    Dear Colleagues,

    How is your year going? Hasnt it beenB-U-S-Y? School has only been in

    session for 8 weeks but quite a fewteachers Ive spoken with are feelingburned out! I know the sub shortage isputting an undue burden on many ofyou. We have brought this issue upwith Superintendent Schulze and sheis looking at ways to reduce thenumber of teachers out of theclassroom on a regular basis.

    Unfortunately this is a larger issue thatrequires a greater solution. We havevacant positions at Heights, Black

    Diamond, Rancho Medanos, andPHS. There are actually 233Certificated positions open in ContraCosta County (as of October 15). Thelatest coordinated bargaining datashows Pittsburg teachers maximumsalary is 19th out of 20 districts. Weare also in the bottom 25% across ourcareers, so from a beginning teacherto a veteran, Pittsburg salaries are atthe bottom. We cannot compete to

    attract and retain highly-qualifiedteachers with our currentcompensation. Its time to takeaction. Join us on Wednesday,October 22 to show the school boardmembers you support our bargainingteam!

    Common Core implementation hasbrought other challenges. Teacherswho started teaching before No ChildLeft Behind are familiar with some ofthe methods being suggested Integrated Thematic Instruction,project based learning, constructivism,Inquiry learning, cooperative groups,etc. and are eager to return to thecreative methods of the past.Teachers who have only taught thelast 10 years under NCLB may be

    feeling lost. Many are used to havinscripted programs, direct instructioand strict pacing guides. Now yo

    have a lot more flexibility to plainstruction that meets your diversstudents needs. There is no firm plawith the what to teach, when to teacand how to teach.You can use yoprofessional expertise!

    While you are all quite preoccupiewe must not overlook the importancof voting November 4th and spreadinthe word about reelecting teach

    Tom Torlakson for Superintendeof Public Instruction. He is a truadvocate of public schools, ostudents, and our profession all which are at stake in this electioSpeak to as many people as who wlisten starting today! Absentee balloare out and people are voting as wspeak. The community trusts teacheso feel empowered to speak up anshare why teachers support Tom!

    Martin Luther King, Jr. Memorial Scholarship

    This is a wonderful scholarship established by CTA in order

    to address the shortage of ethnic minority teachers in

    California. Active CTA/SCTA member or dependents of an

    active or deceased CTA member or a CTA/NEA-Retired

    member of a defined ethnic minority group pursing a

    teaching-related career in public education can apply for the

    scholarship. Online applications are available in mid-October

    at www.cta.org/scholarships. The deadline to submit all

    required application and materials is February 20, 2015. In

    the past some applicants neglected to turn in the required

    letters of recommendation dont forget

    to do so! If you are eligible for this

    scholarship, do not let this opportunity

    pass you by! There are other CTA

    that you may pursue as well.

    Who gets to Decide? Your Voice Your VOTE!

    This November 4th, the voters of California will elect aGovernor, Lieutenant Governor, Attorney General, State

    Superintendent of Public Instruction, the entire Assembly,

    State Senators and many other important political offices thathave an enormous impact upon the quality of the education

    your students receive and the rights you have as aprofessional. We need to be very certain that voters weinteract with, and as many others as we can contact,understand the significant differences between the

    candidates for office and the impact they plan to have uponthe education that their children will receive. Exercise your

    right and civic duty by voting on November 4th!

    Specifically, in the State Superintendent of Public Instruction

    race, teacher Tom Torlakson is facing a challenger whobelieves in privatizing public schools and eliminatingteachers rights. Torlakson supports smaller class sizes,

    believes in increasing resources to public schools, and thinksteachers are part of the solution, not the problem. Opponent

    Marshall Tuck has asked Governor Brown andSuperintendent Torlakson NOT to appeal the Vergara

    Decision handed down by a judge in Southern California thateliminates permanent status AND due process for teachers.If this decision were allowed to stand, tenure or due

    process rights would be eliminated, along with seniorityrights. Teachers could be fired at the whim of the District for

    NO CAUSE and with NO FAIR HEARING. Just asimportantly, Tuck is backed by Wall Street and supports

    increased privatization including opening more for-profitcharter schools. Tell Tuck OUR schools are not for sale!

    REALITY CHECKWhat does

    teacher tenure

    really mean?

