NOTICE is hereby given that the Dalwallinu RoadBoard proposes to borrow the sum of £550, to be ex-pended on works and undertakings in the DalwallinuRoad Board District, the said works and undertakingsbeing the acquisition of the Kalannie Hall and altera-tions and additions thereto.

(Registered 10/3/1937.)THIS Agreement made in pursuance of "The Indus-trial Arbitration Act, 1912-1935," this 15th day ofFebruary', One thousand nine hundred and thirty-seven,between the Printing Industry Employees' Union ofWestern Australia Industrial Union of Workers, Perth,and J. Gibliney & Sons Ltd.; Art Photo Engravers(C. W. McKinlay) ; Williams and Sargant; PerthEngraving Works A. Hatch), and C. L. McShane.

1.Scope.This Agreement shall relate to the Process Engraving

Industry.

2.,Terms.This Agreement, as regards conditions of working

and rates of wages, etc., shall come into force from thecommencement of the nearest working week to 15thFebruary, 1937, and shall remain in. operation withoutamendment being sought by either side for a term ofat least (1) one year from the aforesaid date, and, sub-ject to thirty days' prior notice in writing by eitherparty, shall terminate on 14th February, 1938. In theevent of this Agreement not being terminated as afore-said, it shall continue subject to thirty days' previouswritten notice by either party.

3.Area.This Agreement shall operate over the area contained

within a radius of fifteen (15) miles of the G.P.O. ofthe city of Perth (excluding the premises in which thework of the "West Australian" newspaper is carriedout by the proprietors of the "West Australian" news-paper).

(a) hours of Labour:The maximum number of hours to be worked each

week shall be:Day work, 44 hours; night work, 40hours.

(b) Spread of Hours:Day work shall mean work done between the hours of

8 a.m. and 6.30 p.m. Work done by a day-worker be-fore or after these hours shalt be paid for at overtimerates. The maximum daily spread of shift shall be ninehours, inclusive of (1.) one hour meal time. In officeswhere a (5) live day week is worked, the maximumdaily spread of shift shall be 10 hours, inclusive of (1)one hour meal time. Work done beyond these hoursshall be paid at overtime rates.

Night work shall mean work done between G 30 p.m.and 8 a.m. Work done by a night worker before orafter these hours shall be paid for at overtime rates.

(c) Mixed Shift:In a factory where a regular shift is worked between

the hours set down in this Agreement for day and nightwork, the wages shall be the rate proportionate to thenumber of hours day work and night work, and the hoursshall he those for night shift. ( Where a regular mixedshift is worked between the hours set down for day andnight work in this Agreement, 6s. per week shall beadded to the worker's ordinary wage.)

(d) The maximum nightly spread of shift shall he(8) eight hours, inclusive of one hour meal time. Workdone beyond the shift shall be paid for at overtime rates.Where any regular mixed shift is worked, the workshall be rotated amongst the employees. Where a (5)five-day week is worked the maximum nightly spreadshall be (9) nine hours inclusive of meal time.

(e) The hours of duty of all employees on night shiftor unusual shift shall be arranged between each parti-cular employer and the Printing Industry Employees'Union of W.A., or (if members of such Union are notemployed his employees) and, in case they are unableto agree, by the Board of Reference.

(f) All employees working six full shifts a week dayor night (i.e. employees who do not get a day-and -a-halfor two days off consecutively, or who have to work after1 o'clock noon on Saturday) shall be allowed one fullshift off every two weeks, to be paid for. In the weekin which the day or night off is taken, the weekly hoursshall be reduced by one-sixth of the weekly hours agreedto respectively for each section.

Roster:A roster of daily hours shall be displayed in each

workroom, one week's notice of variation to be given,and other requirements of Section 30 of the Factoriesand Shops Act shall be complied with.

(c) Workers shall be paid at the rate for the classi-fication at which they are usually employed and whenput to work at a higher grade shall be paid the differencein the wages prescribed.

Provided that, if a worker is employed at the highergrade for more than two hours per day, lie shall receivethe higher wage for the full day. Provided also, thata permanent employee shall be continuously engaged inthe higher grade.

(d) Pay Day:An employee shall be paid on Thursday or Friday in

each week, and not more than two days' pay shall bekept in hand by the employer.

Basic wage:The basic wage upon which this Agreement is based

is £3 13s. 9d. per week for males.

6.Overtime.(a) All overtime rates earned by an employee shall

be paid in full and no deduction shall be made fromsuch overtime rates by reason of any time not workedby such employee.

(b) Overtime shall he rotated amongst employees ineach section, and shall be charged for at the rate of timeand one-half for the first three hours and double timethereafter. Sunday work shall be paid for at doubletime rates.

