However, if you are going to apply on FLR M (considering you have fulfilled the appendix FM rules) this means that your dependant’s time in the UK would start again from the application and previous time spent in the UK will not be considered. Therefore, on that basis it would be better to apply via the PBS dependant route. The only drawback in comparing the 2 approaches is the cost implication as the fee for PBS dependant is twice that of the FLR M route. However, with FLR (M) route there is no restriction to work as a doctor, dentist or nurse. 10 Year Long Residence: If the main applicant is switching to the 10 year long residence route and their dependants are already here then unfortunately because of the rules which were enforceable from 6th April 2014 it won’t allow them to add their dependants time spent in the UK at all. In other words, their dependant can only apply for the appendix fm FLR M route and their previous stay will not be added. The change will mean such dependants will need to apply for leave to remain under the rules for family members in Appendix FM before they can qualify for settlement.