    Educate yourself, and then share with others who maybelieve these misconceptions.

    MYTHS ABOUT DUE PROCESSCurrent misconceptions regarding the law have createdseveral myths about tenure, popularly held, but all false.Paramount among these is:

    MYTH #1: There is a tenure law in California for K-14.

    The truth is, California dismissal law doesnt refer to tenure.The concept of tenure as it developed in the medieval

    university has no connection with current practice, whichprovides only dismissal procedures guaranteeing due

    process rights and pertinent reasons for dismissalactions. Tenure has become a popular term used as ascapegoat for the real problems, which are ineffective

    evaluation of instruction, poor administrative practices, andinadequate investment by the public schools in

    experimentation, research and development, and in-serviceeducation.

    MYTH #2: Tenure is a lifetime guarantee of employment.

    The truth is that teachers receive permanent statusafter asuccessful two-year probationary period. Within permanent

    status there is a procedure for dismissing teachers whichguarantees due process and impartial consideration of the

    factswhen disagreement about the facts exists.

    MYTH #3: You cant fire a tenured teacher in California.

    The truth is that teachers are fired every year under the

    dismissal laws in California. In addition, when difficulties indismissing teachers arise under the law, it is inadequate

    application of the law by administrators, and not the lawitself, that is at fault.

    MYTH #4:Tenure is designed to protect teachers.

    The truth is that due process was developed and existsprimarily to protect pupils and schools from political,social and economic interference with pupils right to a

    continuing program of quality education. The majorfunction of due process is to insist that decisions about the

    quality of instruction in the schools be based on educationalreasons, rather than on prejudicial or inappropriate selfishreasons.

    MYTH #5:Tenure protects the incompetent teacher.

    The truth is that California Teachers Association policy formany years has insisted that Evaluation Is the Key toExcellence. Where sound evaluation practices exists, it is

    the teacher whose inadequacies are identified and who ismost affected by the need to improve, or in the absence of

    improvement, will be dismissed under due processprovisions. Therefore, due process is a mechanism forevaluation of instruction which exposes rather than protectsincompetence.

    MYTH #6:A good teacher doesnt need tenure.

    The truth is that teachers who perform satisfactorilyneed the protection of due process and it is the

    competent teacher who is most needed to maintain andimprove the quality of education for pupils. Every

    educational employee is entitled to due process. The broad

    spectrum of instructional practices and differingmethodologies require equal protection guaranteed under

    California laws. The competent teacher needs the dueprocess laws!

    From CTAs Evaluation: Key to Excellence

    Know your Contract

    Compensation for Class Coverage

    Article 6.4 A bargaining unit member who volunteers or is

    assigned to teach all or any part of a period during his/herpreparation time shall be compensated. Compensation for

    class coverage shall be one-half (1/2) the Class Coveragehourly rate for the first fifteen (15) minutes of coverage.

    Compensation for class coverage above (15) minutes shallbe at the full Class Coverage hourly rate.

    6.4.2 A period is defined at the secondary level, as the

    length of a student period for the day during which thesubstitution takes place. At the elementary level, a period is

    the length of teachers preparation period contained in this

    Agreement. For Kindergarten, a period is defined by clockhours. If an absent classroom teachers class is dividedamong multiple teachers, then each unit member who takesor receives additional students for all or part of the day shall

    be given credit for one period of coverage and shall be

    compensated at the Class Coverage hourly rate of pay. Inaddition, bargaining unit members who substitute during theirregular work day (e.g. kindergarten teachers, teachers onspecial assignment, etc.) shall be given credit for one-half

    (1/2) period for the first fifteen (15) minutes of substitutingand one full period for substituting that exceeds fifteen (15)

    minutes.

    6.4.3 Each site administrator shall compile a list ofbargaining unit members who wish to volunteer for class

    coverage. The volunteer list shall be posted at a centrallocation chosen by the site administrator. A second rostershall be compiled listing the remaining bargaining unit

    members at that site. If no volunteers are available forsubstituting, substitutes are to be selected from the second

    list. The second list shall be made available to anybargaining unit member to review upon request. Bargainingunit members shall be requested to substitute on a fair andequitable basis. A 120% contract is authorized only for unit

    members teaching a class during their preparation period.

    A note from the grievance chair about this language:Lost your prep? Covering anothers class because of no

    sub?

