Subject: Checking of Dual-Membership in respect of re-verification ofmembership for recognition of Engineers Associations.

Ref: Your OM No. 4/1/2013-EC-III dated 11/04/2013 & Corrigendum of evenNo. dated 12/04/2013.

Sir,

Kindly refer to the above cited OM and corrigendum vide which our Association hasbeen asked to submit our claim for dual membership along with documentary evidencewithin 15 days against the list of membership submitted by All India CPWD EngineersAssociation. The OM dated 11/04/2013 contains only the list of members with their namesand offices etc. but the details submitted by that Association like the authorizationforms signed by the members and letters submitted by the Association forwardingtheir names to the respective DDOs and the copies of letters sent by the respectiveDDOs forwarding the subscription (only letter Nos. and cheque Nos. are given in thelist) are not enclosed, without which it is not possible to check the dual membership. OurAssociation has received information from many members whose names figure in theabove list that they never signed and submitted any authorization form to that Associationand the question of deduction of subscription should not arise.

We already submitted an application under RTI Act with the Section Officer, EC-IIIlong back seeking all the details submitted by the above Association in support of theirclaim for membership so that the veracity of their claim can be verified. But it is regrettedthat till date we are not in receipt of the same. It is requested to send all the above detailsto our Association so that we can submit our reply. Obviously all this procedure will definitelytake more time than the 15 days mentioned by you which may be extended to onemonth from the date of receipt of all the information sought by us.

Subject: Irregularities in the transfer and posting of EEs (C).

Ref: Your O/o No. 88 of 2013 dated 24/05/2013.

Sir,Kindly refer to the above cited order which was released on 28/05/2013. It is seen

from the same that there are many irregularities in the orders. Some of which are asunder:

1. No station seniority has been followed as per readiness list. Many seniors wereeither left out or granted repeated retentions whereas their much juniors in thestation have been transferred, in some cases just after 3 years e.g. Sh. B.S.Sandhufrom Chandigarh has been granted 2nd retention even after completion of 5 yearswhereas Sh. Jaswant Singh’s name is totally missing but Sh. Iqbal Singh hasbeen transferred from Karnal just after 3 years in the longest stayee list of NR.

2. Similarly many such cases have been observed in other regions where somesenior EEs have been granted 2nd / 3rd retention whereas their juniors have beentransferred. e.g. Sh. T.Chidambaram from Chennai has been transferred to Vizageven though he has not completed 3 years.

3. EEs whose sons / daughters are in Class-12 have been transferred even though insuch cases retention for 1 year is allowed. e.g. Sh. P.K.Haldar from Delhi and Sh.K.Ganesh from Mumbai.

4. The EEs who have completed hard area tenure have not been granted their choicestation as per rules. e.g. Sh. B.M.Bansal and Sh. Yadvinder Singh from Jammu.

5. At some places the substitutes have not been posted especially in field unitsthereby making their relieving difficult.

6. It is learnt that EEs who have completed more than 3 years tenure in Delhi are notposted to PWD Delhi as they would be due for outside transfer next year. Butsome exceptions have been seen in the list.

7. Rotation between planning and field has not been maintained while issuing stationtransfers as some EEs who hardly completed a few months in planning haveagain been posted in field units on station transfer.

It is requested to look into the above irregularities and correct the same to issueamended orders at the earliest please.

Subject: Abnormal delay in issue of inter-regional transfers of AEs.

Sir,

It is to bring to your kind notice that many AEs (C) & (E) working in ER & WR on theirinter-regional transfers issued in the year 2010 & 2011 have been waiting for their transferback to NR. Many of them have completed their tenures and the rest are going to completethe same shortly. It is learnt that the hard case committee meeting has been held in themonth of April-2013 but the orders are not yet issued and it is requested to release thesame at the earliest.

