THEPREVENTION AND CONTROLOFANIMAL DISEASES

WHEREAS, taking into consideration that the coun-try's livestock resource is a source of draft power foragriculture and source of food, raw materials for industries,foreign exchange and is generally considered as one of theimportantassets for the economic growth of the country;

WHEREAS,it has becomedecisiveto primarilypreventand control animaldiseasesin order to maximizethe benefitsto be derived from this extensive livestock resource;

WHEREAS, the control of animal diseases requires theestablishment of a system to control the movement ofanimals,animalproductsand by-productswithin, intoand outof the countty; -

WHEREAS, it has become necessary, in general, topromote the export trade of animals,animal products.andby-products by controlling animal diseases and by observinginternationalagreementson animalhealth;

NOW, THEREFORE,in accordance with Article 55(1)of the Constitution of the Federal Democratic Republic ofEthiopia, it is herebyproclaimed as follows:

PART ONEGeneralProvisions

2) "Region" means any of those Regional Statesspecified under Article 47(1) of the Constitution ofthe FederalDemocraticRepublic of Ethiopia and forthe purpose of this Proclamation includes the AddisAbaba and Dire Dawa Administrations;

3) "Animal"meansfor the purposeof this proclamationdomestic and wild animals includs sea animals andbees;

4) "Animal Product" means meat and meat-products,milk products, egg, hOReyand any other animalproducts to be designatedas animal products by theMinistry for the purpose of this Proclamation;

5) "Animalby-product"meanshide, skin,hair, feather,musk, horn wax, hoof, bone, tallow and animal feedderived from these and includes also all otherproducts designated as such by the Ministry for thepurpose of this Proclamation;

6) "Disease"means any animaldisease registered or tobe registered by the Ministry; .

7) "Office International des Epizooties (OlE)" mr:ansthe intemational animal health organization! es-tablished for the purpose of co-ordinating: thecontrol of animal disease of which Ethiopia is amember; .

8) "Noticeable Disease" means all contagious 'animaldiseases which are characterized by high mortalityand/or high morbidity or zoonotic nature or whichcauses serious socio-economiclosses and/or affectsinternational trade of animals, animal-products andby products, and which should be registered andnotified immediately;

9) "Vaccine" means a suspension of attenuated orkilled pathogenic micro-organisms to be adminis-tered to healthy animalsfor the preventionof animaldiseases;

10) "Fomite" meansbeddingmaterials,animal feeds ormanagers, water and watering troughs, stables,utensils, vehicles and other materials which havedirect or indirect contact with sick animals andcapable of spreadingdisease;

11) "Biological Product" means regents, sera, at-tenuated or killed vaccines and mirobial geneticmaterial used for the diagnQsis, prevention andtreatmentof animaldisease;

12) "Pathological Sample" meaps Tumer or materialobtained from live or dead animals, containing orsuspected of containing .-infectiousor parasiticagents, to be sent to a laboratory;

13) "Disinfection" means' the application afterthorough cleaning, of procedures intended to des-troy the infectious or parasitic agents of animaldiseases, from fomites which may have beendirectly or indirectlycontaminated;

14) "Administrative Officer" means an administratorappointed for public administration at any level inregional governments; .

15) "Animal Health Officer" means an animal healthprofessionalassignedand authorized by the Minis-try or by Regional Governments to control animaldiseast?s;

16) "Animal Health Professional" means one who haspursuedveterinaryeducationandhas been awardeddegree, diploma or certificate and permitted topractice his profession;

17) "Animal Health Representative" means a persontrained in basic animal health ~are and who

represents a PeasantAsso~iation or Co-operative orpastoralist community in animal health;

18) "Custodian" means any person who.is an owner ofany animal or who is in charge of such animal;

19) "Person" means natural Person or juridical entityhaving legal personality;

20) 'Quarantin Station" means a place where animalsare kept isolated for a specified period from otheranimals, as may be necessary, to follow-up theirhealth, and be given vaccination and examination,as may be necessary;

21/ "Entrance or Exite post' means any internationalairport or any sea port, road or railway station checkpoint, at the boundary demarcation line, open tointernational traffic;

22) "International Sanitary Certificate" means a cer-tificate issued by the veterinary authority of theexporting country certifying that the products andby-products of animal origin destined for human oranimal consumption or other purposes comply withrecognized international standards or the interestsof the buyer/ importer country for its quality andhygiene;

23) "International Animal Health Certificate" means a

certificate issued by the vererinary administrationof the exporting country certifying the state of goodhealth of animals, semen, embry%va, and hat-ching-eggs destined for export; .

