The property is being sold and delivered to the BUYER in an “AS IS” condition without any representations or warranty of any kind or nature.

FINAL BID CONFIRMATION: Town is selling this property to the highest bidder, regardless of price! Bidding increments shall be at the discretion of the Auctioneer. Valuable Info & Terms of SaleWINNING BIDDER:

The winning bidder will be required to sign in duplicate a Purchase & Sale Agreement (Memorandum of Sale) at the auction. According to the Purchase & Sale Agreement, winning bidders will be required to close on the subject property within 30 days. Property will be sold “as is”. We make no representations, warranties, or guarantees as to the accuracy of the information provided and urge all bidders to rely entirely on their own inspection and investigation of the premises. Other terms, to be announced at the sale.

AUCTIONEER’S NOTE:

Announcements made on the auction block will take precedence over any previously written or published content. Sale is subject to confirmation by the Town of Rockland; confirmation will be immediate. Auctioneer reserves the right to accept or reject any or all bids. Bidding increments shall be at the discretion of the Auctioneer. BUYER’S PREMIUM:

There will be a Buyer’s Premium (BP) of 7.5% or $3,500 (whichever is higher) added to the winning high bid. The high bid amount plus the Buyer’s Premium shall constitute the Total Sale Price. The Total Sale Price is the total due from the buyer and is the amount that will be represented on the Purchase & Sale Agreement.

PROCESSING & RECORDING FEES:

At closing, buyer will also be responsible for legal processing fees to be determined, plus all required payments in lieu of taxes, plus all amounts associated with recording or registration, and any other amounts described in the terms and conditions. The Balance Due is the Total Amount of the Sale less the deposit paid at the auction. The Balance Due must be paid by certified bank treasurer's check within 30 days of the auction (December 5, 2020). Time is of the essence. All stamps, taxes, charges, costs, fees, buyer’s premium and expenses of recording or registration are to be added to the bid amount and paid by the buyer.

MEMORANDUM OF SALE (PURCHASE & SALE AGREEMENT):

A sample copy of the memorandum of sale (P&S agreement) will be available for your review prior to the auction. At the auction, the final copy will be provided to all qualified bidders. This will be signed by the successful high bidder upon confirmation of sale.

area. Unless the deficiencies with the subject lot can be rectified within 90

days from the sale of the property, the purchaser shall, as a condition of sale,

tear the existing structure down within 90 days after the sale. The subject

NOTICE OF PUBLIC AUCTION FOR THE SALE OF TAX POSSESSIONS

NOTICE IS HEREBY GIVEN THAT on Thursday, the 5th day of November, 2020 at 12:00 noon

at 320 Concord St., Rockland, MA 02370, pursuant to the provisions of Acts of 1938, Chapter

358, Section 2, as amended by Acts of 1939, Chapter 123; Acts of 1941, Chapter 296, Acts of

1947, Chapter 224, Section 1; Chapter 436 of the Acts of 1997, M.G.L. Chapter 60, Section 77B

and by virtue of the authority vested in me as Custodian of Tax Possessions, IT IS MY

INTENTION TO SELL AT PUBLIC AUCTION for the TOWN OF ROCKLAND the following

parcels for fair market value.

BUYERS SHOULD BE AWARE THAT THE TOWN OF ROCKLAND DOES NOT

WARRANTY OR GUARANTEE THIS PROPERTY TO BE IN CONFORMITY WITH

EXISTING ZONING BY-LAWS OR OTHER APPLICABLE CODES OR REGULATIONS.

Instrument of Tax Taking dated November 2, 2015 recorded at Plymouth County Registry of

Deeds in Book 46462 Page 24. Final Judgment foreclosing rights of redemption dated July 22,

2019, recorded at the Plymouth County Registry of Deeds in Book 51508 Page 220.

Pursuant to M.G.L. c. 60 §77B, the Custodian for the Town of Rockland may reject any and all

bids at such sale or any adjournment thereof if in his opinion no bid is made which approximates

the fair value of the property, and he may adjourn the sale from time to time for such periods as

he deems expedient, giving notice thereof at the time and place appointed for the sale or for any

adjournment thereof.

statement pursuant to M.G.L. c. 7C, §38 giving the names and addresses of all persons who will

have a beneficial interest in the property with the Commissioner of Capital Asset Management

and Maintenance; 2) sign under the penalties of perjury an affidavit indicating that no one who

would gain equity in the property has been convicted of a crime involving the willful and

malicious setting of a fire or of a crime involving the aiding, counseling or procuring of a willful

and malicious setting of a fire, or of a crime involving the fraudulent filing of a claim for fire

insurance; or is delinquent in the payment of real estate taxes to the Town of Rockland, or if

delinquent, that a pending application for abatement of such tax, or a pending petition before the

Appellate Tax Board has been filed in good faith; and 3) sign the Memorandum of Sale. All

buyer(s) will be required to pay a buyer’s premium: seven and a half percent (7.5%) or $3,500,

whichever is higher. Buyer shall also pay pro

forma taxes as required by M.G.L. c. 44, §63A, all recording fees, and special assessment of $350

for closing costs and legal fees on or before Tuesday, December 8, 2020 at 12:00 noon. The

Town reserves the right to extend the closing date thirty (30) days under terms and circumstances

in its sole discretion. Additional terms and conditions may apply.
