(2.1 km) of Holman Road and make pedestrian safety improvements from Greenwood Ave. N. to NW 87th Street. Additional work includes sidewalk spot repairs, curb ramp installations, bus zone and bus shelter improve- ments and bridge expansion joint replacement. Bus stop improvements include light- ing and new facilities. DESPITE OPPOSITIONState transportation officials are pushing for construction of a toll road in North

Texas even though many towns near the planned route are condemning the

project. The Northeast Gateway is part of the state’s 10-year plan for

transportation projects. It would extend from the Dallas suburb of Garland

northeast to Greenville.

AEMP Certifies Ecco Equipment GreenBy Lori TobiasCEG CORRESPONDENT

The Ecco Equipment Corporationmay not be the biggest equipmentrental business out there, but they canclaim a distinction that is perhaps evenbetter. The company recently earnedthe right to call itself the largest equip-ment rental company to be certifiedgreen by the Association of EquipmentManagement Professionals. It’s thesecond time Ecco has achieved the sta-tus, but this time they moved up a level,earning silver over the previous bronze.

It’s exactly what AEMP hopedmight happen.

“By aiming for higher, clearlydefined levels, the AEMP green fleetcan give a company a solid goal toattain,” said Sara Sanderman, AEMPvice president of education and certifi-cation. “They’ll say, ‘Ok, we’re bronze.Here’s what our fleet looks like. Let’ssee if we can get silver in two years.’Ecco is a great example of that.”

Ecco President David Schmidagreed the program was a great moti-vation.

“When we first qualified, we were atthe bronze level and we had set a goalto reach the silver level in two years,”he said. “The program worked asintended where it did motivate us toreach certain milestones in terms ofour fleet composition. We had toturn over more of our older fleetand replace it with newer machinesso we could reach that goal.”

The certification program isused to recognize green fleets andthe fleet managers who activelypursue a greener fleet, and to highlightthe fact that they have gone above andbeyond current regulations to reduceemissions, Sanderman said.

The AEMP requirements for the 4Green Levels for Off Road 2014Certification the four green levels are:

• 2014 Bronze Status: 50 percent ofFleet Tier II and a Written Idle Policy

• 2014 Silver Status: 50 percent TierII and 25 percent Tier III and a WrittenIdle Policy

• 2014 Gold Status: 75 percent TierII and 50 percent Tier III and a WrittenIdle Policy

2014 Platinum Status: 75 percentTier II and 50 percent Tier III and 25percent Tier IV OR Equivalent AfterTreatment Devices or Hybrid and aWritten Idle Policy

AEMP began the program in 2010and has certified 15 different entities asgreen. “We have everything from

waste management companies, cityfleets, large construction companiesand even some military fleets,”Sanderman said.

Not only does a green fleet lead to acleaner environment, it is something ofa public relations boon to the wholeindustry.

“The construction industry andheavy equipment industries are often

perceived as unclean and major con-tributors to emissions,” she said.“We’re trying to create a more accurateimpression of how fleets really are.”

Ecco never made a sudden decisionto go green, Schmid said. “It was justan evolution. We could do this andreduce our footprint and promote our-selves as being a little more responsi-ble. Where we saw opportunities to dothat we did.”

When they first learned of the certi-fication program, they already had thewritten anti-idle policy in place. “Wethought, well we’re already half waythere. It was not quite that easy. It’squite a chore to submit your fleet anddocumentation to determine if youqualify. Now every time we make achange in our fleet, we update on line.”

It can also be costly. “We’ve got older machines that are

at a tier one level and we are trying to

sell those for $140,000. The replace-ment machine which would be tierfour, that’s going to run you $700,000,but they push the same amount of dirt.We have to do a certain amount of thisto stay competitive. People don’t wantto rent old tired equipment. Even with-out the green aspect, we would have acertain amount of upgrade we wouldneed to do. To do it at the pace we do it

definitely adds a lot of expense.”But despite the extra work and

cost, Schmid believes it is wellworth it. He promotes his greencertification in advertisements andwhen people don’t know what it is,his staff takes the time to engagethem in a conversation about it.

“If you are outside of the construc-tion industry and you are looking at allthese big machines, it’s pretty easy tothink these guys are raping the environ-ment,” he said. “If you are an environ-mentalist, you might have a naturalanimosity for people in our industry.By being as environmentally consciousas we can, it might help soften that ani-mosity and help people to see we areresponsible members of the communi-ty.