24) "Animal Health Service Administration Office'means an office established, at the Federal andRegional level, for the prevention, control ofanimal diseases and to carry out vaccination as wellas other treatments related to animal diseases., -

PART TWOPrevention and Control of Animal Diseases

3. Notification to be given ujJon outbreak' of AnimalDisease

I) The custodian of an animal shall immediately notifyverbally or in writing the occurrence of animaldisease to the nearest veterinary animal healthrepresentative, administrative officer or animalhealth officer.

2) Every animal health professional, who in the courseof his work or practice discovers the existence of anoticeable disease, shall forthwith report the matterto the nearest veterinary administration.

3) The animal health officer after being notified shalltake steps as may be necessary for the purpose ofascertaining the existence of the said disease and onbeing satisfied that such disease exists, shall promp-tly make a reprot to the concerned veterinaryadministration. ' . . ,

4) The region' so notified the occurrence of noticeabledisease shall forthwith report to the Ministry.

5) The Ministry shall make the information available toother countries through the Office International DesEpizootic (OIE) concerning the occurrence ofnoticeable disease in the country.

6) The animal nealth officer shall have the primaryresponsibility and accoun~bility to follow up thealready establiShed reporting system and accordin-

. gly to co-ordinate the measures to be taken wheneveranimal disease outbreak occurs in his surrounding.

7) The animal health representative and the adminis-trative officer are responsible to carry out thenecessary measures for the proper implementation ofthis proclama.tion.

8) The list of noticeable animal diseases and the

procedure for their notific~tion shall be disclosed bya regulation issued pursuant to this Proclamation.

4. Authority to Declare Areas Infected with Animal DiseaseI) The Ministry is authorized to declare an area being

infected by noticeable animal disease throughpublic media.

2) The notice shall specifically indicate the infectedarea, the type of disease and measures to be taken.

3) The Ministry may extend, diminish or otherwisealter the limit of an area declared as an infected area.

5. Provisions Applying to Areas Infected by AnimalDisease

1) No animal, animal products and by-products shallbe removed from an infected area without the

written permission of the animal Health Office~'.2) All animals in such areas shall be herded as far away

as possible from public roads.3) In an area where animal disease exists, the animal

health officer may isolate any animal infested orsuspected of being infected with animal disease andbrand with marks he deems appropriate.

4) Ring vaccination shall be carried out as deemednecessary to animals in the infected areas.

5) The carcasses of animals infected or suspected ofbeing infected with animal disease shall be disposedof in accordance with the instruction given by theanimal health officer.

6. Declaration of an Infected Area Free from AnimalDisease

1) An area which has been declared infected bynoticeable disease, shall not be considred free fromthe disease until it is declared free by the Ministry.

2) An area which has been declared to be an infectedarea pursuant to Article 4(1) of this Proclamationwould be declared as free by the Ministry in thesame manner in which it was declared infected, after

the disease has been complete!y put under control.

7. Measures for the Prevention and Control of the Spread ofAnimal Disease .

In order to prevent the occurrence and the spread ofanimal diseases at any time and.place, the Ministry and/or the concerned region, as the situation requires, shall:1) Prohibit and Control and the importation of animals,

animal products, animal by-products, and fomitesfrom areas or countries infected or suspected ofbeing infected by animal disease.

2) Prohibit and Control the movement of animals,animal products, by-products, and fomite fromregions infected or suspected of being infected byanimal disease to other regions in the country.

