From The Wall Street Journal : [1] “ U.S. spy drones had no trouble spotting the Tali-ban fighters. There were more than 20 . . . In the starry darkness overhead, American helicopters loitered armed with precision-guided missiles along with a flying gun ship capable of drenching the area with cannon fire. It would have been a hard shot to miss. But before they could fire, the Americans knew they would have to get past the law-yers . . . Before they shoot, U.S. troops have to navigate a tricky legal and political question: When is it okay to kill Taliban? . . . U.S. commanders, monitoring video feeds and radio traffic miles from the front, had to judge whether enemy fighters who weren’t actually fighting constitute an imminent threat . . . [Taliban forces can be fired on only if they constitute an imminent threat to friendly forces] U.S. commanders and military lawyers make seat-of-the-pants calls every day about using force against the Taliban, trying simultaneously to respect the rules, avoid killing civilians and spare their allies casualties that a quick air strike might prevent . . . U.S. commanders and their lawyers will have to decide . . . whether they can justify the use of force against Taliban fighters. The limits have come into particular focus since a U.S. warplane, in a terrible blunder, attacked a Doctors Without Borders hospital in intense fighting in the northern city of Kunduz last year, killing 42 civilians . . . The Pentagon punished 16 service members for the incident . . . At headquarters, the lawyer and officers focused on several con-cerns: Was there a risk that an air strike would kill civilians? Were the men actually militants? Even if they were, did they pose a threat that made them legitimate targets on this particular night? . . .” (Article by Michael M. Phillips); [2] “It doesn’t take much to get a doctor to prescribe a brand name medication, a new study suggests. The study found that U.S. doctors who received a single free meal from a drug company were more likely to prescribe the drug the company was promoting than doctors who re-ceived no such meals. Meals paid for by drug companies cost less $20.00 on average. The findings, published online Monday by JAMA Internal Medicine . . . Researchers examined payments and prescriptions in 2013 associated with three brand name cardio-vascular drugs and one antidepressant, each of which had lower cost alternatives . . . Prior studies have shown that large payments can sway physicians’ prescribing habits. The new study shows that even relatively small payments or gifts are associated with increased prescribing of promoted brands, said the lead study author, R. Adams Dudley, a professor of medicine and health policy at the University of California, San Francis-co.” ; [3] “ . . . a class-action suit . . .” has been filed “. . . against Starbucks for under-filling its grande lattes. According to a lawsuit in San Francisco, Starbucks instructs baristas to leave a quarter of an inch free space at the top of its drink cups. The two plaintiffs argue that counting foam to the drink volume is contrary to the ‘industry standards’ of the ‘food science community’ and “weighs and measures community.’ Another suit in Chicago gripes that Starbucks cold drinks contain less ‘product’ than advertised. ‘Ice is not fluid,’ the lawsuit asserts . . . This alleged deception supposedly constitutes an even graver injustice since the company charges more for and reaps a greater profit from cold drinks. So Starbucks is also accused of discriminatory pricing.

The Washington County Court Administrator is seeking to hire a Secretary to provide administrative support to the Court Administrator in an accurate and timely manner. The position is generally responsible for answering telephone calls in Court Admin-istration; formatting, typing, and circulating memorandums and other correspondence from the Court Administrator; managing the Court Administrator’s calendar; schedul-ing meetings; and maintaining files for Court Administration.

The applicant must have strong communication skills, and proficiency in Microsoft Office is required. Previous experience as a legal secretary is preferred.

The case, NLRB v. SW General, Inc., interprets a federal law called the 1998 Federal Vacancies Reform Act, report SCO-TUSblog, The Wall Street Journal, Reuters and Bloomberg News. SW General, an am-bulance company, contends that a president who appoints a pending nominee to work in an acting capacity is able to advance his agenda without obtaining the advice and consent of the Senate. The Pennsylvania Lawyers Fund for Client Security reimburses clients who have been victimized by a dishonest lawyer. The Fund is financed entirely by Pennsylvania licensed attorneys.
