On February 1, 2017, the Administrative Office of the Pennsylvania Courts posted a notice seeking volunteers to serve in two capacities. The Office is seeking volunteers for: The Juvenile Court Procedural Rules Committee; and The Disciplinary Board of the Supreme Court. The Disciplinary Board member must be admitted to the bar of Penn-sylvania. On February 1, the details for the positions were published at the website of the Pennsylvania courts. Applications will be due February 27, 2017’ • • • • From ABA Journal Daily Journal : [1] “Congress . . . entered its summer recess with-out acting on President Obama’s Supreme Court nominee Merrick Garland, along with 49 others nominated to lower federal courts. Will they get a vote? Russell Wheeler, a visiting fellow at the Brookings Institution who tracks nominations, expects the number will be ‘pretty paltry’ because of the political fighting this year, Law.com reports. For some of those nominees – especially small-firm lawyers – the consequences can have financial consequences that last for years. Supreme Court nominee Merrick Garland tied the record Tuesday for the longest wait for a Supreme Court confirmation vote, the Huffington Post reports.”(Article by Debra Cassens Weiss); [2] “Voters in three states passed ballot initiatives supporting capital punishment. In California, voters re-jected a measure to repeal the death penalty and passed a measure that seeks to speed up the appeal process . . . In Nebraska, voters restored the death penalty law after lawmak-ers repealed it last year. And in Oklahoma, voters passed a constitutional amendment that says the death penalty does not amount to ‘cruel and unusual punishment.’” (Article by Debra Cassens Weiss) ; [3] ACLU: Trump will face its 'full firepower' if he doesn't reverse course on unconstitutional plans: “The Amer ican Civil Liber ties Union is calling on Donald Trump to reverse course on campaign promises the group deems un-American and unconstitutional. In a press release, the ACLU urges Trump to ‘reconsider and change course’ on several campaign promises. They include pledges to remove 11 million immigrants living here illegally, to ban Muslims from entering the country and surveil Muslims, to punish women who have abortions, to reauthorize wa-terboarding and to change the nation’s libel laws. ‘These proposals are not simply un-American and wrong-headed, they are unlawful and unconstitutional. They violate the First, Fourth, Fifth, Eighth and 14th Amendments,’ the press release says. ‘If you do not reverse course and instead endeavor to make these campaign promises a reality, you will have to contend with the full firepower of the ACLU at every step.’” [4] “Donald Trump’s victory means the U.S. Supreme Court will have a majority of Republican-appointed justices . . . National Law Journal . . . ABC News spoke with Cardozo law professor Kate Shaw about what Trump’s election will mean for [Merrick] Garland. ‘Absent something wildly unexpected,’ she said, ‘Garland will go back to being chief judge of the D.C. Circuit and after inauguration, Trump will nominate someone new to fill the vacancy.’ Trump has said his Supreme Court nominees will support overturning Roe v. Wade and will support the Second Amendment. If Democrats try to filibuster a Trump Supreme Court nominee, Republicans will likely change the rules to foreclose that option, the stories point out. Trump’s ability to shape the Court may extend beyond nominating a replacement for the late Justice Antonin Scalia. The court’s three oldest justices are liberal Justices Ruth Bader Ginsburg, 83, and Stephen G. Breyer, 78, and swing voter Justice Anthony M. Kennedy, 80 . . . Kennedy has written all of the court

The American Bar Association, which oversees the nation’s more than 200 accredited law schools, is working on a new rule that would require 75% of a law school’s graduates sitting for a bar exam to pass it within two years. The proposal, which recently cleared a key administrative hurdle and could be implemented early next year, is rankling some law schools that say it will unfairly hurt those institu-tions with a mission of increasing access to legal education to a more diverse array of students. Others say a national standard makes little sense when some states, such as California and New York, have notoriously more difficult bar exams than others . . . To Barry Currier, the ABA’s managing director of accreditation and legal education, the rationale behind the bar-passage rule is simple: if less than three-quarters of a school’s graduates can’t become lawyers, ‘you’re not offering a sound program of legal educa-tion.’ Currently, law schools can stay accredited by posting first-time bar-passage rates within 15 percentage points of statewide averages, or achieving a 75 % pass rate within five years of student graduations, among other metrics . . . The Pennsylvania Lawyers Fund for Client Security reimburses clients who have been victimized by a dishonest lawyer. The Fund is financed entirely by Pennsylvania licensed attorneys. The victims appreciate the members of the Pennsylvania Bar providing a source of relief for actions caused by a small number of Pennsylvania lawyers.