“It’s something we’re proud of, thatwe’ve gone to the trouble to do it andnobody else does, so we stand out inthat way. We are certainly not thelargest rental fleet around, but we arethe largest that’s bothered to get our-selves certified this way.”

DALLAS (AP) State transportation officials are pushingfor construction of a toll road in North Texas even thoughmany towns near the planned route are condemning the proj-ect. The Northeast Gateway is part of the state’s 10-year plan

for transportation projects. It would extend from the Dallassuburb of Garland northeast to Greenville. The Dallas Morning News reported that state Rep. Cindy

Burkett, R-Garland, sent a letter to the Texas TransportationCommission arguing it hadn’t taken “into account publicinvolvement.” Towns such as Fate, Rockwall and Wylie have criticized

the project. The North Central Texas Council of Governments

reversed an earlier recommendation to include the road in theregion’s transportation plans. The gateway is being developed by private company

Texas Turnpike Corp., which has authority to use eminentdomain.

More Than 700 Exhibitors Participate in 2014 GIE+ExpoMore than 700 exhibitors displayed their equipment

at the 2014 GIE+Expo, which was held at theKentucky Exposition Center in Louisville on Oct.

23 and 24. The event also featured a Dealer Preview Day onOct. 22nd.

Attendees and dealers had an opportunity to get a firstlook at plenty of new machines as several manufacturerschose the show to debut their latest equipment. Gravely, anAriens Company brand, unveiled the new job site vehicle(JSV), the Atlas. Caterpillar’s indoor and outdoor displaysfeatured several new machines and accessories, including thenew Cat 303E CR and Cat 305.5E CR mini hydraulic exca-vators and the new Cat 903C compact wheel loader.Case Construction Equipment introduced the new TR310

Alpha series compact track loader, offering a midsized framewith wider tracks with a counterweight for greater liftingcapacity. JCB’s new 86C compact excavator and new 3CXbackhoe drew a lot of attention at the show.Toro unveiled the new steering-wheel Z mower and stand-

on sprayer.Gravely also held a special press event at the Buffalo

Trace Distillery before the show to give editors an up closepreview of the Atlas job site vehicle with presentations con-ducted by factory representatives and hands on demonstra-tions of the new vehicle. The Atlas is the product of a strate-gic alliance with Polaris. Design and engineering was con-ducted by Ariens while production of the Atlas JSV is under-taken by Polaris. The vehicle features a 1,750-lb. (793 kg)payload and 2,000-lb. (907 kg) towing capacity, and isoffered in two models, the Atlas JSV-3000 with three person

76 years, WITZCO Challenger trailershave been manufactured with thepromise of excellence. How can a busi-ness last for more than seven decadesand continue to be successful? WITZCO Trailers Inc., named after

its founders Israel and Rebecca Witzer,was founded in 1938 in Philadelphia,Pa., under the name IR WitzerCompany. It began as a simple steelworkshop that produced artistic sculp-tures and small household items. Paving the WayLakeside, the paving subcon-

tractor, oversees a substantial por-tion of the project that involvesequipment such as an EX-75Hitachi excavator, an asphaltpaver, an asphalt grinder, a con-crete grinder, a 580 Case backhoewith breaker and numerous dumptrucks.That equipment is being used to

place 5,000 tons (4,536 t) ofasphalt to create 2,000 sq. yds.(1,672 sq m) of sidewalk, 1,500 LFof curb and 60 ADA ramps.“Paving is weather-dependent,

but under the guidance of generalcontractor WestwaterConstruction, work remains onschedule.” Cruz said, “We’vecommunicated that the projectwould wrap up by the end of sum-mer, which still looks to be thecase. There are a few more mile-stones that need to be reached, butso far the weather has been a bighelp in keeping this project on

schedule. The project has [had]surprisingly great weather. There[have] been a couple of weatherdays, but considering it’s Seattle,that’s a pretty good statistic.”

