Comments mixedon overcharge limit

The Federal Maritime Commission has received varied comments concern-ing its proposal to stop ocean carriers and their conferences from limiting ship-pers to less than the maximum two years allowed by law to file for refunds ofovercharges. This case is F.M.C. Docket 81-$1.

Most of the comments received from shippers such as Dupont were solidly infavor of the rules and claimed current actions by conferences or carriers tryingto limit the time for overcharge claims to six months or less caused overworkat the commission since such actions virtually force shippers to go to the FMC.The National Industrial Traffic League also supported this rule and claimed thesix months limitation was extremely wasteful.

Several steamship lines including Sea-Land Service and U.S. Lines also hadsubmitted comments. Sea-Land conditionally supported the rule but request-ed permission to coninue making corrections in recent measurements prior tothe time the cargo is released from the carrier’s control.

U.S. Lines, Inc., was very much against the time limit, claiming the resultswould be detrimental to shippers and carriers alike.

The Gulf European Carriers Association, a trade association of four con-ferences serving the Gulf and European trades urged the commission to allowshippers and carriers to settle their own small claim (under $5,000) disputesand to authorize a voluntary arbitration-like system without recourse to thelegal commission for others.

Time-volume rateproposal studied

The Federal Maritime Commission has proposed rules for comments inDocket No. 81-54 which is a proceeding to consider rules allowing time-volumerates. Until recently, the FMC has ruled that time-volume rates are unlawfuland not available for U.S. - serving steamship lines.

However, under this proposed rulemaking proceeding the FMC may allowpublication of the rates, based on information recently received from carriersand shippers, as long as certain safeguards are set up. The FMC would set upspecific rules governing publications, accessibility, surcharges, disabling oc-currences, and deficit accountability of these type of rates. Since these arenearly contract rates the FMC also is proposing the records on each contract bekept for at least five years.

If allowed, such time-volume rates would also apply to joint, through inter-modal service but the FMC reiterated that it did not intend to expand itsjurisdiction over activities normally regulated by the Interstate CommerceCommission.

Time-volume rates would be those which would allow shipment of a specificor minmum quantity of cargo over a specific amount of time. The carrier orconference of carriers would set up a contract between themselves and theshippers or consignees governing the application of the proposed rate. Anycontract would have to specifically show the minimum quantity needed to ob-tain a rate, the time period of the contract, and origin and destination of theshipment.

Also to be shown would be the manner in which the records pertaining totime-volume rates are to be kept and the identity of the person who would bein charge of such rates, along with a specific description of compelling cir-cumstances which would force reduction in the quantity of cargo required orextending the contract period or cancellation of the contract. In addition, therules would state whether surcharges would apply and whether the shipper-consignee would pay any deficit occurring when the quantity fails to meet theminimum, or whether the entire amount shipped would be rerated.

All comments on this proposal are due within 60 days from the publication inthe Federal Register.

Lawrence E. Hoyt was named executive vice president-corporate relations, Thomas C. Buckley vice president ofpublic relations and Robert W. Taggart vice president ofgovernment relations.

Mr. Hoyt, with Southern Pacific since 1948, had beenvice president-executive department since 1967. He holds amaster’s degree in civil engineering from Stanford Univer-

Lykes to retire; Amoss to take over as CEOJoseph T. Lykes, Jr. will retire at

year-end as chairman and chief ex-ecutive officer of Lykes Bros. Steam-ship Co., Inc. He will be succeeded aschief executive officer by W. JamesAmoss, Jr., president of the company.

Mr. Lykes, 63, has served the com-pany for 35 years, rising through theranks to president in 1962 and chair-man in 1967. In 1968, he directed theacquisition of Youngstown Sheet andTube steel
