Annex 2. Declaration of State Aid/ De Minimis

Declaration of State Aid/ De Minimis

The aid being sought is provided under the European Commission Regulation on De Minimis

Aid. Small amounts of State aid, up to 200,000 Euros in any three-year period to any one

enterprise, are regarded as too small to significantly affect trade or competition in the

common market. Such amounts are regarded as falling outside the category of State aid that

is banned by the EC Treaty and can be awarded without notification to or clearance by the

European Commission. A Member State is required to have a mechanism to track such aid

(called 'De Minimis aid') and to ensure that the combined amount of De Minimis aid

payments from all sources to one enterprise in any three-year period respects the 200,000

Euro ceiling. Please provide details of all other De Minimis aid which has been granted to

your company within the past three years. It should be noted that a false declaration by a

company resulting in the threshold of 200,000 Euro being exceeded could later give rise to

the aid being recovered with interest.

Annex 4. Data Protection

Information that we record, including information that you give us, is added to our records. The data supplied will be processed in accordance with the Data Protection Acts 1988 and 2003

You have the right, given by the Data Protection Acts of 1988 and 2003 to obtain a print out of your computer record at any time. You can get this by contacting us. The information we record is used only for the following purposes:

Processing applications. Compiling statistical information to help us plan and improve our services. Analysing information about applicants for other bodies such as Government,

Departments, and producing our own statistics for publication.

Once the grant has been issued, under Article 111 of Commission Regulation (EC) No. 1306/2013, it is a requirement that details of CAP beneficiaries are published on the Department of Agriculture, Food and Marine’s website, the Department and/or the LAG website.

The CAP beneficiaries’ details will include the name of the project promoter/beneficiary, the town where the beneficiary resides or is registered (including postal code if available) and the total amount of public funding received by the beneficiary for the particular year.

Successful project data will be made public and that the data may be processed by auditing and investigating bodies of the European Union and the Member States for the purpose of safeguarding the Union’s financial interests.

Personal information about you will be disclosed only in accordance with Avondhu Blackwater Parnership’s registration under the Data Protection Act. The purpose for which we hold information and the people and bodies to whom we may disclose it are listed in the Register of Data Controllers.
