Dear Mr. Boice:
On behalf of Outboard Marine Corporation, (hereinafter referredto as "OMC"), I am responding to USEPA's September 30, 1994letter requesting information regarding the Yeoman Creek/EdwardsField Landfills Site in Waukegan, Illinois.
This response is made without any acknowledgement that OMC is a"responsible party" under CERCLA; without any admission of anyliability or responsibility under CERCLA or any other statute;and without acknowledgement of the applicability of theauthorities referenced in the letter. Furthermore, OMC does notadmit or agree that any activities which have been, are nowbeing, or will be conducted at the Yeoman Creek/Edwards FieldLandfills Site by the USEPA or its representatives are warrantedor are authorized under CERCLA or any other authority.
While OMC is supplying USEPA with information, it wishes to stateand preserve its objections to certain aspects of the request.First, OMC cannot be required to supply information or documentsunder Section 3007 of RCRA, 42 U.S.C. § 6927 because that Sectionapplies only to development of regulations and enforcementactivities under RCRA. The request for information is obviouslynot in connection with the development of regulations, and CMC'sproducts do not fall under RCRA regulations. Also, theinstruction section of the letter contains requests for which wecan find no basis. Such requests include the requirement tosubmit certified and notarized statements. Since we have locatedno basis for either of these requests, we assume there are none.

If, however, USEPA does have any basis, please inform us of itand OMC will respond accordingly.
The information provided herein by OMC is based on a lengthy andthorough investigation that included a diligent file search forrelevant documents as well as an interviewing process withpresent and former employees who may have had knowledge ofactivities referenced during the 1959-1969 time period. CMC'sresponse to each question is based on the above investigationprocedure, and is arranged according to the numbering system ofthe agency's September 30, 1994 information request letter.
The response covers all known OMC facilities operated in theWaukegan area during 1959-1969. OMC operations during thisperiod included CMC's main manufacturing operations at theWaukegan lakefront, the OMC Boat Division facility formerlylocated at 3145 Central Avenue in Waukegan, a warehouse formerlylocated on Market Street in Waukegan, a warehouse formerlylocated on Sunset Avenue in Waukegan, and a boat service centerformerly located at 3815 Grandville Avenue in Gurnee, Illinois.The lakefront operations during the relevant period included thefacilities located in Waukegan at 100 Sea Horse Drive (corporateoffice), 200 Sea Horse Drive (OMC Johnson Plants 1 and 2), 300Sea Horse Drive (OMC Marine Engineering), and 701 Pershing Road(OMC Johnson Plant 3).
Without waiving any right to further object to the scope of orbasis for the request for information and documents and/or anyspecific requests for information or documents, OMC responds asfollows:
1. Provide a list of all companies and individuals with whichyou made arrangements with for disposal of wastes. Alsoidentify the individual(s) responsible for makingarrangements for the disposal or treatment of wastematerials at the facilities.
List of companies and individuals with which OMC made wastedisposal arranqements
OMC has limited records regarding the waste disposalarrangements made by its Waukegan area operations from 1959-1969.

No contemporaneous documentation has been identified for theperiod 1959-1969 regarding the waste disposal arrangementsmade by CMC's Waukegan lakefront operations. The accountingand purchasing records identified to date do not go backthat far, and no other records from that time period relatedto waste disposal arrangements have been found.
OMC previously identified Century Scavenger Service ashaving provided solid waste disposal services to the OMClakefront operations from 1959-1969 (see CMC's July 26, 1989104(e) response and the March 24, 1976 letter from Hugh B.Thomas of OMC to Kenneth A. Fenner of USEPA).
Based on CMC's inquiry of past and present employeesregarding waste disposal practices during the relevantperiod, we have also identified that the OMC lakefrontoperations may have made waste disposal or recyclingarrangements with Rowe Oil Services, Inc. during the 1959-1969 time frame. OMC is also thought to have arranged withDiamond Scrap Yards, Inc. for handling recyclable materials.
Detailed accounting ledgers containing possible wastedisposal-related entries for the OMC Boat Division'sfiberglass boat manufacturing operation formerly located at3145 Central Avenue in Waukegan have been located forOctober 1968, November 1968, and all of calendar year 1969.No other waste-related documents from the relevant periodhave been found for this facility. The following companiesthat possibly provided waste hauling services wereidentified in the ledgers:

Copies of the ledger pages referencing these and othercompanies that possibly provided waste transportation orwaste disposal services to the Boat Division facility duringthe relevant period are provided in Attachment A.

