IN EXERCISE of the powers vested in h im by Article 3 of the Emergency Powers (Colonial Defence) Order in Council, 1939, and the Emergency Powers (Defence) Act , 1939, the H i g h Commissioner has made the following Defence Regulations :—

1. These Regulations may be cited as the Defence (Amendment Citation, of W a r Risks Insurance Ordinance) Regulations, 1942.

2. In these Regulations the term "principal Ordinance" shall mean the W a r Risks Insurance Ordinance, 1941.

3. Section 2 of the principal Ordinance shall be amended —

(a) by the deletion of the definition of ' 'goods'' appearing there­i n , and the substitution of the following definition there­for :•—

" "Goods" means all chattels personal, not being (a) things in action, money, and the goods specified in Schedule I to this Ordinance, or (b) the property of H i s Majesty's Government or of the Government of Palestine; and, in relation to a seller or supplier of goods of any description produced by such seller or supplier, means both goods of that description and goods used as material from which goods of that description are produced or as ingredients or component parts of goods of that description."

(b) by the deletion of the definition of " K i n g ' s enemy r isks" appearing therein and the substitution of the following de­finition therefor :—

" " K i n g ' s enemy risks" means the risks of —

(a) damage occurring (whether accidentally or not) as the direct result of action taken by the enemy, or action taken in combating the enemy or in repelling an imagined attack by the enemy;

(b) damage occurring (whether accidentally or not) as the direct result of measures taken under proper authority to avoid the spreading of, or otherwise to mitigate, the consequences of such damage as afore­said;

(c) accidental damage occurring as the direct result —

• (i) of any precautionary or preparatory measures taken under proper authority with a view to pre­venting or hindering the carrying out of any attack by the enemy; or

(ii) of precautionary or preparatory measures in­volving the doing of work on land and taken under proper authority in any way in anticipa­tion of enemy action,

being, in either case, measures involving a substan­tial degree of risk to property :

Provided that the measures mentioned in para­graph (c) of this definition do not include the im-

posing of restrictions on the display of lights or mea­sures taken for training purposes.

For the purposes of this definition, such action against the enemy as is referred to in paragraph (a) hereof —

(a) shall, in relation to any ship or aircraft taking part in such action, be deemed to continue unti l the ship or aircraft has returned to its base;

(b) includes naval, military or air reconnaissances and patrols.";

(c) by the insertion of the words "or in lighters and barges in ports" between the words "waters" and " i n Palestine" in the definition of "situated in Palestine" appearing therein.

4. Section 5 of the principal Ordinance shall be amended by the substitution of the expression "1943" for the expression "1942" appearing at the end of subsection (3) thereof.

Amendment of section 5 of the principal Ordinance.

5. Section 6 of the principal Ordinance shall be amended —

(a) by the substitution of the word " o n " for the word "of" be­tween the words "day" and "w T hich" appearing therein;

(b) by the insertion of the following new subsection therein :-—

"(4) For the purposes of this section the expression "goods" shall not include the goods specified in Schedule I I to this Ordinance.' '

Amendment of section 6 of the principal Ordinance.

6. Section 7 of the principal Ordinance shall be repealed, and the following section substituted therefor

"Voluntary insurance of goods.

7.—(1) Notwithstanding the provisions of sec­tion 6 of this Ordinance any person carrying on business as seller or supplier of goods the value of which in the course of that business is less than the sum prescribed under that section, but which would otherwise be compulsorily insurable under that section, may apply to the Board in the pre­scribed manner for a policy of insurance on such goods.

(2) A n y person carrying on business as a seller or supplier of any of the goods specified in Sche­dule I I to this Ordinance may apply to the Board in the prescribed manner for a policy of insurance on such goods."

7. Section 9 of the principal Ordinance shall be amended by the substitution of the word "some" for the word "such" between the words "occupation of" and "other person "*appearing in subsection (2) thereof.

