CLAUSE 1 – MORTON STREET
The Forbes Shire Council urban residential release master plan was adopted by Council in December 2007 and subsequently incorporated into the Forbes Development Control plan adopted by Council in June 2012. Forbes currently has a severe shortage of available developed residential land and given the business and population growth it is timely to review the options for development of residential land. Within Lot 1 DP 1077961, the adopted master plan design has 25 lots ranging in size from 956 sqm to 1351 sqm with the majority being over 1000 sqm. (Refer to Appendix 3 - Option 5). Council has recently received feedback from potential developers and real estate agents on the proposed master plan regarding the proposed block sizes and the potential to create more blocks for sale. The current trend is for smaller block sizes ranging between 650 sqm and 800 sqm and there is some small potential for larger blocks. Council design officers have reviewed the lot layout design and it is feasible to reduce the size of the blocks and create more blocks for sale. The proposed amended plan is attached (Appendix 4) The proposed amended plan provides for 54 block of varying block sizes ranging from 680 sqm to 2000 sqm with the majority between 680 sqm and 850 sqm. The Mayor and General Manager have sought feedback form the local real estate agents and a developer on the proposed amended plan and have received positive feedback. Given the positive feedback received should Council wish to amend the master plan lot layout, there should be no need to modify the Development Control Plan (ie advertised for 28 days and undertake public consultation) given the proposed amended plan can be suitably accommodated within the existing master plan concept and will not adversely affect the development potential of surrounding properties. I can confirm that the Acting Director Environmental Services and Planning concurs that the proposed amended plan can be suitably accommodated within the existing master plan concept and will not adversely affect the development potential of surrounding properties. At this stage the costs to develop the subdivision has not been finalised however council would seek to develop on a cost recovery basis as the main purpose of the development would be to increase the availability of affordable residential housing and to further stimulate economic activity in Forbes through the construction of new homes. The amended plan proposes development in four stages to enable revenue to be received to develop the next stage. A governance procedure and sale contract conditions will also need to be developed and all these issues will be the subject of a further business paper once development costs are finalised.
RECOMMENDATION That Council adopt the proposed amended master plan lot and road layout design for the area known as Morton Street Lot 1 DP1077961;

CLAUSE 1 – COMMUNITY SERVICE OBLIGATION (CSO)
Background Councils Sewer Service Pricing Policy requires a uniform annual sewerage bill for each residential property, calculated to ensure that collectively residential customers meet an equitable share of the cost of the sewerage system. For non residential customers, sewerage bills should not be less than residential bills, and are based on a two part tariff – an annual access charge and a uniform sewerage usage charge per kilolitre. The exception to this principle is those non residential land uses recognised by Forbes Shire Council to meet the Community Service Obligation (CSO) eligibility criteria. Specifically the land use under application must:
Provide a community benefit;
Non-profit organisation;
Operated and run solely by volunteers; and
All public have access to the facility at all times.
An example of this type of land use may include a church building (place of worship only), or a locally operated tennis club that is run by volunteers and is non-profit. Where a CSO application is successful the charge will be calculated on the full access and usage charges only. Organisations or properties seeking to be classified as a CSO must formally apply to Council with applications being accompanied by sufficient documentation to support the claim and be signed by the governing body, CEO or owner of the property. Council reserve the right to seek further confirming details where required. Forbes Preschool Application has been received from the Forbes Preschool seeking re-classification as a CSO provider and as such consideration for the concession on charges. The letter advised the Preschool is a non-profit organisation, committed to providing an affordable, accessible service that prioritises access for children the year prior to school, who are from an Aboriginal background, have additional needs or are from a low income family. The saving will support the preschool program and be of long term benefit for this service. Whilst the Preschool is run by a volunteer Committee it is operated by award remunerated staff. This is similar to other organisations who have been granted CSO status by Council where savings are returned into the community organisation not to a private owner. It is recommended Council approve the CSO recognition for the calculation of the Forbes Preschool sewer charges.
RECOMMENDATION That Council grant the Community Service Obligation concession to the Forbes Preschool in line with Councils Sewer Service Pricing Policy in 2013/2014.