Century Metal Corporation
No contemporaneous documents are available from the 1959-1969 period which relate to the disposal of waste materialsfrom the OMC lakefront operations by Century MetalsCorporation. OMC has previously identified a possiblyrelated company, Century Scavenger Services, that isreported to have provided solid waste disposal services tothe OMC lakefront operations during 1959-1969. OMC isunaware of any existing written contemporaneous documentsfrom the 1959-1969 time period that identify the generic,common or trade name and the chemical composition andcharacter (i.e., liquids, solid, sludge) of the materialstransported, stored and/or disposed by Century ScavengerService.
Chemical composition data is not available for the OMClakefront operation's solid waste stream during the 1959-1969 time period. Floor sweepings, including sawdust orother sorbent materials, would likely have been included inthis waste stream. The waste sorbent materials from the diecasting department may have contained hydraulic fluids andother oily materials. Hydraulic fluids used by CMC's diecasting operation during this period included the Monsantoproducts Pydraul F-9 and Pydraul A-200. These productscontained Aroclor 1242 and/or Aroclor 1248.
No documentation is available on the nature of the materialsthat may have been transported from the OMC Boat Divisionfacility by Century Metals Corporation, pursuant to theidentified accounting ledger entries.
No documentation of any kind is available regarding thenature of any waste streams generated by the boat servicecenter or the two warehouses, or the transporters that mayhave been used for these wastes.

Other Listed Transportation and Disposal Companies
TK City Disposal is the only other transportation ordisposal company listed in USEPA's letter known to have beenused by OMC during the relevant period. As noted above, TKCity Disposal was listed in the detailed accounting ledgersfor the OMC Boat Division operation formerly located at 3145Central Avenue in Waukegan. However, these listings wereprimarily for dates after the Site closed.
No information is available on the nature of the materialsthat may have been transported from the OMC Boat Divisionfacility by TK City Disposal.
2c) For each waste material identified above, please give thetotal volume in gallons for liquids/ in cubic yards forsolids, for which you have arranged disposal.
OMC has no contemporaneous data from the relevant periodregarding the volume of waste for which disposal wasarranged at any of its Waukegan area operations.
OMC previously reported highly speculative estimates of theamounts of polychlorinated biphenyls (PCBs) that may havebeen present in its solid waste stream during the relevantperiod (March 24, 1976 letter from Hugh B. Thomas of OMC toKenneth A. Fenner of USEPA). The estimates were apparentlydeveloped in 1976 assuming 70-80 % loss of purchasedhydraulic fluids to the solid waste stream. OMC is unawareof any existing written contemporaneous documents from the1959-1969 time period that formed the basis for these highlyspeculative estimates.
Earlier OMC and Monsanto documents from the 1970's (many ofwhich OMC likely did not even have in 1976) and the reportsof independent consultants who studied air emissions andwater discharges from the facility in 1968 suggest thatlosses of hydraulic fluid to solid waste disposal were muchless than the 70-80 % estimates. These documents indicatethat hydraulic fluid losses to solid waste disposal were onthe order of 20-25 % of the purchased quantities. Much ofthis information was first assembled in the early 1980'spursuant to litigation involving USEPA, Monsanto, and OMC.

2e) Provide copies of all records, including analytical results,and material safety data sheets, which indicate the chemicalcomposition and/or chemical character of the wastematerial(s) transported, or disposed by Century MetalCorporation or any of the other transportation or disposalcompanies listed above, including drummed wastes, oilywastes and floor sweepings.
OMC has no contemporaneous records, including analyticalresults or material safety data sheets which indicate thechemical composition and/or chemical character of the wastematerial(s) transported or disposed during the relevantperiod for any of its Waukegan area operations.
OMC does have contemporaneous information on the chemicalcomposition of the hydraulic fluids that were used in thedie cast department at CMC's lakefront operations during the1959-1969 time period. These materials would have beenpresent in the waste sorbents (i.e., sawdust/sorbent floorsweepings) that were apparently disposed of in the generalplant trash. Chemical composition data for these hydraulicfluids is provided in Attachment B.
2f) Do you have any information regarding where the wastesaddressed in a) through e) above were disposed of ? If youdo, provide this information.
OMC has no contemporaneous information regarding the off-site disposal location(s) of the waste streams generatedduring 1959-1969 by any of its Waukegan area facilities.
Based on the litigation deposition testimony of WilliamShulski, OMC believes that none of the wastes from itsWaukegan lakefront operations were ever disposed of at theEdwards Field Landfill. The Shulski testimony alsoindicates that OMC's lakefront operation wastes were onlydisposed of at the Yeoman Creek Landfill for a portion ofthe relevant period.
4. Identify all persons consulted in the preparation of theanswers to these Information Requests.
Numerous past and present OMC employees and otherindividuals with possible knowledge of the waste disposalpractices at OMC's Waukegan area operations during therelevant period have been consulted by OMC's EnvironmentalAffairs Department in the preparation of this response.