(c) No junior worker under seventeen years of ageshall be on duty in any event before 8 min. or later than9 p.m. on any working- day.

(d) An employer shall not require or permit an em-ployee to work overtime or on night shift in connectionwith power driven machinery, unless he works in com-pany with at least one other person. Provided that an

prentice shall not be permitted to work overtime unlessat least one journeyman is employed in company withthe said apprentice.

7.Holidays.Each employee shall receive twelve consecutive work-

ing days holidays in each year on full pay, at times con-venient to the employer. Provided always, that shouldthe services he brought to a termination after the ex-]Oration of three calendar months but before theexpiration of tc clue calendar months, the said twelvedays holiday shall be commuted to a holiday for oneday for each calendar month's service.

Permanent part-time employees averagin2], three ormore shifts per week shall receive proportionate holi-days. Other part-time employees shall receive only suchproportionate holidays as may be agreed upon betweenemployer and the Union.

One day at Christmas, Good Friday, Easter Saturdayand Labour Day shall be paid holidays, and should anyemployee be required to work on these days, he shallreceive double pay for the time worked in addition tothe holiday pay. Provided that, if given a day off onfull pay within seven days of the paid holiday, he shallreceive double pay only for the time worked.

8.Meal Time.Each person employed shall receive a meal time not

less than one hour. .Should an employer require an em-ployee to work through his usual meal time, he shall paysuch employee 5s. for each meal time worked, and, inaddition, such employee shall be allowed time for ameal. Provided that the employer may vary the usualmeal hour by half an hour.

9.Sick Pay.Permanent employees absent through sickness shall

be paid full wages for the first week of absence, afterwhich the legal liability of the employer shall cease.

10.Casuals.(a) A "casual" or a. "part-time worker" is a

wirkrr hy the hour or per day whos2 term of ,mpluyment in any one office does not exceed four continu-ous full weeks. For the purpose of this clause the con-tinuity of employment shall not be affected by reasonof an interruption in any week due to any of the holi-days provided in this Award.

(b) Casuals shall be guaranteed a full shift at nightand four hours in the day time. A full shift shall meanone-sixth of the usual weekly working hours. All casualsshall Le paid at the rate prescribed for their sectionper hour plus 12 per cent. for each shift. Casualsworking day work, if employed for a full week, shallbe paid the prescribed weekly wage, with no extra allow-ance per shift.

(c) Casuals working mixed shifts, i.e., shifts commenc-ing before 6.30 p.m. and ending after 6.30 p.m. shall bepaid day rates, providing the work after (3.30 p.m. doesnot exceed one hour. If it does, then night rates are tobe paid throughout and the guarantee to be four hours.

(d) If employed for a full week at night, casualsshall be paid the prescribed weekly wage, plus five shil-lings, with no extra allowance per shift.

(e) A casual working for eleven (11) consecutiveshifts shall be allowed one full shift off on full pay:Provided that, where such time is allowed off and paidfor, the extra allowance for casuals shall not apply.

11.Call Time.Two hours' time shall be allowed as a call in addi-

tion to the time worked, if any employee is sent for,or required to attend the factory to do any other specialwork not in the ordinary working hours. Time workedon a call shall be charged by the employee on a separatetime sheet, and shall stand alone, in no way affectingor complicating any computation of the ordinary work-ing week.

Whenever the finishing time of any worker workingovertime or any temporary night shift is of such as tocause him to miss his usual means of conveyance home,he shall be conveyed home in a suitable manner, with-out delay, at the expense of the employer.

12.Classes of Labour.Two classes of labour only shall be engaged in the

industry, i.e., journeymen and apprentices.

13.Record Book.Each employer shall keep at his office, or at each of

them if more than one, a hook containing a record of(a) the names of all workers employed by him at

such factory and to whom this Agreementapplies; and

(b) the class of work performed, the hours worked(including overtime) and the wages paid toeach such worker.

Such book may be inspected at any time during ordi-nary business hours by the secretary for the time beingof the Workers' Union and/or the Employers' Associa-tion, and these two secretaries may conjointly visit andinspect the various factories to ascertain whether theprovisions of this Agreement are being carried out.

The employer and the worker shall be severally re-sponsible for the keeping of this book.

14.Agreement, etc., to be Posted.(a) A copy of this Agreement, with any variation

thereto, shall be kept posted in a prominent place in eachworkroom. The Printing Industry Employees' Union ofW.A. shall be permitted to post notices as to Unionmeetings on a board at each establishment in a reason-able manner.

(b) Notices containing advice for the preservationof health and protection of workmen if provided by thePrinting Industry Employees' Union of W.A.., shallbe kept prominently posted and displayed in all work-rooms by the employer.

