The Lehigh County Court of Common Pleas is seeking a Law Clerk to serve Judge Maria L. Dantos in the Criminal Division of the Lehigh County Court of Common Pleas. He or she will assist Judge Dantos in legal research, writing opinions and drafting court orders. Furthermore, the Law Clerk will conduct research and review pleadings and docu-ments to prepare the judge for conferences, hearings and trials. In addition, the Law Clerk will attend hearings, trials and conferences, and provide general support and assistance to Judge Dantos. KEYSTONE ALLIANCE OF PARALEGAL ASSOCIATIONS FORMS

REGULATION COMMITTEE

In 2016, the American Bar Association House of Delegates adopted Resolution 105, ABA Model Regulatory Objectives for the Provision of Legal Services, which could be used as a guide to assist the state’s highest courts when assessing regu-latory framework related to non-traditional legal service providers. Since that time, many legal organizations within Pennsylvania have written to the Pennsylvania Supreme Court and/or passed resolutions asking to participate in this process should the Court begin discussions on this topic, including members of the Keystone Alliance of Paralegal Associations (the “Keystone Alliance”). The Keystone Alliance has re-cently formed a Regulation Committee, consisting of mem-bers of the Keystone Alliance, chaired by Robert S. Hrouda, RP (former President of the Philadelphia Association of Paralegals and National Federation of Paralegal Associations and a paralegal at Hangley Aronchick Segal Pudlin & Schiller in Philadelphia), to investigate ways other states, including but not limited to Washington, Utah and New York, are implementing programs to allow nonlawyers, with proper education and other requirements, to assist in bridging the gap to the access of justice for those underserved by tradi-tional means.

The Keystone Alliance consists of delegates from the Cen-tral Pennsylvania Paralegal Association, Chester County Paralegal Association, Delaware County Paralegal Associa-tion, Lehigh County Paralegal Association, Montgomery County Paralegal Association, the Philadelphia Association of Paralegals and the Pittsburgh Paralegal Association. The President of the Keystone Alliance is Catherine E. Wright, Pa. C.P., of the Central Pennsylvania Paralegal Association.

The Court set aside a tax upset sale based upon the Tax Claim Bureau failing to provide sufficient notice of the sale. The Court noted that notice provisions must be strictly complied with to ensure the property owner is afforded due process.

I. INTRODUCTION

Before the Court for consideration is the Petition to Set Aside Upset Tax Sale filed on September 26, 2018. A Hearing was held on March 15, 2019. Petitioner is King Realty NY, Inc. (“Petition-er”).1 Respondent is Lehigh County Tax Claim Bureau c/o North-East Revenue Service, an agency of the County of Lehigh (“Re-spondent”). Petitioner was the record owner of real property located at 402 W. Juniata Street, Allentown, Lehigh County, PA (“Property”). On September 19, 2018, the Property was exposed to an Upset Tax Sale. Petitioner alleges that no notice of the Upset Tax Sale was received at any time prior to the date of the Upset Tax Sale. Petitioner further alleges that no notice of delinquent taxes was received at any time prior to the date of the Upset Tax Sale.

II. ISSUE PRESENTED

III. DISCUSSION

In a tax sale case, the Tax Claim Bureau has the burden of proving compliance with the statutory notice provisions of the Real Estate Tax Sale Law (RETSL). Pitts v. Delaware County Tax Claim Bureau, 967 A.2d 1047, 1053 (Pa. Cmwlth. 2009); 72 P.S. §5860.602. “It is well settled that the notice provisions of the Law [RETSL] are to be strictly construed and that strict compliance with the notice provisions is essential to prevent the deprivation of property without due process.” Pitts, supra. The tax sale laws were enacted with the primary purpose of ensuring the collection of taxes, and not to strip away citizens’ property rights. Rice v. Compro Distributing, Inc., 901 A.2d 570, 575 (Pa. Cmwlth. 2006). The Pennsylvania Supreme Court has also instructed that “[t]he strict provisions of [the Law] were never meant to punish taxpay-ers who omitted through oversight or error ... to pay their taxes.” Id. (citing In re Return of Sale of Tax Claim Bureau (Ross Appeal), 366 Pa. 100, 107, 76 A.2d 749, 753 (1950)). Thus, the focus is not on any alleged neglect of the owner, which is often present in some degree, but on whether the activities of the Tax Claim Bureau comply with the requirements of the statute. Id.

