The meeting was called to order at 7:35 p.m. by the Board President, Leslie Winograd, who announced that adequate notice of this meeting had been provided by amendment to notice approved at the Board’s voting meeting on February 13, 2012 and posted at the Board of Education office and communicated to The Star Ledger, West Essex Tribune, The Alternative Press, Patch.com and the Livingston Township Clerk. Members Present: Barry Funt, Charles Granata, Bonnie Granatir, Ronnie Spring, Leslie Winograd and Spencer Silverman Members Absent: Moshe Pasternack Also in Attendance: Brad Draeger, Steven Robinson, Mary Oates, Lawrence Russell, Susan Burman, Thomas Douglas, Joann Goldberg and approximately 20 members of the public PROCLAMATIONS Mr. Spring moved the following: 1. Whereas, The New Jersey State Bar Foundation invited elementary school students and their teachers to submit original mock trial cases for the annual Law Fair Competition; Whereas, Harrison Elementary School students Aiara Chakraborty, Robert Bellina, Thomas Chun, Hannah Swee, Robyn Burger, Riya Bhansali, Linda Ahmed and Siraj Akmal received honorable mentioned for their original case, Jewelry Store Vandalism, in the Grade 3 competition and were taught by Karin Pinto; Whereas, Mt. Pleasant Elementary School students Lauren Altman, Matti Bruskof, Annie Eisner, Isabella Flaum, Thomas Gangi, Kylie Gorsky, Anant Gupta, Eli Hartman, Madison Lysek, Ally Mintz, Veena Nambi, Joshua Pitman, Danielle Ralston, Skyler Rowe and Justin Wang received second place for their original case, The Case of the Falling Rider, in the Grade 3 competition and were taught by Carol Geers; Whereas, Riker Hill Elementary School students, TJ Bedore, Molly Cantillon, Ethan Chang, Jesse Feinberg, Shayna Goldfarb, Julia Herbst, Zachary Jacobson, Olivia Kim, Madi Moynihan, Ankita Sharma and Sasha Vaysman received first place for their original case, The Case of the Injured Boy, in the Grade 3 competition and were taught by Donna Richter-Maschio; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education congratulates these students and wishes them continued success. Mrs. Winograd moved the following: 2. Whereas, Riker Hill Elementary School student, Magnolia Wang, received third place in the 2012 New Jersey Association for Gifted Children Student Art and Writing Contest for her entry, “Saving Tuvalu;” Whereas, Magnolia’s entry highlighted the South Pacific country of Tuvalu, which consists of nine islands or atolls, with an average elevation of 3.3 feet above sea level, whose existence is at risk if the sea level keeps rising at the current rate; Whereas, Magnolia was honored for her accomplishment at the New Jersey Association for Gifted Children’s annual conference; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education congratulates Magnolia and wishes her continued success. Mrs. Granatir moved the following:

NJ Association for Gifted Children Student Art and Writing Contest

3. Whereas, The Continental Math League is a valuable supplement to school programs, aiding schools in helping their students improve their reading comprehension and problem solving skills by having students compete against other students from schools all over the United States; Whereas, Mount Pleasant Middle School placed fifth out of two hundred and twenty-one schools nationally, and third in the State out of thirty schools and sixth grade student, Carrie Li, was named a National Student Leader for achieving a perfect score of thirty; Whereas, Heritage Middle School’s seventh grade placed nineteenth out of one hundred and twenty-nine schools nationally, and fifth in the State out of eighteen schools; and the eighth grade placed first nationally and first in the State and eighth grade student, Cathy Nie, was named a National Student Leader for achieving a perfect score of thirty; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education congratulates these students and wishes them continued success. Continental Math League

4. Whereas, Mount Pleasant Middle School students participated in the Morris Area Debate Tournament sponsored by the New Jersey Consortium for Gifted Education; Whereas, Eight school districts consisting of forty students participated in the Junior Varsity level competition; Whereas, Catherine Yu and Richard Kim received fifth place in the Affirmative category for their support of debate resolution, “Be it resolved that the process of hydraulic fracturing should be banned in the United States;” Whereas, These students were coached by Carol Geers; and