15.--Ibnion Officials Visiting Factory.An employer shall permit the Secretary of Printing

Industry Employees' Union of W.A. Industrial Unionof Workers, Perth, to enter the workroom during work-ing hours to interview the Father or Clerk of the Chapel,or individual members, or to collect subscriptions, butshall not interview members severally in such a manneras to delay the working of the office.

16. health Conditions.(a) Dark rooms must be thoroughly ventilated and

the cubic capacity must be in accordance with the Fac-tories and Shops Act.

(b) Flues or other satisfactory means of ventilation,to he approved by the Factories Inspector, to be pro-vided over all acid baths, which shall be so fitted thatall tunics and heavy gases are drawn off into the open

(r) Proper facilities shall be provided by the em-ployer for the employees to change their clothes.

(d) The employer shall provide a suitable place foremployees to wash their hands.

(e) Proper facilities shall be provided by the em-ployer so that clothing of employees, taken off duringworking hours, may be protected from the dust andfumes of the workroom.

(f) If artificial light is in use, effective shades shallbe provided by the employer to prevent eye strain. Arti-ficial light shall be so situated as to enable the em-ployees to work without unnecessary strain to the eyes.

1.7.Preference to Unionists.(No agreement was reached on this clause. It was

agreed, however, to register this Agreement subject tothe preference clause being submitted to an IndustrialBoard.)

18.Termination of Employment.Except as to casual workers, the employment is ter-

minable on either side by one week's notice given onany day or by payment of one week's pay, but for thefirst month of employment the hiring shall be from dayto day and during that period a day's notice or a day'spay shall be sufficient.

19.Definitions.When used in this Agreement, "Journeyman" shall

mean a worker 1% Ito has served (5) years in the indus-try: Provided that special arrangements shall be madebetween the Union and the employer in regard to anyperson employed in the Industry for twelve months priorto the date of this Agreement. Failing a satisfactoryarrangement the matter to be referred to the Board ofReference.

"Permanent employees" shall mean any worker whohas completed one (1) mouth's continuous employment.

20.Work not to be taken off Employer's Premises.No work shall be taken off the employer's premises to

be executed by any employee.

21.Board of Reference.(i) For the purposes of this Agreement, a Board of

Reference is hereby appointed, consisting of a Chairmanand (2) two representatives of the employers and (2)two representatives from the Union, nominated by theparties.

(ii) The parties shall submit the name or names ofpersons from whom the Chairman may be chosen by theCourt of Arbitration, but the Court may appoint anyother person as Chairman.

(iii) The Board shall hold its deliberations in pri-vate, unless the majority of the representatives of theparties or the Chairman otherwise decides.

(iv) A majority of the members, one of whom mustbe the Chairman, shall constitute a quorum.

(v) The Board may sit at such times and places asthe majority may decide and may adjourn from timeto time and from place to place.

(vi.) A member may resign at any time by certifica-tion in writing signed by him and served upon the Regis-trar of the Court. Any party may at any time vary itsrepresentatives and fill any vacancy.

(vii) All meetings of the Board shall be convenedby the Chairman by notice served upon the membersthereof.

(viii) The decision of the Board shall be the decisionof the majority of the members and shall be signed bythe Chairman and forwarded to the Clerk of the Court,who shall forthwith notify the parties.

(ix) The decision of the Board may be reviewed andaltered by the Court on application of any of the parties:Provided that notice of an application to the Court toreview such decision shall be given within seven daysfrom the date thereof to the Chairman and the oppositeparty and the application lodged with the Registrar ask-ing for such review within fourteen (14) days of such

decision: Provided further, that all parties shall abideby the decision, unless and until the same is altered bythe Court.

(x) The functions of the Board shall be :(a) to settle, and/or determine any matters left to

the decision of the Board by this Agreement;(h) to settle, allow, determine and deal with any

matter or thing which the Court may fromtime to time refer to the Board;

(c) subject to the jurisdiction of the Court ofArbitration, generally to settle and/or deter-mine any dispute or questions arising out ofthis Agreement, except a matter involvingthe interpretation of any of the terms thereofor any variation in the rates of wages or anyother term thereof, excepting the matter re-ferred to in Clause 19 of this Agreement.

22.Apprentices.(1) The maximum numl,er of apprentices allowed to

any employer shall be in the proportion of one to everythree or fraction of three journeymen employed in any-one section by him. Provided that, where an employerhas two or more permanent journeymen employees indepartment, special arrangements may be made betweenthe Union and the employer as to what may he deemed_to he the quota. For the purpose of ascertaining the!umber of apprentices allowed to be taken at any time,the :LVOrtWe number of journeymen employed on allworking days of the twelve months immediately pre-ceding such time shall be deemed to be the number of.journeymen employed. Where all employer is himselfa journeyman working at the trade, lie shall he countedas a journeyman for the purpose of computing the num-ber of apprentices allowed.

