Background:

Education codes 44256(b), 44258.2, and 44263 expand the authorization for holders of Multiple Subject and Single Subject credentials, referred to as Board Authorizations. Board Authorizations are assignment options provided to employing districts and counties. School districts may expand subject authorizations only to teachers who hold a full credential (i.e., non-emergency, waiver, provisional internship, short term staff permit or intern).

To teach in a subject area other than designated by the credential, a teacher must complete 12 semester units in the additional subject to be authorized for middle school. Teachers must complete 18 semester units in the additional subject to be authorized for high school.

Recommendations:

Culinary Arts 2 focuses instruction on advanced food safety and sanitation, chemical composition of food, reactions of food and food microbiology as related to food preparation and techniques, along with facilities, storage and equipment. State of California in late 2004, and since then school districts, county offices, and the State have been implementing its various provisions. The elements of the settlement are designed to ensure certain standards of quality are followed in providing instructional materials, assigning teachers, and maintaining facilities. One element of the settlement, now found in Education Code section 35186(d), provides that quarterly reports summarizing complaints by subject area be reported to the Governing Board and the County Superintendent of Schools. The Second Quarterly Report for the period October 1 to December 31, 2018 is attached. RECOMMENDATION: That the Second Quarterly Report be received by the Governing Board and that staff be authorized to provide a copy of the report to the County Superintendent of Schools. LONG BEACH UNIFIED SCHOOL DISTRICT ______________________________________________________________________________ SUBJECT: Charter Petition from We The People Charter High School ______________________________________________________________________________ CATEGORY: NEW BUSINESS Reason for Board Consideration: Action Date: January 17, 2019 ______________________________________________________________________________ CONSIDER ADOPTION OF RESOLUTION DENYING WE THE PEOPLE HIGH SCHOOL CHARTER PETITION BACKGROUND: Sections 47600 through 47616.7 of the California Education Code provide for the establishment of charter schools and further provide that petitions for charter schools are to demonstrate certain specific elements in order to be approved. During the previous school year, the governing board of the Long Beach Unified School District received a proposal for establishment of a charter school for We the People High School on April 18, 2018. Following a Public Hearing in May, the District Board denied the charter petition as set forth in Resolution 060618-­D at a regular meeting on June 6, 2018. The governing board of the Long Beach Unified School District received a second proposal for establishment of a charter school for We the People High School at its regularly scheduled Board Meeting on July 16, 2018. Following a Public Hearing in August, the District Board denied the charter petition as set forth in Resolution 090518-­B at a regular meeting on September 5, 2018. This item presents a third proposal for establishment of a charter school for We the People High School. At its regularly scheduled Board Meeting on December 5, 2018, the governing board of the Long Beach Unified School District received the petition. In accordance with Education Code 47605, a public hearing was conducted on December 19, 2018 for the purpose of considering the level of support for the charter petition by teachers employed by the district, other employees of the district, parents, and community members. Pursuant to Education Code section 47605(b), the governing board of a school district shall not deny a petition for the establishment of a charter school unless it is not satisfied that granting the charter is consistent with sound educational practice and it makes written factual findings, specific to the particular petition, setting forth specific facts to support one or more of the following findings:

• The charter school presents an unsound educational program for the pupils to be enrolled in the charter school.

• The petitioners are demonstrably unlikely to successfully implement the program set forth in the petition.

• The petition does not include the required number of signatures. • The petition does not contain required non-­discrimination and enrollment affirmations. • The petition does not contain reasonably comprehensive descriptions of required elements.

District staff has been given the responsibility of providing the Superintendent a recommendation regarding the charter proposal. Staff has been carefully and thoroughly reviewing the charter proposal.

The proposal has been assessed against the standards and requirements, as set forth in the Education Code, in order to develop final recommendations. District staff has noted a number of issues and concerns. Several of the most significant of the concerns noted are included as proposed findings in Resolution No.011719-­A. The specific factual findings in the recommended Resolution are within the following statutory findings for denial of the Charter:

The petitioners are demonstrably unlikely to successfully implement the program set forth in the Charter. [Education Code Section 47605(b)(2)]

The Charter does not contain reasonably comprehensive descriptions of all of the required elements. [Education Code Section 47605(b)(5)]

RECOMMENDATION: The Superintendent of the Long Beach Unified School District recommends that the Board of Education adopt Resolution 011719-­A, which denies the We The People High School charter petition, based on findings enumerated in said Resolution.
