Cut-off date The date, after which the people will not be considered eligible for compensation, if they are not included in the list of APs as defined by the census. The cut-off date is well documented and disseminated throughout the project area. It is the date of commencement of the detailed measurement survey (potentially implemented by consultants).

Displaced person Person affected by involuntary acquisition of land or involuntary restrictions on land use resulting in physical or economic displacement.

Economic displacement

Loss of income sources or means of livelihood as a result of involuntary acquisition of land or obstructed access to the resources.

Entitlements All compensation, relocation and income restoration assistances which are due to displaced persons, depending on the type and extent of losses to restore the socio-economic status of the APs/DPs.

Physical displacement

Loss of shelter or residential land resulting from the acquisition of land that requires the affected person(s) to move to another location.

Relocation Settlement of displaced persons in alternative location through relocation schemes organized by the project or government or through self-relocation.

Replacement cost Compensation for lost assets based on the current market value of the assets plus transaction cost, interest accrued, transitional and restoration costs, and any other applicable payments, if any. In determining the replacement cost, depreciation of the asset and the value of salvage materials are not taken into account, nor is the value of benefits to be derived from the project deducted from the valuation of an affected asset.

Resettlement Plan A time-bound action plan with budget setting out resettlement strategy, objectives, entitlement, actions, responsibilities, monitoring and evaluation

INTRODUCTION 1.1 About the Report 1. This is the 3rdspecial social monitoring report (external) that has been prepared by the external monitoring consultant of National Transmission and Despatch Company (NTDC) for 220 kV Mirpurkhas substation under tranche 2 of multi-tranche financing facility (MFF – II) funded by ADB for Power Transmission Enhancement Program (PTEIP II). 2. The subproject the report refers to is the construction of 220 kV Mirpurkhas substation on an area of 52.37 acres of private land which was acquired by NTDC through the urgency procedure of Pakistan’s Land Acquisition Act 1894 (LAA).The Asian Development Bank (ADB) fielded a mission to the project site in August 2018 and held discussions with NTDC officials including the land acquisition officer who informed the mission that the land for the substation has been acquired using the urgency clause (sections 17/4/6) of the Act. This was noted as not in line with the agreed Land Acquisition and Resettlement Framework (LARF) of the MFF, loan agreement and subproject specific LARP. Nevertheless, NTDC provided to ADB the documentation work along with supporting evidence that confirmed adequate and meaningful consultations with land owners in land valuation, fixation of land/compensation price. NTDC also provided an evidence in which the land owners expressed their willingness to the use of urgency procedure due to two reasons; (i) compensation amount higher than market rate, and (ii) payment of compensation before start of construction work. However, in order to fulfill the requirements of LARF, LARP and loan agreement, NTDC also prepared a corrective action plan (CAP) which guaranteed disbursement of compensation to all land owners before possession of land by NTDC and start of construction work. 1.2 Purpose of Report 3. This report carries a special purpose which is to review and validate the implementation of the CAP of Mirpurkhas Substation prepared by NTDC to comply with LAR requirements of LARF, LARP and loan agreement. The need for such a CAP arose when ADB learnt about the use of urgency class by NTDC which the land acquisition collector (LAC) inadvertently applied to expedite the process of acquisition According to the agreed safeguard procedures, the Land for the substation was needed to be acquired using normal procedures and guidelines provided in LARF and LARP of the project. However, LAC used the urgency clause only for the purpose of expeditious acquisition process but in consultation with land owners who expressed their willingness conditional to a higher market price and payment before start of construction. In order to expedite the acquisition process, the LAC issued the section 4 of land acquisition act 1894 with respect to section 17 but without invoking its provisions which are seen in conflict with IR principles of ADB’s SPS 2009. The LAC did not set aside the provisions for section 5-A and in fact involved the land owners in the process of consultations and land valuation. There are meetings that took place between NTDC, Revenue department/LAC and the land owners which prove that land prices were fixed in consultation with land owners. This is the reason that the land price fixed/awarded was much higher than the market value of land. For example, the land price provided in the draft LARP was Rs.1.5 million per acre, but the price agreed through consultation meetings with land owners was fixed as Rs. 3.49 million of commercial land, which is higher than the price proposed in the LARP and the prevailing market rate for agricultural and commercial types of land. Further in order to ensure that land is not possessed by NTDC and construction work did not start before making payments to all land owners, the NTDC prepared a CAP which NTDC endorsed for implementation and validation by internal and external monitoring