The maximum number of apprentices shall not exceedfour (4) in any one section.

(2) The period of apprenticeship shall be for five (5)years.

(3) The minimum weekly wage payable to an appren-tice shall be:

(4) An apprentice shall be apprenticed to learn andshall be fully and thoroughly taught and instructed bythe employer ill one at least of the following branchesof the industry:

(i) Operating;(ii) Printing;(iii) Half-tone etching;(iv) Line etching;(v) Mounting, routing and finishing.

(5):(i) An apprentice to operating shall be taught and

instructed in the coating, sensitising, develop-ing, fixing, reducing and intensifying ofnegatives; the exposure of fine and coarsescreen (half-tone offset and line), wet and/ordry plate negatives, and the use and careof camera, screens, stops and filters.

(ii) An apprentice to printing shall be taught andinstructed in the preparation of and use ofsensitised and enamel printing solutions forcopper and zinc; and polishing, graining,coating, whirling, exposing and fixing underline and half-tone and offset, wet and dryplate negatives of zinc and copper plates,and stripping, ruling and ghosting of nega-tives and the use and care of arc lamps (andguillotine). He mast be taught all formulaeof solutions used in printing zinc, copper andoffset; he must lie taught the correct methodof printing from negatives, line half-tone dryplate and offset.

(iii) An apprentice to half-tone etching shall betaught and instructed in the etching of coarseand fine screen half-tone zinc and copperplates, and the use and care of acid and acidbaths.

(iv) An apprentice to line etching shall he taughtthe proper care and use of acid baths andmachines, ink rollers and slabs. He must betaught and instructed in the dusting and roll-ing methods of etching line, copper and zincplates, retouching, and stopping out for tints.

(v) Au apprentice t;o routing, mounting and finish-ing must be taught the proper care andoperation of such machines as:Router, saw,type-high heveller-planing machine, jigsaw,trimmer, and proof press, also bevelling andplaning by hand where there are no machines.

Ile must be taught mounting of zinc, cop-per and steel plates, including the mountingof colour plates in register. Finishing meansproofing of black and white. His instructionmust include piercing, anchor and vignette,Int:muting and proofing. In the last year ofhis apprenticeship he must be given theopportunity of learning colour proofing inpremises where this class of work is carriedout.

vi) Colour work applicable to each section shall betaught, the apprentices of that section dur-ing the last twelve months of his appren-ticeship.

(vii) Provided that, where any process above-men-tioned is not carried out in the ordinarycourse of business on the premises, the pro-vision as to training need not apply.

(6) An employer shall be deemed to undertake thetidy which he agrees to perform as a duty enforceablelimier this Agreement-. The employer of every appren-tice slinll keep him constantly at work and teach suchapprentice, or cause hint to he taught the industry, craftoccupation, or calling in relation to which he is boundtilquentice, by competent instruction in a gradual andcomplete manner, and, he shall give such apprenticereasonable opportunity to learn the same, and receive,during the term of his apprenticeship, such technical,n'Ilde, and general instruction and training as nuty benecessary. And every apprentice shall, during the periodof his apprenticeship, faithfully serve his employer forthe purpose of being taught the industry, craft, occupa-tion or en tiing in relation to which he is bound, andshall also conscientiously and regularly accept suchtechnical, trade, and general instruction and training asaforesaid, in addition to the teaching that may be pro-vided by his employer.

(7) A Board of Reference, to be called the "Appren-ticeship Board," is hereby constituted, to consist of aChairman and six other members, three to be nominatedby the Metropolitan Master Process Engravers' Associ-ation and three to be nominated by the Printing Indus-try Employees' Union of Western Australia industrialUnion of Workers, Perth.

(8) The ,functions of the Board shall be as follows:--(i) 'I'n advise the Court as regards apprenticeship

matters in the Process Engraving Industrywithin the area covered by the Agreement and,in particular, on the following, heads:

(a) The appointment or re-appointment of exam-iners.

(b) The preparation of a syllabus for the courseof instruction from time to time.

(e) The methods of instruction to he followed.(d) The conduct of examinations of apprentices.(e) Schemes for the institutions of scholarships

and prizes.To receive monthly or other periodical re-

ports front the instructors for the purpose ofamending or correcting any laxity in attend-ance or conduct of apprentices at classes of in-struction.

To assist in selecting the best type of appren-tice and to advise upon ability of any person,firm, or company to effectively train an ap-prentice or apprentices, and to encourage andfoster the study of subjects bearing upon thetrade or occupation in the evening classes orother classes instituted for the purpose.

To advise the Court and parties interested asto what additional plant is required from timeto time for the effective training of appren-tices.

To assist in the promotion of classes for in-struction in branches of the industry notalready provided for.

