A modern and upmarketshopping mall will soonbe a reality for residentsof Uitenhage.

“With lettable space of approxi-mately 30 000m² it will host a varietyof national outlets similar to thosefound in the most popular malls,”said Darell Willemse, spokespersonof Elatiprox Pty. Ltd., the developingcompany.

“The developer also realised thelack of entertainment, parking andsecurity in town. He therefore gavespecial attention toensure thatawell-known entertainment brand wouldbe a prominent tenant.

“Parking will definitely not be aproblem as three levels will be allo-cated with a total of 1 883 parkingbays.When it comes to security, therewill be a zero tolerance towards anyactivities prohibiting mall clientsfrom shopping in peace.”

The East Cape Mall will be built on50 000m² next to Union Avenue, oppo-site theAandmymeringoldagehome.The developer, Piet Botha, who hailsfrom Pretoria and owns several de-velopments, bought the land fromRay Long who previously operated anursery from the premises.

Botha visited the Nelson MandelaMetro with the aim of getting to knowthe area and searching for an appro-priate site for development.

“Apropertyagentaccompaniedmeto Uitenhage and when we visited thesite I knew this was it,” said Botha.

“To find an already zoned area in

the country, which has all the quali-ties needed for a decent development,is not easy. I am looking forward tothis new development,” said Botha.

According to Willemse they are

“very excited as it has been long over-due for theresidentsofUitenhageandDespatch to enjoy the luxury andpleasure of shopping in an upmarketmall. Among the shops will be several

well-known brand restaurants aswell as a high class gym.”

All the necessary impact studieshave been succesfully completed andthe plans had been handed in for ap-

proval. If all goes according to planearthworks will commence withinthe first half of 2012. It is expected thatthe development will be completedwithin 14 months.

Dance in support of Brendan (5)HEILIE COMBRINCK

A dance will be held in Uitenhagein aid of Brendan van HeerdenSmit (5) who has a severe respira-tory disease and needs to urgentlyundergo an operation in CapeTown.

According to a letter from paedia-trician Dr Jordaan, Brendan needsthis operation to ensure that hislungs do not deteriorate any further.

“Brendan has to be at the Chris-tiaan Barnard Memorial Hospital onthe 17th March where Dr RichardWood will handle the operation,”said Mrs Johanna “Sussie” Mostertthe foster parent of Brendan.

“As he is a disabled child who alsohas a heart defect, doctors told me hewill never be able to walk or talk.Well, they were amazed the other daywhen Brendan walked into the sur-gery. Where there is hope and lovethere is life.”

Brendan twice received certifi-cates for the “Bravest Boy” by stafffrom the children’s ward of CuylerNetcare Hospital.

“We want to thank the staff anddoctors at this children’s ward fortheir fantastic support and care. Alsoa huge thank you to the persons whogave Brendan a wheelchair andthose who supported his school feesand travelling costs to Aurora. Yoursupport is heart-warming,” said MrsMostert.

‘n Sateliet rotariërklub van die Uiten-hage-Suid Rotariërs is op Despatchgestig met die doel om die gemeen-skap en dorp te ondersteun en by tedra tot vernuwing en vooruitgang.

Die waarnemende president vandie satelietklub, Rynhardt Fourie, hetgesê daar is ‘n behoefte aan so ‘ndiensklub op die dorp.

“Dit ‘n ‘n eerste vir Despatch en al-mal met wie ons gesels het oor dié ro-tariërklub is saam met ons opge-wonde en positief oor die projekte watons graag wil aanpak,” het Fouriegesê.

Die klub het afgeskop met ‘n skryf-behoefteprojek wat “Rotary Kit” ge-noem word. Laerskool Frans Con-radie was die eerste van die dorp seskole wat tien van hierdie noodsak-kies ontvang het.

Volgens Fourie is die doel van

hierdie sakkies omdit aan klasonder-wysers toe te ken,wat dan skryfbe-hoeftes aan leer-linge in die klaskan leen indienhulle om een of an-der rede nie skryf-goed by hulle hetnie. Dié sakkiessal deur die rota-riërklub aangevulword indien itemsopgebruik is.

Low flying helicopterworried residents

A low flying helicopter dur-ing the early hours of lastSunday had many a Uitenha-ge resident wide awake andworried.

The helicopter circledmainly above Scheepers-hoogte, Mosel, Penford, Jans-sensdal and the Central areaof Uitenhage for approxi-mately an hour or two.

Several residents phonedtheUDNewsonMonday to en-quire what this was all about.

“The sudden overwhelm-ing sound woke me. I was soconfused and at first thought

it’s my cell phone or thunderor somethingand then Ihearda helicopter flying at a verylow altitude,” said a residentfrom Scheepershoogte.

A resident from Penfordsaid “I was so worried as thehelicopter kept on circlingthe area. I decided to ratherplay safe and immediatelychecked if all the windowsand doors were locked.”

