CHAPTER – I INTRODUCTION

1.1 THE BACKGROUND OF THIS HAND BOOK

The Right to Information Act, 2005 was assented to by the President on 15th June 2005

and published in the Gazette of India on 21st June 2005. Section 2(1)(b) of that Act stipulates

that every public authority shall publish the particulars and details listed in that Section. In

fulfillment of this statutory requirement, the Commercial Taxes Department of the Tamil

Nadu Government headed by the Commissioner of Commercial Taxes has published this

Hand-Book.

1.2 OBJECTIVE / PURPOSE OF THIS HAND – BOOK

This Hand-book is intended to serve as a general guide to all citizens informing them as

to the kind of information that can be obtained from the Commercial Taxes Department of

Tamil Nadu Government, from whom and how that information could be got.

1.3 WHO ARE INTENDED USERS OF THIS HAND – BOOK ?

This Hand-book is intended to be used by all citizens of India for whose benefit the

Right to Information Act, 2005 has been passed.

1.4 ORGANISATION OF THE INFORMATION IN THIS HAND – BOOK

This Hand – book contains 18 chapters including this Introduction chapter [vide Index]

1.5 DEFINITIONS – In this manual, unless the context otherwise requires -

(a) “Government” means the State Government

(b)(i) “Information” means any material in any form including records, documents,

manuals, e-mails, opinions, advices, press releases, circulars, orders, log books, contracts,

reports, papers, samples, models, data material held in any electronic form and

information relating to any private body which can be accessed by a public authority

under any other law for the time being in force.

(ii) “Information” includes copy of any document relating to the affairs of the State or

any local or other authorities constituted under any Act for the time being in force or a

statutory authority or a company, corporation or a cooperative society or any

organization owned or controlled by the Government.

(c) “record” includes -

(a) any document, manuscript and file;

(b) any microfilm, microfile and facsimile copy of a document;

(c) any reproduction of image or images embodies in such microfilm (whether enlarged or not); and

(d) any other material produced by a computer or any other device

(d) “right to information” means the right to information accessible under the Right to

Information Act, 2005 which is held by or under the control of any public authority and

includes the right to –

(i) inspection of works, documents, records ;

(ii) taking notes, extracts of certified copies of documents or records ;

(iii) taking certified samples of materials

(iv) obtaining information in the form of diskettes, floppies, tapes, video cassettes or in any other electronic mode or through printouts where such information is stored in a computer of in any other device

(e) “State Information Commission” means the State Information Commission constituted

under sub-section (1) of Section 15 of the Right to Information Act, 2005

[RTIA, 2005; Sec.2(k)] (f) “State Chief Information Commissioner” and “State Information Commissioner” means

the State Chief Information Commission and the State Information Commissioner

appointed under sub-section (3) of Section 15 of the Right to Information Act, 2005

[RTIA, 2005; Sec.2(l)] (g) “State Public Information Officer” means the State Public Information Officer

designated under sub-section (1) and includes a State Assistant Public Information Officer

designated as such under sub-section (2) of section 5 of the Right to Information Act, 2005

[RTIA, 2005; Sec.2(m)] (h) “third party” means a person other than the citizen making a request for information and

includes a public authority

[RTIA, 2005; Sec.2(k)] 1.6 Contact person in case somebody wants to get more information on topics

covered in the hand-book as well as other information also The name, designation and other particulars of Public Information Officer of the

Commercial Taxes Department of the Tamil Nadu Government are given in chapter 8 of

this hand-book. The information that qualifies to be obtained under the Right to

Information Act, 2005 can be obtained from those Public Information Officers. Any more

information on topics covered in this hand-book as well as other information can be

obtained from the Deputy Commissioner (Special Cell) / State Public Information Officer,

Office of the Commissioner of Commercial Taxes, Chepauk, Chennai-5.

1.7 Procedure and Fee Structure for getting information not available in the Hand-

book The procedure and Fee Structure for getting information under the Right to Information

Act, 2005 and the Tamil Nadu Right to Information Act, 1997 are given in the Right to

Information (Regulation of Fee and Cost) Rules, 2005 and the Tamil Nadu Right to

Information Rules, 1997 respectively. Besides, the procedure prescribed in District Office

Manual for Copy Application relating to eligible document will continue.

CHAPTER – 2 PARTICULARS OF ORGANISATIONAL FUNCTIONS AND DUTIES

2.1 OBJECTIVE / PURPOSE OF THE PUBLIC AUTHORITY

The objective / purpose of the Tamil Nadu Commercial Taxes Department is to administer certain taxation statutes enacted by the State Legislature, the most prominent

among them being the Tamil Nadu General Sales Tax Act, 1959.