To formulate and submit to the Court ascheme for the instruction of country appren-tices.

To consider and recommend improvementsin the training of apprentices from time toti me.

(ii) The Apprenticeship Board shall hold its delibera-tions in private, unless a majority of the re-presentatives of the parties or the Chairmanotherwise directs.

(iii) A majority of members, one of whom must bethe Chairman, shall constitute a quorum: pro-viding that, in the ease of differences ofopinion between members representing the saidUnion of workers and members representingthe said Union of employers, the decision ofthe Chairman shall be accepted and taken asthe decision of the Apprenticeship Board.

(iv) The Apprenticeship Board may sit at such timesand places as the majority may decide andarrange from time to time, and place to place.

(v) The decision of the Apprenticeship Board maybe reviewed and altered by the Court on theapplication of any of the parties: providedthat notice of an application to the Court toreview such decision shall be given within sevenclays from the date thereof to the Chairman andthe opposite parties and the application lodgedwith the Registrar asking for such review, with-in fourteen days of such decision; providedfurther, that all parties abide by the decision;unless and until the same is altered by theCourt.

(vi) With the consent of the Court, either party mayat any time vary its nomination of represen-tative members.

(9) Every apprentice shall be employed on probationfor a period of three months, to determine his fitnessor otherwise for apprenticeship, and shall work only forsuch hours per day and for such remuneration as maybe prescribed by this Agreement. In the event of hisbecoming an apprentice, such probationary period shahbe counted as part of the term of apprenticeship.

Before completing such probationary period, the pro-bationer shall submit himself to an eyesight test andobtain a certificate of his fitness to be apprenticed tothe trade, and a copy of such certificate shall be at-tached to the notice of registration of the apprentice-ship.

(10) An employer taking an apprentice on probationshall, within fourteen days thereafter, register suchprobationer by giving notice thereof to the Registrarin the prescribed Form 1 (a) in Appendix, and if atthe date of coining into operation of this Agreementan employer is employing an apprentice or probationerwho has not been duly registered as such, he shall forth-with apply for the due registration of such apprenticeor probationer.

(11) The Court may, in any case where it seems expe-dient to do so, order that the probationary period Hofemployment be extended for a further period not ex-ceeding three Months.

(12) The Apprenticeship Agreement shall be com-pleted within fourteen days of the termination of theprobationary period.

(13). All agreements of apprenticeship shall be drawnup on Form 6 in Appendix, and signed by the employer,the legal guardian of the apprentice, and apprentice. Noemployer, guardian, or apprentice shall enter into anyagreement or undertaking purporting to add to, vary,alter or amend any such Agreement without the appro-val of the Court.

(14) The Agreement shall be executed in triplicate;and one part shall be held by the employer, one shallbe held by the legal guardian of the apprentice, and oneshall be retained by the Registrar.

(15) Every Agreement of Apprenticeship shall besubject to the provisions of the Agreement in force forthe time being applicable to apprenticeship in the in-dustry.

(16) Every Agreement of Apprenticeship entered intoshall contain:

(a) the names and addresses of the parties to theagreement;

(b) the date of birth of the apprentice;(c) a description of the industry, craft, occupation

or calling or combination thereof to which theapprentice is to be bound;

(d) the date on which the apprenticeship is to com-mence and the period of apprenticeship;

(e) a condition requiring the apprentice to obey allreasonable directions of the employer and re-quiring the employer and the apprentice tocomply with the terms of the Industrial Agree-ment, so far as they concern the apprentice;

(f) a. condition that technical instruction, whenavailable, shall be at the employer's expenseand shall lie in the employer's time;

a condition that, in the event of any apprenticein the opinion of the examiners not progressingsatisfactorily, increased time for technical in-struction shall be allowed at the employer'sexpense, during the fifth year of such appren-ticeship, to enable such apprentice to reach thenecessary standard;

(h) the general conditions of apprenticeship.(17) The Court may order the transfer of an appren-

tice from one employer to another, either temporarilyor permanently:

(a) if the employer does not provide the necessaryfacilities for the apprentice to become pro-ficient in his trade, or

(b) upon the application of the employer or theapprentice for good cause shown.

(is) The transfer of every apprentice shall be onForm 2 in Appendix and shall be made out in quadrupli-cate, and shall, unless the Court otherwise directs, besigned by the late employer or his assigns, the legalguardian of the apprentice, the apprentice and the newemployer. The transfer ferns shall be completed withinone month of the date upon which the transfer is orderedto be effected.

(19) The document of transfer shall be held one partby the late employer, one by the new employer, one bythe legal guardian of the apprentice, and one shall besupplied by the employer to and be retained by theRegistrar.

