORDINANCE NO. 2001-01 REAPPORTIONING LIVINGSTON COUNTY BOARD

ORDINANCE NO. 2011-06-33 BE IT RESOLVED by the County Board of Livingston County, Illinois (“County Board”), that the following changes be made in Ordinance No. 2001-01 Reapportioning Livingston County with regard to the election of members of the County Board, the county having less than three million inhabitants and a township form of government, to wit: 1. Effective July 1, 2011, the County Board shall consist of twenty-four (24) members, eight (8) each to be elected from three (3) County Board Districts

as described below and the voters in these districts shall not have cumulative voting rights. 2. The three (3) County Board Districts are substantially equal in population, are comprised of contiguous territory, have been created so as not to divide any townships municipalities or precincts and are described as follows:

a) District One-all of all of Rooks Creek and Pontiac Township. b) District Two-all of Reading, Newtown, Sunbury, Nevada, Dwight, Round Grove, Long Point, Amity, Esmen, Odell, Union, Broughton and

Owego Townships. c) District Three-all of Nebraska, Waldo, Pike, Eppards Point, Saunemin, Sullivan, Avoca, Pleasant Ridge, Charlotte, Indian Grove, Forrest,

Chatsworth, Belle Prairie, Fayette and Germanville Townships.

3. The chairman of said County Board shall be elected by the members of the County Board for a two year term commencing the first Monday in December, 2012, and each succeeding chairman of the Board shall serve a two year term and be elected in the same manner. If a vacancy in the office of Chairman of the County Board should occur, the members of the County Board shall elect one of the members to serve for the balance of the unexpired term of the previous Chairman.

4. The salary of the members of the County Board shall be computed on a per diem basis of forty-five dollars ( $45.00) per day. In addition, the Chairman of the County Board shall receive an additional per diem of thirty-five dollars ($35.00) per day, or a total of eighty dollars ($80.00) per diem.

5. Because the County Board will be elected from multi-member districts, the members elected in November of 2012, shall divide

each of the three (3) County Board Districts publically by lot into two (2) equal groups. County Board members or their successors from one group shall be elected for successive terms of two (2) years, four (4) years and four (4) years, and members or their successors from the second group shall be elected for successive terms of (4) years, four (4) years and two (2) years. All terms shall commence on the first Monday of the month following the month of the election. This division shall be done in such manner that the terms of four (4) members from each County Board District shall expire every two (2) years.

6. If a vacancy on said Board occurs, said vacancy shall be filled by appointment by the remaining members of said Board within sixty (60) days thereafter, said appointment to be effective until the next election of County Board members, at which time an election shall be held to fill said vacancy for the unexpired term.

7. If any provision or clause of this Ordinance or application thereof to any person or circumstance is held to be invalid, said invalidity shall not affect other provisions, clauses or applications of the Ordinance which can be given effect without the invalid provisions, clause or application and to this end, the provisions and clauses of the Ordinance are declared to be severable.
