Richard (Ru) CollinRu will use his experience in the horticulture sector and strong governance skills to make a positive impact for the community.

Ru Collin envisages an ‘enabling’ Chamber, offering a pragmatic approach to issues, generating a healthy tourism sector, and aiming for initiatives that will generate higher disposable cash levels throughout the community.

Ru is a past director of HorticultureNZ, an elected director of New Zealand Fruit growers Federation, a life member of the Hawke’s Bay Fruit growers

Association, and a trustee for the New Zealand and Hawke’s Bay Fruit grower’s charitable trusts. Ru has also served on the Hawkes Bay Chamber of Commerce board between 2002 -2005. Ru was an ex councillor for the Hastings District 2010-2013.

Ru is General Manager of Kono Horticulture, the food and beverage arm of Wakatu Inc., a local Maori owned and operated agribusiness. The Horticulture division is located in Motueka.

Ru moved to the Tasman district in August 2013. He is happily married with three sons.

2014 in review – President and CEO reportKey measures of success for any membership based

organisation include:

• a growing number of active and engaged members

• members who are getting value out of their organisation

• an organisation that is financially sustainable and viable – ie one

living within its means!

• an organisation that is true to its vision

In the 2014 year the Chamber grew its membership – with a

significant growth in new members and reduced churn from existing

members. The result was a net growth of 54 members.

The majority of our new members are from businesses with less than

five staff (79%), and in the construction, property and retail sectors.

We have also seen good growth in the accommodation, café and

restaurant, communication services and tourism sector.

This is consistent with and reflects the current membership of the

Chamber – the majority of our members are small and medium sized

businesses. 67% of our members employ less than six staff – and

45% of our members are 1 – 2 person businesses. While the majority

are based in Nelson, 206 of our members operate across both Nelson

and Tasman.

Members continue to value the Chamber’s networking events and

see these as an opportunity to grow their business and contacts, stay

informed about local business news and issues, and overcome any

sense of isolation from other business owners. It has been fantastic to

see the number of members able to attend Chamber functions and

we thank those members who have hosted either a BNZ Partners BA5

or BMG Business Women’s Network meeting.

I had forgotten how refreshing it is to mix with other business owners! We all experience the same frustrations and it’s great to meet others in similar situations. I am so pleased that our company BioSea have become members of the Chamber of Commerce to take advantage of the benefits offered.

Members reflect the diversity and vitality of our business sectors.

Our top five sectors are property and business services; construction;

retail trade; finance and insurance and communication services.

The Chamber is owned by, funded by, and accountable to local

member businesses. 80% of our income comes directly from

members through subscriptions, services and sponsorship.

We are particularly grateful for the support of our members and

of our key sponsors. We thank our cornerstone sponsors for their

We are an independent and positive voice for business that ‘speaks

without fear or favour’ in support of regional business vitality and

prosperity.

Throughout the year we have made submissions to and met regularly

with both councils to share issues, concerns, and business successes.

The audited financial accounts for the 2014 year show the Chamber

remains in a very positive position. We lived well within our means

and were in a position to increase the funds in the bank to provide

security and certainty going forward. While no significant new

investments were made during the calendar year, the ground work

has begun to streamline our systems (including moving to Xero) and

refresh the chamber website.

Klaas Breukel, branding and poster design online tutor, is a designer from the Netherlands with over a decade of design experience. He also teaches on NMIT’s Creative Industries degree and diploma programmes.

To help you meet this challenge NMIT have created a special set of graphic design and photography courses which focus on developing your practical design and creative thinking skills. Each course is delivered entirely online which allows you to study them in your own time while having the support of NMIT’s industry savvy tutors that understand your local context.

These courses are ideal for; small business owners, in-house marketing support teams and freelancers looking to extend their abilities in other areas.

Branding Design

This course introduces you to the principles of graphic design through a focus on contemporary logo and brand design. You will develop skills in practical design and creative thinking. Through set branding projects you will gain an understanding of design processes and strategies. You will engage in visual and conceptual research, learn to document, communicate and contextualise design related topics as you develop a number of logos and identities for various products and services.

Course participant, Jessica Shirley says, “I found that by completing the NMIT

online branding course I was able to learn the most important foundations of graphic design in regards to branding. I now have a much greater understanding of how graphic design works in the real world and have used terminology learnt on the course in job interviews which has given me huge confidence. I find myself looking at every logo and design I see now with a stronger appreciation.”

