y Employee use of electronic mail (e-mail) duringbusiness hours is a common characteristic of the21st century workplace both for intra companyand inter company communication and
communication with client.
y It is interesting to note that employee privacyissues frequently arise in many areas of the work
environment other than e-mail monitoring.Employers often monitor employee telephonecalls and some companies also record the timeeach employee spends on bathroom breaks.

y employers have many legitimate reasons
for desiring to monitor their employees
e-mail usage, such as:
y Maintaining the company's professional
reputation and image;
y Maintaining employee productivity;
y Preventing and discouraging sexual or
other illegal workplace harassment;

y Preventing "cyberstalking"by employees;
y Preventing possible defamation liability;
y Preventing employee disclosure of trade
secrets and other confidential
information; and
y Avoiding copyright and other intellectualproperty infringement from employees

compelling, but so are the reasons for
protecting an individual's privacy.The

company's monitoring program achieves
necessary business objectives while alsoadequately protecting employee privacy

y The absence of any private right by employees while using thecompany's e-mail.
y This could be accomplished by including a statement in the policydeclaring that the employer's e-mail system is employer property,
to be used for the purpose of furthering employer business.
y The policy should state whether personal e-mails are permitted,and define any limitations on personal use of the system.
y An explanation of the rules governing the use of the e-mail system;
andy The employer's ability and right to monitor, intercept, record and
review all communications sent by employees over the company'se-mail system.

y Employees, on the other hand, need to understand that
current laws governing workplace e-mail will not
protect them from excessive personal use.
y Most employers seem willing to tolerate some personal
e-mail use and will police violations by looking more at
employee work product and ability to meet deadlines
y Employer monitoring of electronic mail constitutes an
emerging area of the law that is clearly unsettled at this
point in time.

information, the company provide a privacy statement
to enable the customers to understand the terms and
conditions associated with the collection of data, as wellas how they use it and how customers can correct or

without permission, and we should immediatelyterminate any communications with upon