Another resident from Mo-sel told the UD News that theywent outside to determinewhat it was and then saw ahelicopter circling the area ata very low height.

W.O. Gerda Swart,spokespeson from the Uiten-

hage police confirmed that itindeed was not a police heli-copter, but one of Altech Net-star’s air recovery teams insearch of a stolen vehicle.

According to Swart no ve-hicle was found.

Altech Netstar is the larg-est user of helicopter servicesin the country.

In searching for stolen ve-hicles the air recovery teamsconsist of the aircraft pilotand the airtracker.

The tracker is responsiblefor locating the signal, guid-ing the pilot and the groundcrew to the stolenvehicle, andcommunicating with the con-trol centre.

Die groep is in 2005 gestig deurDennis Jood, Stanley Sampson, Eu-gene Fourie, Malcolm Myburgh enBeverley Jood. Fourie het die groepverlaat, maar drie talentvolle nuwel-inge is nou deel van 3rd Degree LiveBand naamlik Izelle Links, DeanJood en Martin February.

“Ons is betrokke by verskeiefondsinsamelingprojekte van kerke,skole, sportklubs en liefdadig-heidsorganisasies. Maar dit is ‘n op-draende stryd om ‘n band aan die

gang te hou sonder die regte of nod-ige musiekinstrumente.

“‘n Musikant sonder ‘n instru-ment soos ‘n mens in die woestynsonder water, jy wil iets doen maarjy kan nie,” het Jood gesê.

Lede van die band het by raadslidKenneth Kohl van Wyk 48 gaan aan-klop om hulle nood aan hom te ver-duidelik.

“Hy het ons inligting geneem enonmiddelik aan ons versoek aandaggegee. ‘n Ruk daarna het hy die goeienuusaanonsoorgedradat onsons in-strumente by Musikland in die Baaikan gaan haal,” het Jood gesê.

Nou is 3rd Degree Live Band enevuur en vlam oefen vir hulle vol-gende optrede op 7 April in die Allan-ridge gemeenskapsaal.

Die groep bedank raadslid Kohlvir sy bydrae wat dit nou vir hullemoontlik maak om die gemeenskapdeur middel van hulle musiek teondersteun.

The “mighty” gatherings hit thecountry by storm with the latestbeing the Mighty Family Festivalwhere local singer Illana van Vu-uren was invited to perform.

This versatile young singer fromDespatch was offered a 40 minute slotto perform at the festival which willbe held near Great Brak River. Well-known Michael Lindt will also per-form at the Mighty Family Festival.

Angus Buchan started the MightyMen conference and now his brotherDr Fergus Buchan organised thefamily festival which will be held atYellowoods on the banks of theMoordkuyl River near Great BrakRiver on the 3rd and 4th March.

Ilana gained her popularitythrough her brilliant performance ofBrenda Fassie’s “Vulindlela”. Whatmakes her shows vibrant is that shesings in Zulu, Xhosa, English and Af-rikaans.

During the Mighty Family Festi-val she will sing mainly gospel songs.

Entrance to the festival is free ofcharge and camping facilities areavailable.

Dr Fergus Buchan will address thecrowd on Saturday, 3 March at 18:00and Sunday, 4 March at 10:00.

Marryats to open new shop mid MarchHEILIE COMBRINCK

The roaring of the top selling ani-mation movie Lion King was thelast sound heard on big screen atthe Uitenhage cinema in BairdStreet. Now the roaring of bull-dozers will soon be heard as thismovie house complex will have tomake way for new development.

The Marryats schoolwear and

garments shop which is part ofthe old cinema complex will alsobe demolished.

A “new” Marryats will open itsdoors at 20 John Street by mid-March.

“Marryats was established bymy mother, Joey van Zyl, sixtyyears ago. She opened her firstshop in the Mosel shopping areaand then later moved to the cen-tral business area of town,” saidMrs Gloria Rens, owner of thebuilding which houses Marryatsand the former Uitenhage cine-ma.

The late Mrs Van Zyl was re-nowned for her exceptional

skills in baking, the making ofbridal wear and the variety offashionable hats. The nameMarryats is a compilation of thewords “marry” and “hats” forwhich the business was well-known. Apart from her mother’sshop, Mrs Rens opened her ownfashion wear shop next to the en-trance of the cinema. After herlate mother’s retirement, shetook ownership of Marryats.

In continuing the Marryatsfamily business tradition MrsRens said she prefers to operatein the central business area andtherefore purchased premises inJohn Street.

In October last year, CapeTown-based musicians DarrenDigby Peens and Rouchelle Hüb-sch (formerly from Uitenhage) ofthe duo Digby and the Lullabytook a leap of faith and boardeda plane to New York after forginga relationship with Americanproducer Kieran Kelly.