Poster Design

This course introduces you to the principles of graphic design using poster design as a mode of visual communication. You will design eye-catching posters for a variety of purposes and target audiences in both commercial and non-profit scenarios. Design processes and strategies will be explored and topics of focus will include; principles of design and composition, typography, imagery and concept generation.

Digital Photography

You will develop practical skills and a theoretical understanding of digital photography processes and contexts through interesting projects. You will use digital photography to research, develop, document and communicate ideas in response to set tasks and activities. Overhaul of RMA this year?For those businesses that are affected by the Resource Management Act 1991 (RMA), it looks like more change is on the way.

In a speech to Nelson Rotary in January this

year, Minister for the Environment, Nick

Smith, signalled the government’s intention

to continue with the second phase of

amendments to this Act this year.

The government completed its first phase

of RMA reform during its first term (with

the final changes coming into effect by 15

March this year). This first phase was largely

focused on procedural changes to improve

the workability of the RMA. This second

phase of reform is more significant, including

fundamental changes to the principles

guiding all decision making under the

Act. The government was unable to secure

the parliamentary numbers to advance

this second phase of reform to a Bill last

year. The United Future and Maori parties

opposed the changes. With the support of

Act, the government now has the numbers

that it needs.

So what are the key areas of change

now proposed?

Smith’s speech indicates that the key areas of

proposed change are:

a. Significant changes to sections 6 and 7 of

the Act, including addition of the following

new overriding principles:

• The need for careful design of

urban environments;

• Recognising the importance of more

affordable housing;

• Provision for appropriate infrastructure;

• The need to recognise the benefits of

economic growth and jobs;

• More explicit recognition of private

property rights.

b. Further procedural changes intended

to speed up plan making processes and

foster a more collaborative rather than

adversarial approach to resolving resource

management issues;

c. Standard planning templates to simplify

plans across the country;

d. Strengthening some of the powers for

national regulation. In his speech, Smith

gives the example of a rule requiring dairy

cows to be banned from streams and rivers

to be implemented following one round of

national consultation and being immediately

backed up by an instant fine regime by

July 2017.

In addition to including the importance of

affordable housing as a new overarching

principle, Smith’s speech also suggests

possible changes to limit the consultation,

submissions and appeal rights of neighbours.

These areas of change are broadly the same

as those proposed by the government last

year. We do not yet know whether any of the

details have changed, for example in order

to obtain a broader base of support.

Smith has indicated an ambition to have a

Bill drafted and introduced into Parliament

in the first half of this year, advancing to a

full select committee process for passage by

the end of the year.

How to create better cashflow when your business is growingIf you’re in the happy position of seeing

your business in a growth phase, it pays

to consider how you can most effectively

manage your in-comings and out-goings.

In a time of growth, cash is required to

pay suppliers but it may not be replaced

for some months until a sale is converted

into cash. The level of Stock and Debtors

will increase until these reach the optimal

level for the business size and that requires

an increase in the level of cash to support

this growth. Funding is also needed to

pay overheads, tax obligations and capital

investment. Inadequate planning and

management during this phase is one reason

such a high percentage of new businesses

fail in their first year.

To avoid this cash trap, here are some key

tips to consider.

Choose the right business structure

It should limit liability but allow for the

appropriate level of capital input from

shareholders or partners and it should

accommodate borrowing from both owners

and external financial organisations.

Plan and budget

Create an up to date business plan that

includes a cashflow budget. Compare actuals

to budget and regularly update the budget

to meet reality. Prepare your own realistic

personal budget so that you can draw a

set budgeted amount from the business.

Plan for income tax payments and at the

very least have annual accounts and tax

positions completed as soon as possible

after balance date.

Carefully decide how to bring cash into the business

Introduce an appropriate level of cash

into the business by way of capital or

Owner advances. Meet further funding

requirements with an optimal mix of short

and long term debt.

Monitor sales and stock

Monitor Gross margins on your sales. Have as

many Cash Sales as possible. Ensure careful

stock management so as not to overstock.

Use Consignment stock where possible. Have

good systems so that all stock and sales are

accounted for.

Keep control of debt and overheads

Negotiate better discounts and more

favourable payment terms with your

suppliers, where possible, including the

possibility of instalment arrangements.

Have a strict Customer Credit policy in

place and administer this efficiently. Charge

interest on overdue accounts. Stop Credit

where necessary.

Consider using a financing mechanism to

fund your debtors. Consider leasing fixed

assets instead of purchasing them. Monitor

and reduce overheads as much as possible.

Consider subcontracting rather than

employing where appropriate.

Align your bank accounts

Consider maintaining a separate bank

account where PAYE, GST and Income tax

(expressed as a percentage of sales) are

regularly transferred. This will ensure funds

are available on due dates.