Under 72 P.S. §5860.602(a), the Lehigh County Tax Claim Bureau was required to:

At least thirty (30) days prior to any scheduled sale the bureau shall give notice thereof, not less than once in two (2) newspapers of general circulation in the county, if so many are published therein, and once in the legal journal, if any, designated by the court for the publication of legal notices. Such notice shall set forth (1) the purposes of such sale, (2) the time of such sale, (3) the place of such sale, (4) the terms of the sale including the approximate upset price, (5) the descriptions of the properties to be sold as stated in the claims entered and the name of the owner.

Testimony by Kim Ciavarella, the office manager of Northeast Revenue Service and agent for the Lehigh County Tax Claim Bureau, confirmed that they understood that advertising the Prop-erty is a statutory requirement; however, no evidence was pre-

sented that the Lehigh County Tax Claim Bureau complied with this requirement. Strict compliance with the notice provisions is essential to prevent the deprivation of property without due pro-cess. Therefore, without any evidence to prove that the Property was properly advertised pursuant to 72 P.S. §5860.602(a), the Upset Tax Sale of the Property held September 19, 2018 must be set aside.

IV. CONCLUSION

For the foregoing reasons, the Petition to Set Aside Upset Tax Sale filed by Petitioner on September 26, 2018 is GRANTED and the Upset Tax Sale of 402 W. Juniata Street, Allentown, Lehigh County, Pennsylvania 18103 held September 19, 2018 is SET ASIDE.

ORDER

AND NOW, this 22nd day of May, 2019, upon consideration of the Petition To Set Aside Upset Tax Sale filed September 26, 2018, after hearing held March 15, 2019, and for the reasons set forth in the accompanying Opinion;

IT IS ORDERED that said petition is GRANTED and the Upset Tax Sale of 402 W. Juniata Street, Allentown, Lehigh County, Pennsylvania 18103 held September 19, 2018 is SET ASIDE.

“Pro Bono CLE, Emeritus Status and Other Creative Ways to Expand Access to Justice” Presented by: David K. Trevaskis, Esq.

Pennsylvania lawyers have a duty to improve access to justice, encapsulated in Rule 6.1 of the Pennsylvania Rules of Professional Responsibility. That duty has been supported by new rules on getting CLE credit for doing pro bono work, on retired lawyers taking emeritus status to handle pro bono matters and by other creative means to expand access to justice. Come to this one-hour ethics session to explore these new avenues to support Rule 6.1.

David Keller Trevaskis, Esq., is an attorney and former third grade teacher with a Master’s Degree in Education. He is the Pro Bono Coordinator for Legal Services for the Pennsylvania Bar Association (PBA), responsible for assisting local bar associations, legal services programs and other groups who offer pro bono legal services across the Commonwealth. Trevaskis coordinates the PBA’s pro bono placement efforts, using the PALawHelp.org and PAprobono.net technologies to expand the resources for the neediest among us. He runs the PBA’s Pro Bono Office and the wide range of that work is viewable at http://www.pabar.org/public/probono/probonohome.asp. Trevaskis is a frequent presenter across Pennsylvania on civil legal aid and pro bono issues and is recognized as a national expert in public education about the law. He is the recipient of the 1996 Philadelphia Bar Association’s Leon J. Obermayer Education Award, a 2000 President’s Award from the Pennsylvania Bar Association for the Project PEACE anti-violence program he developed and still coordinates, the Philadelphia Bar Association’s Young Lawyer Division’s 2002 F. Sean Peretta Service Award, and a 2004 Chester County Bar Association President’s Award. In 2006, Trevaskis was the second recipient of the Compass Award, which was first given to United States Supreme Court Justice Sandra Day O’Connor.

“Attacking the Expert’s Opinion” Monday, August 12, 2019

The adverse expert is typically the most dangerous witness and at the same time, the most vulnerable. Most dangerous because he testifies cloaked in the mantle of the “unbiased scientist”; thus his testimony, if accepted by the jury, can determine a major issue, maybe the entire case. Yet most vulnerable because, unlike the fact witness who must defend only his first-hand observations, the expert witness must defend his testimony from attacks on a dozen fronts.

As seasoned litigators from all areas of practice have attested, this presentation elucidates the one-and-only logical method with which to effectively attack the purported scientific merits of any adverse expert’s opinion…no matter the field of expertise.
