, אושר 2014-לפיקוח על מזון לבעלי חיים, התשע"דהחוק

ופורסם ברשומות. 2014רואר בפב

עוד טרם כניסת החוק החדש לתוקף, ובמקביל לכתיבת התקנות,

מזון לבעלי חיים, מושתת על הפעילות של האגף לפיקוח על

העקרונות של החוק החדש. שלפיה האחריות, הן לבטיחות המוצר

והן לאיכותו, מוטלת על היצרן, כאשר המדינה מפעילה פיקוח

עליון על מנגנוני הייצור, היבוא והשיווק, ברמות משתנות בהתאם

למדיניות ניהול סיכונים.

עסקאות במספוא, ושם עוסק בתנאים לביצוע המספוא לצו 2 סעיף

The Animal Feed Production and Marketing Inspection Law or "Animal-Feed Law", was passed in February 2014 and published in the Reshumot. The Law is expected to come into effect in circa two years, during this period we are obliged to create a secondary legislation framework. In the meantime, supervision over production and marketing of animal feed is currently regulated by the Animal Feed Order (AFO), which has been in effect since 1971. Until the new law comes into effect, and during the period of establishing the secondary legislation, the Animal Feed Division will operate in accordance with the mandate specified in the new Animal Feed Law. In accordance to which, the responsibility, of both the safety and the quality of the product, lies on the producer or importer, and the state supervises the production, import and marketing, in accordance with the risk assessment policy. Article 2 of the Animal Feed Order deals with conditions for animal feed transactions, determining: "A person shall not perform transaction of a material used or which might be used for animal feeding unless it is animal feed, and unless per a written permit as for this purpose issued by the Director in accordance with the conditions of such permit" Therefore, Feed business operator (FBO) who produce and trade in animal feed must receive a permit to manufacture and trade in animal feed in the State of Israel. A Permit will only be issued if the FBO meets the requirements specified in the Animal Feed Order, and requirements specified therein, according to its line of business. Please find below updated requirements for issue/renewal of manufacturing, marketing and trade permits in animal feed products, according to the AFO and requirements for animal feed import permit, based on the Free Import Act – 2012:

Clarifications: Transactions in animal feed without permit are a violation of the AFO. To avoid doubt, if a certain manufacturer or product's permit has not been renewed, it is forbidden to manufacture, use or trade in this product from the previous year's stock. Importing is not permitted prior to receiving the permit, as well. Some products belong to several categories; therefore additional documents may be required for the main category to which the product falls under in order to receive a permit. Needless to say, a permit for marketing, manufacturing and trading in animal feed products and import permits based on the Free import Act do not exempt the manufacturer, trader and plant from any additional licenses and permits required by law.

1. According to the AFO, a person may not conduct a transaction in animal feed without a permit issued by the Director of the Veterinary Service at the Ministry of Agriculture (MoA) or a person empowered by him. 2. Definition of "transaction" according to the Act: " any of the following actions made by a person not for the purpose of feeding the animals under his supervision or care" 2.1. The possession of feed or its transportation from the jurisdiction of one local authority to another, furthermore, offering of feed for sale or its display for sale. 2.2. Gaining ownership or possession of feed. 2.3. Transfer of ownership or possession of feed to another. 2.4. Manufacture. 3. Anyone carrying out a transaction in feed for feeding animal under his control or care is exempt from upholding the requirements herein. 4. The requirements herein apply to existing activities, new applicants and/or beginning of new actions taking place in approved plants. 5. The permit is valid up to one year from the date of issue. 6. The Director may determine a shorter permission period, based on the feed properties and type. 7. New applications or renewal applications during the calendar year will be submitted to the Animal Feed Division by post or by hand delivery. All documents and certificates required for examination must be attached to the application form according to the type of request. For further information, contact by email [email protected]. 8. All attached documents will be originals or Certified copies. 9. All documents must be up to date, and issued during a period of maximum 6 months previous to the submission of the application. All analysis must be issued from ISO/IEC 17025 competent laboratories. 10. The Payment of the permit fee according to the price list in Appendix 6, a notification regarding the sum to be paid will be sent after the approval of the application by the feed division. 11.The applications will be examined by the division and if the manufacturer fulfills the requirements, a permit will be issued within a period of 15 business days.

12. Manufacturers' applications for a permit for Group VI in Section C and/or Section B of this document of requirements will receive a response within a period of 90 business days. 13. To ensure the fulfillment of the requirements and conditions of the permit, the inspectors of the Veterinary Services will conduct inspection and control checks over the permit holders. 14. Frequency and extent of supervision over FBO permit holders will be based on a supervision plan founded on risk survey management. 15. FBO permit holders will be required to manufacture or trade in animal feed that meets the requirements specified in Appendix 8.

In order to obtain an Importer permit, the following documents shall be presented:

1. Permit request application, Appendix 1 or 2, according to the type of product.

2. Statement signed by applicant regarding committing to AFO requirements, Appendix 5.

3. Submit a recall procedure, according to the guidelines in Appendix 3.

4. The Payment of the permit fee according to the price list in Appendix 6, according to the

type of product

5. a notification regarding the sum to be paid will be sent after the approval of the application by the feed division

In addition, the importer is requested to present to following documents, according to the type of product and the group to which it belongs.