However it is seen that a few orders are issued in a piecemeal basis now and then,the latest one being O/o No. 89 dated 27/05/2013 in which 9 AEs have been transferredback to NR from ER. Further 2 more AEs have been transferred on 31st May 2013 vide O/o No. 92 of 2013 in which one AE is transferred from Shillong to NR without TA & DA(much before completion of his tenure) and another AE Sh. Anil Kant Gandhi has beentransferred from Delhi to NEZ. It is surprising to note that while the inter-regional transferson regional seniority basis as per the guidelines, from NR to other regions having shortageof AEs, are yet to be done the sole case of Sh. Gandhi has been done even though thereis no shortage of AEs in ER or NEZ as per your own calculations. We fail to understandhow such cases with choice posting to NEZ are being issued when general orders are tobe issued through the designated committee meetings. Many AEs whose names figure inthe IRT readiness list have opted for NEZ / IBBZ in ER but it is learnt that not a singleAE is considered by the committee for posting from NR. Either all such requests are tobe considered on similar lines or the irregular single order of Sh. Gandhi may becancelled.

Due to the delay in issuing IRT orders from NR, the station transfers within the NRare getting abnormally delayed. These delays will result in inconvenience and hardshipto the affected AEs as the academic session is approaching fast and the school admissionof their children at new place of posting will be highly difficult. Hence it is requested toimmediately issue all inter-regional transfers at the earliest.

Letter No CPWDEA/F-7/52 DATED 11/06/2013 to Shri V.K.Gupta, DG, CPWD, New Delhiwith Copy for information & n.a. to the SDG, WR & SDG, SR with a request to upload thelist of station wise vacancies in their regions on website so that the concerned AEs canexercise their choice of posting please.

Subject: Inter-regional transfers of AEs – directions for options.

Ref: Your O/o No. 96 & 97 of 2013 dated 06/06/2013.

Sir,

Kindly refer to the above cited orders vide which many AEs (C) & (E) have beentransferred from NR mainly to WR & SR. The orders state that further posting orders in therespective regions will be issued by the concerned Special DGs. The officers who areunder transfer are to be relieved immediately as per your directions.

From the above it seems that the officers under transfer are to report to the respectiveSpecial DGs of the regions at Mumbai and Chennai after being relieved from their presentposts and they will be reposted to particular stations within those regions by the SpecialDGs. Obviously this procedure involves wastage of time and money for the government asthe officers have to perform two official journeys, one from the present station to theRegional Headquarters and again after their posting to another station in that region whichinvolves double TA & DA as well as waiting time for postings which can be avoided in thepublic interest. Hence directions may be issued from the Directorate asking the officersunder transfer to exercise their options / choices of posting in their concerned regions andsend the same through PIMS as well as by post so that they can be considered forposting in their choice stations by the respective SDGs and they can actually join directlyat the station of posting from their present post. Such practice is already in vogue in thecase of JEs on promotion and the same can be implemented in the present case also.

Being the summer vacation season it is also very difficult to the concerned officersfor undertaking frequent travels due to the scarce availability of reserved train tickets atsuch a short notice. Hence considering all the above points it would be in the publicinterest to issue directions for exercising prior options instead of asking them to report tothe Special DG of the respective regions. It is requested to issue such directions at theearliest please.

Kindly refer to your above OM issued vide No. 6/1/2013-EC.1 dated 20/06/2013 inwhich it was stated that only Chief Executive or the General Secretary of the recognizedservice Associations will be retained at Headquarter or brought to the Headquarter ondemand of the Association. A reference to the GOI, MHA OM No. 23/3/69-Estt.(B) dated08/04/1969 was given in the above OM but the enclosed OM is of different number i.e. 27/3/69-Estt.(B) dated 08/04/1969. In the enclosed OM the underlined portion and the subhead at serial No. 3 are different. In fact the correct OM No. is actually 26/3/69-Estt.(B)dated 08/04/1969 which has been reproduced in the Swamy’s Manual on Establishment &Administration (Copy of which is enclosed herewith for ready reference) which says thatsuch transfer facility should be restricted to Chief Executive/General Secretary and oneother executive member of each of the recognized Association.

According to the above OM from the Swamy’s Manual it is clear that the facility isavailable for one other executive member also besides the Chief Executive / GeneralSecretary. In the past, your Directorate has sought the names and designations of the twoexecutive members (including General Secretary) required by our Association to be retainedin the Headquarter. We have submitted the names of Sh. Bhupendra Singh, President andSh. P.R.Charan Babu, General Secretary to be retained in Delhi as per the above facility.Both the above are still elected for the same posts and they may be retained in Delhi asalready intimated. However the correct OM as enclosed may be circulated for this purpose.