consultants. Hence this special monitoring report is prepared with regards to monitoring the implementation of CAP and its validation. 4. The report reviewed the implementation of CAP prepared for the substation as a measure to correct the use of 17/4/6 and put construction work on hold until all 8 APs of Land are fully compensated and validated accordingly by EMC. 1.3 Action to address noncompliance 5. The use of urgency land acquisition procedure in 220 kV Mirpurkhas substation of tranche 2 of MFF 2 was highlighted by NTDC during ADB’s mission in August 2018. The ADB Mission had advised NTDC to correct it immediately. In response, NTDC agreed to ADB’s advice and took immediate actions which included (i) putting hold all the work in substation site until all APs are paid (ii) preparation and implementation of CAP which further included awarded land and asset prices, and schedule of payment to land owners and other DPs to be monitored by NTDC/ESIC through Internal Monitoring Report and (iv) validation of payments to DPs by external monitoring consultant of MFF I. In order to prevent further use of urgency clause in ADB funded projects, NTDC also agreed to issue a memo to all the concerned project delivery units to inform the LAC not to invoke the urgency clause in the acquisition of the sites for the other new substations funded with assistance from ADB.

EXTERNALSOCIAL MONITORING 1.1 Resettlement monitoring in investment program 6. The Transmission lines and grid station projects under MFF II are subject to monitoring by NTDC (for internal monitoring on a quarterly basis) and external monitoring by external monitoring agency/consultant. The monitoring is a requirement of ADB’s policy on Involuntary Resettlement and the aim and objectives of monitoring are to ensure that implementation of RPs meet the objectives of resettlement and that RP activities are on target, timely and adequately financed. Thus the EMC is required to provide an objective assessment and analysis of the implementation of RPs, identify if there are any gaps in implementation (RP activities planned vs. actual implementation) which may result in deviation from agreed safeguard measures, in which case EMC has to recommend appropriate remedial or corrective actions to bring any deviation or safeguards noncompliance back on compliance. In pursuance of this monitoring requirement of MFF II, NTDC engaged the EMC of MFF I (while hiring of EMC for MFF II is under process by NTDC) to review implementation of CAP and validate its implementation whether consistent with ADB requirements. Within this perspective, the EMC followed the following monitoring methodology to verify and validate implementation of CAP. Monitoring methodology/strategy 1.2 Desk Review of Relevant Safeguard Documents and Consultations with DPs and

officials and Field Visits: 7. The EMC undertook desk review and analyses of subproject RP, CAP, safeguard requirements as in MFF’s LARF and loan agreement, field visits, and meetings with concerned officials of NTDC and DPs who were interviewed to obtain their views about implementation of CAP and their satisfaction or any concerns about the delivery of compensation and objectives of resettlement whether achieved. 1.3 Field visit: 8. Filed visit was undertaken to NTDC’s office in Lahore in October 2018 where EMC had meetings with NTDC officials of EHV-II and in November held meetings with NTDC officials in Islamabad about the implementation of CAP whereas consultation meeting were arranged with DPs of substation to confirm compensation they received.

KEY FINDINGS OF MONITORING 9. Field visit was jointly conducted by EMC, IMC, ADB and ESIC to NTDC’s Lahore office in October 2018 where meetings and in depth discussions were held with executive engineers of EHV 2 managing the implementation of subproject and contractor staff managing ADB contract 200. The findings of the discussions held are summarized below: 1.4 Cost of Land compensation and disbursement: 10. NTDC prepared a corrective action plan for the 220 kV Mirpurkhas substation in which 52.37 acres of Private Land needed to be acquired by NTDC which belong to 8 DPs that were permanently losing their Land. The affected Land was identified as agriculture Land in revenue department’s records but for a decade the land has been commercialized due to its proximity to the road and future potential. Since the revenue records were not updated so the land prices mentioned in LARP were based on agriculture value of Land. However, NTDC in response to the request by land owners made a fresh assessment of land price based on the commercial value through the LAC. Based on the commercial value of land the price was fixed as Rs. 3.49 million per acre. Hence total cost of 52.37 acres of land comes to be around 182.6 million which was transferred to Land acquisition officer by NTDC through three cheques and no any outstanding amount is left from NTDC side. 1.5 Consultations with DPs for price negotiation: 11. NTDC held several consultation meetings with DPs for price fixation and maintained documentary evidence that confirmed involvement of land owners in the following meetings:

a) Joint survey/impact assessment of the land acquired b) Assessment and fixation of land price c) Objections related to valuation of land owners d) Transfer of acquired land to NTDC’s name after completion of payments to the land

owners. e) DPs undertaking and translation form attached as annex 3

1.6 Timing and Adequacy of compensation: 12. The rates of the Land been assessed by NTDC and revenue officials based on market rates of commercial land provided by revenue department and keeping in view the consultation meetings held with DPs for price fixation. The DPs of land were satisfied with commercial rates of their land provided to them by NTDC which they endorsed by signing an undertaking stating that the DPs agreed with given rates. All DPs have received payment of compensation for their land details are provided at annex 1.