Work ScheduleWork began the week of April

14, 2014. Normal work hours willbe 7 a.m. to 5 p.m., Mondaythrough Friday, with some week-end and weeknight work. In orderto reduce the impact to surround-ing communities, work has beendivided into two zones and will beconstructed one phase at a time.The first zone of the project is on

Holman Road NW between 7thAvenue NW and GreenwoodAvenue N. The second zone of the

project on Holman Road NWbetween NW 87th Street and 7thAvenue NW began the week ofMay 19. This phase will includereplacing bridge expansion joints,which will require full weekendnight closures in both directions.Working mostly 7 a.m. to 5

p.m., a crew of 8-15 has been keep-ing the project on schedule, butsome nighttime and weekend workhas contributed to maintaining thetimeline. Late night and earlymorning grinding is allowed underthe conditions of a city noise vari-ance. “Residents have had several

nights of grinding and pavingthroughout the project, which hasbeen kept to a minimum as possi-

ble,” said Cruz.The project has even been lucky

in regards to unforeseen issues thatcan often adversely affect a sched-ule. “We had one issue when a utili-

ty line broke underneath a newlypaved surface,” Cruz said, “but itwas not the fault of our project andour inspectors quickly contactedSeattle Public Utilities, who cameout quickly to address the issue.”

Getting AroundOne of the more challenging

aspects has been traffic control. “The most challenging part has

been maintaining traffic controland keeping traffic moving in thearea,” Cruz said. “Holman Road is

a popular commute route for manydrivers from different parts ofSeattle. The most important partwas communicating to that audi-ence. We have maintained at leastone lane of traffic in each directionat all times except for one 24-hourclosure to make bridge repairs.”Some local bus routes were rerout-ed during these closures. Drivers have had to contend

with occasional driveway andintersection closures, parking andloading restrictions near workzones, temporary bus stop reloca-tions or closures and detours forpedestrians and cyclists. During the project, temporary

wheel stops were installed to pro-vide safer passage for pedestriansand bicyclists along Mary AvenueNW and NW 92nd Street. Thisimprovement will be in effect untila new sidewalk is built as part of aSafe Routes to School project in2016.“Drivers have had delays in

their commutes or they have foundalternate routes,” Cruz added.“Since we don’t know exactlywhere many of the drivers arecoming from or going to, portablemessage signs in the roadway andgetting the word out to local mediato publish was important. We setup our messaging early and senttraffic advisories to local mediaoutlets with personal follow up tomake sure the news was shared.”A good community outreach

program has kept complaints to aminimum.

In order to provide drivers with a smoother, more efficient route, extend the life of the roadwayand improve both accessibility and safety for pedestrians, SDOT will grind and repave 1.3 mi. (2.1km) of Holman Road and make pedestrian safety improvements from Greenwood Ave. N. to NW 87thStreet.

In order to reduce the impact to surrounding communities, workhas been divided into two zones and will be constructed one phaseat a time.

The new W 220 cold millingmachine from Wirtgen AmericaInc. rounds out the lineup of high-performance large cold mills fromWirtgen Group, providing thecapabilities of Wirtgen’s largestmachine in a lighter-weightmachine that can be readily trans-ported.The W 220 provides the milling

width and depth of the heavier W250i — Wirtgen’s biggest andmost powerful mill — but with alower weight that enables it tomore easily meet legal weight loadlimits. The W 220 — like the W250i — will mill up to 14 in. (35.5cm) deep, at a nominal millingwidth of 87 in. (221 cm). Its powerplant provides 766 hp, with anoperating weight of 80,160 lb.(136,360 kg). The W 220 can pro-duce up to 900 tons (816 t) perhour of reclaimed asphalt pave-ment (RAP).The Wirtgen W 220 can remove

asphalt layers more than 1 ft. (.3 m)deep — and tough portland cementconcrete pavements as well — at ahigh advance rate. Three differentmilling drum speeds can be adjust-ed from the operator’s platform:high speed for large-scale millingof thin lifts, medium for standardsurface courses and low speed foroptimized fuel consumption andlow cutting tool wear.While the W 220 comes with a

standard 87 in. milling drum width,via the optional FCS Light system,a 98-in. (249 cm) drum can be fit-ted. FCS Light also permits easyexchange of drums with standardtool spacing with those of wider ortighter tool spacings. The standard milling width of

the W 220 can be extended withadditional milling drum units forworking widths of 8.2 ft. (2.50 m),10.2 ft. (3.10 m), 11.5 ft. (3.50 m),12.5 ft. (3.80 m), up to a maximum14.4 ft. (4.40 m).In addition to removing com-

