The Division of Investigation, U. S. Department of Justice, is charged

with the duty of investigating violations of the laws of the United States '

and collecting evidence in cases in which the United States is or may be a party in interest.

The Division does not have investigative jurisdiction over violations of Counterfeiting, Narcotic, Customs, Immigration, or Postal Laws.

However, the Division of Investigation will immediately institute inves­

tigations of alleged violations of Federal Laws other than those listed above.

The following list indicates some of the major violations over which the Division has investigative jurisdiction:-

National Motor Vehicle Theft Act Interstate transportation of stolen property valued at $5,000 or more National Bankruptcy Act Interstate flight to avoid prosecution or testifying in certain cases

White Slave Traffic Act

Impersonation of Government Officials Larceny of Goods in Interstate Commerce Killing or Assaulting Federal Officer Cases involving transportation in interstate or foreIgn commerce of

any persons who have been kidnapped Extortion cases in which interstate commerce or interstate communication

is an element Theft, Embezzlement or Illegal Possession of Government Property

Antitrust Laws Robbery of National Banks and Member Banks of Federal Reserve System National Bank and Federal Reserve Act Violations, such as embezzlement,

abstraction or misapplication of funds Crimes on any kind of Government reservation, including Indian Reserva­

tions or in any Government building or other Government property

Neutrality violations, including the shipment of arms to friendly nations Frauds against the Government

Crimes in connection with Federal Penal and Correctional institutions Perjury, embezzlement, or bribery in connection with Federal Statutes or

officials Crimes on the high seas Federal Anti-Racketeering Statute The location of persons who are fugitives from justice by reason of vio­

lations of the Federal Laws over which the Division has jurisdiction, of escaped Federal prisoners, and parole and probation violators.

It will be appreciated if information in the possession of law-enforce­ment officials concerning the above listed violations is promptly forwarded to the Special Agent in Charge of the nearest field office of the Division of Investigation, U. S. Department of Justice. If the information indicates

that immediate action is necessary, telegrams marked "Government Rate Collect" or telephone calls will be accepted. The address of each of the Field Offices of this Division appears on the inside back cover of this bulletin.

I feel certain that all law enforcement officiæls will be interested in the Federal crime bills summarized below which were

passed by the last session of Congress:

RECENT FEDERAL CRIME BILLS

H. R.-9370 - THE FEDERAL REWARD BILL

This Act authorizes the Attorney General to designate any criminal a public enemy and to offer up to $25,000 reward for the capture of such public enemy, or for information leading to his capture. If any such designated public enemy js killed resisting lawful arrest; the re­ward may be paid to any person or perRons whom the Attorney General shall adjudge to be entitled thereto.

S.-2080 - TO PROVIDE PUNISHMENT FOR KILLING OR ASSAULTING FEDERAL OFFICERS

This Act applies Sections 273 and 274 of the Criminal Code to the killing of a Special Agent of the Division of Investigation and

other Federal officers while engaged in the performance of official duties or on account thereof. It also provides that whoever shall forcibly resist, oppose, impede, intimidate or interfere with any

Special Agent of the Division and other Federal officers while engaged in the performance of official duties, or assault such officer on ac­count of the performance of official duties, shall be subject to a fine of not more than $5,000 or to not more than 2 years imprisonment or both. If such individual uses a deadly or dangerous weapon, the maximum penalty

is increased to $10,000 fine or 10 years imprisonment, or both.

S.-2249 - EXTORTION BY MEANS OF TELEPHONE, TELEGRAPH, RADIO, ORAL MESSAGE OR OTHERWISE

This Act makes it a Federal crime to transmit in interstate

commerce by any means whatsoever, with intent to extort, any threat (1) to injure the person or property of any person, or the reputation of a deceased person, (2) to kidnap any person, (3) to accuse any person of a crime, or (4) containing any demand or request for a

ransom or reward for the release of any kidnaped person. The maximum penalty is $5,000 fine or 20 years imprisonment or both.