Whereas, The Knowledge Master Open is a computer-based, semiannual, worldwide academic competition in which teams of students compete by answering multiple choice questions in fifteen subject areas; Whereas, The Mt. Pleasant Middle School team competed against two hundred and eighty-one teams nationally, ranking first in New Jersey and third overall, and is comprised of Aditya Agarwal, Ian Bae, Caleb Chow, Ricky LaGrotta, Carrie Li, Selene Li, Benjamin Litvin, Yiblin Long, Jesica Porcelli, Dev Rathod, Michael Sun, Evan Tong, Kyle Ume, Mary Yang, Catherine Yu and Serena Zhao; Whereas, These students were coached by Carol Geers; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students. Whereas, Students participated in the Essex County Steering Committee for Gifted and Talented Education’s Forensic Tournament in Declamation and had to prepare a four to five and a half minute excerpt from a speech presented by a public figure, and deliver it in the spirit in which it was intended and present it from memory; Whereas, Heritage Middle School students Mallissa Vuong received second place, Jeanna Qiu received third place, and Natalie Kahn received fifth place in the Varsity competition;

Whereas, Mount Pleasant Middle School students Ben Asher received first place and Tina Li received second place in the Junior Varsity competition; Whereas, Students were coached by Lenore Argen, Michelle Bodow, Carol Geers, Sharon Handley, Karin Pinto, and Donna Richter-Maschio; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students. Whereas, Heritage Middle School students participated in the Union Catholic Junior Regional Forensics Tournament; Whereas, More than two hundred students from fifteen schools participated in the tournament; Whereas, The Forensics Public Speaking team of Catherine Yang and Natalie Kahn placed second in the DUO category out of fifty-one other teams competing, the third consecutive year they have placed in this Tournament as a team; Whereas, These students were coached by Lenore Argen; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students.

Mr. Funt moved the following: 10. Whereas, The Heritage Middle School offers a Team Chess enrichment program in which students learn and practice the tactics used for Team Chess, a fast paced game played with traditional pieces, but engaging four students at once; Whereas, Students participated in the Spring County Tournament, sponsored by the Essex County Steering Committee for Gifted and Talented Education; Whereas, Max Brustein and Jason Guo placed first, Kevin Xu and Forest Song placed second, Fan Tang and Patrick Wolfe placed third, Tina Wu and Douglas Cheung placed fourth, Mitchell Yang and Daniel Krasner placed sixth, and Shannon Li and Tiffany Yu placed seventh in the Varsity level; Whereas, Matthew Park and Justin Schoenbach placed fourth; and Albert Wen placed fifth while partnering with an alternate player in the Junior Varsity level; Whereas, Students were coached by Lenore Argen; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students. Whereas, The Livingston High School Forensics Team organized and judged the LHS Lancers Junior Invitational in which more than seventy students competed from ten school districts; Whereas, The Livingston Public Schools team comprised of Catherine Yang, Natalie Kahn, Ruth Albuquerque, Rebecca Lin, Melana Odegova, Shay Weiser-Schlesinger, Ricky LaGrotta, Eileen Deng, Sasha Weber, Ido Kadouri, Prathik Lolla, Jason Schneiderman, Aryan Tawde and Samantha Burggraf won the team trophy; Whereas, Aryan placed seventh in the Junior Varsity Interpretive Reading category; Samantha placed first, Ricky placed third and Sasha placed sixth in the Junior Varsity Declamation category; Catherine placed first, Natalie placed second and Melana placed fifth in the Varsity Interpretive Reading category; and Catherine placed second, Natalie placed fifth and Ruth placed sixth in the Varsity Declamation category; Whereas, Students were coached by Lenore Argen, Michelle Bodow, Carol Geers, Sharon Handley, Karin Pinto, and Donna Richter-Maschio; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students. Annual University Liberty Bell Classic National High School Invitational Forensics Tournament is sponsored by Penn for Youth Debate and is one of the nation’s oldest and most prestigious high school invitational tournaments attracting schools from all over the northeast and southeast; Whereas, Dylan Camche was a finalist in Student Congress; Grace An was a quarterfinalist in the Novice Lincoln-Douglas Debate; Devin Grossman and Zach Lustbader were quarterfinalists and Benjamin Leff and Eric MacBlane were double octofinalists in the Public Forum Debate; Whereas, Zach earned the sixth place public speaker award; Whereas, Students were coached by Teacher of English, Michael Suñga; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students. Annual NCFL Forensics Grand National Tournament, Star Spangled Nationals, and was the largest attended Tournament in with two thousand one hundred and fourteen entries from two thousand seven hundred and five students representing six hundred and forty-five schools, dioceses and leagues from the United States and Canada; Whereas, Devin Grossman and Zach Lustbader competed in Public Forum and debated the topic, “Resolved: Increasing US energy production should take precedence over protecting the environment,” and finished among the top thirty-two of two hundred and twelve teams making the double-octofinals; Whereas, Scarlett Ferman and Jared Goldsmith competed in Duo Interpretation of Literature and were among the top twenty-four qualifying for the quarterfinal elimination round with their rendition of Sam Wolfson’s play, Boy Meets Girl: A Young Love Story and finished fourteenth place out of two-hundred and seventeen entries; Whereas, Joshua Hubert and Scott Levin competed in Duo Interpretation of Literature and delivered a strong and spirited performance from Disney’s Toy Story; Whereas, Students were coached by Livingston High School teacher and Director of Forensics, Michael Suñga, and Assistant Director of Forensics, Francine Dubrow; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education extends its gratitude and best wishes for future success to these students. Whereas, ExploraVision is a science competition that encourages K-12 students of all interests, skill and ability levels to create and explore a vision of future technology by combining their imaginations with the tools of science and is sponsored by Toshiba and the National Science Teachers Association;