“We sent Kieran a link to oneof our songs For Now onYouTube and he took a liking toour music,” says Darren.

The duo spent a month in Kel-ly’s studio to record what theysay is their dream-come-true de-but album. While in New York,they performed shows at Goog-ies in Manhattan and a charityshow forOneHomeManyHopes,an organisation that rescues or-phaned and abandoned girls in

Kenya.“Our trip to the States has not

only given us a great record butalso put us in touch with theright people in the industry. Ourmusic is getting into the righthands,” says Darren.

Digby and the Lullaby’s soundhas been described as sublime,ethereal alternative indie folk –think Neal Young’s Harvestmixed with a little Norah Jonesand a touch of Seventies. Theyare aiming to have their first sin-gle out in April, and to launchtheir album in June.SThey will be performing at

While most learners on a Sat-urday morning are probablychatting on social network,hanging around not really do-ing anything constructive orstill sleeping, there are somewho attend the DOT SaturdaySchool.

The Department of Trans-port (DOT) in conjunctionwith the Nelson Mandela Met-ropolitan University, Engenand other roleplayers em-barked on this venture to as-sist in educating learnersthrough extra-mural classes

in physical science, mathe-matics and English.

“It is absolutely encourag-ing! Their marks say it all,”said Mrs Nomvuyo Daka,Principal at Mary Mount HighSchool.

During the recently heldaward ceremony of DOT Sat-urday School at the NMMU,Mary Mount High School wasawarded the Most SupportingSchool, Best PerformingSchool in Mathematics andMost Improved in Science. AMary Mount Grade 12 learnerfrom the 2011 class, Vuyol-wethu Joosen was named thetop learner attending last

year’s DOT Saturday School.His matric results were alsothe best of all learners fromhistorically disadvantaged in-stitutions in the Uitenhage ar-ea. Several of the currentMary Mount learners also re-ceived subject awards.

According to Mrs Daka, theapproximately 20 Grade 10 to12 learners identified to at-tend the DOT school are all ea-ger and helpful towards theirfellow classmates back atschool.

“There is a great difference.These children are so motivat-ed and their performance isgood.”

Owners responsible for section repairsThis week the Property Poser pan-el deals with two similar ques-tions regarding responsibility formaintenance in a sectional titlecomplex.

The first reader is having prob-lems with water damage to built-incupboards, caused by a leakingshower in the unit above.

The body corporate referred the is-sue to the person living in that unit,but he is merely a tenant who has un-dertaken to contact the owner.

In another matter, a reader com-plains about a badly neglected gar-den gate in one of the units in hiscomplex.

The hinges are broken and thewood unvarnished and rotten. Theowner refuses to take responsibility.

According to Charlotte VermaakfromChasEveritt inNelsonMandela

Bay, the maintenance in a sectionaltitle scheme is typically the responsi-bility of the body corporate.

“The Sectional Titles Act makesthe body corporate responsible forthe maintenance of the commonproperty, while owners are responsi-ble for their sections.”

Vermaak says common propertyincludes driveways, parking baysand garages, private and communalgardens, swimming pools, corridors,lifts and entrance foyers.

“With reference to the first read-er’s problem, it is the duty of the own-er of the upper unit to keep his sec-tion in a state of repair and fix theshower.”

Vermaak says the insurance of thebuilding will sometimes cover re-sultant damage in these situations.

“However, if not, he may claim thecost of the repairs from the offending

owner.”The Act even allows the body cor-

porate to perform maintenance to asection at the owner’s expense,should he or she fail to do so, saysVermaak.

“After giving 30 days’ notice, thebodycorporatemayremedy the situa-tion and recover the reasonable costsof repair from the owner.”

RianduToit fromDTSAttorneys inthe metro says some parts of the com-mon property may be allocated as ex-clusive use areas to certain owners.

“An owner who enjoys such rightsis obligated to keep that area cleanand neat.”

Du Toit says exclusive use areasremaincommonpropertyandbelongto all owners in the scheme in undi-vided shares. “They are therefore theresponsibility of the body corpo-rate.”

However, says Du Toit, the Actmakes it plain that the body corpo-rate requires the owner to make ad-ditional contributions, in the form ofa levy, for exclusive use.

“This is for maintenance, ratesand taxes as well as insurance, un-less the rules of the scheme state thatthe owner is responsible for thesecosts.”

In the second example, Du Toitsays one must determine whetherthe rules make the owner responsi-ble for repairs or whether he merelypays an additional levy.

“If he is responsible for the repairsand fails to fix the gate, the body cor-porate may do so and claim any rea-sonable costs. If he pays a levy, thebody corporate must effect the re-pairs.”

Making sure you get enough sleep really isas simple as going to bed seven to eight hoursbefore you have to get up. Sometimes the solution iseven as simple as skipping that late afternooncup of coffee – even if you’ve been drinking itfor years without problems.
