All individuals interested in participating must obtain a Bar Admissions Ceremony Information Packet from the Court Administrator’s Office in Room 614 or request an electronic copy by sending an e-mail to: [email protected]. Criminal History Record Information Act—Discovery— Civil Litigation—Negligence—Expungement.
Plaintiff filed a negligence case against Defendant arising from a motor vehicle accident. Plaintiff sought discovery of criminal records that may have contained information as to Defendant’s behavior and physical condition at the time of the accident. Defendant objected to Plaintiff ’s request and sought a protective order. Defendant argued the records were not releasable per the expungement language of the Pennsylvania Criminal History Record Information Act (“CHRIA”) because the records had been expunged. Plaintiff challenged this argument.
The Court rejected Defendant’s argument. The Court concluded that CHRIA did not apply because Defendant is not a criminal justice agency and any information in his possession cannot be protected by the CHRIA even if such information would be pro-tected if it was sought from a criminal justice agency. Further, the Court reasoned that, even if the CHRIA did apply, investigative information relating to the accident is not ex-pungable under CHRIA. The Court noted that the purpose of the CHRIA is not to protect legitimate evidence, relevant to a negligence case, from being obtained by a plaintiff. Ad-ditionally, the Court reasoned that while expungement provides an individual with some protection from the difficulties that may result from an arrest record, it cannot entirely protect a person from the consequences of that person’s actions.
Accordingly, the Court held that a protective order was not warranted.

I. INTRODUCTION
Before the Court for consideration is the Motion of Defendant, Craig Ellis, for Protective Order filed on June 5, 2018. A Hearing was held on September 13, 2018.
Issue Presented
A. Whether Defendant Is Entitled to a Protective Order Limiting the Scope of Discovery by Precluding Information Related to the
Expunged Record of Defendant From Being Sought or Exchanged Through All Aspects of Discovery?
II. DISCUSSION
In Pennsylvania, the retention of criminal records is governed by the Pennsylvania Criminal History Record Information Act

(“CHRIA”), 18 Pa. C.S. §§9101 et seq. Defendant relies upon the Expungement section of the CHRIA as the basis of his argument for a protective order against responding to particular discovery requests propounded on him by Plaintiff. The CHRIA defines “expunge” as:
(1) To remove information so that there is no trace or indication that such information existed; (2) to eliminate all identifiers which may be used to trace the identity of an in-dividual, allowing remaining data to be used for statistical purposes; or (3) maintenance of certain information required or authorized under the provisions of section 9122(c) (relat-ing to expungement), when an individual has successfully completed the conditions of any pretrial or posttrial diversion or probation program.
18 Pa. C.S. §9102. The CHRIA further provides:
Notwithstanding any other provision of this chapter, the prosecuting attorney and the central repository shall, and the court may, maintain a list of the names and other criminal history record information of persons whose records are re-quired by law or court rule to be expunged where the indi-vidual has successfully completed the conditions of any pretrial or post-trial diversion or probation program or where the court has ordered expungement under this section. Such information shall be used solely for the purposes of determin-ing subsequent eligibility for such programs, identifying persons in criminal investigations or determining the grading of subsequent offenses. Such information shall be made avail-able to any court or law enforcement agency upon request.
18 Pa. C.S. §9122. The CHRIA defines “criminal history record information” as:
Information collected by criminal justice agencies con-cerning individuals, and arising from the initiation of a criminal proceeding, consisting of identifiable descriptions, dates and notations of arrests, indictments, informations or other formal criminal charges and any dispositions arising therefrom. The term does not include intelligence informa-tion, investigative information or treatment information, in-

cluding medical and psychological information, or information and records specified in section 9104 (relating to scope).

It is important to remember to whom the subject discovery requests have been made. They have not been made to a “criminal justice agency”; they have been made to the Defendant. The CHRIA defines “criminal justice agency” as:
Any court, including the minor judiciary, with criminal jurisdiction or any other governmental agency, or subunit thereof, created by statute or by the State or Federal consti-tutions, specifically authorized to perform as its principal function the administration of criminal justice, and which allocates a substantial portion of its annual budget to such function. Criminal justice agencies include, but are not lim-ited to: organized State and municipal police departments, local detention facilities, county, regional and State correc-tional facilities, probation agencies, district or prosecuting attorneys, parole boards, pardon boards, the facilities and administrative offices of the Department of Public Welfare[] that provide care, guidance and control to adjudicated delin-quents, and such agencies or subunits thereof, as are declared by the Attorney General to be criminal justice agencies as determined by a review of applicable statutes and the State and Federal Constitutions or both.