Good news storyRezource, formerly Keep It Simple

Business Solutions Ltd (KIS Solutions

2006) primarily an outsource, temping and

recruitment company, providing outsource

service around administration, payroll,

bookkeeping, accounting and HR, providing

insource temps for short term requirements,

and can recruit the staff required to grow

your business. Clients vary across sectors;

aquaculture, horticulture, trade, service,

retail and Maori. Services are tailored to suit

the needs of each business, providing them

with solutions to meet their needs long term.

The business had experienced huge growth

over the past 12 months; however they had

three areas of challenge; brand, processes/

systems and strategic growth. They wanted

The NZTE Capability Development scheme

enabled Sacha to engage Rebecca Mason

House), firmed up decision making processes,

taken on additional staff, and identified what

set up robust internal systems and split the

business into two separate brands.

KIS Solutions will now trade under the

first brand “Rezource” which maintains

the outsource, insource and recruitment

services, with the secondary brand focusing

on the work they do around kaupapa maori,

business start-ups, entrepreneurship and

connecting people with business. Having

two separate brands now allows for growth

strategies and alignment with a larger

profile of organisations to partner with. The

secondary brand also aligns well with Maori

entities and organisations that are focused

on economic development. This new brand

will be released in the coming weeks.

Overall the coaching resulted in increased

turnover, with an increase in operating profit,

they have not changed direction but are now

more focused.

$168k for privacy breach The Human Rights Tribunal’s decision that NZCU Bayside breached the privacy of their previous employee Karen Hammond was not a surprise. The company admitted to the breach. The level of compensation however was staggering. The awarding of $168k compensation, surpassed the previous highest award by an astonishing $128k.

The actions of NZCU Bayside were

extraordinary. Hammond had posted on

her facebook page a photo of a cake she had

baked, iced with the words ‘NZCU F*** YOU’.

Only people she had accepted as ‘facebook

friends’ could access the page. There were

approximately 150 of these. NZCU Bayside

obtained through coercion of a junior

employee, a screen shot of the photo and

emailed it to four local recruitment agencies,

along with contemporaneous phone calls

warning against employing Hammond.

In addition the Chief Executive sent an

email to staff disclosing information about

Hammond. The company also placed severe

pressure on Hammond’s new employer to

terminate her employment. This was to the

extent that continuing to employ her would

have resulted in significant financial loss.

Hammond resigned from her new job on

the basis it had become untenable for the

company to continue with her there. She

remained unemployed for 10 months, she

had to obtain a position outside her chosen

sector, and in a position considerably below

her skill level. Hammond felt unable to apply

for any positions that used recruitment

agencies for fear of what they would say to

prospective employers.

The tribunal determined the company was

less than honest in their evidence at the

hearing. The evidence of two of their key

witnesses was described as being defensive

and in disarray, and the consequences of the

breach was downplayed by the company.

Members of the management team also

contradicted each other. In contrast the

tribunal found Hammond and her witnesses

to ‘be sincere and genuine individuals and

their evidence unrehearsed, direct and frank.’

Although the Chief Executive did provide

an apology, the tribunal said the apology

was ‘delivered without any detectable note

of sincerity.’

All of these factors were taken into account

when the tribunal considered remedies.

The award was made up of $38,350 in lost

income, just over $15,500 for legal expenses,

$16,177 for the difference in wages from

the job she was forced to resign from and

her new job, and $98,000 damages for

humiliation, loss of dignity and injury to

feelings. The tribunal described the breach

as at the serious end of the spectrum, with

the company’s responses at the hearing as

contributing, and hence justifying the large

damages award.

The lesson of this case is clear. Even though

an employer may feel offended by an

employee’s actions, that does not justify a

breach of the individual’s privacy. Sharing

information with third parties, without the

individual’s permission, is a breach of privacy.

Access, availability of this product has now

been limited to the Enterprise Plans. Many of

the Access capabilities can now be delivered

using SharePoint as part of one of the Small

Business plans.

Prior to a major pricing announcement in

October 2014, most businesses adopting

Office365 selected a plan with Services only

(primarily for email) and purchased the

Office Suite separately as required.

This meant that there was time involved

in installing the software but also that the

software could be tied to the computer

on which it was installed, meaning when

the computer is eventually replaced, the

software may need to be purchased again.

Those businesses that subscribe to the

applications can install the full version of

Office on up to five devices for each user

– so you can use the same version of the

software on your desktop, laptop, tablet,

phone and home computer for no additional

license costs.