8. The Schedule to the principal Ordinance shall be repealed, and the following Schedule substituted therefor :'•—;

" S C H E D U L E I .

(GOODS NOT INSURABLE UNDER T H E ORDINANCE).

1. Non-metalliferous mine and quarry products, unmanufactured, other than mica.

2. Ores, concentrates, mattes, drosses and residues of gold, silver, platinum, palladium, i r idium, rhodium, osmium and ru­thenium.

3. Gold , silver, platinum, palladium, ir idium, rhodium, osmium, and ruthenium and alloys thereof, in grain, ingot, bar, sheet, tube, wire or powder and ply metal in the form of sheet, tube or wire, of which any of the said metals or any alloy thereof is a component.

•1. Articles and findings made solely (except for fittings and em­bellishments, if any), of gold, platinum, palladium, ir idium, rhodium, osmium or ruthenium.

5. Silver at the following stages of manufacture; Settings, stampings, draftings, spinnings, castings and pressings.

6. Unmounted diamonds, whether rough or polished and indus­trial diamonds, mounted or unmounted.

7. Natural pearls, mounted or unmounted.

8. Other precious and semi-precious stones, unmounted, cut or uncut.

9. Gem set jewellery, that is to say, precious and semi-precious stones mounted in gold, platinum, palladium, ir idium, rhodium, osmium or ruthenium.

10. Jewelled watch cases.

11. The following compounds of radium of a concentration ex­ceeding ten per cent. :—־ Bromide, carbonate, chloride and sulphate.

12. Recovered sewage grease; sewage sludge; and manure manu­factured or derived from sewage.

13. Paintings in oil or water colours; pencil, ink and charcoal drawings and pastels on canvas or paper (including board); hand printed impressions taken from blocks, plates or like material, whether framed or unframed; reproductions by the colour-collotype process; sculpture, whether i n the round, in relief or i n intaglio.

14. Printed books, being not less than 50 years old, and manu­scripts.

15. Objects of art or craftsmanship being not less than one hundred years old.

16. Postage stamps (intended for collection purposes) denoting a postal service or services, being marks or devices embossed or impressed or comprised in a label.

17. Goods forming the subject of a hire purchase agreement or agreements where the bailee is a person not carrying on the business of selling, letting or hiring goods of the description so hired and wherein provision is made for payment i n not less than four instalments spread over a period of not less than six months.

18. Electric current.

19. A n y product of animal husbandry or of agriculture, horticul­ture or silviculture, before it has been baled, bagged or packed i n any other manner whatsoever, for marketing.

20. Mineral oils of all descriptions.

21. The following products of petroleum when held for sale on premises which are mainly used as oil installation premises, namely, greases, wax, candles, bitumen and butane and other gases derived from petroleum in liquid or gaseous form.

22. Water.

23. Salts recovered from brine by process of evaporation before they have been bagged or packed for marketing."

respect of the same, whether on his own account or as agent, trustee, or guardian for any other person, and shall •also i n ­clude the mutawalli of any waqf, and any one of several co-owners if the building is owned bv more than one owner.

" L i f t " means a mechanically operated appliance used for the transport of passengers between two or more levels in a ver­tical or substantially vertical direction by means of a guided car or platform.

"Escalator" means a mechanically operated appliance designed to transport persons between two levels i n an oblique direc­tion by means of guided treads.

' 'Approved' ' means approved by the Municipal Commission of Hai fa .

3. —(1) No owner of a building within the municipal area of Hai fa may operate, cause or allow to be operated a lift or escalator whether it existed before the promulgation of these by-laws or was built or installed thereafter, before having first obtained a licence for this purpose from the Council or an officer of the Council duly authorised by them.

(2) A licence issued under these by-laws shall expire on the 31st of March of each year.

4. A fee of £P.5 for the period of one year or part thereof shall be payable to the Council by the licensee upon the issue or renewal of any licence under these by-laws. The fee prescribed or any part thereof shall not be recoverable i n any circumstances.

