A s Ness,Motley endeavors toroot out and bankrupt the logistical and fundingsources of terrorism, we wish tocontribute and share in the Commission's work and,where appropriate, provide insights and materials in an effort to enhan ce the overallim pact of this m onu m ental initiative. attacks. In our work to illustrate the complicity and liability of terrorist financiers in the

September 11 th attacks, we are striving to answer the following probative question: "Did

the financiers of terrorism have sufficient pre-9/11/01 information to be placed on noticethat funding Al-Qaeda would result in a catastrophic attack on the U.S. homeland?"

Indeed, there was sufficient information and tangible evidence available, no t onlyto relevant government and industry decision-makers, but also to financiers of terrorismof a likelyplot whereby suicidal hijackers woulduse civilian aircraft as a weapon of massdestruction years in advance of the September 11,2001 attacks. As such, we believethere is tremendous value in the Commission examining issues of foreseeability andpriorgovernment and industry knowledge of similar terrorist plots. An examination of theseissues will inform the Commission, relevant governmentactors, and the Americanpublicabout what we as a country knew about the possibility of this plot being carried ou t priorto 9/11.

In an effort to contribute to this sensitive and vitally important discussion, Ness,

Motley has compiled a timeline and an historical summary of critical terrorist events. We

hope the enclosed memorandum will assist the Commission in examining the systemicfailures of the aviation industry and our intelligence agencies in preparing for andresponding to similar terrorist threats and activities involving commercial aircraft prior toSeptember 2001.

Again, Ness, Motley, P.A. appreciates the Commission's substantive examinationof these important issues. I encourage Commission members or staff to contact me to

further discuss ways in which our Firm may be of assistance to the work of the

T he 1990 Commission numbers faced a task sadly similar to thai faced by ikepresent

Commission: to come to grips with the fac ts of the single greatest terrorism ac t against

American citizens (as of vat time), and to make recommendations aimed at deterring

f u t u r e ierrahst attacks. Had that Commiss ion ' s , r e c o m m e n d a t i o n s presented in i ts 1 82pg .report of May 15. 1990 been f u l l y headed, 9/1 1 might indeed have been averted.