Merck State Science Day

Whereas, The Merck State Science Day Program provides for competition between individuals and teams of New Jersey secondary school students in which students compete in the subjects of biology, chemistry, physics, integrated science and advanced integrated science and is a combined effort between the Merck Institute for Science Education and the New Jersey Science Teachers Association Whereas, Livingston High School placed seventh in the State; Whereas, The Biology Team of Lucy Zhou, Xin Xu, Krisha Kania, Katherine Lee and Helen Chen placed sixth in the State; the Chemistry Team of Jennifer Berger, Jennifer Dzera, Nevin Matthew, Ryan Saccoman and Tate Prodigalidad placed thirty-seventh in the State; Whereas, The Physics Team of Zach Lustbader, Kevin Sun, Alex Li, Justin Yu and Nathalie Tran placed 4th

Whereas, The New Jersey Science League is a competitive science organization operating within the State of New Jersey with students throughout the State competing against one another; Whereas, Livingston High School AP Physics C team, comprised of Alex Nie, Alex Li, Patrick Xia and Justine Jang, placed fifth out of sixty-three teams; the Physics I team, comprised of Jason Cai, Aria Soltani, Spencer Luster and Jason Ou, placed twelfth out of one hundred and thirty teams; the Physics II team, comprised of Kevin Sun, Peter Yao, Zach Lustbader and Dan Chi, placed second out of sixty-three teams;

Whereas, The American String Teachers Association (ASTA) promotes excellence in string and orchestra teaching and playing and selects one hundred and twenty competitively selected high school musicians to perform at the ASTA National Conference; Whereas, Livingston High School student Katherine Lee was selected as a member of the National High School Honors Orchestra and performed at the ASTA National Conference in Atlanta, Georgia on March 23, 2012; and Whereas, This is a unique and wonderful achievement deserving of official recognition; Therefore Be It Resolved, that the Livingston Board of Education congratulates this student and wishes her continued success. Chemistry Olympiad Whereas, The U.S. National Chemistry Olympiad and the International Chemistry Olympiad are multi-tiered competitions that bring together the world’s most talented high school students to test their knowledge and skills in chemistry; Whereas, Livingston High School students Alexander Nie and Justine Jang rank among the top twenty students in the nation in the U.S National Chemistry Olympiad and qualified for the opportunity to compete for one of four places on the United States team which will compete in the 44th Annual International Chemistry Olympiad;

WORKSHOP DISCUSSION ITEMS

1.

