    sale of the vessel, the highest bidder intended to walk away with the vessel (which was the subject of the sale) and the cargo (which was not). However, the cost of discharging the cargo was prohibitively high, and furthermore the risks involved in discharging the cargo in the open seas in the monsoon season proved daunting. In the end, the Court ordered that the auction be re-opened, and that in the fresh auction, bidders were to bid as a package, i.e., one bid for the vessel and one bid for the cargo. Seng Sheoh's client finally was awarded title to the vessel and cargo.

    • In 2000, Seng Sheoh represented the shipowner in the release of a vessel in the custody of the Johor Naval Police. The vessel was detained by the Johor Naval Police at the Port of Tanjung Pelapas following reports that the vessel had been highjacked in the high seas while transporting a cargo of crude palm oil. Seng Sheoh successfully procured the release of the vessel within 7 days of receiving instructions.

    • In 2001, Seng Sheoh represented the vendor of the vessel. The sale proceeds of the vessel were injuncted by a third party who had a claim against the previous owner of the vessel. The third party alleged that the sale was a sham, and that the previous owner and the current vendor was one and the same person as both were under the control and management of the same person. Seng Sheoh successfully struck out the Statement of Claim filed by the plaintiffs and obtained the release of about USD1,500,000 for his client.
