"Apprenticeships" areworth consideration

Apprenticeships are common in many professions. Training the skills needed to practice achosen trade requires on-the-job experience in addition to formal education. Prior to theestablishment of accreditation procedures for law schools, the lack of formalized legaltraining was covered in clerkships where apprentices learned from seasoned attorneysand slowly earned more responsibility and control over their work.

Several law firms are considering and implementing apprenticeships for first-yearassociates who didn't have extensive clerking experience during law school. Theseassociates may be paid less during their first two years of work; however, they are closelysupervised and taught how to handle client matters by senior attorneys at the firm, andbecome trusted and profitable attorneys in less than average time.

Today, in this tough economy, there are many young lawyers who cannot find jobs andconsider launching solo practices. While many newly licensed attorneys have access tothe proper legal resources to research, draft pleadings, conduct proper court appearancesand hearings. What the resources cannot teach however; is experience, and knowingwhat to do when your client, opposing counsel or facts take an unexpected turn intouncharted territory.

In and around bar associations and law schools the formal requirement forapprenticeships for young lawyers is a topic of debate. Proponents push for a mandatoryapprenticeship requirement similar to a residency in medicine. Many of the youngattorneys are likely to respond favorably as well, as the stress of decision making andstrategy easily overwhelm a young practitioner. Critics of formal programs may stress theinequity of reduced initial salaries while law school tuition continues to increase.

If I were graduating from law school today and couldn't find a job I would considerlaunching solo and establishing an informal referral-based apprenticeship with a seasonedpractitioner. The rules in most jurisdictions require lawyers receiving referrals to 1)disclose that transaction to the client, and 2) monitor the case and remain some level ofresponsibility. The case monitoring aspect really opens the door to a mentoringrelationship.

I would first cover my fixed expenses with a "day job" or some part-time but steady incomestream if I didn't have savings to pay the bills while hanging my shingle. Next, I wouldcompose a letter to known attorneys who may have more work than they would like butnot enough to take on a full-time associate. That lawyer may turn over some files or sendincoming referrals my way, at which time a standard letter would disclose the referral feepaid and the nature of the working relationship.

There is no substitute for experience and advice of seasoned practitioners in anyprofession. Informal apprenticeships present a win-win scenario for the mentor attorneyand their protégé attorney.

Before hiring an investi-gator here are a few tipsfor searching for a person.First, review the file. See ifthere is any informationabout the person you areseeking to locate in thefile. Start with the easystuff. Send a letter to theold address and see if it isforwarded or it may bereturned with a newaddress. So that is usuallytoo easy and rarely works.Okay, call the individual’sold employer and ask if theperson left a forwardingaddress or contact forwages, W2s, pension infor-mation, etc. No luck. Askto speak to co-workers.Sometimes co-workersmaintain contact with theirold friends.

Okay, you still have notfound that elusive person.Try the telephone book.Call persons with the samelast name. While I do notrecommend it if the nameis Baker, Smith or Jonesfor other individuals itmight be successful. Youmight reach a family mem-ber.

Try the Internet. Thereare several free web siteswhich give addresses andtelephone numbers. Itdoes take some time to siftthrough all the informa-tion if you do not have spe-cific information such ascity and state of residence.Try Yahoo.com,W h o W h e r e . c o m ,Freeality.com/find, orAnywho.com. These sitesare just a few of the freesites to locate individuals.Do you have the socialsecurity number of the per-son you are seeking?While there are helpfulwebsites on the Internet tolocate missing persons usu-ally you need a social secu-rity number or last knownaddress to use them.