3) Control and regulate the movement of, with outhaving ful filled the required preconditions,animals, animal products and by-products acrossborder in order to prevent the spread of animaldiseases.

4) Cause international and regional animal- healthagreements, to be respected within the country, towhich Ethiopia is a signatory.

5) Work in close collaboration with the Ministry ofHealth in order to control zoonotic diseases.

6) Take necessary preventive measures to control thetransmission of noticeable diseases from domesticanimals to wild animals and from wild animals todomestioanimals.

7) Keep informed, importers, exporters, producers,consumersand the generalpublic, of animals, animalproducts and by-products about animal diseasesituation in the country. .

8) Establish an emergency preparedness and epidemic-surveillance system to contain the spread of animaldiseases and avoid the introduction of exotic

diseases into the country.9) Set priorities for the control of animal diseases based

on their socio economic and public health impact andimplement control programms.

10) Establish disease free zones with concerned bodiesto free the coutnry, step by step, from noticeablediseases and promote the export of animals, animalproducts and by-products.

8. Powers of Animals Health Officer

In order to prevent and control animal diseases, ananimal health officer shall have the power to:1) inspect animals and apply prophylactic, therapeutic

treatments or necessary quarantine measures asrequired;

2) inspect animals prior to transport, during transportand after transport, limit or prohibit their movementif so required;

3) enter and inspect any premise or area whereanimals, animal products, animal by-products oranimal feed are kept;

4) take samples from any animal, animal products orby-products for the purpose of identifying animaldisease;

5) require at any time, animals to be examined,vaccinated, treated, sprayed with anti pest or un-dergo a period of quarantine if he considers itnecessary;

6) order isolation, slaughter or disposal of animals;7) Cafryout appropriate inspection at entrance and exit

posts. .

8) supervise the safe disposal of dead animals, partsthereof, contaminated animal products, wastes ob-tained at slaughter, dung, manure and litter;

9) Take all other necessary veterinary measures asrequired, without being restricted to the abovementioned.

9. Exchange of Animal HealthInfonnation1) In order to prevent and control animal diseases, to

formulate effective policy and strategies for diseasecontrol and to execute the country's internationalobligation the Ministry shall establish a nationalanimal health informationsystem.

2) TheMinistryshalldisseminatecurrent animal healthscientificfindingsto thosepersonsand organizationsengaged in animalhealth activitIes.

3) In order to prevent and control noticeable animaldiseases, each regional government shall exchangenecessary information with neighbouring regionalgovernmentsand the Ministry.

PART1HREE

Movement of Animals, Animal productsand By-products

10. Establishmentand Supervisionof Quarantine Stations1) A quarantinestation shall be established with neces-

sary facilities in an isolated and suitable area forkeeping and transporting animals.

2) Conditions and requirements of quarantine stationsshall be determined by regulations to be issuedpursuant to this Proclamation.

3) Pertaining. to animal health service, the Ministryshall inspect established quarantine stations, and ifrquired delegate its power to regions.

11. Establishment of EntranceandExit Posts1) The Ministry may decide with concerned bodies on

the establishmentof entrance and exit posts throughwhichanimals,animalproductsandby-productsexitor enter the country.

2) For the purpose of controlling noticeable diseasesand establishment of disease free zones, the Minis-try, as deemed necessary, may decide with theconcernedregionsto establishcheck-poststo controlthe movement of animals, animal products and by-products from one region to another region.

12. Export of Animals, Animal Productsand By-Products,I) Animals for export shall be kept in a quarantine

station for specifiedperiod.2) Animals kept in a quarantine station for export

purpose, must originate from an area free fromnoticeableanimaldiseasesandmust be accompaniedby movement permit.

3) Persons who transport export animals, animalproductsand by-productsshould comply with trans-port requirementsand use designated exit posts.

13. Importationof Animals, AnimalProductsand By-ProductsI) Any person' shall obtain an entrance permit by

applying to the Ministry stating the type of product,country of origin, quantity, means of transport, dateof arrival, port of entry and transit countries prior toimportation of animals, animal products and by-theproducts. .

