    Dear BenThank you for your emai l below and for forwarding M r Assanges com men ts.As I set out in my original respon se to the comp laint, I do n ot bel ieve our art icle w as m isleading given that i t w as acontemp oraneo us repo rt of fast-mo ving events. AP h ad m ade se veral attempts to contact Wiki leaks staf f withoutsuccess. Nonetheless, the piece m ade quite c lear that W ikileaks rejected a l l claims abou t i t being to blame for thesecurity breach.I do bel ieve that rem edial action is truly necessary und er the terms of the Co de but have p ropo sed runn ing a footnoteto ensure abso lute c lar ity and in the spi r it o f med iation, as fostered by the P CC . I wo uld be ha ppy to use theamend ed w ord ing as put forward by M r Assange but I th ink the m ost appropr iate p lace for i t to be publ ished w ould beas a foo tnote/upda te to the art icle und er comp laint. I dont think i t w ould be reaso nable to pu bl ish the text (or even aname nded version) as a letter.Do let me kno w w hat you think about this.     Julian Assange has asked us to make it clear that, contrary to our review of "Julian Assange: TheUnauthorised Autobiography (Books, 2 October, 2011), he did not "criticise author Andrew OHaganswriting". He says his criticisms of the book w ere directed at the publisher, Canongate. H e wishes tounderline that he adm ires Mr O Hagans w riting.

    Thank yo u for your let ter o f 13 Jan uary 2012 (ref 1156 1 7) regard ing the comp laint f rom Jul ian Assan ge inrespe ct of three art icles published by the Guard ian.In respect o f the art ic le headl ined, Jul ian Assan ge ext rad i tion ap peal : QC s clash over concept ions ofconsent , and M r Assang es dispute over the use of the wo rd "charges" , we no te the decision of theCo mm ission, issued o n 18 January in respe ct o f a paral le l complaint about other Gu ard ian art ic les thatreferred to "charges" against Mr Assange. The Commission concluded that in the context, a dist inct ionbetween a formal indictment by the Swedish authorit ies and the accusation specified in a European ArrestW arrant was not s igni ficant and raised no breach of the Cod e.Reg ard ing the opinion piece headl ined, Steve Jobs v Julian Assange: w hat makes a good b iograp hy?,wh ich w as publ ished on our Co mm ent is f ree s ite under a clear heading of com men t , M r Assangecont inues to con test the comm entator s use o f the w ord " fugi t ive". Here is the passage in quest ion:

    For a start, Assange is not a recently dead hero , but an al l-too-alive fugit ive from rap e al legations wh ose lack ofinterpersonal skil ls has yet to be m odif ied by blistering commercial success. His stock-in-trade w as no t to bedifficult but irresistible. It was just to be difficult.

    I t is clear ly the w r i ter s view of M r Assa nges ongo ing at temp ts to res ist the S w edish jud icia l process. I tcannot be asse ssed a s a statement of fact when u sed so plainly in a rhetorical context, althoug h itsinteresting to note the Merr iam-Webster def init ion of " fugit ive from justice": "One who having committed orbeing accused o f a cr ime in o ne jur isd ict ion is absen t for any reaso n from that jur isd ict ion." W e d o no tbel ieve readers, for who m a l l the deta i ls of M r Assang es h igh-prof i le e f for ts to avoid a return to Sw edenare avai lab le in l inks around th is piece, wou ld be m is led. In any event , used in a f igurat ive po lemicalcontext, the d i f ference betwee n running a w ay and refus ing to go back can hard ly be s igni f icant .Kind regards