S.-2252 - AMENDING THE FEDERAL KIDNAPING ACT OF JUNE 22, 1932

This Amending Act permits imposi.tion of the death penalty where recommended by the trial jury. The Amending Act excepts the case of a minor taken by his parent, and has the added provision that the death penalty shall not be imposed if prior to its imposition the

kidnaped person has bean released unharmed. The Amending Act makes illegal the interstate or foreign transportation of any person unlaw­fully seized, confined, inveigled, decoyed, kidnaped, abducted or carried away by any means whatsoever and held for ransom or reward or otherwise, and provides further that the failure to release such parson within seven days after his seizure shall create a presumption that he has been transported in interstate or foreign commerce.

S.-2253 - FLEEING FROM ONE STATE TO ANOTHER TO AVOID PROSECUTION OR GIVING TESTIMONY IN

CERTAIN CASES

This Act makes it a Federal crime to (1) move or travel in interstate or foreign commerce to avoid prosecution for murder, burglary, robbery, mayhem, rape, assault with a dangerous weapon, extortion with threats of violence, or the attempt to commit any of these crimes, or (2) to avoid giving testimony in any criminal proceedings in which a

felony is charged. Prosecution lies in the Federal Judicial District in which the original crime is alleged to have been committed, and the maximum penalty is $5,000 fine or 5 years imprisonment or both.

S.-2845 - THE NATIONAL STOLEN PROPERTY ACT

This Act in effect simply extends the provisions of the National Motor Vehicle Theft Act to the transportation in interstate or foreign commerce of stolen goods, wares, merchandise, securities or money of the value of $5,000 or over. The maximum penalty is $10,000 fine or 10 years imprisonment or both.

S.-2841 - ROBBERY OF BANKS ORGANIZED OR OPERATING UNDER LAWS OF THE UNITED STATES OR OF ANY MEMBER

OF THE FEDERAL RESERVE SYSTEM

This Act in effect makes it a Federal crime to rob or at­tempt to rob by force, Violence, or putting in fear, any bank or­ganized or operating under the laws of the United States, or any member of the Federal Reserve System. The maximum penalty is $5,000 fine or 20 years imprisonment or both. If the commission of the crime or its attempted commission results in the assault of any person or puts the life of any person in jeopardy through the use of a dangerous weapon or device, a fine of not less than $1,000 nor more than $10,000 may be imposed or imprisonment for not less

If in committing any of the offenses defined in the Act in avoiding, or attempting to avoid ap­prehension therefor or in freeing or attempting to free himself from arrest or confinement for such offenses, any individual kills any person or forces any person to accompany him without the person's consent, the penalty shall -De imprisonment for not less than 10 years or death if the verdict of the jury so directs.

S.-2575 - CRIMES IN CONNECTION WITH FEDERAL PENAL AND CORRECTIONAL INSTITUTIONS

This Act makes it a Federal crime for any person including

officers and emp l oyees of Federal penal or correctional institutions to instigate, connive at, wilfully attempt to cause, assist in, or to con­spire to cause any mutiny, riot or escape at a Federal penal or cor­rectional institution. The conveyance into or within such institution or assisting in such conveyance of any tool, device, firearm, weapon, explosive, lethal and pois onous gas or any other substance or thing designed to aid in escape or to disable any officer, agent, employee or inmate is also made a crime. The maximum punishment for any of the above crimes is 10 years imprisonment.

H.R.-9741 - THE NATIONAL FIREARMS ACT

This Act provides for the taxation of manufacturers, importers, and de alers in certain firearms and machine guns. and makes provision for the taxation and registration of all sales, transfers or other disposition of certain firearms in interstate transportation. Shotguns and rifles with barrels less than 18 inches in length, machine guns, sub-machine guns and silencers are covered by the Act.

H.R . -9476 - POWER OF ARREST FOR SPECIAL

AGENTS OF THE DIVISION, AND THE RIGHT TO CARRY FIREARMS

This Act gives Special Agents of the Division of Investigation authority to serve warrants and subpenaG issued under the authority of the United States and to make arrests for felonies cognizable under the Federal law where there is a likelihood of escape before a warrant can be procured. In the latter case the arrested person must be taken before a committing officer immediately. The Act also specifically authorizes Division Agents to carry firearms.

