I. INTRODUCTION

A. Background

1. Guwahati is the largest city and gateway of North-Eastern states of India. The city is

lagging behind in respect of providing basic services like water supply, sewerage, proper

drainage and scientific solid waste management system. It has almost no sewerage

system and more than two third of the area has not been covered by any piped water

supply system. Further, Dibrugarh, the third largest populous city of Assam is suffering

with the inadequacy of drainage and improper management of solid waste system.

2. Looking forward to improve the quality of life, Govt. of Assam have prioritized some

projects and taken initiatives for Infrastructure development in the field of water supply,

sewerage, drainage and solid waste management. Basing on the priority, the Govt. has

identified projects and decided to implement water supply and sewerage scheme for

Guwahati and rehabilitation of Dibrugarh Town Protection (DTP) drain as well as

improving Solid Waste Management (SWM) system for Dibrugarh. Due to requirement of

huge investment, the Govt. of Assam have availed external funding assistance in order to

address the situation and improve the basic service levels. The work for supply of surface

water based water supply project to South Guwahati West Zone funded under JNNURM

Program is in progress and in completion stage. A surface water based water supply

project work for South Guwahati Central Zone with JICA assistance also has been

started. The water supply of South Guwahati East zone as well as drainage and solid

waste management of Dibrugarh are under implementation with funding assistance of

ADB under Assam Urban Infrastructure Investment Program (AUIIP), which has been

constituted to implement the ADB funded project on behalf of Guwahati Development

Department and Urban Development Department of Government of Assam.

3. The estimated cost of the investment program is $ 285.80 million and is proposed to be

implemented in a period of six years from 01-03-2012 to 31-12-2017 in 2 Projects i.e. in

Project-I & Project-II. Assam Urban Infrastructure Investment Program envisages

implementation of physical investments in various components ,namely (1)Water Supply

in South East Guwahati (2) Sewerage System in South East Guwahati (3) Pilot Project of

Bus Rapid Transport in Guwahati (4) Drainage for Dibrugarh and (5) SWM for Dibrugarh.

Other components include Capacity Building, Institutional development, Governance,

Urban Reforms and Investment Program Support.

4. The Project - I is being implemented at an estimated cost of $115.50 million out of which

ADB share is $ 81.0 million and GOA share is $ 34.50 million. A tripartite agreement

between Govt. of India, Govt. of Assam & ADB was signed on 9 March 2012 for $ 81

million loan agreement for Project-I (ADB loan No.2806 –IND). The work of Project-I is

targeted to be implemented during the period from 01.03.2012 to 31.12.2016. The Loan

Agreement between the State Govt. and ADB for Project-II investment plan will be signed

in a later stage.

5. To support implementation of the Program, AUIIP have engaged Design & Supervision

Consultant (DSC) as well as Project Management consultant (PMC).The work of Project

Management Consultancy (PMC) services under AUIIP has been entrusted to M/s Tetra

Tech India Ltd. in association with M/s Poyry Environment GmbH and M/s Vision EIS

Consulting Pvt. Ltd. Design and Supervision work of the project has been entrusted to

M/s Shah Technical Consultant (P) Ltd. in association with SMEC India (P) Ltd.

B. Project & Report Purpose

6. AUIIP has been set up by Government of Assam to oversee the implementation and

monitoring of various sub projects in the project cities of Guwahati and Dibrugarh.

7. Sub projects under Project-I has been classified by ADB as environmental assessment

Category B (some negative impacts but less significant than category A) and the impacts

of subprojects were assessed through Initial Environmental Examination (IEE), prepared

according to ADB Safeguard Policy (SPS 2009).

8. This report is the “Environment Monitoring Report” for the period July to December 2014

to describe the implementation of the mitigation measures and monitoring recommended

in the IEE.

C. Project Profile Project- I

9. Till 31st December, 2014, contract agreement has been signed for three sub projects, two

sub projects at Guwahati and one at Dibrugarh under Project-I. Also “Notice to Proceed” (NTP)/Work Order has been issued to selected bidder for all the three sub projects.

II. IMPLEMENTATION PROGRESS

A. Major works and progress

12. Till date physical work has been started for one sub project under Project-I. Table 3

shows the work progress status format. Work scope for the package for which Work

Order (NTP) has been issued is also given hereunder.

B. Compliance of Safeguard Loan Covenants

14. The status of compliance of ADB’s major Loan Covenants related to Safeguard issues

is shown below:

(EARF) for PR-I. Same will be followed for

subsequent Program.

Initial Environmental Examination (IEE),

Environment Management Plan (EMP) report

prepared and approved by ADB (for PR-I). In

case of any change of scope and locations IEE

will be revised. Documentation for next tranches

commenced & review under progress as per

project design.

