The CSLB held their quarterly board meeting last week. On the agenda was the approval of the Legislative Com-mittee’s 2016 legislative ‘wish list.’ There were 8 propos-als in total that were discussed, 7 of which were approved to move forward on, and one that was sent back for additional discussion at the board’s next strategic plan-ning meeting in April (at which time it will likely be killed according to board members). Following are the 6 that were approved as presented:

1). Reorganization of the Contractors State License Law (BPC 7000-7199.7) – This will be a multi-year project to reorganize the entire law to make it easier to read and to locate specific legal provisions.2). Test Scheduling (BPC 7074) – Would eliminate the voiding of an application after 90 days when an applicant does not reschedule for an exam whether because of not showing or after failing.3). Citation Disclosure (BPC 7124.6) – Will require dis-closure of citations on future licenses of a licensee (will eliminate ability to obtain a new license to hide past transgressions).4). Fee Increases and New Fee for Expedites (BPC 7137) – Will propose fee increases for most CSLB applications and will propose a fee for application expedites. This proposal will be discussed in more detail in a future CLC update.5). Rewrite of Home Improvement Contract (BPC 7159) – Condense, simplify, and better address service and repair contracts.6). Home Improvement Contracts – Additional Disclosure for Solar Contracts (BPC 7159.15) – Will provide addition-al protections for consumers desiring to install solar PV systems (one addition - to note it only applies to residen-tial solar projects).

CSLB Approves 2016 Legislative ‘Wish list’

As with last month’s stakeholders’ meeting, most of this portion of the board meeting was spent on the remaining two proposals. One was sent back for some re-working, but was approved in concept, while # 8 will be placed on the strategic planning agenda in April:7). Public Works Projects – Working Out of Class (BPC 7059) – The CSLB can only offer recommendations to public agencies seeking guidance on the proper licensing classification for a specific project; but, it could ensnare contractors awarded projects using a different class than recommended by the CSLB. Staff cited the problem of small, often very rural, public agencies awarding contracts on projects that are significantly out of a contractor’s license scope. An example was a C-15 Flooring Contrac-tor building a structure (which would require a B General Contractor’s license). After a lengthy discussion about the need for the board to have final say over the public agency as to which license classification is the correct one, the staff will re-work this proposal.8). New C-1 Non-Structural Remodel and Repair Con-tractor Classification – This proposal to create a new sub-classification garnered the most discussion. Many of the board members expressed concern about this license classification being able to bid on single, health and safety-specific classification jobs such as plumbing, electrical or HVAC. It was decided that staff will place this on the agenda for next April’s strategic planning meeting where several board members claim it will likely be killed. We will discuss this issue in-depth next week.

December 14, 2015 HOW LOW WILL OIL FUTURES GO? Did they hit bottom Friday afternoon, when WTI crude settled at $35.62 on the NYMEX? Maybe not, given the International Energy Agency’s new advisory that the oil glut may grow larger in 2016. Even Brent crude, the global benchmark, closed at $37.94 at the end of the week. Forecasts for a mild winter have also disappointed oil investors. Not since February 2009 have WTI crude prices been this low.1

RETAIL SALES IMPROVE 0.2% The November gain fell short of the 0.3% advance projected by analysts polled by Briefing.com, but it surpassed the 0.1% increase for October. Core retail sales (minus auto, gas, and home improvement purchases) rose a healthy 0.4% last month.2

CONSUMERS GROW A BIT MORE POSITIVE Last week brought a minor gain for the University of Michigan’s consumer sentiment index. It had ended November at 91.3; its preliminary December reading was slightly better at 91.8, beating a Briefing.com consensus forecast of 91.6.2

PRODUCER PRICES HEAD NORTH After three months without an advance, the federal government’s Producer Price Index rose 0.3% for November. The core PPI increased by the same amount. Year over year, headline PPI was still down 1.1% while core PPI was up 0.5%.2,3

STOCKS RETREAT AS CRUDE PRICES SINK All three major indices were rattled by the rout in oil. On the week, the Dow lost 3.26%, the S&P 500 3.79%, and the Nasdaq 4.06%. Their Friday closes: Nasdaq, 4,933.47; Dow, 17,265.21; S&P, 2,012.37.4

THIS WEEK: Monday, China releases new data on its industrial output and Navistar and VeriFone offer Q4 earnings news. The November CPI arrives Tuesday. Wednesday, investors around the world will react to the Federal Reserve’s latest policy decision (announcement at 2:00pm EST with subsequent press conference); reports on November housing starts, building permits and industrial production will also appear, plus earnings news from Cintas, FedEx, Jabil Circuit, Oracle, and Pier 1. Thursday, the Conference Board issues its November leading indicator index, new initial claims figures are released, and Accenture, Carnival, General Mills, Red Hat, Scholastic Corp., and Winnebago all present earnings. CarMax, Darden Restaurants, and Lennar round out the week with earnings news on Friday.

Slips and falls are a leading cause of workplace injuries. What do experts recommend as the single most important step to take in preventing slips and falls? Simple...keep floors clean, dry, and free of obstruction. When it comes to safe-guards against slips and falls, nothing is more important than good housekeeping.

When you walk through a work area, look for spills, grease spots or dust (flour and machine byproducts can be highly slippery). Water spilled by drinking fountains or tracked in on wet or snowy days can create a major hazard. Look around and be aware of wet areas or objects on the floor. Then take the time to do something about it. Clean up the hazard or place cones or hazard signs nearby, warning of the danger. People can walk on extremely slippery surfaces by modifying their speed and stride, provided they know about the danger-ous condition. It’s the lack of warning that can cause prob-lems. An unexpected shift from a smooth to a slick surface heightens the likelihood of a slip or fall.

Look for signs of flooring change. Changes in lighting and floor color can conceal a change in friction or angle between adjacent surfaces. Wherever possible, waxes and polishes

should cover an entire area, extending to natural breaks in flooring. Choose footwear according to floor surface.

Consider slips and falls when you’re doing a job. Some tasks, such as pushing loads, may require special attention to slip-resistant floor surfaces or carefully selected sole material and treads. For some jobs, better lighting or a stable brace is help-ful. Carefully placed and mounted hand rails, poles or hip bars may help operators brace themselves. This reduces reliance on foot/floor friction, which thereby reduces the potential for slipping.

Slips can occur because of how you walk on a surface. Some simple things you can do to minimize your chance of slipping and falling would be to wear appropriate footwear; watch where you’re going; take slow, short steps where slip potential is high; and use hand holds where possible.