(20) Should an employer at any time before the de-termination of the period of apprenticeship desire to dis-pense with the service of the apprentice he may, withthe consent of the apprentice and guardian, transferhim to another employer carrying on business withinreasonable distance of the original employer's place ofbusiness, qualified and willing to continue to teach theapprentice and pay the rate of wages prescribed bythe Agreement, or otherwise, according to the total lengthof time served, and generally to perform the obligationsof the original employer.

(21) Every agreement' shall include a provision thatit may be cancelled, by mutual consent, by the employerand the legal guardian of the apprentice giving onemonth's notice in writing to the Court and to the partiesconcerned that such apprenticeship shall lie terminated.

(22) On the transfer or termination of any- appren-ticeship from whatever cause, the employer shall give theapprentice a certificate stating what time he has served,full particulars of the :branches of the trade or industryin which he has received instruction, the proficiencyattained, and shall also notify the Clerk of the Courtat the cause thereof.

(23) When an apprentice is discharged for cause theemployer shall send notice in writing of the dischargeand the cause thereof to the Cleric of the Court in Form8 in the Appendix.

(n) Na apprentice employed under a registeredagreement shall lie -discharged by the em-ployer for alleged misconduct until the regis-tration of the agreement of apprenticeshiphas been cancelled by order of the Court, onthe application of the employer.

(b) It shall not be obligatory to find the appren-tice another employer if he shall so miscon-duct himself as to entitle the employer to dis-charge him.

Provided, however, that an apprentice may be sus-pended by the employer for misconduct, but in any suchcase, the employer shall forthwith make an applicationfor cancellation of the agreement of apprenticeship, andin the event of the Court refusing same, the wages ofthe apprentice, or such portion thereof as the Court mayorder, shall be paid as from the date of such suspensionand, in the event of the application being granted, suchorder may take effect from the date when the apprenticewas suspended.

(24) Subject to regulation thirty-nine (30, time lostby the apprentice through sickness or any other causewhatsoever, may, with the consent of the Court, on theapplication of any party, be added to the original termin the Apprenticeship Agreement.

(25) In the event of an employer being unable toprovide the work for the apprentice, or to mutuallyagree with the legal guardian of the apprentice to cancel

the agreement or arrange a transfer, application mayhe made to the Court to arrange for such transfer orto have such agreement cancelled.

(26) Where in any case an employer is temporarilyunable to provide work to employ an apprentice for Isisfull time, application may be made by the employer tothe Court for permission to employ the apprentice onother work in the factory or establishment.

(27) Every apprentice shall attend a Governmenttechnical school, vocational classes, or classes of instruc-tion, where provided, for instructions in such subjectsas are deemed necessary for his branch of the trade. Heshall be allowed necessary time off during his ordinaryworking hours to attend such classes. Any apprenticefailing to attend such classes when given time off forthat purpose, shall be deemed to have unlawfullyabsented himself from his employment and may have hiswages reduced accordingly.

(28) The fees for the classes attended by the appren-tice shall be paid by the employer.

(29) The period during which apprentices are toattend such technical school or classes shall be fourhours per week.

(30) Where instruction is provided for any branch ofthe trade, the method of training shall be as follows:

(a) The name of each apprentice, as soon as he isregistered as such, shall be forwarded by theClerk of the Court to the ApprenticeshipBoard, which shall keep a. waiting list of suchenrolments.

(b) The full course of instruction shall be designedto cover the first, second, third and fourthyears of the apprenticeship term: providedthat, in the event of failure to satisfactorilycomplete such course by the end of the fourthyear's instruction, the term may be extended(see Regulation 16 (g)).

(c) Each year's instruction shall be divided intotwo terms, ending June and November re-spectively.

Each session of instruction shall consist offour hours weekly.

The syllabus covering the whole four years'period shall be drawn up by the instructorsin collaboration with the ApprenticeshipBoard.

The instructors shall complete the course setdown by the syllabus for each term in timeto hold the terminal and annual examinations.

All practical work given out by the instructorsshall be entered upon a "Work Docket," andthis, with the student's first proof and finalproof shall he examined by the instructor,allotted the deserved number of marks, andcarefully preserved in a "Dossier," for refer-ence during and at the completion of hisstudent course. These practical tests shallbe recorded on a Special Form, which maybe inspected from time to time by membersof the Apprenticeship Board, who shall havethe right to snake periodical visits of in-spection during class hours.

(h) The instructors shall forward to the Appren-ticeship Board a monthly report of theattendances and conduct of students, suchreport to be in the hands of the secretary ofthe Board by the seventh day of the follow-ing month.

(31) Every apprentice shall be bound to submit him-self to examination by the examiners hereinafter pro-vided for.

(32) The Cleric of the Court shall notify examinersof the names and addresses of the apprentices requiredto submit themselves to examination.