All measures and requirements as prescribed in

IEE and EMP will be considered during

implementation.

Corrective or preventive action plans which will

be reflected in Environment Monitoring Report

and project implementation authority will be

taken care.

Human and Financial Resources to Implement

18. The Borrower shall cause the State to make

Safeguards – Related Provisions in Bidding Documents

and Works Contracts

19. The Borrower shall cause the State to ensure

that all bidding documents and contracts for

Works contain provisions that require

contractors to:

(a) comply with the measures and

requirements relevant to the contractor set

forth in the IEEs, the EMPs, the RPs and any

IPP (to the extent they concern impacts on

affected people during construction), and any

corrective or preventative actions set out in a

Safeguards Monitoring Report;

(b) make available a budget for all such

environmental and social measures;

(c) provide the PMU with a written notice of

any unanticipated environmental, resettlement

or indigenous peoples risks or impacts that

arise during construction, implementation or

operation of the Project that were not

considered in the IEEs, the EMPs, the RPs or

any IPP;

(d) adequately record the condition of roads,

agricultural land and other infrastructure prior

to starting to transport materials and

construction; and

(e) fully reinstate pathways, other local

infrastructure, and agricultural land to at least

their pre-project condition upon the completion

of construction.

Under compliance

(a) Approved IEEs, EMPs and RPs are attached

in Bidding documents. This will be followed for

all the sub projects.

In case of any change of scope, revised IEEs,

EMPs will be prepared and corrective measures

will be disclosed to contractor and same will be

reflected in the “Environment Monitoring Report”

(b) All IEEs indicate budgetary provisions for

implementation of EMPs

(c) With the development of sub project and

implementation, in case of additional

impacts/risks due to change in scope/area, that

will be reflected in the revised IEEs, EMPs and

Environment Monitoring Report and accordingly

project Executing Agency will inform the

Construction Agency for taking relevant

corrective measures.

(d) Haul roads will be marked properly (by

avoiding residences and agricultural land)

before commencement of transportation of

materials.

(e) Pathways, land which are likely to be

affected for a short period during

implementation of the sub project will be

restored by concerned construction agency

before acceptance of the work. Restoration

status will be reflected in post construction

monitoring report

Safeguards Monitoring and Reporting

20. The Borrower shall cause the State to do the

following:

(a) submit semi-annual Safeguards

(b) if any unanticipated environmental and/or

social risks and impacts arise during

construction, implementation or operation of

the Project that were not considered in the

inform ADB of the occurrence of such risks or

impacts, with detailed description of the event

and proposed corrective action plan; and

(c) report any breach of compliance with the

measures and requirements set forth in the

EMPs, the RPs or any IPP promptly after

becoming aware of the breach.

Report was prepared for the period January to

June 2014. This is 5th

semi-annual

environment monitoring report for the

period July to December 2014. Next semi-

annual report is due on 30th

June 2015

(b) With the development of project and

implementation, in case of additional

impacts/risks due to change in scope/area, will

be reflected in revised IEEs, EMPs and

accordingly Executing Agency (EA) will inform

the ADB along with corrective action plan which

will be reflected in the Monitoring Report.

(c) In case of any breach of compliance with the

measures and requirements set forth in the

EMP; EA will promptly inform ADB and suitable

corrective action plan will be planned.

Prohibited List of Investments

21. The Borrower shall ensure or cause the State

to ensure that no proceeds of the Loan are

used to finance any activity included in the list

of prohibited investment activities provided in

Appendix 5 of the SPS.

Under Project - I, there is no violation of

prohibited investment activities as per ADB SPS

(2009) Appendix 5.

Same will be followed in subsequent project.

C. Environmental and Social Organization and Management along with

Implementation Arrangements

15. Guwahati Development Department (GDD) and Urban Development Department

(UDD) of the Government of Assam (GoA) will be the Executing Agency (EA) on behalf

of Govt. of Assam. PIU of AUIIP will be the implementing agency for Dibrugarh. A

state-level PMU, headed by a Project Director (PD) is in-charge of overall execution

and technical supervision, monitoring, and financial control of all activities under the

Project.

16. Two Project Implementation Units (PIUs) dedicated exclusively to the Project will be

set up in Guwahati and Dibrugarh. Each PIU will be headed by a senior technical

officer and assisted by qualified and experienced officers seconded from the ULB,

finance, and other line departments. The PIUs will be responsible for the day-to-day

activities of project implementation in the field and will be under the direct

administrative control of the PMU.