plete pavement sections in a singlepass, the W 220 permits individuallayers to be removed very econom-ically. The intelligent WIDRIVEmachine management system andthe three selectable milling drumspeeds keep operating costs verylow for a cold milling machine inthis performance class. The W 220 operating platform

provides the operator with an opti-mal work environment, whichspeeds productivity and providesan abundance of operating infor-mation. Part of this intuitive oper-ating environment — a multifunc-tional control display — operatesas a practical information hub. Itcan be swung to the left or right ofthe operator — together with theLevel Pro control panel — and dis-

plays operating status and servic-ing data in an easily comprehensi-ble way.The control display provides

user-friendly diagnostic optionswith clear graphics for identifyingthe source of any problem. Anotherhandy function is the logging ofjob data: at the end of the day, thelog can show how many truckshave been loaded and the overalltonnage achieved.The new W 220’s parallel-to-

surface (PTS) system automatical-ly aligns the cold mill parallel tothe road surface. The systemensures simple, accurate operationof the machine in demanding pro-filing jobs. PTS also assists theoperator with positioning themachine in the milled cut to initiate

the milling process. In automaticmode, the system takes care of allthe steps that the operator wouldotherwise need to select manuallyone after another; the need for rep-etitious manual correction is elimi-nated.The operator activates the inte-

gral Level Pro control system atthe flick of a switch, and all fourcrawler track units of the largemilling machine are loweredsimultaneously at high speed.When the milling drum unit reach-es the surface to be milled, the low-ering speed is reduced and themilling drum slowly penetrates thematerial down to the set depth. Theautomatic process helps to preventexcessive cutting tool wear or eventool failure when commencing the

milling operation.The same applies when the W

220 is aligned transverse to thedirection of travel. In many cases,cold milling machines need toovercome significant differences inheight when being moved into orout of the milled cut. The integrat-ed four-fold, full-floating axle bal-ances out all four track units quick-ly and reliably to reduce themachine’s lateral inclination to aminimum. This lends a highdegree of stability to the largemilling machine, according to themanufacturer.The W 220’s intelligent speed

control (ISC) system ensures max-imum traction. The ISC system is particularly

useful for highly demandingmilling jobs. Just like the tractioncontrol system of a car, ISC pre-vents crawler track slip andensures perfect traction of all trackunits to achieve maximum millingperformance, reducing track padwear.When negotiating turns, the ISC

system automatically increases thespeed of the outer crawler tracks,depending on the steering angle.As a result, even extremely tightturns can be milled using the all-track drive. Automatic adjustmentof the advance rate to match thediesel engine load always ensuresmaximum performance yet quietoperation of the machine.An optional vacuum cutting

Crawler Concrete Pump Offers Easy Wear Part AccessThe crawler concrete pump THS 110 D-K

with a concrete output of 133 cu. yds./h (102cu m/h) and equipped with a six-cylinderengine, was unveiled by Liebherr. The seriesof Liebherr crawler concrete pumps encom-passes three different models — the THS 80D-K, the THS 110 D-K and the THS 140 D-K providing maximum concrete outputs of85 cu. yds./h (65 cu m/h) to 177 cu. yds./h(135 cu m/h).

Smooth running and outstanding suctionperformance are the hallmarks of a powerfulpump unit in the crawler concrete pumpTHS 110 D-K, while an open hydraulic cir-cuit guarantees reduced system maintenancerequirements. Additional structural detailsalso contribute to optimum serviceability.

Utmost importance was afforded duringthe design phase to ensure that wear partscould be replaced quickly and easily. More than 2,550 bidders partici-pated online and in person atRitchie Bros.’s unreserved pub-

lic auction at its Phoenix site. Bidders came from 44 countries,

including 48 U.S. states. More than 69percent of the equipment was sold to out-of-state buyers, from as far away asGuatemala, Poland and Vietnam. Onlinebidders purchased 39 percent of the

equipment sold (by dollar value). In total, more than 1,700 equipment

items were sold in the auction, including90 plus scissorlifts, 70 plus truck tractors,70 plus pickup trucks, 30 plus compactorsand more. “We are very pleased with the partici-

pation and results from our Novemberauction here in Phoenix,” said ChrisHolmberg, regional sales manager,

Ritchie Bros. Auctioneers. “The 2006CON-E-CO concrete batch plant whichsold for $270,000 to an on-site bidderfrom Texas was one of the main high-lights of the auction. We also saw strongresults in the crushing and heavy con-struction equipment sectors.”