2) Animals, animalproducts and by-products importedin accordance with Sub-Article (1) of this Articleshall be checked at the port of entry by the animalhealth officer.

14. InternationalAnimal Health and Sanitary Certificates1) Any animal, semen, embryo, hatching-eggs, animal

products, animal by-products, biological productsand pathologicalsamplesto be exported or importedshall be accompanied by recognized internationalanimal health or sanitarycertificate.

2) Details to be included in the certificates shall bedetermined by the regulations to be issued pursuantto this Proclamation.

15. Animals Movement Pennit1) Any person shall obtain animals movement permit

with respect to animal disease, from the animals'place of origin to transport animals from Woreda toWoreda and/or from region to region.

2) The animals movement permit to be issued shallindicate the animals' place of origin, destination,route, type and number of animals,health status andother necessary details. .

PARTFOUR

Registartion of AnimalsHealth Professionals and

Delivery of Services

16. Registration-I) No animal health professional shall practice

veterinary professioQ unless he is registered andobtained registrationcertificate.

2) The Ministry shall issue directives concerninganimalhealthinterventionswhichmay be performedby unregistered animal health professionals andother non- professionalusers.

3) A veterinary council shall be established for theregistration and licensing of animal health profes-sionals.

4) Conditions for the registrationand establishment ofthe council shallbe determinedby a regulations to beissued pursuant to this Proclamation.

17. Animal Health Services DeliveryI) Any person may establish animal health station,

center or institution upon the fulfillment of thenecessaryrequirements.

2) Any person shall in advanceproduce a certificate ofcompetence from the Ministry or concerned regionin order to obtain a business license of animal healthstation, center or institution.

3) The Ministry shall create favorable conditions forthe promotion of private animal health servicesdelivery.

4) The Ministry shall, based upon the nature of theservices, define the role and responsiblites of thepublic and the private sector in the delivery of animalhealth services.

PARTFIVEMiscellaneous Provisons

18. CompensationI) No compensation shall be paid to the custodian if

deseased animal is killed or slaughtered for thepurpose of prevention and control of the spread ofanimal disease based on the instruction of the animalhealth officer.

2) When the carcass of a dead animal is buried orburned upon the instruction of the inspecting officer,no expense of disposal shall be paid to the custodian.

3) without prejudice to Sub- Articles (l)and(2) of thisArticle, if the Ministry gives order for the slaughter

: or removal of animals in order to prevent and controlnoticeable animal diseases in the whole or part of thecountry, the Ministry may arrange for compensationas deemed necessary.

4) No compensation shall be paid for animals slaug-tered because of occurrence of noticeable animaldesease in the quarantine stations.

5) The Council of Ministers may issue a regulation forthe implementation of Sub- Article (3) of this Articleand having regard to compensation to injuriesincurred by professionals engaged in animal healthservice rendering activities.

19. Duty to Co-operateAny concerned person shall co operate for the im-plementation of this Proclamation and regulations anddirectives to be issued pursuant to it.

20. Collection of Service FeeThe Ministry may collect fees for the services renderedin accordance with the regulation to be issued by theCouncil of Ministers.

21. PunishmentAny person who violates the provisions of thisProclamation, regulations and directives issued pur-suant to it shall be punishedunder the provisions of thePenal Code.

22. Repealed and Non- applicableLaws1) Animal Diseases Control Proclamation No 1711

1961 is repealed by this Proclamation.2) No Proclamation, regulations and directives

which is inconsistentwith this Proclamation shallhave no effectwith respect to matters governed bythis Proclamtion.

23. IssuanceofReguJations and DirectivesI) The Council of Ministers may issue regulations

necessary for the proper implementation of thisProclamtion.

2) The Ministry may issue directives for the properimplementaion of this Proclamation andregulations issued under this Proclamation.

24. Effective DateThis Proclamationshall enter into force as of the 31'I day

of January, 2002