1.7 Information disclosure: 13. DPs mentioned that the information regarding project impacts, assessment of land and price fixation has been well explained to them by NTDC staff. They were also aware of project benefits as it will improve the electricity shortage in the area. DPs mentioned that NTDC staff communicates to them from time to time about project activities including assessment of their damages and compensation payments. DPs signed an undertaking stating that they are satisfied with given rates of land and will hand over land to NTDC after full payment of land (attached annex 2) 1.8 Grievance Redress Mechanism: 14. NTDC needs to issue notification to establish grievance redress committee at the substation and appoint staff members to record and address complaints of DPs keeping in view the guidelines provided in LARP/ LARF of the project. So far NTDC has received verbal complaints and resolve them in time hence no records have been found in the field. However to comply with ADB SPS 2009 NTDC needs to have 3 tier grievance redress mechanism as elaborated in LARP to receive, record and resolve community complaints. 1.9 Safeguard CAP Milestone status: 15. To avoid the noncompliance issues corrective action plan has embedded implementation milestone which agreed upon by NTDC to avoid any delay and slippage of activities that are linked to safeguard compliance. CONCLUSION AND RECOMMENDATIONS 1.10 Conclusions and Recommendations 16. Based on field visits, discussions with NTDC field staff, NTDC ESIC officials, community consultations and after reviewing records of price assessment and compensation amount, EMC concludes that the CAP for the 220 kV Mirpurkhas substation has been fully implemented, the land for the substation is acquired using urgency procedure but without invoking its provisions instead involving the land owners in the valuation process and engaging in them in the consultation process. NTDC provided the full amount of cost of land (based on commercial value of land acquired) to the LAC who made the land award worth Rs. 1826 (m) (attached annex 2) for payment to all 8 land owners. All the land owners have been fully compensated based on commercial rates provided by revenue department. 17. The EMC can safely conclude that with implementation of CAP, the subproject stand safeguards compliant. However, caution needs to be given to NTDC field staff that no reference to urgency clause should be mentioned in any corresponding letters as it create misperception and may arise un avoided circumstances in project implementation even with the land has been acquired using normal procedure. 18. Furthermore In order to ensure compliance in subsequent implementation and improve safeguards compliance, EMC makes following recommendations for NTDC to implement:

a) NTDC through Chief Engineers EHV I and II should issue instructions to LAC and regional staff involved in implementation of ADB funded projects not to apply sections 17/4/6 of LAA in any project funded by ADB.

b) NTDC field staff needed to be given orientation training from time to time regarding implementation of project as per ADB guidelines

c) NTDC needs to speed up process to prepare standard operating procedures for LAR components that will guide NTDC field staff to implement projects in compliance with ADB SPS 2009 and other international laws.

d) EMC for MFF II needs to be on board as earliest as possible to undertake the monitoring work of MFF II and ensure project compliance as per LARFs, LARPs and ADB SPS 2009.

Statement about Land

200KV-NTDC Grid Station Mirpurkhas

(WAPDA), the land that has been approved for the grid station, which is situated in the village of

Mouza: Mubarak Jagir, Taluka Shujaabad survey no. 179, 180, 181, 182, 183, 287, 295, 296, 297,

298, 299, 300 and 301. The measurements and signs of the survey were found in the area under the

supervision of Mohammad Haris (Survey L.A.O), Mohammad Ismail Abro, Mr. Kelash (Revenue

A.L.O) Mr. Zeeshan (Sub-Engineer, Mirpurkhas Grid Station) staff and the respective concerned

owners (within the grid station). All of us agreed on the measurements, and signed, according to the

measurements, which is 37-52 acres of land come into Grid Station. All of us are agreed and we have

no objection on land measurement and valuation.

All of us are unanimously agreed on the measurements which comes in the 220 KV – Grid Station

at Mirpurkhas and signing down
