    Asthisreportwasbeingprepared,NewYorkwasemergingslowlyfromone

    oftheworstnaturaldisastersinUnitedStateshistory. HurricaneSandycaused

    unprecedenteddamagetohomesandpropertyanddisruptedcountlesslives.Americansrespondedbygenerouslydonatinghundredsofmillionsofdollarsto

    charitiestoproviderelieftothoseinneed. Theextraordinaryoutpouringof

    supportdemonstratesthattheAmericanphilanthropicspiritisaliveandwell,even

    intheaftermathoftheworsteconomicrecessionindecades.

    As

    the

    regulator

    of

    nonprofits

    in

    New

    York

    State,

    Attorney

    General

    Schneidermanhasmadeitaprioritytoensurethatpublicconfidenceinthe

    charitablesectorremainshigh. Inadditiontobringingactionstostopfraudulent

    fundraisingandworkingwiththenonprofitsectortodevelopbestpracticesfor

    charitablefundraising,ourofficecontinuestopromotetransparencybyshininga

    spotlightonhowcharitablefundsraisedfromthepublicarespent. Through

    PenniesforCharity,theAttorneyGeneralsannualreportontelemarketinginNewYork,thepubliccaneasilyfindouthowmuchoftheircontributionsisspentontelemarketers feesandexpensesandhowmuchislefttosupportcharitable

    programsandservices.

    Theresultsofourreportaresobering. Overallfartoomuchmoneyisspent

    ontelemarketers feesandexpenses,andfartoolittleoncharity. Forexample,in

    nearly8outevery10fundraisingcampaigns,charitiesretainedlessthan50%ofthe

    contributionsraised. Astelemarketingcontinuestobewidelyusedbycharities,

    greatereffortsareneededtoreduceamountspaidtoprofessionalfundraisersand

    increaseamountsgoingtocharity. Itisimperativethatcharitiesnegotiatethebest

    dealspossiblefortheirorganizations. PenniesforCharityshowsthatfundraiserscanproducegoodresultsforcharities,allowingcharitiestoretainasignificant

    Thisreportisbasedonfinancialreportsfiledbyprofessionalfundraisersfor

    telemarketingcampaignsconductedduring2011.

    $240

    million

    was

    raised

    on

    behalf

    of

    434

    charities

    in

    2011

    in

    the

    602telemarketingcampaignscoveredinthisreport. Thisamountincludesfunds

    raisedinNewYorkandotherstatesduringfundraisingcampaignsconductedby

    telemarketersregisteredtosolicitcharitablecontributionsinNewYork.

    Keyfindingsinclude:

    In78percent,or467,ofthe602campaigns,thecharitieskeptlessthan50percentofthefundsraised.

    In287,or48percent,ofthe602campaigns,thecharitiesretainedlessthan30percentofthefundsraised.

    In

    76

    of

    the

    602

    campaigns

    reflected

    in

    the

    report,

    charities

    actually

    lost

    money.

    Inonly49ofthe602campaignsdidthecharityretainatleast65percentofthemoneyraised,theamountdeemedacceptableunderthe

    Uncollectedpledgestoacharityarenotreportedaspartofthetotalamount

    raised,butarereportedinaseparatecolumnineachtable.5

    OOTTHHEERRIINNFFOORRMMAATTIIOONNFFOORRCCHHAARRIITTIIEESS,,DDOONNOORRSSAANNDDTTHHEEPPUUBBLLIICCInadditiontoissuingPenniesforCharityannually,theAttorneyGenerals

    CharitiesBureaustaffworksyearroundtoensurethatdonorsareprotected,and

    thatcharitableassetsarepreservedandputtoproperuse.

    ImmediatelyafterHurricaneSandy,theAttorneyGeneralbegangathering

    informationfromcharitiescollectingdonationsfromthepublic. Asthisreportwas

    beingissued,theAttorneyGeneralsstaffwascompilingthatinformation,

    includingamountsraisedandexpended,servicesprovidedandplanned,andhow

    anysurplusfundswillbeused. Thistypeoftransparencyisimportanttomaintain

    thepublictrustinthecharitablesector. Moreinformationaboutfundraisingfor

    Also,inconjunctionwiththisyearsBreastCancerAwarenessMonth,the

    AttorneyGeneralsstaffreviewedpinkribboncausemarketingcampaigns

    conductedbycompanies. Causemarketingisagrowingbilliondollarayear

    industryinwhichproductsforsaleadvertisethatapurchasewilltriggera

    contributiontoacharity. Toensurethatconsumersknowhowtheirpurchasewill

    benefitcharityandthatcharitiesreceivewhattheyhavebeenpromised,the

    AttorneyGeneralissuedbestpracticesforcausemarketing,whichhavebeen

    adoptedbysomeofthecountrysleadingcharities. Thecausemarketingbest

    practicesandtipsforconsumersandcharitiesarepostedonCharitiesBureaus

    websiteatwww.charitiesnys.com. Thewebsitealsoincludesanonlineregistry

    whereyoucanfindtheannualfinancialreportsofregisteredcharities,guidancefor

    charities,links

    to

    watchdog

    organizations

    that

    evaluate

    charities

    and

    online

    tutorials.

    Howmuchisthetelemarketerbeingpaidandhowmuchisthecharityguaranteed?

    Also,remember:

    Onlygivetocharitieswithwhichyouarefamiliar. Donotgiveacreditcardnumbertoanunknowncaller. Bewaryofcallerswhopressureyoutogiveorsaytheywillsendsomeone

    toyourhousetopickupacontribution. Worthycharitiesshouldgiveyou

    time

    to

    make

    up

    your

    mind.

    Screencallsifyouwishtoavoidansweringcallsfromtelemarketers. Ifyoureceiveacallfromatelemarketerordirectlyfromacharity,you

    mayasktobeplacedonadonotcalllistofaspecificcharity.