Mr. Robinson reviewed the shared service arrangements we currently have with the Township as well as the newly entered agreement of sharing mechanical maintenance of our bus fleet and maintenance vehicles.

2. Dr. Draeger explained the District’s philosophy regarding the vision for or purpose of assigning homework. Mrs. Granatir asked about extra credit as mentioned in the Grading and Reporting Handbook. Ms. Oates explained extra credit opportunities should not be a random assignment given to one or two students to boost a grade but rather a curriculum based opportunity available to all students. Ms. Oates added that a homework assignment can sometimes turn into an assessment. Ms. Oates offered the example of a class being given a reading assignment for homework and then a short quiz on that assignment the next day in class. Dr. Draeger continued that the handbook also includes language asking staff members to be mindful of religious holidays when scheduling assessments during the course of the school year.

Policy #2330– Homework

Alternative High School Dr. Draeger began that the Board held a meeting at the Alternative School back in November which showed the building is in need of repair. The Administration has researched moving students in the alternative school to a different location, building a new structure on another site and repairing the building to fit our needs. An RFP to find commercial space in town to house the program was created and sent to local realtors with no response. The proximity to the high school makes the current location desirable. Dr. Draeger and Mr. Robinson have had many conversations with the Township over the past few months about entering into an agreement to perform construction on the building. Dr. Draeger and Mr. Robinson have already met with an architect who provided us with a $2 million estimate to build a lobby and elevator that would make the building ADA compliant, upgrade the bathrooms and create classroom space that is equal to what students utilize in our schools. Other needs for the building include an upgrade to the electrical service and replacement of the boiler. Mr. Robinson requested the Board give him latitude to tweak the language in the agreement with the Township. The Board discussed the agreements, the work involved, financing and requested Dr. Draeger and Mr. Robinson go back to the Township to bring forth a more detailed agreement to cover some of these concerns. It was decided the Board would pull voting on these agreements tonight and reconvene on Thursday, June 21 at 5:30 p.m. to discuss further.

4. Dr. Draeger explained we are keeping an eye on the heat and temperature as graduation day approaches. Mr. Stern will not make a decision until later in the week as to whether or not graduation will be held inside or out. If it is held outside and people in your family are heat sensitive, they will be able to watch it projected on a screen in the comfort of the air conditioned high school auditorium. Dr. Draeger continued that the Board has been discussing whether or not to have a shortened February break so that school could end earlier. A survey was sent to parents with 41 percent of families responding. There were 962 in favor of shortening the February break and 569 in favor of maintaining a weeklong February break. It has been decided that there will be no change to the 2012-2013 calendar because many staff and students have already made travel commitments for next year. The Board will discuss how to handle the break in the 2013-2014 calendar and after in the fall.