CLAUSE 1 – PUBLIC TOILETS – OLD BASKETBALL COURTS:
Summary As a result of the ongoing issues with the old basketball toilet facility and continued vandalism a further review has been undertaken. Basketball Toilets These facilities were erected in the early 1980’s at the height of the basketball competition in Forbes. The structure is constructed in double brick with iron roof with wooden doors. The contents include separate gents and ladies. The male toilet contains 1 x pan toilet, stainless steel urinal, hand basin, soap and hand towel dispenser, used syringe holder. The female toilet contains 2 x pan toilets, hand basin, soap and hand towel dispenser and used syringe holder. It is estimated that to demolish and remove these toilets would cost in the order of $5,000. Theses toilets have been locked up for approximately 10 years and are in poor condition with vandals continuously breaking the doors to gain access. As the facility is located nearby to the new Apex Lakeside Park facilities and the South Circle facilities under the Rugby club house and the basketball courts are not in use, this facility is an ongoing maintenance issue for Council.
RECOMMENDATION: That Council demolish the old toilet facility adjacent to the basketball courts.

CLAUSE 1 – DONATIONS
Clause 1.1 Funding Request: Amaroo Aboriginal Corporation
Council has received a request for financial assistance from Amaroo Aboriginal Corporation Inc. The organisation is currently in a phase of rebuilding and is focussed on providing housing for the Aboriginal community, streamlining and digitising records, purchasing the land currently leased from Peak Hill Land Council and improving the entity as a whole. The organisation have advised their current rental payment is the payment of the rates for the property and they have requested Council provide assistance by covering their rental expenses for the current year being $206.00.
RECOMMENDATION That Council donate $206.00 to Amaroo Aboriginal Corporation Inc. to assist with their rent expenses to be sourced from the donations budget.

PUBLIC ACCESS TO COUNCIL MEETINGS
In accordance with the provisions of the Local Government Act 1993 and Local Government (General) Regulations 2005, in the opinion of the General Manager, the following business is of a kind as referred to in section 10A(2) of the Act, and should be dealt with in a part of the meeting closed to the media and public. In accordance with Section 10A of the Local Government Act 1993 - Which parts of a meeting can be closed to the public? S10A Which parts of a meeting can be closed to the public? (1). A Council, or a committee of the Council of which all the members are councillors, may
close to the public so much of its meeting as comprises:
(a). the discussion of any of the matters listed in subclause (2), or (b). the receipt or discussion of any of the information so listed;

(a). personnel matters concerning particular individuals (other than Councillors); (b). the personal hardship of any resident or ratepayer, (c). information that would, if disclosed, confer a commercial advantage on a person
with whom the Council is conducting (or proposes to conduct) business; (d). commercial information or a confidential nature that would, if disclosed:-
i). prejudice the commercial position of the person who supplied it, or; ii). confer a commercial advantage on a competitor of the Council, or; iii). reveal a trade secret.
(e). information that would, if disclosed, prejudice the maintenance of law; (f). matters affecting the security of the Council, Councillors, Council staff or Council
property; (g). advice concerning litigation, or advice that would otherwise be privileged from
production in legal proceedings on the ground of legal professional privilege; (h). information concerning the nature and location of a place or an item of Aboriginal
significance on community land. (i). alleged contraventions of any code of conduct requirements applicable under
section 440.
(3). A Council, or a committee of the Council of which all the members are Councillors, may also close to the public so much of its meeting as comprises a motion to close another part of the meeting to the public.
(4). A Council, or a committee of a Council, may allow members of the public to make
representations to or at a meeting, before any part of the meeting is closed to the public, as to whether that part of the meeting should be closed.