    If you volunteer or are assigned to teach during your prep

    period because a sub was not available then you are due

    financial compensation for prep time you have lost. Pleasekeep track of this time, but for the most part, the officesecretary will enter it into the systemthere has been areport of a principal informing the office secretary to not enter

    the time to payroll unless the teacher asks for it. Watch yourback. Keep track and check your pay stub.

    Do you get asked to sub more often than others?

    The principal should have a list of volunteers who are willingto give up their preps and this list should be posted for all to

    see. There should also be another roster with all of the novolunteers for giving up their preps. First the principal

    chooses from the first list....no volunteers? then principalgoes to the second list and takes turns going down the list.

    This must be done fairly and equitably.

    Remember our contract was agreed upon between PUSDand PEAkeyword: agreed.

    Can my principal give me a write-up?

    Our Collective Bargaining Agreement has a process forProgressive Discipline. Administrators may not arbitrarily or

    capriciously discipline you. Be familiar with the following

    steps and note there is no such thing as a write-up.

    Article 25.3Progressive DisciplineThe following progressive discipline procedures will beapplied except where the serious nature of the offense may

    require the District to directly impose a written warning,

    written reprimand, or suspension without pay.

    25.3.1Verbal Counseling/WarningThe district shall first issue a verbal counseling/warningbefore imposing further discipline. Verbal counseling/warning

    may result in a post-conference summary memorandum.Post-conference summary memorandum will not be placed inthe unit members Personnel File, but may be attached to a

    subsequent Letter or Warning and/or Letter of Reprimandand included in the Personnel File.

    25.3.2 Written WarningSubject to 25.2.1 above, written warnings will not be used

    unless the unit member has been verbally warned aboutsimilar actions within the last four (4) years. A WrittenWarning will not be placed in the unit members Personnel

    File at the time of delivery, but may be attached to asubsequent Letter of Reprimand and included in the

    Personnel File.

    25.3.3 Written ReprimandSubject to 25.2.1 above, written reprimands will not be usedunless the unit member has received a written warning about

    similar actions within the last four (4) years. The unit member

    will be provided with a copy of the reprimand and a copy willbe placed in the unit members Personnel File. The unit

    member may attach a written response in a timely manner.Written Reprimands (the procedure) shall be grievable whennot brought to the attention of the unit member in a timely

    manner and/or violates Article 24: Non-Discrimination.Content of Written Reprimands are not grievable.

    25.3.4 Suspension without PaySubject to 25.2.1 above, suspensions will not be used unless

    the unit member has received a written reprimand aboutsimilar actions within the last four (4) years twelve (12)

    months. No unit member will be suspended more than (15)

    working days during a school year. In all instances, however,

    the length of a suspension will relate to the severity of theaction.

    Union Representation

    If you are asked to attend a meeting with an administrator,you have a right to know the purpose of the meeting. If you

    believe the meeting may be part of an investigation, is

    disciplinary in nature, or that discipline might flow from it, youhave a right to take a Union Representative with you. If theDistrict does not allow your Union Rep to attend, you mayrefuse to answer any questions. And, if your Union Rep is

    with you, she or he may not be barred from speaking. Theseare known as "Weingarten rights," named after a 1975 U.S.

    Supreme Court decision that secured representation rights

    for Union members.

    However, the District is not required to inform you of yourright to bring a Union Rep. So, be sure to make it clear,preferably in writing, that you want a Union Rep to be

    present. Otherwise, you may be deemed to have waivedyour right to Union Representation.

    Do employees have a dress code?

    PUSD Board Policy 4119.22:

    The Board of Education believes that appropriate dress andgrooming by district employees contribute to a productivelearning environment and model positive behavior. Duringschool hours and at school activities, employees shall

    maintain professional standards of dress and grooming thatdemonstrate their high regard for education, present animage consistent with their job responsibilities and

    assignment, and not endanger the health or safety ofemployees or students. All employees shall be held to thesame standards unless their assignment provides for

    modified dress as approved by their supervisor.

    PEA encourages you to please use your professional

    judgment. Also know that PEA has the right to negotiate aspecific dress code and your principals may not tell you what

    you can and cannot wear.