PUBLIC INPUT ON AGENDA ITEMS ~ up to 15 minutes

Bernard Searle, 14 Washington Court, asked how much money the Township is putting towards the renovation of Monmouth Court and if we are able to do any of the work ourselves over the next 20 years. Dr. Searle also asked why not put the elevator in the back to alleviate some of the cost, how many classrooms would be upstairs and what the Township’s plan is for the downstairs. Sage Blinderman, 18 East Drive, asked why we are not discussing the 2013-2014 calendar now. Mrs. Winograd responded we will be discussing the calendars for 2013-2014, 2014-2015 and 2015-2016 in the fall. Isabella Fiske, 7 Goodhart Drive, asked that we let parents know through email that the calendars will be discussed in the fall so that we don’t fall into the same situation of not being able to change the calendar because people have already made plans. Ms. Fiske also asked who owns Squiretown and have we looked at doing renovations to that building. Dr. Draeger responded that Squiretown has a long term lease with Cerebral Palsy that goes until 2025 and that the location is not convenient to the high school. Dr. Draeger responded to Dr. Searle that he does not agree with having people with disabilities walk around to enter through the back of a building. Dr. Draeger continued that the Township needs to answer the questions about what they plan to do with the downstairs of the building. Mr. Robinson added one of the tweaks to the agreement is to put in writing how much the Township will be contributing to the project. (“Tri-State”); and Whereas, Tri-State did not bid on the specified product, but a product Tri-State claimed was equivalent to the specified product; and Whereas, the Board has determined the product bid by Tri-State is not equivalent to the specified product and that Tri-State’s bid is non-responsive; and Whereas, the next lowest bid substantially exceeded the Board’s cost estimate and budget for the Project; and Whereas, N.J.S.A. 18A:18A-22 permits a board of education to reject all bids for a project when the lowest responsive bid substantially exceeds the board’s cost estimate and/or budget for a project. Now, Therefore, Be It Resolved, that the above recitals are incorporated herein by reference; and Be It Further Resolved, that the Board hereby rejects Tri-State’s bid as non-responsive and non-compliant to the requirements of the Specifications; and Be It Further Resolved, that in accordance with the provisions of N.J.S.A. 18A:18A-22, the Board hereby rejects the remaining bid for the Project on the basis that it substantially exceeds the Board’s cost estimate and/or budget for the Project; and

Whereas, on May 13, 2010, the Livingston Township Board of Education (“Board”) entered into an Agreement with Turner Construction Company (“Turner”) to provide Construction Management Services in connection with several construction projects (“Project”) which are being subsidized by bond referendum funds; and Whereas, given the size, scope and schedule of the Project, the Board previously amended the Agreement whereby Turner provided additional on-site staffing (“Additional Services”) for the Project; and Whereas, the Additional Services are set to expire, and the Board has determined that it still requires additional construction management services commencing on July 1, 2012 through August 31, 2012; and Whereas, the Board has determined that the services being provided by Turner are being performed in an effective and efficient manner; and Whereas, Turner has proposed to provide the Services for the amount of Twenty Eight Thousand Five Hundred and Seventy Six Dollars ($28,576.00) in accordance with its proposal, which price is consistent with previous services rendered and which the Board has determined is reasonable and in the best interests of the Board; and Whereas, the terms and conditions of the Agreement shall remain substantially the same. 4.4 Longevity Resolved, that the Board approve the individuals on Addendum C for longevity retroactively to July 1, 2011 for 12-month employees or September 1, 2011 for 10-month employees. Resolved, that the Board approve the individuals on Addendum D for longevity retroactively to February 1, 2012. Resolved, that the Board approve the individuals on Addendum E for longevity effective July 1, 2012 for 12-month employees or September 1, 2012 for 10-month employees. 4.5 Lateral Moves Resolved, that the Livingston Board of Education approves contract changes to be made for the certificated staff members listed on Addendum F who completed course work with passing grades and are eligible for a lateral move on the contract guide. Resolved, that the Livingston Board of Education approves the individuals listed on Addendum S as Bus Drivers and Bus Aides for the summer of 2012, beginning June 27, 2012. Resolved, that the Livingston Board of Education approves the appointment of the individuals on Addendum T as Summer Project Workers at the approved rates. Resolved, that the Livingston Board of Education approves the individuals listed on Addendum U as Summer Workers in the Buildings & Grounds Department. 4.11 Substitutes Resolved, that the Livingston Board of Education approves the appointment of Kelly Boyle as a long-term substitute Teacher of Biology at Livingston High School (replacing Emily Walker) effective May 7, 2012 through the end of the 2011-12 school year. Ms. Boyle will be compensated at the rate of $250.00 per day for this assignment. Bernard Searle, 14 Washington Court, asked for clarification as to what happens to the lease after 20 years. Dr. Draeger stated a new lease agreement would be negotiated. Dr. Searle asked why not make the lease longer and Dr. Draeger explained we are unable to enter into a lease agreement longer than 20 years unless we get Commissioner of Education approval. OLD BUSINESS Mrs. Granatir asked with the new construction on Monmouth Court, have we gotten approval from the State given the limitations of increasing the footprint on green acres property. Dr. Draeger responded that legal counsel researched and mitigation won’t be needed because of the ADA accommodations being made to the building.