(33) The examiners shall be persons skilled in thessdustry, one shall be nominated by the employers and

one by the workers, for each particular branch of thetrade. Failing such nomination or nominations, theCourt may appoint such person or persons as it maydeem fit. In the event of a disagreement between theexaminers, the matter in dispute shall be referred to theApprenticeship Board, at the request of any one of theexaminers, and the decision of such Apprenticeship Boardshall be final and conclusive.

(34) It shall be tlse duty of the examiners to exam-ine the work, inquire into the diligence of each appren-tice, and, where any apprentice fails to show progress,to inquire as to the opportunities provided by the em-ployer for such apprentice to learn, and to submit a

report to the Court in writing as to the result of theexamination within fourteen days from the date ofholding; the examination.

(33) Such examination shall include theory and prac-tice as applied to the trade, industry, craft, occupation,or calling to whirls the apprentice is indentured.

(36) The method of conducting the examination ofapprentices in those branches of the trade where techni-cal instruction is provided shall be as follows:

(a) Except in the case of the first examination, noapprentice shall be examined unless he hasgained a pass in the previous examination.

(b) The whole of the practical work of the examin-ation shall be performed at the technical schoolclassroom. (In those branches of the tradewhere no technical instruction is provided, theexamination shall be held at the factory wherethe apprentice is employed, and it shall bethe duty of the employer to provide such neces-sary material and machinery as may be re-quired and in all ways facilitate the conductof such examination.)

(e) The terminal (June) examination shall be fortheory only, and shall be conducted by the in-structors during the last week but one pre-ceding the end of the term. The questionsshall also be set out by the instructors, andthe written answers checked, and the deservedMarks allotted. These, with easel student'spractical work for the term under review, shallbe handed to the examiners, who shall approveor otherwise of the instructor 's decisions. Anydifference of opinion that cannot be agreedupon mutually shall be referred to the Appren-ticeship Board, whose decision shall be final.

(d) The examiners shall, during the month of June,make their annual visit of inspection to eachfactors- where apprentices are employed, andpersonally interview the employer( or foreman).and also the apprentice and shall satisfy them-selves as to the assiduity of the apprentice inhis daily work, and especially as to the facili-ties afforded lsim to enable him to make therequired progress in his particular branch ofthe trade.

(e) The examiners shall :present a report to the Courtas to the progress made by the students duringthe term, and at the same time forward acopy to the Apprenticeship Board. The ter-minal report shall also cover their inspection offactories.

(f) The annual examination shall take place in No-vember. The test papers shall be set by theexaminers in collaboration with the instruc-tors. The practical tests set during the termshall be checked by the examiners, who shallalso set each student a special practical test,which shall be performed under their directsupervision at the technical school classroomduring the second week of the examination.With these three results before them, viz., thewritten answers of the theory examinations,the term's progressive tests already marked bythe :instructors, and the special test judgedby themselves, the examiners shall draw uptheir annual report and submit same to theCourt at least three days before the date fixedfor the final day of the term. A copy of sudsreport shall be forwarded to the Secretary ofthe Apprenticeship Board.

(g) Marks shall be awarded for these examinationsas follows:

A first-class certificate shall be granted toall who secure 90 per cent. and over of marks.A second-class certificate shall be awarded tothose who secure 80 to 89 per cent. marks,while 70-79 per cent. shall entitle a student toa pass. Less than 70 per cent. marks shallnecessitate a student continuing his studiesanother term.

(h) At the conclusion of the student's course, heshall sit for his final examination, which shallbe conducted entirely by the examiners. Astudent securing marks totalling 96 per cent.and over shall be deemed to have attained"Honours" and shall be entitled to receive anadditional "Honours" certificate. A first-class certificate shall be granted to all whosecure 90 per cent. and over of marks. Asecond-class certificate shall be awarded tothose who secure 80 to 89 per cent. marks,

while 70 to '70 per cent. of marks shall entitlea student to a pass. Less than 70 per cent.of marks shall necessitate a student continuinghis studies another term.

(i) The Registrar shall, after each examination, issuea certificate to each apprentice indicating (onForm 4 in the Appendix) the result of hisexamination, and the final certificate in Form5 in the Appendix.

(l) If the examiners report to the Court that anyemployer has not provided sufficient opportun-ity for the apprentice to learn, the employershall be deemed prima facie guilty of a breachof this Agreement. Upon any proceedingsagainst him in respect of such a breach thereport may be received in evidence.

(k) Any apprentice claiming to have cause for com-plaint regarding instruction, either in techni-eal school or in workshop, shall have the rightto appeal to the Apprenticeship Board.

(37) Such fees shall be paid by the Clerk to theexaminers as the Court shall allow.

