Texas” – ETJ Project Number: 19-00027 Dear Mr. Linzer:

This letter is to assist you in completing the subdivision plat of your property. Your subdivision plat request will be considered by the City Plan Commission at its meeting on May 28, 2019 in the Waco Convention Center, Bosque Theatre, 100 Washington Avenue, at 7:00 p.m. City of Waco staff and affected utility companies have reviewed your subdivision plat request for compliance with City of Waco ordinances and have forwarded their comments to the City Plan Commission for action.

The City Plan Commission reviews subdivision plat requests to determine whether the subdivision contains all of the items required by City of Waco ordinances. If the subdivision contains all of the required items, the City Plan Commission recommends to the City Council approval of the subdivision. If the subdivision does not contain all of the required items the City Plan Commission can recommend either disapproval of the subdivision or disapproval of the subdivision until your subdivision meets all of the requirements. The Waco City Council will make the final decision on your subdivision.

The Waco City Council will consider your subdivision along with the City Plan Commission’s recommendation on June 18, 2019, in the Waco Convention Center, Bosque Theatre, 100 Washington Avenue, at 6:00 p.m. The City Council will review your subdivision

plat request along with the City Plan Commission’s recommendation. The City Council may approve your subdivision if its meets all of the requirements. If your subdivision is a final subdivision and is approved it is recorded in the Official Public Records of McLennan County. The City Council may disapprove your subdivision until it meets the necessary requirements. If your subdivision is disapproved until it meets the necessary requirements you have until December 31, 2020, to complete the requirements. If you complete the requirements and return the plat to City staff by that date your final subdivision is approved and is recorded in the Official Public Records of McLennan County. Also, the City Council may disapprove your subdivision request.

1) The current owner of the property must sign the owner dedication. A notary public in the appropriate county and state shall notarize the signature. The owner must provide proof of ownership (e.g., a deed) to the Planning Services. Provide documentation showing how Gary Linzer has authority to sign for Heritage Ministries.

2) The surveyor must sign, seal the plat, and set the monuments as shown. The surveyor must submit an electronic copy of the plat using a current version of AutoCad (.dwg) or Digital Exchange Format (.dxf) that is oriented to within 10 feet of correct Texas Plane Coordinates, NAD83. This information may be obtained from Engineering Services at the City of Waco. Place these coordinates on the plat.

3) The surveyor must provide a lien holder acknowledgement on the plat if this applies to the owner of the property. The lien holder acknowledgement must be signed and notarized in the appropriate state and county.

4) A payment of $300.00 is required for a standard plat application. Payment must be made using the Citizen Self Service online portal.

5) A copy of the final plat must be uploaded on the Citizen Self Service online portal. 6) For all the streets in the subdivision, provide an easement width of 60 feet to accommodate

a potential, future, rural, typical street section, which is measured 30 feet each way from centerline of road.

7) Section 5.205 Appendix B of the City of Waco Subdivisions Ordinance requires recording information regarding permanent ingress/egress access easements to be shown on plat. This recording information is required for all private roads shown on plat.

8) Per Section 5.205(I)(2) Appendix B – City of Waco Subdivisions Ordinance requires a street terminating in a cul-de-sac may be no more than 600 feet in length.

9) Include on the plat, utility information as to the provider of water (including CCN#). If served by the City of Waco, submit a utility impact study for the full build out of the subdivision in accordance with the City of Waco's Water & Wastewater Comprehensive Plan. Based upon this study, the developer may be required to construct additional utility improvements. Please contact Mike Norman (254.750.8049) City of Waco Utilities Department, regarding the scope and timing required for the study.

10) Submit plans and specifications for upgrading streets and water improvements for this addition, which must meet city standards. Either the infrastructure be completed and then approved by the City of Waco, or a performance guarantee submitted and approved before the plat can be filed and recording. The performance guarantee and the required ¾ of 1

percent review and inspection fee can be based upon the engineers estimated construction cost.

11) A note on plat must be added that states the following: “Maintenance of streets will not be the responsibility of the City of Waco or McLennan County”.

12) Please provide On-Site Sewerage Facility (OSSF) planning materials and suitability study prepared by a Professional Engineer (P.E.) or a Registered Professional Sanitarian (R.S.) in accordance with Chapter 285, section 285.4 Facility Planning of the OSSF Rules. A check amount of $50.00 payable to the City of Waco will be required along with planning materials. Please contact the On-Site Sewerage Facility (OSSF) office, 254.299.2405, for more information. Section 3.303 (18) of the City of Waco Subdivision ordinance requires a certification on the plat to be signed by the local health authority.

i Include information that verifies and shows any existing systems and that the proposed subdivision will not create violations or violate minimum setback distances to the existing OSSF systems.

13) Section 3.303 (D) Appendix B - City of Waco Subdivisions Ordinance requires a copy of any requirements or deed restrictions imposed upon the proposed project or subdivision, if applicable.

14) Plat must show all existing and proposed easements as required by the City of Waco, Appendix B - Subdivisions ordinance, if applicable.

15) Construction of infrastructure may not be started and/or final plat(s) may not be approved and recorded until preliminary plat has been approved. If you have any questions concerning the requirements stated in this letter or wish to discuss