2.2 MISSION / VISION STATEMENT OF THE PUBLIC AUTHORITY

The ideal of this department to collect all legal dues falling under the taxation statutes administered by it without any single omission in strict conformity with the concerned

statutes, rules and Government orders.

2.3 BRIEF HISTORY OF THE PUBLIC AUTHORITY AND CONTEXT OF ITS FORMATION

This department was formed in the year 1939 to administer the Madras General Sales Tax Act, 1939. The sales tax was introduced through that Act by the then Congress Ministry

headed by Late Thiru C.Rajagopalachari with the original intention to make good loss to the

State Exchequer on account of introduction of Prohibition. Since then, the department has

grown by leaps and bounds and has become permanent and major source of tax revenue of

the State. 2.4 DUTIES OF THE PUBLIC AUTHORITY

It is the duty of this department to administer the Acts allotted to it in strict conformity with the provisions of those Acts, Rules made thereunder and Government

orders and instructions.

2.5 MAIN ACTIVITIES / FUNCTIONS OF THE PUBLIC AUTHORITY

The assessments of the liabilities of the assesses under the taxation statues administered by the department and collection of those liabilities are the main activities/

functions of this department.

2.6 LIST OF SERVICES BEING PRODUCED BY THE PUBLIC

This department is not a service department but a Revenue Department earning money for various services being provided by the Government.

2.10 MECHANISM AVAILABLE FOR MONITORING THE SERVICE

DELIVERY AND PUBLIC GRIEVANCE RESOLUTION

The hierarchical structure of the organization ensures that the activities at any level are monitored by a supervising authority. The supervising authorities can be approached by

the public for redressal of their grievances against any exployee / activity of the department. A system known as “VOICE RECORDING SYSTEM” has been installed and any member

of the public can dial the number 28520805 and record his complaint / suggestion which will

be treated as strictly confidential.

CHAPTER - 5

In every Revenue District, a committee known as District Sales Tax Advisory Committee normally meets once in a month under the Chairmanship of respective District

Collector.

The public, especially members of Trade and Industry participate in those meetings

through their representatives and contribute their suggestions for enhancing the efficiency of

the department.

Similarly, at State Level Sales Tax Advisory Committee meetings are conducted under the Chairmanship of the Hon’ble Chief Minister and the people’s representatives from

various fields of trade and industry participate and give their valuable suggestions which are

being examined and implemented.

CHAPTER – 9 PROCEDURE FOLLOWED IN DECISION MAKING PROCESS

9.1 What is the procedure followed to take a decision for various matters ?

The procedure to be followed by the assessing authorities in making assessment

orders and the appellate authorities in making appeal orders are detailed in the Acts

administered by the Commercial Taxes Department of Tamil Nadu and the Rules made

thereunder. The Administrative guidelines and instructions are given in Commercial Taxes

Manual Volumes I, II and III

9.2 What are the documenting procedure / laid down procedure / Defined criteria / Rules to arrive at a particular decision for important maters? What are the different levels through which a decisive process move ?

The assessing officers, being quasi-judicial officers are not bound by civil or criminal

procedure codes and Evidence Act. But they are duty-bound to follow the principles of

natural justice while taking decisions. They have to act without any bias. Whenever a

decision that is likely to affect the interests of any person is taken, that person should be

given an opportunity of making representation against that decision.

9.3 What are the arrangements to communicate the decisions to the public ?

The Acts, Rules and Notifications are published in the Government Gazette. Any

assessment orders or any other order intended for a particular person is served on that

person in accordance with the manner prescribed in the relevant statute or rules made under

it. 9.4 Who are officers at various levels whose opinion are sought for the process of

decision making ?

An assessing authority may make use of the information obtained from inspecting

officers and other reliable sources while making assessment orders. But any opinion of

another authority is not binding on the assessing authority while taking quasi-judicial

decisions in assessment proceedings. In respect of administrative decision taken at the State

level, the Commissioner of Commercial Taxes is assisted by the Joint Commissioners and

Deputy Commissioners working under him.

9.5 Who is the final authority that vets the decision ?

In respect of quasi-judicial decisions taken by competent statutory authorities, the

question of pre-vetting does not arise but those decisions can be challenged in statutory

appeals/revisions wherever provided.

Certain Acts administered by the Department authorizes the Government to grant

exemption from tax and concession in the matter of tax in deserving cases. For example,

Section 17 of the Tamil Nadu General Sales Tax Act, 1959 grants power to the Government

to notify exemption and reduction of tax. Section 17-A of the same Act grants power to

defer the payment by new industrial units or sick units or sick textile mill of the whole or any

part of the tax payable in respect of any period.

