This new shed was built and donated by the students of the Construcon Academy at Lincoln High School and United Rentals / A&A Tool Rentals donated a boom liſt which was used to place the new shed at the facility. Jack Welch of Welch Construcon was a great help in geng the shed through some ght squeezes and into it’s new locaon. Construction Weekly

Recently the Builders’ Exchange of Stockton delivered a shed to the Haven of Peace locat-ed in French Camp to replace an old, non-salvageable storage shed. This new shed was built and donated by the students of the Construction Academy at Lincoln High School and United Rentals / A&A Tool Rentals donated a boom lift which was used to place the new shed at the facility. Jack Welch of Welch Construction was a great help in getting the shed through some tight squeezes and into it’s new location.

LAW FIRM ADDS NEW ATTORNEY The Stockton law firm of NEUMILLER & BEARDSLEE is pleased to announce the addition of Andy J. Pinasco as an associate attorney of the

firm. Mr. Pinasco’s areas of practice will concentrate in public works construction, employment, labor, and public agency law.

Mr. Pinasco joined the firm in 2016 upon earning his Juris Doctor with Distinction from University of the Pacific McGeorge School of Law. While at McGeorge, Mr. Pinasco wrote for the McGeorge Law Review and was an editor for the University of the Pacific Law Review. He finished in the top 15% of his class and received recognition at graduation as the recipient of the Outstanding Scholastic Achievement Award for the class of 2016. He achieved all of this while work-ing full time and commuting from Stockton to attend evening courses in McGeorge’s evening law degree program.

While attending McGeorge, Mr. Pinasco participated in the management of his family’s construction business. Upon completing high school, he enrolled in and com-pleted a California accredited apprenticeship program for sheet metal work. Mr. Pinasco gradually worked his way from job sites to the controller’s desk of his fam-ily’s business, managing a multi-million dollar annual gross income.

Mr. Pinasco is a member of the State Bar of California. He is also a member of cultural community organiza-tions including the Italian Athletic Club of America and the Italian Gardener’s Society.

Licensees also reminded to renew Dept. of Industrial Relations registration in June

The Contractors State License Board (CSLB) is reminding contractors and subcontractors who work on public works projects that they must continue to keep certified pay-roll records while the California Department of Industrial Relations (DIR) updates its online reporting system. En-forcement of the requirement to submit certified payroll records using DIR’s online system will resume in August. DIR has additional compliance information on its Public Works page.

In a related matter, public works contractors who are reg-istered with DIR for the current fiscal year (ending June 30, 2016) are encouraged to renew their registrations for the next fiscal year (starting July 1, 2016) using DIR’s online public works contractor registration system. Regis-tered contractors who fail to renew by July 1 but continue working on public works after that date will be subject to late fees and potential penalties. Contractors must be registered with DIR before bidding, being awarded or per-forming work on public works projects in California. DIR registration requires that all contractors be in good legal standing, which includes having a current license in good standing with CSLB.

Using any Internet-connected computer, public works contractors can:• Register for the first time• Renew an active registration• Reactivate a prior registration• Securely pay the non-refundable $300 registration/ renewal fee (and penalties if applicable)

The registration process is finished upon processing of payment. If paying by credit card, the registration process can be completed within 24 hours.

Contractors who are not currently registered should care-fully consider when to register. Any contractor who fails to register before bidding for a public works project or being awarded a public works project may be subject to a $2,000 penalty. Contractors who plan to bid or work on public works prior to July 1 may complete the registration process, including payment of the $300 fee, to register for the remainder of the current fiscal year, which expires on June 30, 2016. Once registered, contractors may then re-new their registration for the following fiscal year (begin-ning July 1), which will also require payment of the $300 renewal fee.

New features on DIR’s online registration system allow contractors to print out proof of registration and verify the status of their renewal or application on the data-base of qualified public works contractors. A user guide with instructions is posted online. DIR has additional compliance information on its Public Works page. Public agencies must confirm this registration before consider-ing a bid or awarding a public works contract, and prime contractors are required to make sure their bid team members are registered.