Defendant is clearly not a criminal justice agency and any information in his possession cannot be protected by the CHRIA, even if such information would be protected if sought from a criminal justice agency. Thus, the CHRIA does not determine the answer to the issue raised in this particular motion.
Further, assuming arguendo that the CHRIA is applicable, the CHRIA specifically excludes “investigative information” from this definition, which is defined as “information assembled as a result of the performance of any inquiry, formal or informal, into a criminal incident or an allegation of criminal wrongdoing and may include modus operandi information.” Id. The statute is clear;

the transformation from investigative information to criminal his-tory record information only applies to: (1) identifiable descriptions, (2) dates and notations of arrest, (3) criminal charges, and (4) dispositions. After the initiation of criminal proceedings, investiga-tive information that does not fall into one of the above categories is not expungable under the CHRIA. In Doe v. Zappala, 987 A.2d 190 (Pa. Cmwlth. 2009), defendant was charged with murder and sought to preclude the use of investigative materials from a previ-ous murder case against him in which he was acquitted and his record expunged; however, the court found that the investigative materials were not subject to the expungement and were admis-sible. Similarly, in this case, the investigative information relating to the accident is not expungable under the CHRIA.
It is also important to remember what the issue in this motion is not. It is not whether the discovery sought is admissible at trial. It is not whether a particular answer or answers to discovery re-quests are sufficient. It is whether the discovery sought could reasonably lead to relevant evidence. The discovery requested could reasonably lead to relevant evidence such as the blood alco-hol level of the Defendant at the time of the accident, identities and contact information of witnesses, statements made by the parties and/or witnesses and/or other physical evidence.
In this case, Defendant seeks to invoke the expungement of his criminal record to prevent Plaintiff from developing any evi-dence of Defendant’s drunk driving and behavior in injuring Plaintiff. That is not the purpose of the CHRIA. The purpose of expungement is to protect an individual from the difficulties and hardships that may result from an arrest on record including the harm to one’s reputation and opportunities for advancement in life. However, although expungement affords an individual some protection from the difficulties and hardships that may result from an arrest on record, it cannot entirely protect him from the conse-quences of his prior actions. Commonwealth v. Butler, 448 Pa. Superior Ct. 582, 672 A.2d 806 (1996). Expungement means that the criminal record is expunged, not that the event underlying the criminal charge is erased as if it never took place. The purpose of the CHRIA is not to protect legitimate evidence, relevant to a negligence case, from being obtained by a plaintiff.

We find that the information Plaintiff seeks in his discovery requests is not protected under the CHRIA. Therefore, a protec-tive order is not warranted in this case.
III. CONCLUSION
For the foregoing reasons, the Motion of Defendant, Craig Ellis, for Protective Order filed on June 5, 2018 is DENIED.
ORDER

Bar Association of Lehigh County Holiday Assistance Drive 2019
Dear Bar Association Member,
The Bar Association of Lehigh County has started the Annual Ask for the Lehigh
County Lawyer’s Charitable Fund Grant. This year’s theme is “Summer School
Programs & Camps”.
We are proud to remind all lawyers that the Bar Association of Lehigh County
has conducted an Assistance Program to benefit area 501c3 organizations to
provide much needed assistance to our surrounding communities for many
years. This program has raised over $230,000 throughout that time and
distributed these funds to many deserving area organizations.
This year to assist these organizations, we are asking each lawyer to give
generously to help support those in our local community. Remember, these
contributions stay in the Greater Lehigh Valley area.
The Program is administered through the Lehigh Valley Community Foundation
and all gifts are tax deductible to the fullest extent of the law. The Foundation
will automatically acknowledge all gifts for tax purposes over $250.
We will recognize all those nonprofit organizations receiving funds as part of our
Law Day celebration in May.

This one-hour seminar will look at WHY a client should consider a 1031 exchange for their commercial property. It will discuss HOW a 1031 exchange works step-by-step, and the thought process to consider when selling a property and in the context of exiting a business. Emrich will focus on WHAT the advisory team needs to consider when planning a 1031 exchange. He will also discuss WHO is involved in the 1031 process including the key roles of the financial, legal, and tax advisors working with a qualified intermediary (QI). This session will review the requirements of the Ignition Interlock program in Pennsylvania, review the changes that occurred when Act 33 went into effect in 2017 and update participants on the changes in 2018, including Interlock as a option for ARD and surrendering of license. Attendees will be better prepared to answer client’s questions and provide information, so they may help their client’s through the interlock process and respond to questions and concerns. Topics to be covered will include what is Interlock and how it works, the PennDOT process and paperwork, violatioins, fees and what their clients can expect from the Interlock installation to removal. Kathleen Riley is the Judicial Services Liaison for Smart Start in Pennsylvania & West Virginia. Before starting with Smart Start in 2012, Ms. Riley worked for the WV DMV – DUI Interlock Department as a Customer Service Representative, handling DUI clients from the initial phone call right through to the completion of the WV Test & Lock Program. Her responsibilities also included handling all violations reports and working with out-of-state DUI clients, who had a WV DUI requirement. Ms. Riley holds a BS in Marketing from Indiana University of PA and lived and worked in the Pittsburgh area for over 13 years as a Pharmaceutical Sales Representative, which gives her a unique perspective on DUID’s. Although her home is in West Virginia, Kathy is proud to exclaim that Pennsylvania is her Home State and that she is a Clinton County girl at heart.

The Lawyer Referral office receives phone calls from clients requesting services from attorneys. At this time, the office will obtain all needed information from the client and contact the attorney to schedule. They are entitled to a half-hour consultation with the attorney for a $30 fee. The Coplay Whitehall Sewer Authority (CWSA) is a joint municipal authority incorporated by the Borough of Coplay and the Township of Whitehall in Lehigh County, PA, is seeking the services of a Solicitor. CWSA currently serves over 13,500 sanitary sewer customers with approximately 120 miles of pipe. Wastewater is conveyed to the City of Allentown treatment facility (now operated by the Lehigh County Au-thority).