CHAPTER 15

NORMS SET BY IT FOR THE DISCHARGE OF ITS FUNCTIONS

15.1 Details of Norms/Standard set by the department for execution of various activities /programs

The various activities of the department are governed by the relevant Acts and Rules made thereunder and standing orders contained in CT Manual Volumes I, II and III and the

administrative circulars and instructions issued by the Commissioner of Commercial Taxes.

The citizen’s charter announced by this department promises that the department

shall endeavour to

- acknowledge declarations, intimations, applications, returns and all communications on the spot and in any case, within 7 days of their receipt

- respond to all communications within 30 working days of their receipt

- give interim reply to the applicant in case of unavoidable delay in decision making

- refund amounts due within 90 days of receiving a valid claim

- release the detained consignments immediately where the representation for the

same is correct and complete

- check the accounts produced for final assessment promptly

The department shall further strive to ensure the following :

- All offices who deal with dealers will carry an identity card.

- Information disclosed, both personal and business, will be kept in strict confidence

- If consignments have to be detained, it will be done only after explaining the reasons for the same. Sufficient opportunity will be provided before passing any final order.

- Business premises will be inspected only based on the authorization letter from the competent authority

- Full information will be provided to those who seek information about appeal

procedures and the authorities with whom appeals can be filed.

- Consultations will be held with the Associations of Trade, Industry and consumers

while reviewing the policies and procedures.

- The Joint Commissioner (Public Relations) in the Office of the Special Commission and Commissioner of Commercial Taxes, Chepauk, Chennai-5 will be accessible and will provide the required information and procedural details promptly

- Timely publicity of all changes in the law or procedures will be done.

The Citizen’s charter also promises the following towards providing quality service :

- Dealers are entitled to get the Certificate of Registration within 30 days from the date

of filing of applications.

- The Certificate of Registration issued is valid for the financial year and is renewable every year or once in five years, as the case may be.

- The Traders’ Welfare Board has been constituted with a view to extend financial

assistance to the members and their family for medical treatment, educational purposes, etc.

- General information regarding the Commercial Taxes Department, the procedure

for registration and tax payment and current tax rates of commodities are available in the web site “www.tnsalestax.com “

- On application, under Section 28-A of the Tamil Nadu General Sales Tax Act, 1959,

Commissioner of Commercial Taxes will provide / issue clarifications on tax rates within the least time possible. If due to unavoidable reasons, this process takes more time, the Commissioner of Commercial Taxes will send an interim reply.

The application for information in the prescribed form with the prescribed fee can be given to any Public Information officer. (Vide chapter 8).

OTHER USEFUL INFORMATION 18.1 Frequently Asked Questions and their Answers

Question 1 : Who should be contacted for a new registration under TNGST Act, 1959?

Answer : The Head of the assessment circle having jurisdiction over the main place of business of the applicant should be contacted.

Question 2 : Who should be approached for release orders of detention of goods at checkpost ?

Answer : The officer in-charge of the checkpost from whom the goods detention notice issued should be approached with Detention Order and requisite details asked for therein. In case, where the place of business is in a far off place, the Assistant Commissioner(Enf.) having jurisdiction of the main place of business should be approached with details.

Question 3 : What are the forms available for availing of concessional rate of tax and exemption from payment of tax ?

Answer : i) Form XVII – for availing concessional rate of tax for purchase of goods, which are used as materials, component parts and packing materials for the finished product covered by First Schedule in general. Form XVII may also be used to purchase specified capital goods at concessional rate.

Answer : The respective territorial or Enforcement Assistant Commissioner or Deputy/Joint Commissioner having jurisdiction over the place of business of the dealer should be contacted.

Question 5 : Where to get clarifications on rates of tax, exemption from payment of tax etc. on goods ?

Answer : The Joint Commissioner (Public Relations), Office of the Special Commissioner and Commissioner of Commercial Taxes should be approached with details required, on payment of fee Rs.500/- per commodity.

Section 9 of the Right to Information Act, 2005 provides for appeal in case of denial

of information. The list of appellate authorities is given in Chapter 8.

Rule 4 of the Tamil Nadu Right to Information Rules, 1997 gives the procedure for appeal.

18.3 WITH RELATION TO TRAINING IMPARTED TO PUBLIC BY PUBLIC AUTHORITY

At present, there is no training imparted to public by this department.

18.5 WITH RELATION TO REGISTRATION PROCESS

HOW TO GET A REGISTRATION CERTIFICATE UNDER THE TAMIL NADU GENERAL SALES TAX ACT, 1959 ?

1. Every dealer whose total turnover in any year is not less than Rs.3,00,000/- should get himself registered under the Act.