(38) The employer shall pay the apprentice, in re-spect of time lost through compulsory military or navaltraining, the amount (if any) by which wages prescribedby the Industrial Agreement for the trade, calling, oreraft, occupation or industry exceeds the amount re-ceived by the apprentice from the Department of De-fence: provided, however, that this clause shall notapply to military or naval training imposed throughfailure to attend compulsory parades.

(39) All time lost by reason of compulsory militaryor naval training, other than the additional trainingmentioned in the above proviso, shall count as part ofthe apprenticeship.

(40) When an apprentice attends a technical schoolduring his ordinary working hours, the time so occupiedshall be regarded as part of the term of his apprentice-ship, and the employer shall not be entitled to make anydeduction from the wages of the apprentice for suchtime.

(41) If the Apprenticeship Board makes represen-tations to the Court that the facilities provided by thetechnical school or other place of vocational training forthe teaching of apprentices are inadequate, the Courtmay make such investigations and such report to theMinister controlling such technical or other such place,as it deems necessary.

(42) The term of apprenticeship may be extended bythe Court on the failure of an apprentice to pass anyof the examinations, and for such purpose it shall bethe duty of the examiners to make any necessary recom-mendation to the Court. Any extension of the term ofapprenticeship shall be subject to all the conditions andstipulations in the original Agreement, except as torates of wages, which shall be of such amount as theCourt may determine.

(43) Upon the failure of an apprentice to pass twoconsecutive examinations, it shall be the duty of theexaminers to report same to the Court, with a recom-mendation as to such remedial measure as they maydeem advisable. The Court, after notice to all partiesconcerned, may cancel the Agreement or make suchother order in the circumstances as it may deem neces-sary.

(44) The wages of an apprentice under this Agree-ment are subject to alteration by the Court when thewages of journeymen under this Agreement are re-viewed.

not do or suffer to be done or committed anywaste, damage, or other injury to the propertyor goods of the said employer, or any firm orcompany of which he may be a member, or sellor lend them to any person without the con-sent of the said employer;

not unlawfully absent himself from the service ofthe said employer during working hours;

not by word or action induce other apprenticesto disobedience;

duly perform and observe the covenants, condi-tions, and stipulations contained in the nowcurrent Industrial Agreement so far as thesense relate to the Apprenticeship.

(1) The apprentice shall not be entitled to receiveany pay for any time during, which he shallfrom any cause whatsoever be absent from theservice of the said employer without leave.

(2) Time lost by the apprentice through absencefrom any cause whatsoever shall be added tothe terns of this Agreement, and so that theamount of such lost time during any six-monthly period shall be made up before thenext ensuing period of six months shall bedeemed to commence.

If at any time during the said term the saidemployer shall die or cease to carry on hisbusiness aforesaid as now carried on by him,he or his executors, administrators, or assignsshall be at liberty within one month from thedate of such death or ceasing to carry on, toassign or transfer the said apprentice to someother employer upon and subject to the sameor the like conditions and stipulations as areherein contained: Provided that, if the saidemployer or his executors, administrators, or

assigns as aforesaid shall not within the saidperiod of one month be able to find anothersuch employer able and willing to accept theapprentice, then the said employer or his exe-cutors, administrators, or assigns as aforesaidshall have the right to discharge the saidapprentice and to terminate this Agreementby giving the said apprentice one week's noticein writing.

(4) That if the employer shall remove his businessto some place beyond the radius of three milesfrom his place of business at the date thereof,the parent and the apprentice may, within onemonth of such removal, by notice in writing,elect to have the apprentice transferred to someother employer within the said radius, if therebe one such able and willing to accept theapprentice, and on receipt of notice in writingof such election, the employer will use his ut-most endeavours to find such an employer andto obtain the transfer of the said apprentice,and it is further agreed, that if at the expira-tion of three months from date of such elec-tion there shall not have been found anothersuch employer able and willing forthwith toaccept the apprentice, then the parent and theapprentice, may by a further notice in writ-ing, claim to have this Agreement terminated.

(ii) If at any time during the said term the saidapprentice shall neglect or refuse to obey thelawful commands of the said employer or hisrepresentative, or shall commit a breach of anyof the covenants on his part herein contained,the said employer shall have the right, subjectto confirmation by the Court, to discharge thesaid apprentice and to terminate this Agree-ment by giving the said apprentice one week'snotice of his intention to do so.

(0) That upon the termination of this Agreement byany means before the expiration of the saidterm and confirmation by the Court, no pro-ceeding,s shall be taken by any one partyagainst the other or others in respect of any-thing width has taken place before the date ofsuch termination.

This Agreement may be cancelled by mutual con-sent by the employer and the legal guardian ofthe apprentice giving one month's notice inwriting to the Court.