Industry Adds 231,000 Jobsfor Year; a 3.9 Percent Gainspecialty trades, and heavy and civil engi-neering — experienced an overall gain of3,600 employees for the month and 99,800(2.7 percent) over 12 months.“For the past several months, the con-

struction industry has added jobs at doublethe all-industry rate of 1.9 percent rate,”Simonson said. “Construction wages, whichwere already higher than the private-sectoraverage, rose 2.6 percent in the last year —the fastest rate since early 2010 — as con-tractors ramped up their search for qualifiedworkers.”Simonson added, “There were fewer

unemployed, experienced constructionworkers last month than at any time in thepast eight years. Meanwhile, all constructionemployees worked an average of 39.2 hoursper week, tying the highest mark since thatseries began in March 2006. Together, theseindicators — high weekly hours, low unem-ployment and accelerating wage gains —point to an industry that may be on the vergeof acute difficulty filling key positions.”

Association officials said a survey of near-ly 1,100 member firms released in Octobershowed 83 percent of respondents reporteddifficulty finding craft workers and 61 per-cent said other professional positions werehard to fill. As a result, association officialscontinued to urge federal, state and localofficials to enact the series of measures theassociation identified in its WorkforceDevelopment Plan that will make it easierfor school districts, local associations andprivate firms to establish career and technicaleducation and training programs.“The construction industry has made an

impressive contribution to the nation’semployment gains this year,” said StephenE. Sandherr, the association’s chief executiveofficer. “But those gains are in jeopardyunless schools, colleges and training pro-grams can refill a pool of talent that is rapid-ly drying up.”

Court Will Have‘Negative EffectUpon Industry’manner under Texas law. That liability does not impose extraliability beyond general law. The opinion amounts to anoth-er limitation of the attempt to improperly apply the contrac-tual liability exclusion in the construction context. It includesa discussion of other issues, all of which were resolved infavor of coverage for the insured contractor.“This case will have big picture significance because it

sets out another example of a court beating down the effortto extend the contractual liability exclusion to generalbreaches of contract,” said Patrick J. Wielinski, an attorneywith Cokinos, Bosien & Young in Irving, Texas, who pre-pared an ASA amici brief. “In addition, it also clarifies thescope of the ‘your work’ exclusion to explicitly include dam-age to the named insured’s defective work and preservingcoverage if it was performed by a subcontractor.”Wielinski noted that the opinion indicates that the amount

of property damage need not be excessive. “This could open up coverage where a relatively small

amount of property damage can give rise to significant con-sequential damages such as delay,” he said. “All in all, it wasa good case for construction policyholders, and it may serveto cause the insurance industry to think twice about pursuingthis line of argument, particularly since it lost again in thestate where it had gained the most traction in the Gilbertcase.”In the amici curiae brief filed on July 18, 2014, ASA, the

Texas Building Branch of the Associated GeneralContractors of America, and the Texas Association ofBuilders asked the U.S. appeals court for a panel rehearingto decide whether damages for warranty claims due to an“occurrence” are covered under a standard CGL policy orare excluded from coverage by the “contractual liability”exclusion. “This Court’s opinion … denying coverage for defects in

the construction of the Crownover home will have a pro-foundly negative effect, not only upon the constructionindustry and the insurance brokers and agents that service it,but also upon the ‘consumer’ side of the industry, that is,owners of projects, whether commercial, public or residen-tial,” ASA, AGC-TBB and TAB wrote in the brief. “Amicicuriae respectfully submit that the Court’s opinion misap-prehends the scope of the coverage available to a contractoror builder for completed operations losses under its CGLpolicy. In applying the Contractual Liability Exclusion to theexpress warranty context before it, the Court over-extendedthe exclusion’s scope far beyond the Texas Supreme Court’sopinion in Gilbert …, as clarified and limited by Ewing ….Read together, those two opinions establish that the‘assumption of liability’ that is excluded must exceed theinsured contractor’s liability under general law [Gilbert] andthat the implied warranty against defects, equivalent to theimplied warranty of good workmanship, does not constitutesuch an assumption in excess of general law [Ewing].”For more information, visit www.asaonline.com.(This story also can be found on Construction Equipment