8.-2248 - FEDERAL ANTI-RACKETEERING STATUTE

The avowed purpose of this Act is to protect interstate trade and commerce against interference by v}.0lenr.El, threats, coercion or intimidat.ion. Any interference by a.ny of 1.110 above means is made a felony punishable by imprisonment not to exceed 10 ye ars , or by a fine not to exceed $10,000, or both.

BUSTER BROWN

INTERESTING IDENTIFICATION

UNKNOWN DECEASED PERSON IDENTIFIED THROUGH FINGERPRINTS

On June 13, 1934 th) fingerprints of an unknown deceased male negro were received in the Identification Unit of the Division of Investigation from the State1s Attorney ' s office, Cumberland, Maryland.

Informa�ion appeared on the fingerpr i nt card that this unidentified per­son had bean killed by a freight train on June 12, 1934 at Cumberland, Maryland.

This fingerprint card was clas sified and searched in the tachni­cal files , and it was ascertained that the deceased person was identical with Buster Brown, alias William Brown, who, in December , 1932 had been

arrested by the Police Department at Scranton, Pennsylvania, and had been

sentenced on a charge of larceny to a term of one year in the Lackawanna

County Jail. At the time of this sentence his address was reported &s

1531 East Fifteenth Street, Erie, Pennsylvania. On the same day that the fingerprint card was rece ived , the State's Attorney's office at Cumberland, Maryland was notified by wire of tha identification.

The fingerpri nt files reflected an extensive criminal record on this individual, wh:i.ch included arrests by the police departm ent s of

Kearny , New Jersey, Lancaster, Pittsburg and Scranton, Pennsylvania and Akron, Ohio; and incarcera ions in the Ohio State Penitantiary, Columbus, Ohio, the Hudson County Jail at Jersey City, New Jersey and the Essex

County Penitentiary at Caldwell, New Jersey.

It is observed that law-enforcement agencies with increasing frequency are availing themselves of the services of the Identification Unit for the purpose of determining the identity of unknown deceased per­

sons. The above cc:ae is typ i cal of the numerous identifications tl19.t are

effected in this field of activity.

JUDY JORDAN

ESCAPED FLORIDA LIFE CONVICT APPREHENDED AT

WINNIPEG IDENTIFIED THROUGH FINGERPRINTS

In June, 1934, an identification was effected in the fingerprint

files of the Division of Investigation which illustrates the practical

value of the fingerprint method in the location of fugitives using

aliases, who are taken into custody by peace officers at points

distant from the scenes of crimes, or their escape while serving terms

t.·h6refor.

'ln June 29, 1934, a fingerprint card was received at the Division

by air mail from the Police Department, Winnipeg, Manitoba, Canada, which

indicated that one John Ercheeson had been arrested on June 26, 1934 and

charged with the crime of bank robbery. The fingerprint card was searched

immediately through the fingerprint files which resultad in the identifica­

tion of the fingerprints of John Ercheeson with those of one .Judy Jordan

whose file reflected that he had escaped from the State Road Camp No. 1,

neal' Ponce De Leon, Florida, on Janua17 13, 1933. Jordan had been

convicted of murder in the first degree with a recommendation for mercy

by the Circuit Court of Volusia County, Florida, and had been sentenced

on June 3, 1930 to serve a sentence for his natural life.

The Florida and Winnipeg authorities were immediately notified by

telegraph of the identification. Information was subsequently received

from Winnipeg advising that Jordan, alias Ercheesor., was being held for

the Florida Authorities.

This is one of many such fugitive identifications effected in the

Identification Unit of the Division of Investigation in the course of the

routine classification and the search of apprOXimately 2,200 fingerprint

cards received each day.

OFFENSES KNOWN TO THE POLICE January 1934

There is pre s ented in the following compilation, the number

of offenses reported for the first six months of 1934 by the pol ice de­partments in 88 cities with more than 100,000 inhabitants. The figures are also presented in the form of daily averagefJ. In compari ng the amount of

crime reported in the several months, it is preferable to employ the daily averages , since the number of days in each of the months is not the s ame.

The compilation discloses that during the second quarter of 1934

the number of offenses of murder and nonnegligent manslaughter exceeded the number reported during the first three months of the year. The same is true with reference to cases of aggravated assault. However, cases of robbery, bu rgl ary, and larceny decreased during the second quarter.
