    Transparency campaigner Jul ian Assange has lost a complaint to the PressCompla ints Commiss ion over a boo k rev iew in theNew S t a tes m an .In a piece he adl ined "Every Stone Unturned" a review of the "unauthorisedautobiography" of Assange publ ished by Canongate, James Bal l wrote:

    [Andrew] OHagans writing is at its best covering Assangesearly l i fe: a nomadic e xistence in rural Austral ia, replete withfloppy disks hidden in beehives and nightly forays throughsecure servers. Yet even here, the str ident note famil iar fromAssanges publ ic pronouncem ents often vanishes, replaced withthe ma nnerisms of a Brit ish aesthete. "It occurred to me on thesteps of the court that I had travel led a very long w ay to seesuch snow," he m uses after being granted bail on sexual assaultcharges in December . The language and tone are w hol lyuncharacteristic.

    Assange bel ieved that the reference here to "charges" was in breach o f thePCC code. "1 have not been charged with any offence a nd this statementtherefore represents a significant and misleading inaccuracy. The facts arenot hard to establ ish -- a m atter of basic fact-checking -- and a correctionshould be pr inted with due prom inence." He added that the art iclecontributed to a "hosti le me dia cl imate" and "a reduction in my a bi l i ty to raiserevenue for Wikileaks through loss of reputation".The PCC disagreed, rul ing:

    It was not in dispute that the complainant had not been fo rmallycharged by Swe dish authorities. As such, a claim that Swedishprosecutors had formally indicted the comp lainant with offenceswould clear ly raise a breach of Clause 1 ( i) of the Editors Code.However, the art icles under complaint had not made suc h aclaim: rather they had al luded to "charges" m ore general ly. Inthe view of the Com mission, this conveyed to readers,accurately, that the complainant was be ing accused by Sw edishprosecuting authorit ies of having com mitted the offences (andthat prosecutors were seeking his extradition with a view to hispotentially being tr ied for those offences).

    The PCC wrote to the editor of the NS, Ja son Cow ley, to inform him that thecomp laint "raised no breach o f the Code of Practice and did not requirefurther investigation.     Thomas Devine24 January 2012 at 14:09Assange wanted to control what was said about him. He rejectedtransparency for himself. Hed delight in jamming all diplomacy shut(quiettalk requires privacy), but he finds himself too sacred to be exposed to publicview. Some transparency.

Lets point out that even the general public know the differencebtw allegations (as usually made in tabloid newspapers on a weekly basis) :and charges which come with the obligation of the prosecutor to hand over :evidence to the defendent. Now just why the SW pros.is avoiding that step :until JA is in SW pretrial confinement is sth that only the pros. can butWONT answer (espe cially since they refuse to explain why a n interrogationabroad -a routine action by BOTH Swedish and other European pros.-al leg.isnt possible in this case!

And, more to the point, the very idea that he hadbeen charged is enough to convince the public, who unfortunately rely onpeople like Ball to tell them the truth, of Assanges suppos ed guilt. Anyonewith half a brain can see that this PCC ruling is little more than an attemp t by :