Subject: Posting of AEs in PWD(NCTD).

Sir,

It is to bring to your kind notice that as per the Transfer & Posting guidelines /policyof Assistant Engineers issued by DG, CPWD, the maximum continuous tenure ofposting in PWD (NCTD) for AEs (C) & (E) is 6 years only. After transfer from PWD toCPWD the minimum cooling period for posting back to PWD is 3 years. Both theseperiods have recently been affirmed/confirmed/approved by the Delhi Govt. (Copy of circularenclosed).

It is learnt by us that a few assistant engineers (C) & (E) including the JEs onpromotion who have worked much more than 6 years in PWD and are due for CPWDposting are being posted back in violation of above guidelines. In a particular case, a JE(E) on promotion who was earlier transferred outside Delhi (as he has completed muchmore than Delhi tenure) is being given retention in Delhi on the ground of his ward studyingin Class-XII. As this retention is in order as per the guidelines we have no objection for thesame, but we strongly object any attempt to post the officer back to PWD as he hascompleted more than 12 years in PWD and also in field. As per the guidelines he is due forCPWD posting that too in planning and any violation of the guidelines will not be properand the same will be opposed by our Association. Whatever may be reasons orrecommendations in a particular case, such a gross violation if allowed will not go uncheckedand we will be forced to protest and oppose any such orders.

It is requested to kindly look into the matter and take timely action not to allow suchviolation while issuing the transfer orders which are going to be released shortly.

Subject: Request for grant of meeting.

Reference: Your No. 12/4/2011-S&D/629 dated 10th Oct, 2012

Sir,Kindly refer to your above cited letter vide which the Minutes of Meeting of our

Association held with the then DG were conveyed (copy enclosed for ready reference).More than 10 months period has elapsed since the minutes were issued but no significantdevelopment has been seen on many of the issues and action to be taken by variousofficers in the Directorate is yet to be taken. Long pendency in resolving the grievancesmentioned there in and taking positive action on the demands is causing discontent in ouraffected members which is leading to reduced efficiency and many court cases in searchof solutions. Hence we feel it is high time to review all those decisions taken in the lastmeeting and immediately initiate action on all issues.

We request you to kindly grant us time to discuss the following agenda listing theissues:

1. Immediate restoration of ACP Scheme to allow minimum Grade Pay of ̀ 6600/- toall AEs after 24 years of total service by granting one time individual option tochoose ACP/MACP.

2. Time bound approval of ̀ 7600/- Grade Pay to all eligible AEs & EEs as per MACPSi/c left out cases and review of unfit cases.

3. Immediate adhoc promotions of AE to EE against all existing vacancies i/c cadrereview posts in Civil and Electrical streams in both Diploma and Degree quotas bygetting the stay orders vacated from CAT (PB).

4. Re-designation of the post of AE as Deputy EE as already approved by UD Ministerin line with other posts like ADG(spl.) as Spl. DG, PCE as ADG, D’ Man as Estimatoretc. as per DoPT’s clarification empowering UD Ministry to re-designate any post.

5. Abolition of departmental accounts exams for AEs & EEs by replacing the samewith induction training in accounts on promotion for releasing increments.

6. Removal of anomaly in the initial pay scale of AE by correcting the contradiction inpara 3.4.7 and 7.46.12 of 6th CPC Report.

7. Immediate amendment of Recruitment Rules of AE to EE as per DoPT’s rules byincluding ‘failing which’ clause.

8. Immediate finalization of seniority lists of AEs by pursuing with CAT (PB) topronounce the judgment reserved by them during August-2012.

9. Approval & Notification of amended Transfer & Posting guidelines of EEs & SEswith rotation between field and planning and declaration of IT Valuation/QA postsetc. as sensitive planning posts instead of field posts.

10. Immediate regularization of all adhoc AEs by holding regular DPCs from 2007 to2013.

11. Grant of ` 7500-12000/- scale to all eligible AEs as per seniority and release ofarrears stopped by various PAOs to those AEs/EEs who are already granted thescale.

