    Freedom of the press

    Guaranteed by the First Amendment in the US:

    expressly mentions freedom of the press

    In India, Article 19 freedom of speech andexpression guarantees press freedom

    Curtailed by sub-clause for reasons: to preserve

    sovereignty and integrity of India, the security of

    the State, friendly relations with foreign States,public order, preserving decency, preserving

    morality, in relation to contempt of court,defamation, or incitement to an offense".

    Official Secrets Act and POTA used to limitpress freedom.

    Under PoTA, up to 6 months detention forbeing in contact with a terrorist or terroristgroup.

    PoTA repealed in 2006, but the OfficialSecrets Act 1923 continues.

    Journalistic Rights

    1. Journalists claim free access to all informationsources, and the right to freely inquire on all eventsconditioning public life. Therefore, secret of public or

    private affairs may be opposed only to journalists inexceptional cases and for clearly expressed motives ;

    2. The journalist has the right to refuse subordinationto anything contrary to the general policy of theinformation organ to which he collaborates such as ithas been laid down by writing and incorporated inhis contract of employment, as well as anysubordination not clearly implicated by this generalpolicy ;