2. Any other dealer intending to commence business may also get himself registered under the Act.

3. The following dealers should get themselves registered under the Act irrespective of the quantum of their turnover and

irrespective of the point of levy of tax.

(i) Casual dealer (ii) Every dealer registered under the CST Act (iii) Every dealer residing outside the STATE but carrying on business in the STATE (iv) Every agent of a non-resident dealer (v) Every factor, broker, commission agent or arhati delcredere agent or auctioneer or any other mercantile agent

4. An application in Form D should be duly filled up and submitted to the concerned REGISTERING AUTHORITY along with a Demand Draft for the amounts mentioned in the table below towards REGISTRATION FEES.

5. The following documents should be enclosed to the Application in Form D

(i) Two recent passport size photographs of the applicant (ii) Any document such as Family card or passport or Driving License or Bank Pass Book or VAO certificate to satisfy the

(iv) Copy of PARTNERSHIP DEED and Form IX duly filled up and signed by all Partners in respect of a PARTNERSHIP

(v) Form XI duly filled up and signed by the Applicant and Manager, if Manager is appointed

(vi) Form A return showing the estimated turnover for that financial year.

6. The Registering Authority may demand security equal to 50% of the tax due estimated by the dealer for the year, for proper

realization of tax (instructions have been issued by SC&CCT in ref. No. Acts Cell I/93291/99 dated 16.5.2000 that in all cases a sum of

Rs.2500/- has to be collected by way of security at the time of new registration).

7. Instructions have been issued by the Commissioner to issue registration certificate for new cases within 7 days on receipt of security of Rs.2500/-. If no certificate is received or no notice is received from the Registering Authority with reference to the application,

within 30 days, the dealer is deemed to have been registered under the Act.

8. On its receipt, the Registration Certificate should be exhibited at each place of business conspicuously. A Name Board should

also be exhibited at each place of business showing the name and style of business with full address with Registration Certificate number

both under TNGST and CST Acts. The Name Board shall be in Tamil and the Tamil letters should be in the reformed script. The English

version thereof displayed below the Tamil version should be followed by version in other languages, if so desired.

The dealer should renew the Registration Certificate by paying a renewal fee as mentioned in the table above before the 31st March

without penalty and before the 30th April with penalty equal to the renewal fee.

9. A company registered under Companies Act, may opt to pay Registration fee for 5 years in a lump sum at five times of the fee

payable for one year mentioned in the table above for main place of business and every additional place of business.

10. The return in Form A-1 (for others), Form AB-1 (for exclusive resellers) should be filed on or before 20th of every month for

the business done in the previous month to the concerned assessing authority, along with tax, during the year of registration.

11. A registered dealer may collect the amount by way of tax under the Act subject to the following conditions, namely :

(i) He should issue a bill in respect of every sale, in duplicate, where one copy of the sale bill should be retained by the dealer for check by officials of Commercial Taxes Department.

(ii) He should not collect any amount by way of tax exceeding the rate.

12. The Registration Certificate issued or renewed should not be sold or transferred to anybody

13. When a Registered dealer changes his place of business, he should intimate the fact to the Registering Authority within thirty

days of such change and get the Certificate of Registration amended accordingly.

14. No Registered dealer shall keep his goods in any place or godown not mentioned in the Registration Certificate.

HOW TO GET A REGISTRATION CERTIFICATE UNDER THE CENTRAL SALES TAX ACT, 1956

Every dealer liable to pay tax under this Act should file an application if Form A affixing a court fee stamp of Rs.25/- towards

REGISTRATION FEES to the concerned REGISTERING AUTHORITY (Head of the assessment circle) within 30 days from the date

on which he becomes liable to pay tax under this Act.

1. Any dealer not liable to pay tax may also apply for Registration

2. The following documents should also be enclosed with the Application

(i) Form 5, if Manager is appointed

(ii) Form 6, if it is a Partnership concern

(iii) Form 1-A, for estimated turnover 3. The Registering Authority may demand a security equal to the tax due estimated by him for the year for proper custody and use of the

E-I, E-II, F and C Forms.

4. If the Registering Authority is satisfied that the application is in conformity with the provisions of the Act and if the security demanded

is paid, he will issue the Certificate of Registration.

5. Every dealer liable to pay tax under this Act shall file a monthly (as applicable under the TNGST Act,1 959) return to his assessing

authority in Form I before 20th of the succeeding month along with the payment of tax.

18.6 WITH REFERENCE TO COLLECTION OF TAX BY AN AUTHORITY

The procedure for collection of tax has been given in each Act administered by the Department and rules made thereunder.

18.7 WITH RELATION TO ISSUING NEW CONNECTION ELECTRICITY/WATER SUPPLY, TEMPORARY AND PERMANENT DISCONNECTION ETC.