    NEA Representative Assembly 2014

    I had the most fortunate opportunity to attend the NEA RA

    Assembly this July as a local rep for PEA under CTA. It washeld in the beautiful city of Denver, Colorado. I had no real

    understanding of what I would be in for, but I knew it wouldbe a great experience.

    I was not disappointed in what I discovered! The real processof how NEA as an organization works in concert with all

    teacher associations around the United States to createpolicy for education was finally revealed to me. I saw

    firsthand the process of forming new business items andamendments that would be brought to the entire assembly tobe voted on by members. There were many humbling

    moments as I watched, listened, voted, and helped to shapewhat other educators would know as NEA policy and

    potential legislation intended to be presented to lawmakers.

    The Region I CTA conference weekend was amazing!!! So

    enlightening, inspirational, and informative. We truly learnedthe importance of staying together as ONE; staying united tomake our district a better place for our teachers and ourstudents. We learned about tons of teaching resources that

    we can access through the CTA and NEA websites. It was

    Attending the CTA leadership conference reminded me why

    we have a union. I was reminded that our union not onlyworks hard to protect teachers, our union works hard toprotect our students and teachers ability to advocate forstudents. I met and listened to so many passionate and

    dedicated teachers. It was an amazing experience, and anaffirmation of why I became a teacher. "It's all about the

    It was an honor to attend the CTA Leadership Conference as

    a representative of PEA. The conference provided me withthe opportunity to learn greatly about my rights as an

    educator. I thought I knew all there was to know, but I wasquite wrong. Thankfully, I learned about our Weingarten

    Rights and the benefits of being a PEA member.

    Additionally, the conference gave me the experience ofseeing that PEA is part of an even bigger organization that is

    willing and able to help educators. Our PEA is not alone. Iam willing to share specific information for all thoseinterested. Just ask!

    Attending the CTA Leadership Conference was a truly eye-opening experience. I was one of those who believed

    teachers unions only exist to protect bad teachers whenthey get in trouble (good teachers too, but you know thehype). My weekend at the conference showed me the real

    meaning of being part of a union having a group that cancome together for the betterment of the whole. I now see thevalue of one voice and the power it can have whenteachers are being tromped on or unheard by the powers

    that be. I was able to hear testimonies from a district that

    used their collective voice to defeat an essentially corruptboard. Additionally, I was able to learn about the vast

    resources and tools available to us as members of the CTAand NEA. I used to resent those membership dues being

    taken every month, but I now recognize their full value. Theyrepresent the knowledge that we always have the strength ofour union behind us when we work together. Locally, I hope

    to see the PEA moving forward in a way that pulls in moremembers to ensure we have our collective voice ready sothat we can be proactive and work as a whole to make sure

    Pittsburgs teachers are heard.Lisa Gunderson

    PEA is proud that the Contra Costa County Teacher of theYear is one of our colleagues Liz Lanfranki! Liz wasrecognized for being an outstanding educator who

    challenges her students and makes learning FUN! Herdedication and enthusiasm are admired by all who know her!

    Liz, who teaches English Language Arts at Martin LutherKing, Jr. JHS, was joined by over a dozen of her colleagues,school board members, and site and district administrators at

    the County Teacher of the Year Dinner on Thursday,September 11 where she gave an inspiring speech about her

    students and her teaching practice. Congratulations, Liz!

    Labor 2 Labor Dinner

    On September 19 we had the pleasure of attending the

    annual Labor 2 Labor dinner in Richmond where we

    celebrated with other union activists and elected officialsfrom around the county.The highlight of the evening was theleadership and activism award presented to Betty ReidSoskin, Betty at 92 years old is the oldest Park Ranger in the

    National Park Service. She works at the Rosie theRiveter/World War II Home Front National Historical Park inRichmond. It was a lovely evening with a beautiful view and

    great company.

    AESOP SUBSTITUTE SYSTEM UPDATE

    There were several problems with the new sub system thathave been addressed by HR. If you have additional

    concerns, please let us know.

    Problem: Teachers couldnt enter increments of sick leave

    less than 1/2 day.Solution: Teachers can now enter custom time including

    increments of less than 1/2 day.

    you must speak to the sub beforehand.)

    as of 10/10/2014.

    Problem: Subs cannot see what the assignment until afterthey accept the job; if they dont like the assignment, theycancel

    Response: This is being addressed through an added

    enhancement that will be added to Aesop in the near future(hopefully soon).