12. Simplification of manual procedures with enhanced delegated powers to field officersalong with implementation of cadre restructuring and Increase in tender powers ofAEs to ̀ 10 lacs in view of e-tendering.

13. Regularization of adhoc EEs by pursuing the pending writ petitions in Delhi HighCourt and getting the stay vacated.

14. Abnormal delay in entry of higher qualifications in the seniority list and grant of onetime incentive for acquiring the same.

15. Restoration of 37 days strike period while fixing the date of effect of ACP upgradationsas per Audit note and CCA letter.

16. Grant of Design and Planning allowance @ 20% of basic pay to AEs & EEs andcontinuation of Training Allowances etc.

17. Streamlining of Inter-Regional Transfers of AEs as per rules.

18. Special Allowances for projects at Chungthang etc.

19. More measures to make all Headquarter postings attractive.

We request you to kindly grant us a meeting at the earliest to discuss all the aboveissues so that some affirmative action is taken immediately.

Subject : Consideration of Diploma in Engineering as equivalent to Degree after10 years of technical experience and promotion of Diploma AEs andEEs on that basis.

Sir,It is to bring to your kind notice that as per Government of India, Ministry of Education

and Social Welfare (Department of Technical Education) vide their O.M. No. F 18-19/75/T-2 dated 26.5.1977 has decided to recognize a Diploma in Engineering + Total 10 years oftechnical experience in the appropriate field is recognized as equivalent to Degree inEngineering and considering the same valid for the purpose of selection to Gazetted postsand services under Central/State Governments. Copy of the above said O.M. which waspublished in Gazette of India is enclosed for ready reference. Based on the above O.M.the High Court of Punjab and Haryana has given a judgment on 23.12.2009 in various writpetitions in which it was held that all Diploma Holders with 10 years of experience in thedepartment after acquiring Diploma should be considered as equivalent to Degree inEngineering and they should be promoted to the higher post in which the minimumprescribed qualification is Degree in Engineering. Copy of Judgment is enclosed for readyreference.

The Indian Airforce even issued certificates to all such Diploma holders who haveserved the department for more than 10 years considering them as equivalent to Degree inEngineering. Copies of two of such orders are enclosed for ready reference. Hence it isrequested to kindly consider all Diploma holder AEs and EEs in CPWD who have a totalservice of more than 10 years since their joining as Junior Engineers should be consideredequivalent to Degree holders in engineering and promote them as EEs/SEs. It is alsorequested to kindly issue similar certificates to them declaring their Diploma as equivalentto Degree in engineering as has been done by Indian Airforce.

An immediate action in this regard will go a long way to mitigate the hardships beingfaced by Diploma holder engineers in the department who have been denied their welldeserved promotion and other service benefits.

OFFICE MEMORANDUMCompetent Authority is please to issue the following transfer and posting policy for PWDDelhi Engineers:Transfer & Posting Policy for Executive Engineer (Civil) (for other than Project Posts).

1. Executive Engineer (Civil) who have completed more than 6 years in PWD and havebeen transferred out of PWD by CPWD shall be relieved from PWD. However, Iffunctional requirement of PWD so necessitate, then these EE (Civil) may be relievedin phased manner.

2. At the time of joining from CPWD to PWD(i) Those EE (Civil) who have already completed 3 years or more in field unit,

shall be posted in planning. Those EE (Civil) who have already completedmore than 1 year in planning shall be posted in field units.

(ii) For field posting, those EE (Civil) who have completed at least 4 years inbuilding unit in their previous field tenure shall be considered for road posting,starting with EE (Civil) with longest building tenure in previous field posting,depending upon available vacant posts.

2. JEs (Civil) in PWD who have completed 3 years in roads shall be transferred tobuilding to building units. Rotational transfer & posting from category of building &vice versa shall be taken up in order of seniority in PWD of respective categories,subject to administrative exigencies.

3. At the time of joining from CPWD to PWD, JE (Civil) must complete a minimumperiod of continuous 9 years in building units (including CPWD & PWD tenure)before being considered for posting in road units.

4. Minimum cooling period in CPWD shall be three years before being again consideredfor posting in PWD.However, in view of administrative exigencies, posting may be decided by Competent

Authority in relaxation to above said criteria.