5. —(1) N o licence shall be issued under these by-laws unless the applicant first satisfies the Council or the officer duly authorised by them that he is in possession of an approved insurance policy issued by a company approved by the Council, or by their duly authorised representative, and covering for the period of the licence the risk of death or injury to any person from such lift or escalator, as the case may be.

(2) N o insurance policy shall be accepted unless it covers the persons insured for an amount not less than an amount stipulated by the Council , and includes a condition for quarterly inspections by the insurance company who shall satisfy themselves that the lift or escalator is in good working order. If the lift or escalator is found by them not to be in good working order they wi l l forthwith suspend the policy. I n the event of the suspension or withdrawal of the policy by the insurance company, the company shall forth­with notify in wri t ing the Council, or their duly authorised repre­sentative, of such suspension or withdrawal, as the case may be. I n case the insurance policy is suspended or withdrawn during the period of the licence by the insurance company the licensee shall

forthwith cease to operate or allow to be operated the lift or escal­ator, as the case may be, unti l he has satisfied the Council or their duly authorised representative that he is again in possession of a valid policy covering all the conditions prescribed in this by-law.

6. The Council or their duly authorised representative shall, at Cancellation,

any time and without prior notice, be entitled to cancel at their or his discretion, as the case may be, in case of any contravention of the provisions of these by-laws or of suspected danger, any licence is­sued under these by-laws, and the licensee shall forthwith cease to operate or cause to be operated the lift or escalator covered by such licence. I n case of the cancellation of a licence no claim shall lie against the Corporation in respect of any loss occasioned by such cancellation.

7.—(1) A n y owner, occupier or other person who operates or causes Penalty,

to be operated a lift or escalator without a licence or who contra­venes any of the provisions of these by-laws, shall, on conviction, be liable to a fine not exceeding d9P.20 for an}^ one offence and in case of a continuing offence to an additional fine not exceeding £ P . 2 for every day during which the offence is continued without authority.

(2) I n the event of an insurance company failing to notify, i n Compensation, writ ing, the Council or their duly authorised representative of the suspension or withdrawal, as the case may be, of the insurance policy as required by by-law 5 of these by-laws, such insurance com­pany shall be liable to the payment of such compensation as would have been legally due to any person suffering from an}^ accident re­sulting from the operation of a lift or escalator, as the case may be, if such insurance policy had not been suspended or withdrawn.

I N EXERCISE of the powers vested i n them by section 99 of the Municipal Corporations Ordinance, 1934, the Municipal Council of Gaza have made the following by-laws :— -

1. These by-laws may be cited as the Gaza (Water Supply) (Amendment) By-laws, 1942, and shall be read as one wi th the Gaza (Water Supply) By-laws, 1938, hereinafter referred to as the principal by-laws.

2. By- law 8 of the principal by-laws shall be revoked and the following by-law substituted therefor :—

"8. The Municipal Council shall charge for the supply of water,such fees as may from time to time be, decided upon by resolution of the Council with the approval of the District Com­missioner".

3. The first and second schedules annexed to the principal by­laws shall be revoked.

1. This Order may be cited as the Hebron (Variation of M u n i ­cipal Area) Order, 1942.

2. The area of the Municipal Corporation of Hebron as set out under the name of " H e b r o n " in the first schedule to the M u n i ­cipal Corporations Ordinance, 1934, shall be extended, and the paragraphs setting out the area in the said schedule as aforesaid shall be deleted and the following description of the area sub­stituted thereof :—

"The area comprised in and outlined in red on the Survey Department map of Hebron and environs on the 1 :5,000 scale,—being the urban area of Hebron, as declared i n the Order of the H i g h Commissioner in Council under the Urban Property Tax Ordinance, 1940, published in the Gazette No . 1081 of the 6th March , 1941.
