Career Calisthenics:Whipping Your Career Into Shape

By: Cheryl Rich Heisler

Getting any job in today's market is hard work-are you sure that you are doing everything you can to "work out" all yourcareer opportunities? If you aren't putting in at least as much time and effort crunching your network as you are your abs, your career search isn't in peak form.

As a career trainer for lawyers in transition, I feel a kinship with all the personal trainers I see at my local gym. In a lot ofways, we are in similar positions. We both have clients that come in to see us searching for direction. We both want to helpour clients identify and reach realistic goals by offering directed exercises to help strengthen their resolve and sharpen theirskills. We each relish in our clients successes and feel for them when they fall short. But whereas my compatriots at thegym can point to the loss of the first few pounds or inches to reassure their clients that progress is being made, my clientsfind it much harder to see success in anything less than the acquisition of a new job.

We all know that Rome wasn't built in a day, and that (no matter what you read on the internet) washboard abs can't beobtained without sustained hard work. Yet so many lawyers lose patience and focus as soon as their first round of letters ornetworking attempts fail to yield a job offer. I guess the legal market was too good for too long; many of us have neverexperienced a real job search and the persistence that carrying out such a search requires.

So pull on your sweats and lace up your sneakers-we are going for a trial run through the career obstacle course for gettinga job in these tough times.

1. Bend and Stretch

When you haven't been to the gym for a while, most trainers will start by checking your flexibility. They will push you andpull you to see where and how you bend, how "tight" you are, how flexible (or inflexible) you have become over the years.Where you start is just the baseline-you are expected to loosen up as you begin the training process.

This holds true for career stretching as well. Are you hung up on only taking a job exactly like the one you held before? Inthis economy, the number of traditional legal jobs has shrunk considerably. You may need to figure out a way to stretch yourtechnical and transferable skills into new and different configurations so as to be marketable in areas that are quasi- or evennon-legally related. The good news here is that just as you can train your body and muscles to bend and move in differentdirections, you can reevaluate your intellectual skills and learn to see where and how those skills can be valuable in otherplaces and industries beyond the law.

This mental stretching can be as painful in its own way as the physical type. We all get comfortable with the routines weknow and the comfort that comes with using our skills in the same ways over and over, but humans are flexible-we weredesigned to be adaptable to survive.

2. Start Slow and Steady

No one would start a new exercise routine with a triathlon. That just sounds crazy. But many legal job seekers, in a panic toland something, do exactly that. Before they have even thought about what they might like to do or for whom they might beable to do their best work, they flood the market with their resumes. They network haphazardly. They act without a plan. And just like running a marathon without the proper training, they crash and burn, injuring themselves in the process.

A smarter approach is to work up to being ready to present yourself to your target markets in a controlled fashion. I am allfor maximizing contacts in a given arena, but I believe there needs to be a strategic component to who you target, when andwhy. I try and encourage my clients to learn something from every networking meeting they have, and then to dial thatlearning into the next level contact. When an opportunity is available for a position, submit a tailored resume and cover letterthat speak directly to your qualifications for that specific position. Don't consider an afternoon on LinkedIn asking randomfolks to "friend" you as quality job search time.

3. Build On Your Progress

In the gym, once you can do 10 push-ups, then you work toward 15. Once you can do 15 repetitions of your bicep curlswith 10 pound weights, then you try it again with 15 pounders. Whether you are aiming for strength or flexibility or speed orstamina, you always keep building.

A job search is like this as well. Even after you have had a few good interviews, keep plugging! Some jobs just won't beoffered to you, despite a fantastic interview. Not all positions actually come to fruition; budgets or head counts can get cuteven during an interview cycle. .And coming in second is not always a bad thing-even when you are not the one actuallyoffered the job, being so close to the top should remind you that you did have most of what they thought they wanted for theslot, and you should reach out and investigate related jobs at related companies who might very well see the same positivesin your background as did the first group.

4. Rejoice in Your Results

Progress in the gym can be measured in lots of ways: increased strength, decreased pain, higher tolerance, lower weight. There are also intangible measures of success: you feel a little better, you have more energy, you look healthier. Plenty oftangible and intangible results can be yours from a well-conducted job search also. Your network increases, your confidencegrows, your sense of where and how you can add value to an organization crystallizes. If you use your search time tovolunteer or take an internship, you can develop new skills and realize the benefits of giving something back to yourcommunity.

Best of all, these results are just as real as the new job will be, when you land it. So, if you can manage to stay on trackwith both your physical and job search routines, just think how great you will look (and feel) when you start your newposition!

INDEPENDENT PARALEGALS/FREELANCEPARALEGALS

BY: Caren Mansfield, amember of the IllinoisParalegal Association

Independent paralegalsand freelance paralegals.Terms that float around allthe time. While bothnames may be used inter-changeably there is a dif-ference. Let’s talk aboutthe difference.

Freelance paralegalsare paralegals who areemployed by attorneys, firms, corporations oragencies to work contrac-tually. The freelance para-legal may perform workindependently i.e. athome, at odd hours of theday or night but all workgenerated is reviewed byan attorney. Freelanceparalegals are often usedby firms to supplementstaff when large projects orcases arise. Some free-lance paralegals are hiredas trial approaches toassist in preparing trialnotebooks, interviewingwitnesses and assistingcounsel at trial. The free-lance paralegal performswork under the supervi-sion of an attorney.

Independent paralegalsare paralegals that per-form work for the publicwithout attorney supervi-sion. They have also beencalled legal technicians ordocument preparers. Thisis a sticky area in Illinois. In Illinois a paralegal whoprepares substantive docu-ments for a client withoutattorney supervision isguilty of the unauthorizedpractice of law (UPL). Aparalegal may provideindependent services tothe public through docu-ment preparation, research activities, filingservices, etc. The con-sumer is not always awarethat the independent para-legal can only provide pub-lished factual information(generated by a lawyer),cannot select appropriateforms and can only type ininformation given by theclient. The paralegal can-not give advice, selectforms, help with strategyor even describe whatinformation should beincluded in a form. Theindependent paralegal canfile and serve documentsat the direction of the con-

sumer. The decision onwhere (i.e. which court) tofile the documents must bemade by the consumer.Research must be directedby a client. Those deci-sions that paralegals rou-tinely make in environ-ments under attorneysupervision such as draft-ing complaints, interview-ing clients to solicit infor-

mation and preparingcourt documents are for-bidden for the indepen-dent paralegal in Illinois.Great care must be main-tained by the independentparalegal not to cross overthe boundaries to UPL.In Illinois there is no pro-tection for the indepen-dent paralegal legislativelyor the consumer. There is

no statute that defineswhat an independent para-legal is or can do. Nor isthere a recourse for theconsumer who receivespoor or inaccurate infor-mation from an indepen-dent information.

A state that has takenaction toward regulatingindependent paralegals isCalifornia. The law strict-

ly defines what education-al background and experi-ence a paralegal must havebefore becoming a LegalDocument Assistant. There is a fee to registerand after posting a bondthe paralegal can identifyherself/himself as a LegalDocument Assistant.

Illinois is not yet to thepoint of regulating inde-

pendent or freelance para-legals. That may come inthe future. For now, bothtypes of paralegals must becareful in not practicingUPL.