MAY SAW WEAKEST JOB GROWTH IN 5+ YEARS Did any economist foresee payrolls expanding by just 38,000 jobs in May? The median forecast compiled by MarketWatch projected a gain of 155,000, not the worst number since September 2010. The Department of Labor reduced March and April payroll gains by 59,000 in its new report, meaning monthly job creation averaged 116,000 in the past three months. As labor force participation declined 0.6% in May, the headline jobless rate fell to 4.7%. Annualized wage growth was at 2.5%.1,2

CONSUMERS FLEX THEIR PURCHASING POWER In better news, personal spending rose 1.0% in April according to the Department of Commerce. This was the biggest monthly spending gain since August 2009. Personal incomes were up 0.4% in April as well.2,3

ONE OF TWO ISM PMIS IMPROVE Both of the purchasing manager indices maintained by the Institute for Supply Management were above the 50 level in May, indicating sector growth. The upside? The manufacturing PMI improved 0.5 points to 51.3. The downside? The service sector PMI slipped 2.8 points to 52.9.2

CONSUMER CONFIDENCE DIPS Last month brought a decline in the Conference Board’s index of consumer confidence. Analysts surveyed by MarketWatch forecast a May reading of 96.7 for the index, yet it fell 2.1 points to 92.6 in its second straight monthly descent.2,3

NASDAQ ADVANCES, UNLIKE S&P & DOW Immediately after the May jobs report, futures traders put the odds of a June interest rate hike under 10%. Even so, there was no rally at the end of a short trading week. While the Nasdaq rose 0.83% in four days, the S&P 500 was flat for the week (to be precise, it added 0.07 points) and the Dow lost 0.12%. The Friday settlements: DJIA, 17,807.06; S&P, 2,099.13; NASDAQ, 4,942.52.1,4

THIS WEEK: Federal Reserve chair Janet Yellen speaks on the economy and monetary policy Monday in Philadelphia; investors will also consider earnings from Casey’s General Stores and Thor Industries. Tuesday, Michaels and VeriFone report earnings. Wednesday, Lululemon Athletica presents Q1 results. Thursday offers quarterly results, plus the latest initial claims numbers, from H&R Block and J.M. Smucker. The University of Michigan’s preliminary June consumer sentiment index appears Friday.

Class Information: California’s prevailing wage law and the types of work and projects that are covered, including ready mix concrete hauling. In addition, attendees will learn how to read and interpret prevailing wage determinations, including scopes of work and travel and subsistence provisions. The class will also focus on public works contractor registration requirements; recordkeeping requirements, including eCPR; apprenticeship compliance; prevailing wage enforcement; and new skilled and trained workforce requirements on certain jobs.

Accidents are unplanned and unexpected events that cause injury, property damage, and/or financial loss in the work-place. Incidents or “near misses” don’t result in loss, but have the potential to do so.

Ideally, safety programs focus on preventing accidents and incidents, but if one occurs, have an accident investigation procedure ready and train your employees how to use it. Investigate ALL accidents and injuries; the severity deter-mines the extent of the investigation. Handled properly, accident investigation helps you look at problems, solve them, improve your safety programs, and prevent future accidents.

Accident investigation should prevent recurrence. Adhering strictly to fact finding in a neutral, non-confrontational man-ner identifies the true attitudes, behaviors, and other factors that led to the problem. Analyzing facts and asking a neutral “why” question helps find the root cause of the accident. For example, if employee error caused the accident, dig further to determine why the employee made the error.

Accident investigation should not be used to blame, pun-ish or exonerate workers and managers; true facts will not emerge in this environment. If you investigate an accident just to complete paperwork and satisfy insurance require-

ments, you will erode confidence in the system and you won’t achieve your goal of prevention and loss reduction.

A supervisor in the affected area is the best person to con-duct an investigation because they are most familiar with the tools, equipment, and people involved. Experts in equipment, outside agencies, and other technical resources may also be needed.

Start your investigation by securing the scene, placing equip-ment out of service if necessary, and taking photos. Interview victims and witnesses. Collect evidence and records and document your observations. Find the contributing factors to determine the accident’s root cause. Document the recom-mended corrective actions, the people assigned to complete them, and a due date for completion.