If the product is a Processed plant, Factory's accreditation certificate for ISO 9001/2000 standard or similar (GMP, HACCP or equivalent) that meets the requirements of the country of manufacture, if exists. 3. In cases of importation of a plant submit the appropriate import permit from the Plant Protection and Inspection Services plant quarantine service or, in case of a vital seaweed, from the Ministry of Agriculture’s Fishery Division. Requirements for issuance of an import permit issue according to the Free Import Act: (Issued by the PPIS units at the ports for each product-source-supplier combination). 1. Animal Feed Division permit certificate based on AFO. 2. Annual permit issue requirements: 1. The importers must provide, enclosed to the

application for the annual permit, a list of clients that are expected to obtain permission to use their permit during the upcoming year and a full list of products for each client.

2. The importer shall apply for a permit on behalf of the second party (feed mills / centers) and it shall be issued and sent to the importer who will be responsible to pass it to the second party.

3. In case of any problem with product the responsibility lies with the importer. The importer is must notify the Veterinary Services and the clients regarding any changes in the product.

4. In case of any addition to the list of clients during the year, the applications will be examined by the division and a permit will be issued within a period of 15 business days.

Comments: Manufacturer/importer must submit all documents

specified in this section as prior condition for the

registration of a feed additive. However, if the product

dossier has been previously submitted and no changes have

been made in the product, the dossier is not required for

renewal of the permit certificate.

Dossier registration renewal will be carried out every 5

years

according the guidelines and conditions as specified in

Appendix 4, in addition, the producer must specify on

the shipping bill the expiration date and the conditions

in which the product should be stored.

The stage in which the food becomes a by-product for animal feeding.

The supervision will focus on the conditions in which the by-products are stored and transferred to the farm.

1. By-products shall be collected from food factories licensed by the ministry of Health.

2. A producer must present a technical data sheet for each by-product, including at least the following:

feed industry is food grade e.g.: canola, palm,

soya, sunflower etc.

2. Oil is collected from collection drums for used

cooking oil,

3. Oil may not be collected from cesspits or oil

4. The Collected oil shall not contain soap, cleaning

products and detergents.

Analysis that the manufacturer is required to perform

which fowl are in normal health and the substrate in

the poultry manure will be sawdust, paper or straw.

2. Poultry manure from coops that are to be destroyed

for sanitary reasons, avian flu or any other contagious

disease is forbidden for use.

3. The manufacturer must ensure the poultry manure

is accompanied by the farmer's declaration that

specifies antibiotic medications used for growing of

the poultry, length of use and dosage.

4. Poultry manure from coops that used medication

with the active ingredient is Maduramicin, at any

The FBO shall appoint an employee responsible,

with a job description to act as the authority to

deal with the recall of products from the market.

A notification must be sent to the feed division,

by a written form, regarding the recall and shall

contain the following details:

1) Name of the producer / importer, address and

means of communication (phone number,

email, etc.)

2) Code or production date of the damaged feed.

3) Type of damage.

4) The action and the degree of urgency

required.

5) A distribution list of all points that might be

marketing the feed.

6) A list of those who have been notified

regarding the recall.

7) The total amount of feed produced and the

period of production.

8) An estimation of t The total amount of feed /

product that is on the market and the time

required for its recall.

9) A proposed strategy for the recall.

10) Name and phone number of the contact

person of the procedure / importer.

[Labeling based on articles 2 and 4 of the Consumer

Protection Act (labeling of goods), 1983]

The marking of goods:

A. The marking of the good shall be done by a printed

or imprinted label. The label shall be fixed to the

package or the goods in a manner to prevent its

easy removal.

B. The details of the marking must be clear, legible

and visible. A marking should be in a different

color from the color of the background on which it

appears.

C. In addition, imported goods with a manual or

warning in foreign language, must include a

complete and accurate translation to Hebrew of the

instructions of use or warnings. Hebrew letter size

will not be less than the size of the letters in the

foreign language and will be featured in the same

manner .

Language of marking:

A. Goods made in Israel – the label shall be in Hebrew

and can be additionally marked in foreign language, provided that the marking in each of the languages

contain all the information required in accordance

with the law, and will be identical in content and

form.

B. Imported goods - the marking must be in Hebrew or

Hebrew and foreign language. If additional

information is provided on the label and not

required by Law, it is not necessary to translate it

into Hebrew.

3. Date of production of feed .

4. Species of animals for which the feed is intended.

5. If the feed contains medication , specify the name of the

medication and withdrawal period required for

marketing the animals or products.

6. If the feed contains growth-promoters, specify the name

of the growth promoter and its ratio in the additive. The

following caption must be added: ―Consult with your

veterinarian when using medicated mixes‖

6. Number of permit holder by the Animal Feed Inspection

In additional details are required:

7. Food colors or preservatives, the words "contains

food coloring" or "contains preservatives" as applies,

with the name or marking of the substance.

8. Vitamin or trace element concentrates, include the

words "containing vitamin concentrate" or "containing

mineral concentrate", as applies.

9. Medications, the words "containing medication" in a

box and the name of the medication and its ratio in feed

noted below the box. Additionally, the withdrawal

period required before marketing the animals or

animal-products for human consumption must be

stated.

10. With medicines that are growth-enhancers, the

(b) "Complementary food" or "dog chew" when the feed

does not provide said needs.

(c) Further details should be added:

Food with less than 13 percent moisture, the word

"Dry ---".

Food with moisture content between 13 and 50

percent, the word: "Soft ---".

Food with over 50 percent moisture packaged in a

sealed vessel, the word: "Preserves".

Food sold in a frozen state, the word: "Frozen".

(d) The words "Not For Human Consumption" in bold text.

sought before use or before extending the period of use.‘