17. The PMU will have a Safeguard Officer (SO) to ensure mitigation of any environmental

and social impacts due to the subproject. The PMU’s Safeguards Officer (PMU SO) will

have the following responsibilities: (i) address environmental and social safeguards

issues; (ii) implement the EARF/RF/IPF; (iii) monitor implementation of safeguards

plans; (iv) guide the PIUs as and when necessary on safeguard issues; and (v)

endorse/submit periodic safeguard monitoring reports received from PMC to the PMU

PD, who will then submit these to ADB. The PMU will seek GoA clearance for

submission and disclosure of the environmental and social monitoring report to ADB. It

will also coordinate with national and state agencies to resolve inter-departmental

issues, if any.

18. The PMU is assisted by PMC Safeguards Specialists (Environment & Social). The

PMC Safeguards Specialists will (i) review and finalize all reports in consultation with

the PMU SO; (ii) provide project management support, (iii) assure the technical quality

of safeguards issues related to design and construction, (iv) prepare EIA/IEE/RP/IPP

reports; and (iv) provide advice on policy reforms on safeguard matter. In addition, the

PMC Safeguards Specialists will assist the PMU on the procurement needs and other

project implementation aspects and assist in ensuring capacity building on

environmental management of the PMU, contractors, and line departments through

capacity development support and training.

19. The PIUs will each have an Environment Officer (EO) and Resettlement Officer (RO)

who will be responsible for implementation of the EMP in each EIA/IEE and the RP/IPP

respectively. Both officers will undertake surveys and record their observations

throughout the construction period to ensure that safeguards and mitigation measures

are provided as intended. Both will be responsible for (i) implementing and monitoring

safeguards compliance activities, public relations activities, gender mainstreaming

activities and community participation activities; (ii) obtaining statutory clearances and

obtaining NOCs from government agencies/other entities and entering into agreements

with them for use of their land; and (iii) coordinating for obtaining ROW clearances with

related State and National agencies.

20. In addition Resettlement Officer, RO of PIUs. (i) coordinate with district administration

and NGO for land acquisition and R&R aspects and address any problems and/or

delays; (ii) monitor physical and financial progress on land acquisition and R&R

activities; and (iii) organise monthly meetings with the NGO to review the progress on

R&R.

21. Environment Safeguard Specialist as part of the DSC team to (i) update the existing

IEEs in the detailed design stage; (ii) assist in the monitoring of EMP during

construction stage; and (iii) prepare EIAs/IEEs for new subprojects, where required to

comply with national law and/or ADB procedure. Figure 1 shows the implementation

arrangement for environment and resettlement safeguards. ADB will approve all final

IEEs prior to award of any contract.

III. ENVIRONMENTAL PROCEDURE REVIEW

A. Environmental Legal Requirement

22. Rules, Policies and Regulations currently in force in India related with environmental

issues applicable to infrastructure related projects is attached at Annexure 1.

However, of most of the subproject under AUIIP are likely to cause relatively minor

negative impacts only, therefore it is expected that most of the sub projects would not

invite any serious nature of Environmental related legal issue. Subprojects and

activities which will need to be complied with appropriate laws are:

o Components that require the acquisition of forest land;

o Water Treatment Plant (WTP); and

o Composting and landfill facilities

23. The specific requirements to ensure compliance by these components and subprojects

are shown in Table 4.

27. Field activities have been started (for one sub project) under the Project-I. Application

of EMP commenced as per IEE report. Site specific EMP was prepared by concerned

contractor of water storage reservoirs. The compliance monitoring format for

application of mitigation measures against impacts on air, water, soil environment,

social and safety aspects is enclosed in Annexure 5. Summary compliance status of

V. ENVIRONMENTAL MONITORING AND EVALUATION

28. For effective monitoring, selected environmental parameters have been identified as

indicators which will be qualitatively and quantitatively measured and compared over a

period of time in order to assess/ensure the compliance of EMP. The environmental

performance indicators are physical, biological and social characteristics identified as

most important in affecting the environment at critical locations all along the subproject

locations. The parameters identified as performance indicators are:

o Air, noise and water quality

o Compliance to EMP

o Compliance to local/state/national environmental regulations

29. During implementation process, performance monitoring fact sheet is being prepared

against each possible environmental impact and attached with the monitoring report.

Annexure 6 shows the Performance Fact Sheet for implementation of EMP.

30. During year 2013 base line air and noise quality monitoring has been carried out at 6

water reservoir sites. During report period physical work is started only at Gopalnagar

reservoir site, accordingly construction phase air and noise quality monitoring has

been carried out at that site only. Ambient air quality data is presented in Table 7. At

all the locations concentration of ambient air quality parameters are well below the

CPCB standard. Increasing trend of concentration levels for all the parameters is

observed. Complete mitigation measures like suppression of dust, control of vehicle

emission are required at working sites.

