1. Short Title

This Proclamation may ~e cited as the "Disaster Preventionand Preparedness Commission Establishment ProclamationNo. 10/1995."

2. Definitions

In this Proclamation:

1)"Disaster"meansthedevelopmentof a situationwhereina segment of the community or the population of alocality cannot any longer meet the need for food andother basic necessities, due to natural or man-madecalamities, with its daily life thus fa1ling into crisiswhich renders it unable to survive without assistancefrom others;

2) "Assistance"includescomprehensivemeasurestaken toprevent the coming, in future,of a disasterarea underasimilar situation,in addition to meeting the need of thevictimsof disasterfor food andotherbasicnecessitiesoflife;

3) "Assistance Programme" includes the supply anddistributionof food and other materialsnecessaryfor aliving, the availabilityof clean rinking-water,supportin healthand nutrients,supportextendedto the elderly

'and the disabled, the preventionof destructionto 11Jl'8lwealthsuch as animals,supportfor thedevelopmentofsupplementaryeconomicactivitiesbesidesagriculture,the rehabilitationof the environment, other develop-mental activities that help combat drought andmeasures relating to schemes which createjob oppor-tunities in connectionwith assistance.

3. Establishment

1) The disasterPreventionand PreparednessCommission/hereinafterreferred to as the "Commission"Jis hereby

established as an autonomouspublic instituti~FederalGovernment. /

2) The Commissionshallbe accountableto the CouncilofMinisters. . . '

4. Head Office

The head office of the Commission shall be in AddisAbaba. ~

The Commissionshallhave the followingobjectives:1)to preventdisastersby wayof removingthebasiccauses

thereof;2) to build, in advance,the capacitynecessaryto alleviate

the extentof damagesthat could be causedby disasters;3) to ensure the timely arrival of necessary assistance to

victimsof disaster,

6. PowersanqDuties of the Commission

The commission shall have the following powers andduties:

1) to prepare a disaster.prevention and preparednessnationalpolicy; formulatestrategyfor its application;and, upon approval,follow up its implementation;

2) to formulate strategiesfor future disaster preventionby way of studyingpreviousdisaster areas;

3) to administer the Natiqnal disaster Prevention andPreparednessFund and the NationalFood Reserve;

4) in cooperation with the concerned organs, to under-take prior studies on the causes of disaster; ~t upsystemsfor advancewarning;

5) in cooperation with the concerned organs, to makeknownthe magnitudeand extentof a disastertogetherwith measures that should be taken in connectiontherewith; officially declare any relevant part of thecountry a disasterarea;

6) in accordance with directives issued to it by thegovernment, request for and receive any fonn ofassistancefrom domestic.and foreign sources;

7) "to register all forms of assistance received fromdomestic and foreign sources and ca~ the dis-tributionof sametothePeoplebeinghelped;.

8) to inform the public through the mass media of thetype, volume and utilization of assistance receivedfrom domesticand foreign sources;

9) in cooperationwith the appropriateorgans,to rehabilitatevictimsof disaster;

10) to coordinate and supervise relief activities of non-governmentalaid organizations;

11) to own property,enter into contractstsue and be sued inits own name;

12) to carry out such other activitiesas would enhance theattainmentof its objectives.

7. Organizationof the Commission

The commissionshallhave.1) a DisasterPreventionandPreparednessNati.onalCom-

mittee (hereinafterthe "Committee");2) a Commissionerand Deputy commissionerappointed

by the Government;and3) the necessarystaff.

8. Members of the Committee

The CommitteeshfJIhave the followingmembers:1) an Officialto be designated

9. Meedngs olthe Committee

1) The committee shall hold a regular meeting twiceannually;however,it mayat any timehold an extraor-dinarymeeting,wheneverfound necessary.

2) There shall be a quorum where the majority of themembersof the Committeeare presentat its meetings.

3) Decisions 0: the Committee shall be passed by amajorityvote;in caseof a tie the Chairmanshallhave a

. casting vote.4) Withoutprejudicetotheotherprovisionsof thisArticle,

the Committeemaydrawup its ownrule~of procedure.10. PowersandDudes of the Committee

The committee shall have the following powers andduties:1) to deliberate upon the national policy for disaster. prevention and preparedness;ensure its implemen-

tationon being approved;2) to decideon the officialdeclarationof a disasterarea;3) to causethe allocationof expenditurefor assistanceto

be made subjectto evaluationof assistanceprogram-mes;

4) to make assistanceprogrammeshave their emphasison removal of the basic causes of disaster and onlendinginputto acontinuouseconomicdevelopment;

5) to see to it that disaster prevention programmesreceivedue attentionin developmentactivities.

H. PowersandDutiesof the Commissioner

1).Thecommissionershallbe the chief executiveof theCommissionand, as such, shall direct and administerthe activitiesof the commission.

2) Withoutlimitingthegeneralitystatedinsub-Article(1)of this Article,the Commissionershall:

(a) exercise the powers and duties of the Commissionspecifiedin Article6 of this Proclamation;

(b) employ and administeremployeesof tre commis-sion in accordance with the Federal civil servicelaws;

(c) prepare the annual work programmeand budget ofthe Commission and implement same upon ap-proval;

(d) effect expenditurein accordancewith the approvedbudget and workprogrammeof the Commission;

(e) represent the Commissionin all its dealings withthird parties;

(t) submitreportson the activitiesof the Commission.3) Thecommissionermaydelegatepartof hispowersand

duties to the other officials and employees of theCommissionto the extent necessaryfor the efficiencyof the Commission.

12. Budget

The budget of the Commissionshallbe allocatedby theGovernment.

13. Books of Accounts

1) The commission shall keep complete and accuratebooks of accounts.

2) The commission's books of accounts and financialdocuments shall be audited annuallyby the Auditorgeneralor by auditorsdesignatedby him.

14. Repeal

The Relief and Rehabilitation Commission Establish-mentProclamationNo. 173/1979(as amended)is herebyrepealed. .

15. Transferof Rights and Obligations

The rights and obligations of the Relief andRehabilitation Commission, previously establishedunderProclamationNo. 173/1979,areherebytransferredto the Commission.

16. Effective Date

This Proclamation shall enter into force as of the 24thdayof August, 1995.
