2. APPROVE PARTICIPATION IN CSULB’s SEE US SUCCEED SUMMER CAMP Approve participation in the California State University, Long Beach’s Science Education Experience to Help Underserved Students Succeed (SEE US Succeed) summer program. In addition to providing homeless, foster and under-represented students with rich, hands-on science experiences, students will also be exposed instruction that addresses career awareness, the importance of education, and college readiness. Participating students will receive lab books, simple school supplies/simple science equipment, and a camp shirt. Teams of prospective science teachers from CSULB plan the curriculum, implement lessons, and gather the equipment and supplies needed for inquiry-based science projects. The summer program, scheduled for July 13th-24th, will be held at CSULB science labs and lunch and transportation to and from camp will be provided. LBUSD will cover half the cost of transportation. CSEA reserves the right to advance other modifications, additions, deletions, and interests during the course of negotiations. CSEA understands and hereby notifies the District that all agreements reached in negotiations shall be tentative, subject to ratification by the CSEA bargaining units in accordance with CSEA Policy 610, and approval by the Board of Education. Article III – Association Rights

1. Negotiate language to establish a notification process to CSEA when a Charter School application is presented to the District.

2. Improve and clarify language regarding release time billing, the definition of representation and the respective parties that are responsible for such costs.

3. Negotiate language to assert CSEA’s right to be notified and bargain the effects of the District’s unilateral decision to contract out work historically belonging to bargaining unit employees.

Article V – Compensation

1. Negotiate an increase in salary commensurate with increases in funding and that which allows the District to retain and recruit the highest quality classified staff.

BOARD OF EDUCATION OF THE

LONG BEACH UNIFIED SCHOOL DISTRICT NON-REELECTION OF TEMPORARY CERTIFICATED EMPLOYEES

A. General Recitals

1. WHEREAS, the Board of Education employs temporary certificated employees pursuant to Sections 44909, 44918, and 44920 of the Education Code; and

2. WHEREAS, Education Code Section 44916 requires a temporary certificated employee to receive notice, prior to the first day of paid service, of the temporary nature of the employment and the anticipated length of service; and

3. WHEREAS, each employee classified as a temporary certificated employee pursuant to Sections of 44909, 44918, and 44920 of the Education Code received notice, prior to their first day of paid service, of the temporary nature of the employment and anticipated length of their service; and

4. WHEREAS, Education Code Section 44954 provides that the Board of Education shall notify temporary employees in a position requiring certification qualification of the District’s decision to release the employees from such a position prior to the next succeeding school year; and

5. WHEREAS, through this resolution, it is the intent of the Board of Education to release each temporary certificated employee employed for the 2019-2020 school year effective no later than the last school day of the school year.

WHEREAS, Education Code Section 44909 requires the “terms and conditions under which such persons are employed shall be mutually agreed upon by the employee and the Board of Education and such agreement shall be reduced in writing”; and

7. WHEREAS, all categorical funds used to justify the above-listed employees’ classification as temporary under Education Code Section 44909 will be expended and therefore will expire at the end of the 2019-2020 school year; and

8. WHEREAS, no categorical funding used to justify the above-listed employees’ classification as temporary under Education Code Section 44909 has a duration beyond the 2019-2020 school year; and

9. WHEREAS, accordingly, each of the above-listed employees designated as temporary by the District under Education Code Section 44909 may be released at the end of the 2019-2020 school year without the procedural requirements applicable to probationary and permanent employees; and

Board Consideration: ACTION Business Services Date: February 20, 2020 BACKGROUND: On March 1, 2017, the Board of Education (“Board”) approved Resolution No. 030117-­B and adopted procedures for evaluating qualifications of lease leaseback (“LLB”) contractors in accordance with Assembly Bill AB2316, which amends Sections 17400 and 17406 of the Education Code and provides a new statutory framework for the solicitation and award of lease-­leaseback contracts. Under these newly enacted provisions, lease-­leaseback contracts must be solicited and awarded to the proposer providing the best value to the District pursuant to a competitive request for qualifications and proposal process. Following approval of Resolution No. 030117-­B, the District issued Requests to Prequalify and for Statement of Qualifications for Preliminary and Construction Services (“RFQ”) in accordance with Education Code section 17406. The District’s intent was to add to the pool of qualified contractors that the District plans to maintain for two (2) years from which, proposals on certain projects will be solicited. District staff advertised and issued that RFQ, which identified all criteria that the District would consider in evaluating the proposals and qualifications of the proposers. A total of 11 firms submitted prequalification packets and proposals. Each of these proposals were reviewed and evaluated per the established procedures. Based on the scoring, nine (9) firms were selected for the pool of qualified firms (“Pool”). This Pool was approved by the Board of Education on July 16, 2018. On April 23, 2019, the District issued to the Pool a Request for Proposals for the Gompers K-­8 School HVAC project (“Project”). The District received proposals from five (5) of the ten (10) pre-­qualified firms. These proposals were evaluated to determine the ‘best value’ for the District based on criteria including: Costs and strength of firms pre-­construction services;; Total cost of the project including contractor overhead & profit;; Total cost of financing;; Strength and experience of the staff proposed for the project;; Strength of the firms local hire & local business participation commitments;; and the firms approach and methodology for executing the project. Based upon the strength of the proposal submitted, it was determined that 2H Construction, Inc. provided the best value to the District. The remaining four (4) firms were ranked in descending order based upon their proposals. RFQ/RFP documentation, including final scoring results are on file in the Facilities Procurement Department and are available for review.

This format allows the District to review the contractor’s actual costs and negotiate specific elements of the construction contract to best meet the needs of the District. Once the total cost of the work is known, the District pays the contractor a previously agreed upon fee which includes customary overhead and profit. Following negotiations with 2H Construction, Inc. the Guaranteed Project Cost (“GPC”) for this project has been agreed to be $17,620,005.00. Californians last voted on a State school facilities bond measure in 2016, which passed with 55 percent of the vote. The bond measure, Proposition 51, approved $7 billion for K-12 education facilities and $2 billion for colleges. WHEREAS, the voters of the State of California have, since 1982, consistently approved statewide school construction and modernization bond measures to provide resources through programs contained in Division 1, Part 10, Article 12 and Article 12.5 of the Education Code; and

WHEREAS, state school construction and modernization bond funds are matched with funds provided by local communities; and

WHEREAS, the Long Beach Unified School District has $3.5 Billion in facility need which may be partially funded by State bonds; and

WHEREAS, Proposition 13 on the March 3, 2020 ballot, the Public Pre-School, k-12, and College Healthy and Safety Bond Act of 2020, will provide for renovation and upgrade of existing classrooms, construction of new classrooms to accommodate growth; and

WHEREAS, Proposition 13 will provide Career Technical Education facilities to provide job training to meet the trained workforce needs of California’s employers; and

WHEREAS, Proposition 13 will ensure clean drinking water through testing and remediation of lead levels in water at school sites; and

WHEREAS, Proposition 13 will provide disaster assistance for students and teachers; and

WHEREAS, Proposition 13 will provide school facility assistance for students and teachers in all school districts, including small school districts; and

WHEREAS, Proposition 13 will provide additional funding for energy efficiency, earthquake safety, removal of hazardous materials, and more;

WHEREAS, the California unemployment rate is greater than the national unemployment rate; and