31. Noise level monitoring data is presented in Table 8. At all the locations base line noise

level is below the prescribed standard. It is noted that there is increase in construction

VI. MAJOR PROJECT ISSUES AND PROBLEMS ENVIRONMENTAL CONTEXT

33. Field activity of the one sub-project under Project- I just started. Till date, no major

issues and problems have been encountered with, at the sub project locations.

VII. CONSULTATIONS AND RECOMMENDATIONS ENVIRONMENTAL

CONTEXT

34. For protection of local environment during construction phase, application of mitigation

measures will be done as per specified EMP. Pubic consultation during construction/

implementation phase will be planned as per the requirement. Annexure 7 shows the

blank consultation format for recording.

VIII.GRIEVANCE REDRESSAL

35. A project Grievance Redressal Mechanism (GRM) have to be established to receive,

evaluate and facilitate the resolution of affected people’s concerns, complaints and grievances about the social and environmental performance at the level of the Project.

The GRM will aim to provide a time-bound and transparent mechanism to voice and

resolve social and environmental concerns linked to the project. The grievance

redressal mechanism and procedure is depicted in Figure 2 below. Annexure 8 shows

the sample Grievance Registration Form and Action taken report

36. Till date no GR committee is set up in AUIIP. As per project Executing Agency process

has been initiated for setting up GR committee and which will be completed shortly.

IX. ISSUES AND ACTION PLAN

37. Urbanization has increased at a rapid pace in India over the recent years, much faster

than the increase in urban infrastructure facilities to support them. Also, pressure of

population has been more on larger towns/cities putting enormous pressure on the

resources of municipalities so much so that most are unable to keep up with the

provision of even basic services and infrastructure resulting in irregular availability of

water, sanitation and public amenities. In extreme cases, this has aggravated risks to

public health and safety. Assam is no exception and 2 cities selected under this

program is in dire need of upgradation of such urban infrastructure facilities which

includes, augmentation of water supply, sewerage network, drainage facilities and of

course solid waste management.

38. Experience from ADB-funded urban projects show complex social, economic, legal,

institutional, and management issues in urban development – largely derived from

realities of urban life in developing countries like India. Urban projects typically consist

of a variety of infrastructure such as roads, water, sewerage, gas pipelines, and slum

improvement/upgrading activities. It is important to mention in this context that the final

detailed engineering design in each sub project of AUIIP was prepared keeping in

mind to avoid or minimize social and environmental impact as far as possible.

However, since all the developments foreseen are city/town centric, it is difficult to

avoid any impact whatsoever in densely populated towns or cities.

THE ENVIRONMENT PROTECTION ACT, 1986 AND THE EIA NOTIFICATION, 1994

The Environmental (Protection) Act, 1986 is the umbrella legislation providing for the protection of environment in the country. This Act provided for the Environment (Protection) Rules, which have been formulated under the act “The Environmental Impact Assessment Notification, 1994 and the Amendments / Revised EIA notification on 14th September 2006”.and Year 2009.

THE FOREST (CONSERVATION) ACT, 1980

The Forest (Conservation) Act, 1980 pertains to the cases of diversion of forest area and felling of roadside plantation. Depending on the size of the tract to be cleared, clearances are applied for at the following levels in the governments:

If the area of forests to be cleared or diverted exceeds 20 ha (or, 10ha in hilly area), the prior permission of the Central Government is required;

If the area of forest to be cleared or diverted is between 5 to 20 ha, the Regional Office of Chief Conservator of Forests is empowered to approve;

If the area of forest to be cleared or diverted is below or equal to 5 ha, the State Government can give permission;

and If the area to be clear-felled has a forest density of more than 40%, permission to undertake any work is needed from the Central Government, irrespective of the area to be cleared.

THE WILDLIFE (PROTECTION) ACT, 1972

The Wildlife Protection Act has allowed the government to establish a number of National Parks and Sanctuaries over the past 25 years, to protect and conserve the flora and fauna of the state.

THE WATER (PREVENTION AND CONTROL OF POLLUTION) ACT, 1974, AS AMENDED IN 1988 AND THE AIR (PREVENTION AND CONTROL OF POLLUTION) ACT, 1981, AS AMENDED BY AMENDMENT ACT, 1987

The water (Prevention and Control of Pollution) Act, 1974 resulted in the establishment of the Central and State level Pollution Control Boards whose responsibilities include managing water quality and effluent standards, as well as monitoring water quality, prosecuting offenders and issuing licenses for construction and operation of certain facilities. The SPCB is also empowered to set air quality standards and monitor and prosecute offenders under the air (Prevention and Control of Pollution) Act, 1981.
